MEETING DATE:

OWNER: Yair Ben Daniel
FILE(S): A085/15 Location:
31 Nosson Place Ward 4, Vicinity of Major MacKenzie Drive and Bathurst Street
Proposal:
The owner is requesting permission to install pool equipment and maintain an A/C unit with the following variances:
Variance Proposed Required 1 Minimum interior side yard
setback to pool equipment 0.6m 1.2m
2 Minimum interior side yard setback to an A/C unit
0.4m 1.2m
Official Plan:
The subject lands are designated “Low-Rise Residential” by the new City of Vaughan Official Plan 2010 (VOP 2010), which was approved, in part, by the Ontario Municipal Board on September 30, 2014. The proposal conforms to the policies of the Official Plan.
Comments:
The Planning Department does not object to the proposed variances. The rear yard of the property is fenced and will screen the visual impacts of the proposed pool equipment. The easterly interior side yard permits access to the rear yard. The Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.
Condition(s): None. Recommendation: The Planning Department supports Minor Variance Application
A081/15.

Development Engineering & Infrastructure Planning Services MEETING DATE: March 26, 2015 OWNER: YAIR BEN DANIEL FILE(S): A085/15
Location: Part of Lot 19, Concession 2 (Lot 81, Registered Plan 65M-3985) municipally known as 31 Nosson Place, Maple.
Proposal:
1. To permit unenclosed pool equipment to be set back 0.6 metres from the interior side lot line.
2. To permit an air conditioning unit to be set back 0.4 metres from
the interior side lot line.
By-Law Requirements:
1. A minimum of 1.2 metres is required from the interior side lot line to pool equipment.
2. A minimum of 1.2 metres is required from the interior side lot line
to an air conditioning unit.
Comments:
The proposed 0.6m setback between the pool equipment and the interior side lot line does not appear to pose a grading conflict, as long as the setback distance proposed is maintained. A rear lot catchbasin lead is not installed along this lot line; therefore, there is no concern of damage to existing infrastructure. The air conditioning unit is to be elevated to permit adequate side lot drainage. Accordingly, the Development Engineering and Infrastructure Planning Services Department has no objection to Minor Variance Application A085/15.
Conditions: None.
