Proposal:
The Owner is requesting permission to construct 1 ½ storey single detached dwelling which requires the following variances:

Official Plan:
The subject lands are designated “Low-Rise Residential” by City of Vaughan Official Plan 2010 (VOP 2010), which was approved, in part, by the Ontario Municipal Board on September 30, 2014. The proposal conforms to the policies of the Official Plan.
Comments:
The vacant subject lands are located in an older subdivision characterized by two-storey dwellings. The Planning Department has no objection to Variance 1. The proposed 1 ½ storey dwelling accounts for 33.77% of the total coverage, and the covered, unenclosed front porch and porte cochere accounts for 1.23% of the coverage. The covered, unenclosed portions of the dwelling help to mitigate the impact of the increased lot coverage. It should also be noted that there are residential lots on Helena Gardens that are zoned R2, which permits a maximum lot coverage of 40%. With respect to Variance #2, the Planning Department has no objection. The proposed 4.6 m exterior side yard setback is consistent with previous approvals in the area. Typically the R1 zone permits a minimum exterior side yard setback of 4.5 m, provided that the minimum setback to a garage which faces a lot line is 6.4 m. The 6.4 m exterior side yard setback is a site-specific requirement established by the zoning by-law amendment associated with the original plan of subdivision (By-law 311-85). At the time, the Applicant had requested a reduction to the required exterior side yard setback from 9.0 m to 6.4 m. It should be noted that By-law 311-85 amended By-law 2523 (the predecessor to By-law 1-88). On this basis, the Planning Department has no objections.

Condition(s): Recommendation:
The proposed front yard setback of 7.60 m to the porte cochere and 7.66 m for the covered porch is for a small portion of the proposed dwelling and are both unenclosed. The remaining building envelope consists of a front yard setback of 8.53 m to the garage and 9.25 m to the house, which meet the minimum front yard setback requirements. On this basis, the Planning Department has no objections to the proposed 7.60m and 7.66 m front yard setbacks. The Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. None. The Planning Department supports Minor Variance Application A161/15.

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the
project or plan.
All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing
overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced.
In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing
overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible
for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the
safe limits of approach can be established.
In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and
underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be
responsible for 100% of PowerStream’s cost for any relocation work.
