509 th Council Meeting 2 February 2009 7 Sustainable City Future Committee Meeting 27 January 2009 Adopted Report ITEM 2 PLANNING ENVIRONMENT & TRANSPORT PROPOSED MINOR AMENDMENT PACKAGE NO. 5 TO GOLD COAST PLANNING SCHEME 2003 (VERSION 1.1 AMENDED JANUARY 2007) PD113/106/10/13 (P1) Refer 25 page attachment 1 BASIS FOR CONFIDENTIALITY Not applicable. 2 EXECUTIVE SUMMARY Not applicable. 3 PURPOSE OF REPORT The purpose of this report is to inform Council of the content of Gold Coast Planning Scheme 2003 Minor Amendment Package No. 5, and obtain Council endorsement of the proposed Minor Amendments to commence with Version 1.2 of the Planning Scheme 2003. 4 PREVIOUS RESOLUTIONS Council, at its meeting of 8 December 2008 (G08.1208.013), resolved to adopt the following recommendation of the Sustainable City Future Committee of 2 December 2008 (SC08.1203.002); 1 That Council note the contents of the report. 2 That Council adopt Amendment Package 2, Oxenford Local Area Plan sub- package. 3 That Council authorise the Chief Executive Officer to apply the contents of Amendment Package 2, Oxenford Local Area Plan sub-package in the assessment of development applications. 4 That Council adopt Minor Amendment No. 4. 5 That Council endorse corrections to Gold Coast Airport Overlay Maps 8a, 8b, 8c and 8d as shown in previously endorsed Minor Amendment No. 1, Item 3. 6 That a new amended Planning Scheme (incorporating Amendment Packages 2 and 3, the Oxenford Local Area Plan sub-package and Minor Amendment No’s 1 to 4) be prepared for implementation on Monday 11 May 2009. 7 That the Director Planning, Environment & Transport forward a copy of this report to Logan City Council for their information and records. 5 DISCUSSION Gold Coast Planning Scheme 2003 Minor Amendment Package No. 5 includes ‘Minor Amendments’ as defined by Schedule 10 of the Integrated Planning Act 1997 (refer to Section 6 of this report). changes to Planning Scheme Policies 3A & 3B In Minor Amendment Package No. 4, the density value and density unit for Precinct 10 of the Broadbeach LAP in Policies 3A & 3B were missed. It is the factual matter unstated in the Minor Amendment 4 and hence needs to be included in this package. Further details of the changes triggered by each of the above items are provided in the attached Minor Amendment Package No. 5. Item 3 Consequential amendment to Planning Scheme in response to Adoption of
Oxenford Local Area Plan (LAP) Adoption of the Oxenford LAP triggers a number of consequential minor amendments to the Planning Scheme Maps, Contents, List of Planning Scheme Maps, and Chapter 18 Emerging Communities Domain. These minor amendments include:
Amend the title of the Albert Corridor B: Oxenford/Upper Coomera Structure Plan to remove reference to ‘Oxenford’;
Delete text as required in the Albert Corridor B: Oxenford/Upper Coomera Structure Plan and Albert Corridor E: Kopps Road Structure Plan to remove obsolete reference to local features, population figures, and planning information for land in that is now included in the Oxenford Local Area Plan;
Amend the Upper Coomera Domain Map and Oxenford Domain Map to include land covered by the Oxenford Local Area Plan in the Local Area Plan Domain;
Amend Albert Corridor B: Oxenford/Upper Coomera Structure Plan - Emerging Communities Map 3 and Albert Corridor E: Kopps Road Structure Plan - Emerging Communities Map 6 to remove planning information for land that is now included in the Oxenford Local Area Plan;
Amend Context Map CM3 – Location of Local Area Plans to include 18A Oxenford Local Area Plan;
Amend Gold Coast City Council Domain Map - Northern (A1 Map); Amend the Planning Scheme Maps Table of Contents; and Amend the Planning Scheme Contents.
6 STATUTORY MATTERS The proposed Gold Coast Planning Scheme 2003 Minor Amendment Package No. 5 has been prepared in accordance with the following sections of the Integrated Planning Act 1997 (IPA);
Schedule 1 - Process for making or amending Planning Schemes; Schedule 3 – Process for making or amending Planning Scheme Policies; and Schedule 10 – definition of ‘minor amendment’, stated as follows:
‘minor amendment, of a planning instrument, means an amendment correcting or changing— (a) an explanatory matter about the instrument; or (b) the format or presentation of the instrument; or (c) a grammatical or mapping error in the instrument; or (d) a factual matter incorrectly stated in the instrument; or (e) redundant or outdated terms.

9.1.2 Assets are planned, created and managed to minimise whole of life costs and
maximise value (economic, social and environmental) to the city whilst maintaining their defined level of service and safety; and
Strategic Priority 13 – Land Use & Development Control
13.1.1 A robust framework for the management of new development.
13.1.2 An effective Planning Scheme and Local Laws which encourage ecologically
sustainable development.
13.1.3 Appropriate public infrastructure is supplied in a manner that ensures efficient use of resources.
8 COUNCIL POLICIES Not applicable. 9 DELEGATIONS Not applicable. 10 BUDGET/FUNDING The are no impacts on budgets as a result of these Planning Scheme amendments. 11 COORDINATION & CONSULTATION Gold Coast Water, Engineering Services, Parks & Recreational Services, Transport Planning and the City Plan Unit have been consulted in relation to the proposed minor amendments to the Planning Scheme 2003. 12 TIMING It is proposed to commence Minor Amendment Package No. 5 with Gold Coast Planning Scheme 2003 Version 1.2 on 11 May 2009. 13 STAKEHOLDER IMPACTS There will be some minor business system changes required in order to support the proposed minor amendment to Policies 3a and 3b. These changes are currently being investigated and funds are available for implementation.

A copy of Minor Amendment Package No. 5 is attached to this report. The Minor Amendments are required to make corrections resulting from the adoption of the Oxenford Local Area Plan and relate to the following: Consequential amendments to the Planning Scheme Policies 3A & 3B and Part 8
Infrastructure in response to the Oxenford LAP; and A factual matter unstated in Policies 3A & 3B. Removal of redundant or outdated information from Planning Scheme maps and text
15 RECOMMENDATION It is recommended that Council resolves as follows: 1 That Council adopt Minor Amendment Package No. 5.
2 That the commencement date for Minor Amendment Package No. 5 aligns with the commencement of Gold Coast Planning Scheme 2003 Version 1.2 on 11 May 2009.
3 That a public notice of adoption providing the commencement date for Minor Amendment Package No. 5 be placed in the Gold Coast Bulletin.
4 That certified copies of the adopted Minor Amendment Package No. 5 and a copy of the public notice be provided to the Minister for Infrastructure and Planning.
5 That Logan City Council be provided with a copy of this report for their information and records.
