BY-LAW REQUIREMENT:

Proposal:

The Owner is requesting permission to construct a cabana and pool equipment with the following variances:

Official Plan:

The subject lands are designated “Low-Rise Residential” by the new City of Vaughan Official Plan 2010 (VOP 2010), which was approved, in part, by the Ontario Municipal Board on February 3, 2014. The proposal conforms to the policies of the Official Plan.

Comments:

The reduced rear yard setbacks of the cabana and pool equipment will have limited negative impact, as the subject property abuts OS2 Open Space Park Zone lands to the rear. The area and the height of the cabana are consistent with the established developed in the area. The cabana is partially open and unenclosed, which will mitigate the effect of the increased area and height. The Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Recommendation:

The Planning Department supports Minor Variance Application A089/14.

Other Comments: A dwelling unit means a room or a suite of two or more rooms designed or intended for use by a family, in which sanitary conveniences are provided and in which facilities are provided for cooking. By-law relief is required in this case. Please advise. A maximum eave and gutter encroachment into the required yard, shall not exceed 0.50 metres. Please indicate the projection on the elevation drawings. Uncovered pool equipment on a pad shall be setback a minimum of 7.5 metres from the rear lot line. Please indicate the dimension from the rear lot line to the pool equipment on the site plan. A maximum building height of 3.0 metres is permitted to the nearest part of the roof of the cabana; whereas the drawing indicates the height to the top of the eaves and gutters. Please indicate this dimension on the front elevation drawing. The applicant shall be advised that additional variances may be required upon review of detailed drawings for building permit/site plan approval. We have reviewed the proposed Variance Application and have no comments or objections to its approval.

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the

project or plan.

All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing

overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced.

In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing

overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible

for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the

safe limits of approach can be established.

In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and

underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be

responsible for 100% of PowerStream’s cost for any relocation work.
