The PRESIDENT pro tempore (Senator Joseph B. Scarnati ifi) in the Chair. PRAYER The Chaplain, Reverend JOHN BORROUGHS, Pastor of Calvary Baptist Church, Avondale, offered the following prayer: Let us pray. Heavenly Father, we stand before a people who have a heavy burden, that burden of leading the people of the State of Pennsyl- vania and, Lord, nationally as well. You instruct us in Your word to pray for them and to lift them up before the throne of God, and we do that, Lord, at this time. As I say, it is an awesome respon- sibility. They need wisdom, wisdom from on high, and I pray, 0 God, that truly You would do that. Lord, we are seeing a time where people are turning their backs on Thee. You are being thrown out of school, thrown out of church, and thrown out of government. I pray, God, that truly, Your mercy and Your grace would be with these dear folks here today, and that, indeed, they would begin each day as they get up to look to You for wisdom to make decisions that day. So, Father, to that end, we pray for these Senate folks here, Lord, and pray that, indeed, You would guide them and direct them, even in the course of the actions today that will be taken. But, Father, help them, again, just to draw close to You, because man's wisdom fails us, but Thy wisdom is always right. So, Father, we do pray for our Senate people here today and for all those involved. We thank You for the privilege of coming, and, Lord, we just ask that truly, again, You would bless and guide them. The PRESIDENT pro tempore (Senator Joseph B. Scarnati ifi) in the Chair.

PRAYER

The Chaplain, Reverend JOHN BORROUGHS, Pastor of Calvary Baptist Church, Avondale, offered the following prayer:

Let us pray. Heavenly Father, we stand before a people who have a heavy

burden, that burden of leading the people of the State of Pennsyl-vania and, Lord, nationally as well. You instruct us in Your word to pray for them and to lift them up before the throne of God, and we do that, Lord, at this time. As I say, it is an awesome respon-sibility. They need wisdom, wisdom from on high, and I pray, 0 God, that truly You would do that.

Lord, we are seeing a time where people are turning their backs on Thee. You are being thrown out of school, thrown out of church, and thrown out of government. I pray, God, that truly, Your mercy and Your grace would be with these dear folks here today, and that, indeed, they would begin each day as they get up to look to You for wisdom to make decisions that day.

So, Father, to that end, we pray for these Senate folks here, Lord, and pray that, indeed, You would guide them and direct them, even in the course of the actions today that will be taken. But, Father, help them, again, just to draw close to You, because man's wisdom fails us, but Thy wisdom is always right.

Senator GREENLEAF. Mr. President, today I would like to introduce to the Senate a special guest from my district, Connor Quinn, who brought home the PIAA Class AAA Cross Country Boys' Individuals Championship for Hatboro-Horsham High School. Connor won the State championship with a time of 16:01. Coached by Russ Coleman, Connor became only the sec-ond runner in school history to capture an individual State cross country championship. In fact, it was Russ Coleman who last won a cross country individual PIAA championship in 1994.

Connor, a junior, further distinguished himself by capturing first place in the Suburban One Continental Conference Champi-onship and third place in the district championship. He put in a tremendous amount of hard work to become the runner he is. Cross country racing is not only about being in top physical con-dition, but winning takes a great deal of intelligence and careful calculation to pace yourself at just the right speed during a race. It is incredible to host a State champion here today, and we are extremely proud of Connor and his coach, Russ Coleman. I ask the Members of the Senate to give a warm welcome to these champions.

Through a blend of rigorous academics, on-the-job training, and community service, YouthBuild provides the tools and opportunity for students ages 18 to 20 to earn their high school diplomas and prepare for a career. YouthBuild allows students to acquire skills and knowl-edge through hands-on experience through its healthcare, IT, and building trades training programs, and also provides support services, transitional services, and community service projects, including Martin Luther King Day of Service. We have Lois Chesonis with us, who has worked for over 40 years at Reading Hospital, retiring in 2009. She belongs to a variety of senior citizens' groups, and is a square dancer as well.

With her is Christine Buffington, who currently resides in Robesonia and is retired from the Cocalico School District, hav-ing worked there as a tax collector. These are two wonderful female constituents who came today to see government at work. Mr. President, I ask that you welcome my guests today.

Senator BAKER. Mr. President, until a few years ago, not many people were giving thought to pipeline rights-of-way, the thickness of pipes, the quality of the welds, or the sufficiency of inspections before the pipes were buried, nor was there a whole lot of attention paid to the occasional siting of a gas compressor station. Today, those considerations are of utmost importance to many residents in the Marcellus Shale drilling areas. As residents have inquired about the rules and regulations and oversight of this infrastructure, they are dismayed to discover there are alarm-ing holes in the system.

Today is day three of a comprehensive look by The Philadel-phia Inquirer into the concerns and consequences. It is hard to imagine a clearer or more timely call to action. Look at the pipe-line map for Bradford County. It begins to resemble the street map of a metropolitan area. For safety reasons, and for reasons of environmental protection, we need to know where the pipe-lines are, we need to know how they are constructed, to stan-dards that are suitable for the volume and pressure of the gas they are conveying, and we need to know they are located suffi-ciently far away from people and resources that we want to pro-tect.

Through this bill, we begin to fill the gaps in State law and regulation. The Public Utility Commission has given safety juris-diction over Classes 2, 3, and 4 gas and hazardous liquid pipe-lines. As more permits are approved and more exploratory drill-ing takes place and more wells come into active production, it is imperative for us to insure greater public safety and environmen-tal protection.

This is not the final word on this issue. Gathering pipelines referred to as Class 1 are prevalent in my area and other parts of the Commonwealth. The Federal government chooses not to inspect these lines because they are located in rural, less popu-lated areas. Thus, I believe it has become a State responsibility, a priority one at that. This bill provides for Class 1 registry, so at least we will know where the lines are.

Subsequent legislation that I am introducing will give the PUC the same authority to conduct safety inspections on Class 1 lines as it gains to inspect in the other classes under the bill before us. It will bring such lines under the Pennsylvania One Call System. When we give this authority, we must also provide the means to enforce it. None of this is a threat to the viability of the industry. We must be leaving any aspects of drilling, com-pressing, and shipping beyond the reaches of standards and overseers that would pose a substantial threat to our residents and communities. I urge an affirmative vote on the bill.

Senator DINNIMAN. Mr. President, I rise to support Senator Baker's bill. I think she said a key word when she said that we have not completed the task and she talked about subsequent legislation.

You see, the pipeline issue is not just in the Marcellus Shale area, the pipeline issue is across this Commonwealth, especially in southeastern Pennsylvania. You know, there is no profit from the Marcellus Shale unless it gets to market, unless it gets to the ports of Philadelphia and Wilmington, and other places. So, ev-ery single citizen in this Commonwealth is going to be impacted by Marcellus Shale gas, as it goes from the well to the port and then to the refinery. We must assure every single citizen in this Commonwealth that they are going to be safe.

We must protect the environment, and we must make sure that, at least in the southeast and other areas, where we have invested millions of dollars on easements, on the protection of our rivers and streams, on the preservation of open space, that that is not hurt, that that work, over many decades, is not thrown asunder by these pipelines.

I look forward to working with Senator Baker on that subse-quent legislation. This is a first step, a good step, but we still have much to do to make sure that all Pennsylvanians are safe, to make sure that we protect the water and the environment of this Commonwealth, not just at the well sites, but in every place in this Commonwealth that a gas line goes through.

SENATE RESOLUTION No. 250, ADOPTED

A Resolution establishing the Task Force on Child Protection.

Senator WARD. Mr. President, Senate Resolution No. 250 creates the Task Force on Child Protection. The Senate Commit-tee on Aging and Youth has been examining Pennsylvania's defi-nition of child abuse and mandating reporting of child abuse through public hearings, which were held in August and October. But the charges surrounding the reporting of child abuse at Penn State have elevated the issue's review by an interdisciplinary task

force on child protection, which will make recommendations to improve and strengthen our State's laws. The allegations sur-rounding Penn State shake every decent person to the core. We need this top-to-bottom review of our laws to identify how they can be more effective.

In 2010, Pennsylvania's child abuse hotline, ChildLine, re-ceived approximately 122,000 calls, including 40,000 referrals for general protective services. At least 344 Pennsylvania chil-dren died from abuse between 2002 and 2009, with many of them dying before their second birthday, and many of them from within families previously known to Children and Youth Ser-vices. This 11-member task force will include members experi-enced in issues relating to child abuse or providing services to victims of child abuse. The panel's final report will include rec-ommendations and be in the hands of the General Assembly and Governor Corbett by November 2012.

Senator COSTA. Mr. President, I rise to ask for support of the gentlewoman's resolution which has been offered, and want to commend her as the chairperson of the Committee on Aging and Youth, and our Senate Democratic chairperson, Senator Wash-ington, for the work that has gone into this process to develop this very, very important commission that will review and look into some of the issues that developed and were highlighted at Penn State University.

We know that there are a number of concerns about Child Protective Services and protecting our children. This commission is designed to be able to do that and provide, as I said, an effec-tive way to look at exactly what we do here in this Common-wealth, not only as it relates to our universities, but also to our various agencies of government - the Department of Public Wel-fare, adult services, juvenile services, our State Police, and the like. I think it is a very important process, a very important piece of legislation.

Mr. President, earlier last week, Senate Democrats pulled together a number of pieces of legislation that our Members had introduced over the course of the past several years, and also a number that have been introduced recently. That effort was led by Senator Schwank, and we are very pleased that we have pulled together those pieces of legislation under the guise of legislation aimed at protecting our children. It is our intent, once the commission is constructed and the members are named, and a chairperson is in fact selected, to provide to that commission the various pieces of legislation and ask for their review of what it is that we are working on and what we believe are essential pieces of legislation that need to proceed on parallel paths, one of which is a legislative path, the other a review path that allows for the commission to review those pieces of legislation, and, ultimately, incorporate them in some of their recommendations as we go forward as well.

So we are pleased with the movement today of this very im-portant bipartisan, bicameral commission. We look forward to the recommendations that will come. But most importantly, our Members look forward to having a voice in that particular pro-cess. We thank the gentlewoman from Westmoreland for offer-ing this resolution.

Senator BOSCOLA. Mr. President, you might want to take a seat, because this is going to be a tad long. I am giving you fore-warning.

I want to talk today about reapportionment. To me, reappor-tionment is a strange word for a bizarre process that is compli-cated, confusing, and highly suspicious. Today, it remains one of the most controversial and frustrating exercises in our democ-racy. Only one thing is certain: reapportionment and redistricting are guaranteed by the United States Constitution to drive voters crazy and drive politicians out of office.

Now, this current redistricting plan literally did drive one of my friends and colleagues out of office, Senator Brewster. His seat was moved from the west over into Monroe and Northampton Counties. I feel that was unfair, unjust, unneces-sary, and totally uncalled for. And for the record, because of that move, what happened to Northampton County is just as unjust, because now it has four Senators. Northampton County, in this process, in my opinion, got mutilated. Okay, so I made a couple points here. I think you know that I am a little angry. But now I am going to talk about some history so that the voters, especially in the areas of Monroe, Northampton, and Lehigh Counties, maybe I can help educate them and then maybe add some obser-vations. So there are 10 points I want to make.

Number one, reapportionment is a strange word that only politicians use, because it is one of those words that you rarely use. A normal person rarely even hears the word "reapportion-ment" used in actual conversation, maybe a handful of times during his or her lifetime. So as a result, reapportionment only

seems to occur when politicians in Harrisburg start arguing over it. That is, after all, how news is made and how voters generally find out that their State legislators are behaving badly. So voters are conditioned to associate this strange word solely in the con-text of power-hungry politicians full of evil motives and bad intent, committing dirty politics in broad daylight. I want to add, that is what people think. I personally know a lot of Senators and Representatives who are not that type of person. They are good, they want to serve people, and they are honest.

Secondly, reapportionment always starts with a mathematical calculation performed at the Federal level. So we all know the very first words spoken at the birth of our country, "We the Peo-ple." All of the numbers and the data collected by the Census Bureau every 10 years really is the very definition of America - its people. But do not get lost in the sauce of all those population figures, because the only number you really need to know is 435. That is the number of seats in the U.S. Congress. Reapportion-ment always begins and ends with 435. It follows the census data, like a recipe, to serve up 435 new slices of political power - seats in Congress - to voters in all 50 States. So instead of merely shuffling the cards, so to speak, after each decennial census, reapportionment opens up a shiny new deck of 435 cards that are dealt out to voters.

Number three, redistricting means never having to say you are sorry, because the Constitution made you do it. If reapportion-ment is a math formula, redistricting is always a roll of the politi-cal dice for State legislatures. The Constitution requires all 50 States to redraw election districts within their borders every 10 years to conform to the latest census data. Pennsylvania voters will lose another seat in Congress this year based on the 2010 census data. Since 1970, the number of congressmen represent-ing our Commonwealth in Washington has steadily declined from 27 seats to just 18 seats.

So following the census data, 10 States lost clout - seats in Congress - and most States, 32, stayed the same, but 8 States gained more clout, picking up 12 seats than those 10 that lost. So generally speaking, Sun Belt States continue to gain new seats in Congress as population growth flows mainly out of the west and down south.

Fourth observation. The very first gerrymander was discov-ered in Massachusetts in 1811. Most voters learned how to rec-ognize a gerrymander before they are even old enough to vote. So after 200 years of being able to spot one of them when we see it, why are those treacherous gerrymanders not extinct by now? How many more of these diabolical creatures do we need to kill before they are finally exterminated? That is really what tests voters' patience and drives voters' outrage. How many more times are politicians going to say that a gerrymander is not a gerrymander, even when it is right in front of their noses?

Voters are very intelligent. They instinctively suspect that backstabbing, ruthless, power-grabbing intentions and political maneuvering might explain why these new lines on the new map were so obviously drawn in places where they do not belong. Most of the time, the voters are right. But just because you and I recognize a living, breathing gerrymander when we see it, you still cannot kill it. Only the Supreme Court can kill a real gerry-mander, and only when it violates our constitutional voting rights as Americans. So unless the Supreme Court steps in to squash this ugly little critter, a gerrymander will only die if you remove it from its natural habitat of democracy. I will not be surprised if

political scientists uncover archeological evidence to suggest that gerrymanders could survive a nuclear war, just like roaches. Do not despair though, in a few short weeks, gerrymandering will once again be prohibited in Pennsylvania for another 10 years.

Number five, computer technology has made redistricting more precisely inconsistent, erratic, and unpredictable, but in a very efficient manner. We have come a long way from when political hacks used colored pencils to settle old political scores. But just because we now use the newest 2010 TIGER/line Shapefiles for Pennsylvania released by the U.S. Census Bureau does not mean that redistricting is easier or better than it was 100 years ago. There are just tinier devils hidden in tinier details. Most voters really do not care if State legislatures use the latest geospatial 3-D satellite technology or a Ouija board to draw new congressional maps, as long as it makes some sense to voters that election districts must change when the population of voters changes. The map may look ugly, but it is not going to haunt anybody in their dreams.

However, voters tend to get irritated when every redistricting map looks exactly like a kindergarten drawing of a hippopotamus riding a bicycle eating an ice cream cone. So no matter what the Constitution says, the map will always be controversial. No mat-ter how precise the census numbers may become, redistricting will always be a brutal, nasty, messy process - just like demo-cratic elections, by the way.

Number six, there is no such thing as a safe district. That is the wisdom, sure. A safe district means that a sitting Senator or House Member has such an electoral advantage over any pro-spective opponent that it is almost mathematically impossible to derive how they could possibly lose. That is called packing, by the way. But packing any district with too many Democrats or too many Republicans is always dangerous, because it provides a false sense of security in upcoming elections, but it usually provides for very contested primary elections. That may seem counterintuitive to most voters, but first let me refresh your memory. The two most powerful Senators in Pennsylvania were defeated the next time they ran for reelection following the 2002 redistricting process.

There is no such thing-- I know that people think that we do it as Senators and House Members, that we try to create these really safe districts. There is no such thing as a safe district, nor should there be. Pennsylvania's 50 State Senators belong to the voters of those districts, they belong to the voters of Pennsylva-nia. A seat in the State legislature or in the U.S. Congress is an honor and a privilege, and not some piece of property for anyone to claim they own.

Number seven, it is really and truly not about the map. If you have ever sat in a passenger seat, watching your spouse mutilate a road map or misread simple directions while going 65 miles an hour along your way to getting lost, you know that the map is usually not the real problem. However, the map is what everyone is fixated on. Voters ultimately judge whether their redistricting process was fair or fixed with their own eyes. Just as beauty lies in the eye of the beholder, so does evidence of a perceived politi-cal advantage for one party over the other.

Voters usually project what they expect to see on the map, and actually seeing the map only confirms their expectations and deepens their distrust of scheming, ruthless politicians. Now, most incumbents, and this is what voters do not understand, most incumbents would actually give an awful lot to avoid redistrict-

ing altogether. Change always means uncertainty when it comes to political survival. I have served in the State legislature since 1994. I have yet to meet a single State Senator or State Represen-tative who drew their own district or had one tailor-made exactly to their liking. That is because there are too many variables in-volved in the redistricting process, variables such as maintaining continuity, compactness, minority representation, communities of interest, and respect for natural borders.

Number eight, change may be inevitable, but redistricting is unavoidable. No one likes redistricting, but any redistricting is better than no redistricting. Is the process influenced by partisan politics? Of course it is. That is why incumbents traditionally choose to retire before the map changes and Cinderella's carriage turns back into a pumpkin.

Number nine, everything is connected to everything, espe-cially those things that the map does not reveal. Cynical voters tend to see scheming, treacherous, ruthless motives behind every redistricting map they have ever seen.

My name is Lisa, and I have been gerrymandered. This is my second tour of reapportionment that I am going through. Sorry, my father was a Marine, that is why I said tour. Ten years ago, I went to court after the 2001 redistricting map was approved. Ten years ago, I went to court because the city of Easton was cut out of the 18th Senatorial District and put into the 24th Senatorial District. Ten years later, the new map will put Easton back into the 18th Senatorial District with the city of Bethlehem. Does that mean I feel vindicated, or simply realize that the more things change, the more things stay the same? Both, of course.

So, unless you are obsessed or a conspiracy theorist, do not try to connect all the dots using your little radar decoder ring. There will always be an obvious anomaly somewhere on the map that stands out, like a monkey wrench sticking out of Mona Lisa's forehead. Instead of looking at what stands out, try to see what was left out and what is not there. There is always a ripple effect involving redistricting. And as soon as you move the boundaries from one district, the boundaries for every other dis-trict, especially neighboring districts, must be moved as well. That is why the constitutional requirements for all State's elec-tion districts take sheer precedence over the individual wishes of any incumbent seeking to insure an unfair political advantage over possible opponents.

And finally, redistricting will always be a Rubik's Cube of brutal, political reality. Even with all its obvious defects and drawbacks, it serves a vital purpose to protect and preserve the democracy that we have all inherited called the land of the free and the home of the brave.
