Subject: Enhancement of wage ceiling for coverage under the ESI Act.1948 from Rs.1 0,000/- to Rs.15,OOOI-.

The Govt of India, Ministry of Labour & Employment, vide their

Notification No.S-38025/04/2010-SS.1 dated 20.4.2010 have amended Rule 50

of ESI (Central) Rules, 1950 as a result of which the wage ceiling for coverage of

employees under the Act has been enhanced from Rs,10,OOO/-to Rs.15,OOO/-

w e .f 1st May, 2010. A copy of the notification issued by the Ministry is

enclosed

In order to give effect to the above amendment in the ESI (Central)

Rutes, the following actions may be taken on priority basis:-

• Wide publicity may be given to the above amendment by sending mailers to

all employers, employers'/employees' associations, Chamber of Commerce

and Regional Board/Local Committee members. No press advertisement

need to be done now.

• in all letters Issued from Regional Office, stamp may be affixed indicating

that wage limit for coverage of employees has been enhanced from

RS.10,OOO/-to Rs,15,OOO/-w.e.f. 1.5.2010.

• The employers may be advised to submit Declaration Forms of all persons

drawinq wages above RS.10,000/- and upto Rs.15,OOO/-per month to the

appropriate Branch Office positively by io" May, 2010.

• On receipt of Declaration Forms, immediate action may be taken to issue

Pehchan cards to all such newly covered employees.

• To ensure that Pehchan cards are issued to all these newly covered

employees, Pehchan teamslWlPRO may be suitably advised.

• Employers may be advised that the employees' and employers' contribution

in respect of all such employees drawing wages above RS.10,000/- and upto

Rs.15,000/- shall be required to be paid w.e.f. 1st May, 2010.

• As per the provision of Regulation 4 of ESI (General) Regulations, 1950, the

first shorter contribution period in respect of all such newly covered

employees shall commence from 1st May, 2010 and the corresponding

benefit period for them shall commence only after expiry of a period of nine

months from the date of such employment.

• The benefit rates upto Rs.25,OOO/- are already available in the table of

standard benefits given in Rule 54 of ESI (Central) Rules, 1950.

• As per proviso to Rule 55 of ESI (Central) Rules, 1950, all such newly

covered persons shall be eligible for Sickness Benefit if contribution in

respect of them were payable for not less than half the number of days

available for working in such shorter contribution period. Provision of

benefit to all such employers may be regulated accordingly.

• A monthly report regarding number of newly covered employees falling in

the wage bracket of Rs.10,OOO/- to Rs.15,OOOI- registered as well as

employees who had gone out of coverage earlier due to increase in their

wages and have been re-covered, may be sent to the undersigned by 10th of

every month beginning 10th June, 2010.

This issues with the approval of Insurance Commissioner.

NOTIFICATION

G.S.R. (E)- The following draft rules further to amend the Employees' State Insurance

(Central) Rules, 1950 were published as required under sub-section(l) of section 95 of the

Employees' State Insurance Act, 1948 (34 of 1948) in the notification of the Govenunent of Indian

in the Ministry of Labour & Employment vide No. G.S.R.164(E), dated the 26th February, 2010, in

the Gazette of India, Part Il, Section 3, Sub-section (i), dated 27th February, 2010 for inviting

objections and suggestions from all persons likely to be affected thereby till the expiry of the

period of thirty days from the date on which the copies of the Gazette of India in which the said

notification was published, were made available to the public;

And whereas the copies of the said Gazette were made available to the public on 27th

February, 2010;

And whereas, objections and suggestions received from persons likely to be affected

thereby have been considered by the Government;

Now, therefore, in exercise of powers conferred by section 95 of the Employees' State

Insurance Act, 1948, the Central Govenunent, after consultation with Employees' State Insurance

Corporation, hereby makes the following rules further to amend the Employees' State Insurance

(Central)Rules, 1950, namely:-

1. These Rules may be called the Employees' State Insurance (Central) Amendment Rules,

2010.

2. These shall come into force from the 1st day of May, 2010.

3. In the Employees' State Insurance (Central) Rules, 1950, in Rule 50, for the words "ten

thousand", wherever they occur, the words "fifteen thousand" shall be substituted.
