Box 368 Macy, Nebmka 68039 JAN 1 9 2007 Dear Chairman Parker: On December 6,2006, we received the Compact between the Sovereign Indian Nation of the Omaha Tribe of Nebraska (Tribe) and the Sovereign State of Iowa (State), executed on November 27,2006. We have completed our review of this Compact and conclude that it does not violate the Jmdian Gaming Regulatory Act (IGFLA), any other provision of Federal law that does not relate to jutisdiction over gaming on Indian lands, or the trust obligations of the United States to Indians. Therefore, pursuant to my delegated authority and Section 11 of ERA, we approve the Compact. This Compact shall take effect when the notice of our approval, pursuant to Section 1 l(d)(3HB) of IGRA, 25 U.S.C. (d)(3)@), is published in the FEDERAL REGISTER. Although the parties to the Compact can agree to the modification of appendices or addition of appendices, such as those discussed in Section 19, we consider that if these modifications are substantive, they are subject to the review and approval authority of the Secretary under IGM. However, substantive modifications of the terms of the compact must be approved by the Secretary. It is our view that a substantive modification is one that potentially implicates any of the three statutory reasons available to the Secretary to disapprove a compact in the first instance, i.e., whether the provision violates IGRA, any other provision of Federal law, or the trust obligation of the United States to Indians, See 25 U.S.C. $2710(d)(8)fB). For example the addition of Class IT1 games under Section 2.3 would trigger Secretarial review and approvaI under IGRA. We wish the Tribe and State success in their economic venture. Dear Chairman Parker:

On December 6,2006, we received the Compact between the Sovereign Indian Nation of the Omaha Tribe of Nebraska (Tribe) and the Sovereign State of Iowa (State), executed on November 27,2006.
