    1.0 EXECUTIVE SUMMARY

    This report documents IVI’s findings from our Phase I Environmental Site Assessment

    on the proposed wireless telecommunications facility located at 28 Jansen Lane, Berne,

     New York (the “Subject”). The Subject is situated in a rural setting characterized byresidential development, undeveloped wooded land, and agricultural land. The Subject is

    currently undeveloped wooded land. Prior to development of the Parent Parcel in 1952,the Subject was undeveloped wooded land. The Parent Parcel is owned by Jody Jansen.

    Pyramid Network Services, LLC c/o Alabany County  proposes to construct

    a wireless telecommunications facility on the Parent Parcel. Specifically, Pyramid proposes a 180’ self-support tower, with ancillary equipment at grade within an

    approximate 50’ x 60’fenced equipment compound. Pyramid proposes the

    installation of a 1,000 gallon propane AST, a 12’ x 16’ equipment shelter, a telcocabinet, electric transformer, and a 50kw propane generator within a

    telecommunications compound. Additionally, Pyramid c/o Albany County  proposes to

    trench for new underground conduits that will run from the proposed equipment

    cabinet to the existing utilities location (see attached Lease Exhibits for additionalinformation). The proposed collocation of antennas, ancillary equipment, proposed

    generator, connecting conduit and all areas proposed to be disturbed as part of the

    Pyramid installation are the focus of this report.The purpose of this Phase I Environmental Site Assessment was to assess existing site

    conditions and render an opinion as to the identified or potential presence of recognized

    environmental conditions in connection with all areas proposed to be disturbed as partof the Pyramid c/o Albany County installation in accordance with the scope

    and limitations of ASTM International's Standard Practice for Environmental

    Site Assessments: Phase I Environmental Site Assessment Process E 1527-13 and

    the limitations identified herein. Exceptions to or deletions from the scope of work are

    described in Section 2.0.This assessment has revealed no evidence of recognized environmental conditions

    (RECs) in connection with the Subject and no further action is currently recommended.

    2.0 INTRODUCTION 

    2.1 General and Reliance 

    IVI was retained by Pyramid Network Services c/o Albany County to preparea Phase I Environmental Site Assessment, in conformance with ASTM

    International's Standard Practice for Environmental Site Assessments: Phase IEnvironmental Site Assessment Process E 1527-13. Any exceptions to, ordeletions from, this practice are described below.

    IVI has produced this document under an agreement between IVI and Pyramid.All terms and conditions of that agreement are included within this document by

    reference. This report was prepared for and may be relied upon by Pyramid. Any

    future party seeking to rely on this report may apply to IVI Telecom Services, aCBRE Company and Pyramid for a letter of reliance.

    2.2 Purpose and Scope 

    2.2.1  Purpose

    The purpose of this report is to identify Recognized EnvironmentalConditions in connection with the property, using the methodology

    recommended by ASTM International in order to qualify for the innocent

    landowner defense to CERCLA liability and/or to help understand potential environmental conditions that could materially impact the

    operation of the business associated with the Subject. Specifically, this

    methodology is referred to as Standard Practice for Environmental Site

     Assessments: Phase l Environmental Site Assessment Process

    Designation: E 1527-13.

    The term Recognized Environmental Conditions is defined by ASTMStandard E 1527-13 as “...the presence or likely presence of any hazardous

    substances or petroleum products in, on, or at a property: (1) due to releaseto the environment; (2) under conditions indicative of a release to the

    environment; or (3) under conditions that pose a material threat of a future

    release to the environment. De minimis conditions are not recognizedenvironmental conditions.”

    2.2.2 Scope

    In general, the scope of this assessment consisted of reviewing readily

    available information and environmental data relating to the property;

    interviewing readily available persons knowledgeable about the site;reviewing readily available maps, aerial photographs and records

    maintained by federal, state, and local regulatory agencies; and conducting

    a site visit.

    Of importance, the client is advised that federal, state, and local laws may

    impose environmental assessment obligations beyond the scope of this practice. The client is also notified that there are likely to be other legal

    obligations with regard to hazardous substances or petroleum productsdiscovered on the Subject that are not addressed in this practice and thatmay pose risks of civil and/or criminal sanctions for non-compliance.

    The specific scope of this assignment included the following:

    2.2.2.1  Performing a site reconnaissance to characterize on-site

    conditions and assess the site’s location with respect to

    surrounding property uses and natural surface features. Inaddition, IVI conducted a reconnaissance of nearby surrounding

    roads and readily accessible adjacent properties to identify

    obvious potential environmental conditions on neighboring properties. Photographs taken as part of the site reconnaissance

    are provided in Appendix A.

    The site visit was conducted on August 3, 2015, by Taylor R.

    Weber representing IVI. The site was not represented at the timeof the site visit. It was sunny and the temperature was

    approximately 79° F at the time of our site survey. IVI

    conducted the site reconnaissance in a systematic manner,

    surveying in a grid pattern.

    2.2.2.2 Interviewing persons familiar with the property to obtaininformation on present and previous on-site activities potentiallyresulting in the environmental degradation of the site or

    adjoining properties. An AAI User Questionnaire was provided

    to the User. In this questionnaire, IVI requested title records aswell as information pertaining to whether or not any

    environmental liens or activity and use limitations were

    associated with the property. The purpose of this questionnaire

    was to satisfy the user interview all appropriate inquiryrequirements and disclose any previous or existing hazardous

    waste or toxic material conditions, which may not have been

    apparent at the time of our site reconnaissance.

    2.2.2.3 If provided, reviewing of information such as previously

     prepared appraisals, building plans and specifications, andenvironmental reports.

    2.2.2.4 Reviewing readily available historical documents, such as

    topographic maps, aerial photographs, and/or city directories toidentify previous activities on and in the vicinity of the Subject.

    Copies of these documents are included in Appendix C.

    2.2.2.5 Reviewing readily available environmental databases maintained

     by federal, state, and local agencies within the approximateminimum search distances as described within the RegulatoryReview Section 5.0 of this report. A copy of the Computerized

    Environmental Report, provided by Environmental Data

    Resources, Inc. can be referenced in Appendix D.

    2.2.2.6 Conducting a visual survey of readily accessible areas to identify

    the presence of the most obvious and common types of suspect

    ACMs. The basis for “suspect” determination is taken from thematerials listed in Appendix G of the United States Environmental

     protection Agency (USEPA) publication Managing Asbestos in

    Place (also known as the Green Book). All building materialslisted within Appendix G of the Green Book are considered to be

    suspect ACMs at the Subject. This screening is not intended to beused for demolition, abatement, renovation, or repair work.

    THIS LIMITED SURVEY IS NOT TO BE CONSTRUED AS ACOMPREHENSIVE ASBESTOS SURVEY, WHICH OFTEN

    ENTAILS DESTRUCTIVE TESTING OR THE SURVEY OF

    AREAS BEHIND WALLS, ABOVE CEILINGS, IN TENANT

    SPACES, AND IN OTHER TYPICALLY INACCESSIBLEAREAS. MOREOVER, IVI DOES NOT WARRANT THAT

    ALL ACMs AT THE SUBJECT HAVE BEEN IDENTIFIED.

    2.2.2.7  In the course of conducting representative observations of areas

    that are readily accessible, easily visible, and safe with respect to

    the field observer, IVI will report the presence of materialquantities of microbial growth.

    This limited scan is not to be construed as a microbial growth

    survey, which entails a thorough specific inspection and alsooften includes destructive testing or the survey of areas behind

    walls, above ceilings, in tenant spaces, and in other typically

    inaccessible areas. Moreover, IVI does not warrant that allmicrobial growth at the Subject has been identified, as mold may

    exist in inaccessible or non-observable areas or may have

    amplified subsequent to our site survey.

    3.0 SITE DESCRIPTION 

    3.1 Property Location 

    The Subject is identified with the site name “Jansen Lane” and is located at 28Jansen Lane, Berne, Albany County, New York. The Subject’s approximate

    latitude and longitude are 42 37 14.36 N and 74 8 40.50 W, respectively. Pleaserefer to Appendix C for copies of maps and/or aerial photographs which give agraphic representation of the Subject.

    IVI’s review of the surrounding properties did not reveal any environmental

    concerns.

    3.3 Physical Site Setting

    3.3.1 Size and Shape of Parcel

    The Parent Parcel is irregularly-shaped and is approximately 128 acre

     parcel. The Parent parcel is located on the western side of Jansen Lane.

    119BThe proposed Subject consists of a 180’ self-support tower within a 50’ x

    60’ rectangular lease area located on the northwestern portion of theParent Parcel west of Jansen Lane.

    3.3.2 Topography

    The site slopes 

    in all directions. The topography of the area ischaracterized as hilly. According to the United States Geological Survey(USGS)  Rensselaerville, New York   7.5 Minute Series topographic map,

    the site’s topographic elevation is approximately 1,449’ above mean sea

    level (“amsl”).

    3.3.3 Flood plains 

    IVI reviewed the applicable FEMA flood plain map (#36001C0235D) forthe Subject. According to this review, the Subject is not located within a

    mapped floodplain.

    4.0 HISTORICAL USE

    4.1 Historical Summary

    Prior to the construction of the existing improvements, the Parent Parcel wasagricultural land with interspaced areas of undeveloped wooded land.

     None of the Subject property historical uses are thought to have created a REC tothe Subject.

    4.2 Topographic Maps 

    IVI reviewed the following USGS historical topographic maps of the Parent

    Parcel area provided by Google Earth. The following summarizes the results ofthe topographic map review:

    IVI’s topographic map review did not reveal any environmental concerns.

    4.3 Aerial Photographs 

    Aerial photographs provide visual documentation of site conditions at the time of

    the photographs. Activities such as dumping or industrial use of a site can often be discerned through the examination of historical aerial photographs. IVI

    reviewed historic aerial photographs provided by EDR. The following is a

    synopsis of the aerial photographs reviewed:

    IVI’s aerial photograph review did not reveal any environmental concerns.

    4.4 Sanborn Fire Insurance Maps (Sanborn Maps)

    Sanborn Maps constitute a source of prior site uses of real property for many

    cities and towns in the United States. The maps were originally created to assist

    insurance underwriters in understanding the potential fire risk of structuresrequiring insurance; however, they are also useful in determining the previous

    uses of a Subject. Sanborn Maps often contain information relating to uses of

    individual structures, location of certain petroleum and chemical storage tanks,and the storage of other potentially toxic substances. Sanborn Maps begin their

    coverage in 1867 and continue through the 1990s.

    IVI had a search of Sanborn Maps conducted by EDR. This search did not

    identify Sanborn Map coverage for the area of the Subject. Searching a database

    such as Sanborn Maps constitutes part of the due-diligence necessary for anEnvironmental Site Assessment. The lack of Sanborn Mapping suggests that

    there likely was no historical industrial activity on or in the immediate vicinity of

    the Subject.

    4.5 Chain-of-Title

    Although requested, a copy of the Subject’s Chain-of-Title has not been provided

    to IVI for review.

    4.6 Previous Reports

    Although requested, no previously prepared environmental reports such as Phase I

    or II Environmental Site Assessments, lead paint surveys, lead-in-water surveys,

    asbestos surveys, or geotechnical reports were provided for our review.

    4.7 Interviews

    Fire Department

    IVI has sent a request to the Berne Fire Department for environmental

    information pertaining to the Subject. As of this writing, the Fire Department hasnot responded to our request. Should receipt of a response from the Fire

    Department change the conclusions of this report, Pyramid will be notified in

    writing by IVI.

    Albany County Health Department

    IVI has sent a request to Albany County Health Department for environmental

    information pertaining to the Subject. As of this writing, the Albany CountyHealth Department has not responded to our request. Should receipt of a response

    from the Albany County Health Department change the conclusions of this report,

    Pyramid will be notified in writing by IVI.

    Owner / Operator Interview

    Jody Jansen the Owner of the Subject property, did not completed the UserQuestionnaire. Absence of the AAI User questionnaire remains as a data gap in

    Section 2.3. If the AAI User Questionnaire is returned to IVI, Pyramid will benotified in writing.

    5.0 REGULATORY REVIEW 

    5.1 Computerized Environmental Report

    A copy of regulatory database information contained within a ComputerizedEnvironmental Report (CER) provided by EDR appears in Appendix D. The CER is a

    listing of sites identified on select federal and state standard source environmentaldatabases within the approximate minimum search distance specified by ASTMInternational's Standard Practice for Environmental Site Assessments: Phase I

    Environmental Site Assessment Process E 1527-13. IVI reviewed each environmental

    database on a record-by-record basis to determine if certain sites identified in the CERare suspected to represent a material negative environmental impact to the Subject. The

    following table lists the number of sites by regulatory database within the prescribed

    minimum search distance appearing in the CER:

    IVI’s review of the state and federal databases in the CER report revealed multiple sites

    on the SPILLS and SWF databases within the prescribed search radius.

    State and Tribal Landfills or Solid Waste Facilities List (SWF/LF)

    The SWF list is an inventory of landfills, incinerators, transfer stations, and other sites

    that manage solid wastes.

     Analysis/Comment: The CER did not identify SWF/LF facilities on the Parent Parcel.

    However, the CER identified two (2) properties within the prescribed search distance.

    The first listing is an inactive transfer station. The second listing is an active transfer

    station for MSW type wastes. The town of Berne currently owns the transfer station. BothSWF/LF listings are in a presumed down gradient location to the Subject and located

    approximately 750’ and 1, 875’ northwest of the Subject. Based on the down gradient

    location and distance, these SWF/LF listings are not considered a REC to the Subject orParent Parcel.

    State Leaking Underground Storage Tanks (LUSTs)

    The LUST list is an inventory of reported spills and leaks, both active and inactive. Itincludes stationary and non-stationary source spills reported to state and federal agencies,

    including remediated and unremediated leaking USTs.

     Analysis/Comment: The CER did not identify LUST facilities on the Parent Parcel.

    However, one (1) LUST facility was identified on properties within the prescribed search

    distance. The LUST facility has been granted a “Case Closed” status by the NYDEC,

    requiring no further investigation or remedial action. The LUST facility is in a presumeddown gradient location to the Subject and located approximately 1,610’ northeast of the

    Subject. As such, this listing is not thought to have created a REC to the Subject orParent Parcel.

    State Spills Cases (SPILLS)

    The SPILLS list is a compilation of data collected on spills and reported to the NYSDEC

     pursuant to either Article 12 of the Navigation Law, or 6 NYCRR Section 595.2.

     Analysis/Comment: The CER did not identify SPILLS cases on the Parent Parcel.However, the CER identified four (4) SPILLS on properties within the prescribed search

    distance. All four SPILLS have been granted a “case closed” date by the NYDEC,

    requiring no further investigation or remedial action. The SPILLS cases are located in a presumed down gradient location to the Subject and are located greater than ¼ of a mile

    from the Subject. Based on regulatory status, distance, and down gradient location, these

    SPILLS cases are not considered a REC to the Subject or Parent Parcel.

    5.2 Vapor Encroachment Screening 

    IVI conducted a “Tier I” (non-intrusive) Vapor Encroachment Screening (VES) on the

    Subject in accordance with the methodology set forth in ASTM E 2600-10 “StandardGuide for Vapor Encroachment Screening on Property Involved in Real Estate

    Transactions”. During the VES, the Area of Concern (AOC) was minimized using themethodology taught in the ASTM Screening for Vapor Encroachment onto PropertyInvolved in Real Estate Transactions Training Course. The purpose of the Tier I VES is

    to conduct an initial screen to identify, to the extent feasible, the potential for a vapor

    encroachment condition (VEC) in connection with the Subject with respect to chemicals

    of concern that may migrate as vapors into the subsurface of the Subject as a result ofcontaminated soil and groundwater on or near the property.

    This VES utilized readily available data sources previously discussed in this Phase I ESAto include the type of soils, geology and groundwater characteristics of the Subject area

    (refer to Section 4.3) as well as known or potentially contaminated sites as identified on

    Federal, State, tribal and local databases. IVI also utilized previously discussed standardhistorical sources of information to identify potential historical sources of contamination

    on the Subject and surrounding properties which may be indicative of a VEC. This datacollection and analysis was coupled with our site reconnaissance of the Subject and

    surrounding properties. Based upon the results of our data collection, reconnaissance and

    analysis, a summary of our Tier I VES findings is presented in the table below:

    6.15 Asbestos Containing Material (ACM)

    The use of most sprayed applied surfacing asbestos-containing materials

    (“ACM”) were banned by the National Emission Standards for Hazardous Air

    Pollutants (NESHAPS) during the 1970’s. Specifically, asbestos-containingspray-on fireproofing and insulation were banned under NESHAPS in 1973

    followed by the banning of decorative spray-on applications in 1978. In 1975 NESHAPS also banned the installation of wet-applied and pre-formed asbestos-containing pipe insulation and pre-formed boiler and hot water tank insulation.

    Although revised in 1990, NESHAPS still prohibits spray-on applications of

    asbestos-containing materials to buildings, structures, pipes, and conduits unless

    such material is encapsulated in a bituminous or resinous binder that is not friableafter drying.

    Under the Toxic Substance Control Act (TSCA) the use of asbestos-containingcorrugated paper, roll-board, commercial paper, specialty paper, flooring felt and

    new uses of asbestos were banned in 1989. Notwithstanding the forgoing, most

    U.S. firms voluntarily ceased production of asbestos-containing building materialsnot covered by the aforementioned Federal bans by the mid-1980s. Nevertheless,

    despite the ban, ACM may be present in newer construction in the form ofmaterials which were manufactured prior to the ban.

    As such, IVI requested information regarding ACM at the Subject. IVI did notreceive any information pertaining to ACM at the Subject.

    IVI conducted a limited survey consisting of the identification and (if applicable)

    sampling of friable and non-friable suspect materials for asbestos analysis wherethere existed a potential for disturbance based on the review of the lease exhibits,

    and / or the mention by the client’s representatives. This survey was completedduring IVI’s site visit as part of this report.

    Findings:

    IVI’s visual reconnaissance did not reveal any areas of suspect ACM which are

     proposed to be disturbed by VZW proposed installation.

    6.16 Lead-Containing Paint (LCP)

    The United States Environmental Protection Agency (“EPA”) defines Lead-BasedPaint (“LBP”) as paint with a concentration of lead equal to or greater than 1.0

    mg/cm2, 0.5% by weight. The Consumer Product Safety Commission (“CPSC”)

    considers paint containing less than 0.009% lead to be "lead free." However, theOccupational Safety and Health Administration (“OSHA”) does not accept that

    categorization. If an employer is working with paint which contains any amount

    of lead, including those with less than 0.009%, in such a way that would generate

    airborne levels to which employees may be exposed, it is the employer's duty toconduct exposure monitoring (or use objective or historical data as defined in 29

    CFR 1926.62(d)(3)(iii) through 1926.62(d)(3)(iv)(B) and in 29 CFR

    1926.62(n)(4)) to demonstrate that the Lead in Construction standard's actionlevel (30 micrograms/cubic meter of air) is not exceeded. The results of the

    exposure assessment then determine whether the employer would need to applythe further protections of that rule. If the levels of lead to which employees areexposed are below the action level (which may occur when the levels of lead in

     paint are very low and work is being done in such a way as to not disturb the paint

    and, therefore, generate airborne concentrations of lead), then the further

    requirements of the standard would not apply.

    IVI requested information regarding LCP at the Subject. IVI did not receive any

    information pertaining to LCP at the Subject.

    As such, IVI conducted a limited survey consisting of the identification and (if

    applicable) sampling of suspect materials for lead analysis where there existed a potential for disturbance based on the review of the lease exhibits, and / or the

    mention by the client’s representatives. This survey was completed during IVI’ssite visit as part of this report.

    Findings:

    IVI’s visual reconnaissance did not reveal any areas of suspect LCP which are

     proposed to be disturbed by VZW proposed installation.

    6.17 Potential Mold Conditions

    Although mold is ubiquitous and may occur in a very short time span, an effortwas made to identify conspicuous mold growth in the common areas surveyed.

    Based on the above efforts, conspicuous mold growth was not identified at the

    time of our survey.

    7.0 INTERVIEWS 

    7.1 User

    The User(s) of the report is Pyramid   c/o Albany County. An All AppropriateInquiry (AAI) User questionnaire was submitted to the User. The user

    questionnaire is provided to the User of the Phase I Environmental SiteAssessment in order to obtain information pertaining to the past site useand possible presence of recognized environmental conditions. The owner of

    the site, Jody Jansen, did not completed the questionnaire on behalf of the User.

    7.1.1 Title Records

    Although requested, a copy of the Subject’s Chain-of-Title has not been provided to IVI for review. Nevertheless, the Subject underlying tax parcel

    is owned by Jody Jansen.

    7.1.2 Environmental Clean Up Liens and Activity and Use Limitations(AULs)

    Although requested, IVI was not provided with a filled out AAI UserQuestionnaire and, as such, makes no representations in regards to same.

    information pertaining to the Subject. As of this writing, the Fire Department has

    not responded to our request. Should receipt of a response from the FireDepartment change the conclusions of this report, Pyramid will be notified in

    writing by IVI.

    Albany County Health Department

    IVI has sent a request to Albany County Health Department for environmental

    information pertaining to the Subject. As of this writing, the Albany CountyHealth Department has not responded to our request. Should receipt of a response

    from the Albany County Health Department change the conclusions of this report,

    Pyramid will be notified in writing by IVI.

    8.0 FINDINGS AND CONCLUSIONS 

    This report documents IVI’s findings from our Phase I Environmental Site Assessment

    on the proposed wireless telecommunications facility located at 28 Jansen Lane, Berne,

     New York (the “Subject”). The Subject is situated in a rural setting characterized byresidential development, undeveloped wooded land, and agricultural land. The Subject is

    currently undeveloped wooded land. Prior to development of the Parent Parcel in 1952,the Subject was undeveloped wooded land. The Parent Parcel is owned by Jody Jansen.

    Pyramid Network Services, LLC  c/o Albany County  proposes to construct

    a wireless telecommunications facility on the Parent Parcel. Specifically, Pyramid proposes a 180’ self-support tower, with ancillary equipment at grade within an

    approximate 50’ x 60’fenced equipment compound. Pyramid proposes the

    installation of a 1,000 gallon propane AST, a 12’ x 16’ equipment shelter, a telcocabinet, electric transformer, and a 50kw propane generator within a

    telecommunications compound. Additionally, Pyramid  c/o Albany County proposes to

    trench for new underground conduits that will run from the proposed equipment

    cabinet to the existing utilities location (see attached Lease Exhibits for additionalinformation). The proposed collocation of antennas, ancillary equipment, proposed

    generator, connecting conduit and all areas proposed to be disturbed as part of the

    Pyramid installation are the focus of this report.The purpose of this Phase I Environmental Site Assessment was to assess existing site

    conditions and render an opinion as to the identified or potential presence of recognized

    environmental conditions in connection with all areas proposed to be disturbed as part ofthe Pyramid installation in accordance with the scope and limitations of ASTM

    International's Standard Practice for Environmental Site Assessments: Phase I

    Environmental Site Assessment Process E 1527-13 and the limitations identified herein.

    Exceptions to or deletions from the scope of work are described in Section 2.0.

    This assessment has revealed no evidence of recognized environmental conditions

    (RECs) in connection with the Subject and no further action is currently recommended.

    9.0 LIMITING CONDITIONS

    9.1 This report has been prepared in compliance with the ASTM International’s standard entitled

    “Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment

    Process” E1527-13.

    9.2  The observations described in this report were made under the conditions stated herein. The

    conclusions presented in the report were based solely upon the services described therein, and not onscientific tasks or procedures beyond the scope of described services within the constraints imposed

     by the client. The work described in this report was carried out in accordance with the Terms and

    Conditions of the contract.

    9.3 In preparing this report, IVI has relied on certain information provided by federal, state, and localofficials and other parties referenced therein, and on information contained in the files of

    governmental agencies, that were readily available to IVI at the time of this assessment. Although

    there may have been some degree of overlap in the information provided by these various sources,

    IVI did not attempt to independently verify the accuracy or completeness of all information reviewed

    or received during the course of this site assessment. Observations were made of the site and of thestructures on the site as indicated in this report. Where access to portions of the site or to structures

    on the site was unavailable or limited, IVI renders no opinion as to the presence of direct or indirect

    evidence relating to petroleum substances, hazardous substances, or both, in that portion of the siteand structure. In addition, IVI renders no opinion as to the presence of indirect evidence relating to

    hazardous material or oil, where direct observation of the ground surface, interior walls, floors,

    ceiling or a structure is obstructed by objects or materials, including snow, covering on or over these

    surfaces.

    9.4 As part of this assessment, IVI submitted requests for information via the Freedom of InformationAct (FOIA) to various governmental agencies. As of the preparation of this report, these requests

    may not have been fulfilled. The conclusions of this report are subject to change upon receipt of aresponse from these FOIA requests.

    9.5  IVI does not represent that the site referred to herein contains no petroleum or hazardous or toxic

    substances or other conditions beyond those observed by IVI during the site walkthrough.

    9.6  IVI has produced this document under an agreement between IVI and CLIENT on behalf of Pyramidon behalf of New York Transco, LLC and Jansen Lane County. All terms and conditions of that

    agreement are included within this document by reference. Any reliance upon this document, or

    upon IVI’s performance of services in preparing this document, is conditioned upon the relying party’s acceptance and acknowledgement of the limitations, qualifications, terms, conditions and

    indemnities set forth in that agreement, and property ownership/management disclosure limitations,

    if any. It is not to be relied upon by any party other than Pyramid nor used for any purpose other

    than that specifically stated in our Agreement or within this Report’s Introduction section without

    IVI’s advance and express written consent.

    9.7 TIME LIMITATION TO ENACT CLAIM AGAINST IVI.  If in the opinion of the Client, or any

    third party claiming reliance on IVI’s report or services, that IVI was negligent or in breach of

    contract, such aforementioned parties shall have one year from the date of IVI’s site visit to make a

    claim.

    9.8  Unless specifically identified within Section 2, Chinese drywall, indoor air quality and any other

    non-ASTM scope issues as identified in ASTM E1527-13, Section 13.1.5, are excluded from the

    scope of this assessment.
