Order

Sub: Continuation of provisional affiliation to Echelon Institute of Technology, Faridabad for the Academic Session 2020-21

Whereas the grant of continuation of provisional affiliation including course extension to Echelon Institute of Technology (EIT) Faridabad for Academic session 2019-20 is subjudice before the Hon'ble High Court of Punjab & Haryana vide CWP No. 31056 of 2019, this University as considered the request/claim of EIT for further continuation of provisional affiliation for Academic session 2020-21 as per interim orders of the Hon'ble High Court in CWP No. 8662 of 2020 on June 30, 2020 as follows:

"Till the next date of hearing, the operation of impugned letter/order dated 15.05.2020 shall remain stayed and for the next session, the claim of the petitioner be considered in accordance with law"

2. Due to the non-submission of the requisite information along with supporting documents and the affidavit of self-disclosure by EIT, as per procedure (notified vide letter dated 11.05.2020) adopted during COVID pandemic, despite several reminders, the University couldn't further take up this process to grant continuation of provisional affiliation. Again, the interim orders were issued by the Hon'ble High Court in writ petitions CWP-9970-2020 (O&M), CWP-31056-2019, CWP-279-2020 (O&M), CWP-283-2020, CWP-32785-2019 (O&M), CWP-8662-2020 (O&M), CM-6150-CWP-2020, CM-6539-CWP-2020 IN CWP-3702-2019 (O&M), and CWP-6715-2020 (O&M) on 27.07.2020 as follows:

b) The respondent/University shall also grant the provisional affiliation, which shall be subjected to outcomes of the present writ petition.

Meanwhile, the petitioners too shall not stand on any ego problem and supply the information as demanded by the University to enable them to pass the final order on the said affiliation to the year 2020-21. 11

3. Further, EIT didn't submit the requisite information, supporting documents and the affidavit of self-disclosure, leaving no scope for this University to take up the process to grant continuation of provisional affiliation, rather filed a COCP 1393 of 2020 in which the Hon'ble High Court issued the interim order on Aug 06, 2020 as follows:

''Meanwhile, the provisional affiliation be granted by the next date of hearing, failing which, this Court may be forced to pass harsh orders. It goes without saying that the said provisional affiliation is subject to the outcome of CWP-6715-2020"

4. Thereafter, the Hon'ble High Court issued the directions in CACP-7-2020 on Aug 18, 2020 (received on Aug 21, 2020 at 3:30 pm) as follows:

" .... Be that as it may, counsel for the respondents has submitted that he would send all the required documents which were sent on 8.7.2020 and 14.7.2020 (through email) again by email today itself so that the issue regarding the grant of provisional affiliation may be decided by the appellants by 20.8.2020. Counsel for the appellants has submitted that the necessary order shall be passed by 20.8.2020 for grant of provisional affiliation after receiving the required documents by the respondents through email. 11

5. Accordingly, the information sent by the EIT, Faridabad via email at 10:23 pm on Aug 18, 2020 was considered by the Inspection Committee/Board constituted as per Affiliation Ordinance for

grant of provisional affiliation. The Inspection Committee/Board in its report made the following

obse1vations:

(i) The affidavit of self-disclosure Is not on prescribed format. The content of affidavit has edited

which is a violation.

(ii) The most of the information sought in Inspection Porforma has not been given rather

mentioned tl1at "This falls witl1in tl1e exclusive jurisdiction of the AICTE and as per law

settled by Hon'ble Supreme Court through its Rungta Judgment, University has no authority

on the same" which is as good as supplying no information which is contempt of the order of

Hon 'ble High Court issued in CACP-07-2020 on Aug 18, 2020.

(iii) Details of the faculty members are not given, without which it is not feasible to ascertain the

due dil igence by the Institute w.r.t academic delivery of the curriculum prescribed the

University for its programmes.

(iv) Deta ils of the learning resource material including Lab equipment, Softwares, etc. are not

given without which it is not feasible to ascertain due diligence in teaching learning process.

(v) Even the details of the Director/Principal are not mentioned without which it is not feasible to

make authentic correspondence with regard to various academic matters.

(vi) Details of various safety features required in an Institute like CCTV, Barrier free excess for

physically challenged person, Fire Safety etc. are not given as these are essential for the

safety of students and faculty members of the Institute and others.

(vii) Details of the anti-ragging measures, online grievance redressal mechanism, and internal

compliant committee and SC/ST committee are not there. In absence of these it can't be

ensured that Institute is providing the respectful and in discriminated conduct to the students

seeking admission to the Institute and the staff members.

6. The above observations impede fulfillment of mandatory requirements for considering grant

of continuation of provisional affiliation to any Institute and thus the Inspection Board found it not

feasible to recommend the grant of extension/continuation of provisional affiliation to EIT, Faridabad.

7. Notwithstanding above, in compliance of the above stated orders of the Hon'ble High Court,

the Extension/Continuation of provisional affiliation for under-mentioned programmes for the

Academic Session 2020-21 is hereby granted temporarily "Echelon Institute of Technology,

Faridabad" with the condition that it will submit the requisite Affidavit of self-disclosure

(on the prescribed format without any editing) along with the complete information as

per Inspection Performa without any reservation/excuse /pretext leading to non-

submission of any such information, within 7 working days failing which this temporary

affiliation will stand withdrawn/cancelled:

s. Needless to mention that this temporary extension/continuation of provisional affiliation is purely temporary and subject to outcome of the pending writ petitions as mentioned in above paras

and EIT will comply with applicable norms & standards prescribed by the AICTE/University as amended time to time. The University reserves its right to inspect and verify the same at any time.

9. Accordingly, EIT Faridabad is directed to full-fill the conditions mentioned in para 7 within specified time before giving effect to this temporary affiliation.
