Terms & Conditions of Sale
This list cancels all previous quotations.
ORDERS: All orders will be shipped subject to varieties and size we can
supply at the time of shipment. A 25% deposit is required on plants to be
reserved for pick up at a later date. Orders are accepted on condition that
they shall be void should any injury befall stock from causes over which we
have no control. Orders will be filled as they are received.
TERMS OF SALE—LIVE PLANT MATERIAL: Cash or check payment must
be made at time of delivery or pick-up unless credit has been established.
ALL FREIGHT CHARGES ARE C.O.D. Our terms on plants are Net 30 with
established customers. Any accounts not paid in full in 30 days are subject
to a finance charge of 2% per month. This represents 24% per year. Our
terms for new customers are C.O.D. ALL EXPENSES INCURRED IN COL-
LECTION OF ACCOUNTS WILL BE CHARGED TO CUSTOMER.
A 5% DISCOUNT WILL BE GIVEN FOR ALL C.O.D. ORDERS OF LIVE
PLANT MATERIAL.
TERMS OF SALE—CHRISTMAS TREES: A 25% deposit is required with
all orders, with balance C.O.D. Absolutely no credit will be extended for cut
Christmas trees. All orders received from new customers must be paid in full
before trees are shipped. ALL FREIGHT IS C.O.D.
PRICES: All prices are F.O.B. our nursery and are subject to change with-
out notice. These prices are for the wholesale trade only. ALL PRICES

LIABILITY: When plants are picked up at the nursery, no liability
for damage will be assumed after plants are loaded on your truck.
Liability ceases upon delivery to trucking company except when
delivered by our own trucks; then liability ceases upon delivery to
customer. All stock travels at customers risk and any claims must
be made against the transportation company.
SHIPPING: Shipments will be delivered by common carriers and it
is the responsibility of the customer to unload and check material.
Please note that we do our best to meet requested shipping dates
but cannot guarantee shipment due to weather conditions, availa-
bility of trucks, etc.
DELIVERY AND CLAIMS: ALL MATERIAL MUST BE CHECKED
BY THE CUSTOMER WHILE UNLOADING. ANY PLANTS THAT
ARE NOT ACCEPTABLE OR THAT HAVE BEEN DAMAGED
DURING SHIPMENT MUST BE LEFT ON THE TRUCK IF POSSI-
BLE, AND THESE PROBLEMS MUST BE NOTED ON THE IN-
VOICE OR THE FREIGHT BILL. THE COST OF THE PLANTS
ONLY MAY BE DEDUCTED FROM THE INVOICE. ALL MATE-
RIAL ACCEPTED AND KEPT BY THE CUSTOMER, EMPLOY-
EE, OR PLACE OF BUSINESS MUST BE PAID FOR IN FULL. IT
IS THE CUSTOMER’S RESPONSIBILITY TO HAVE QUALIFIED
PEOPLE OR PERSON ON HAND TO CHECK MATERIAL AT
THE TIME OF DELIVERY. NO CLAIMS THAT THE MATERIAL
SHIPPED IS UNSATISFACTORY WILL BE ENTERTAINED AF-
TER PLANTS ARE ACCEPTED AND THE DRIVER LEAVES THE

BACKGROUND: Gragg Farms & Nursery is a family owned busi-
ness with over 20 years experience. We specialize in the produc-
tion of evergreens and deciduous trees. We love to grow trees and
help bring real green to the world around us. We use Christian
principles as a guide to produce and ship quality trees. Our Christ-
mas tree farm is located in Avery County, North Carolina in the
heart of the Appalachian Mountains. Our nursery is located in the
foothills of Burke County in Morganton. Tours of the nursery are
welcome. Please call for an appointment.
