CHAPTER 1

INTERPRETATION AND APPLICATION

1. Interpretation(�) IntheJointRules,unlessthecontextindicatesotherwise-

“Act”meansthePowers,PrivilegesandImmunitiesofParliamentandProvincialLegislaturesAct,2004;[inserted, 13 September 2005(NA);14 September 2005 (NCOP)]

“Assembly”meanstheNationalAssembly;

“ATC”meansthedocumententitled“Announcements,TablingsandCommitteeReports”;

“classification” with reference to a Bill, means the classification of a Bill in terms of joint rule 160(6) or the reclassification of a Bill in terms of joint rule 163, and “classify” and “classified” have a corresponding meaning;

“constitution amendment Bill”meansaBilltowhichsection74oftheConstitutionapplies;

“Council”meanstheNationalCouncilofProvinces;

“document”meansanywritteninstrument,andincludesanyelectronicorotherdeviceinoronwhichinformation,includingvisualmaterial,isrecorded,storedorkept;

“JTM”meanstheJointTaggingMechanismestablishedbyjointrule�5�;

“member”withreferenceto—

(a) theAssembly,meansamemberoftheAssembly;and (b) theCouncil,meansapermanentorspecialdelegatetothe Council,and“permanentmember”and“specialmember”havea correspondingmeaning;

“mixed section 75/76 Bill”meansaBillthatcontainsprovisionstowhichsection75oftheConstitutionappliesandprovisionstowhichsection76applies;

“money Bill”meansaBilltowhichsection77oftheConstitutionapplies;[amended, 16 November 2006 (NA & NCOP)]

“person in charge”withreferencetoaBill,meansthepersoninchargeoftheBillintermsoftheAssemblyorCouncilrules,asthecasemaybe;

“recess”withreferenceto- (a) aHouse,meansaperioddeterminedasarecessbythe ProgrammeCommitteeoftheHouse,orbyresolutionoftheHouse,during whichthebusinessoftheHouseisinterrupted;or (b) bothHouses,meansaperioddeterminedasarecessbythe JointProgrammeCommittee,orbyresolutionsadoptedintheHouses, duringwhichthebusinessofbothHousesisinterrupted;

“remitted Bill” meansaBillwhichthePresident,onaccountofreservationsaboutitsconstitutionality,hasintermsofsection79oftheConstitutionreferredbacktotheAssemblyforreconsideration;

“Secretary”meanstheSecretarytoParliament;

“section 75 Bill”meansaBilltowhichtheprocedureprescribedinsection75oftheConstitutionapplies,andincludesamoneyBill;

“section 76 Bill”meansaBilltowhichtheprocedureprescribedinsection76oftheConstitutionapplies;

“section 76(1) Bill”meansasection76BillintroducedintheAssembly;“section 76(2) Bill”meansasection76BillintroducedintheCouncil;

“working day”meansanydayoftheweekexcept— (a) SaturdayandSunday;and (b) a public holiday in terms of the Public Holidays Act, 1994 (Act 36 of�994),and,ifsuchapublicholidayfallsonaSunday,alsotheMonday.

(2) AreferenceintheJointRulestotheSpeakerorChairpersonoftheCouncil mustbereadasareferencealsototheDeputySpeakerorthepermanent DeputyChairpersonoftheCouncil,asthecasemaybe,if—

(a) theSpeakerortheChairpersonisabsent; (b) there is a vacancy in the office of the Speaker or the Chairperson; or (c) theSpeakerortheChairpersonisnotavailabletoperforma functionorexerciseapowerconferredontheSpeakerorChairpersonin termsoftheJointRules.

2. Unforeseen matters(�) TheSpeakerandtheChairpersonoftheCouncil,actingjointly,maygive arulingormakearuleinrespectofanymatterforwhichtheJointRulesdo notprovide.

(2) ArulemadebytheSpeakerandtheChairpersonoftheCouncil,acting jointly,remainsinforceuntilameetingoftheJointRulesCommittee hasdecidedonit.

3. Suspension(�) TheAssemblyandtheCouncil,byresolutionineachHouse,maydispose withorsuspendaprovisionoftheJoint Rules for a specific period or purpose.

(2) Thesuspensionofanyprovisionislimitedinitsoperationtotheparticular purposeforwhichthesuspensionhasbeenapproved.

4. Non-diminution or non-limitation of RulesNoconventionorruleofpracticelimitsorinhibitsanyprovisionoftheJointRules.

5. Application of Joint Rules to non-membersWhenaCabinetmemberwho isnotamemberof theAssemblyor theCouncil,participatesintheproceedingsofthejointbusinessoftheHouses,theJointRules,unless clearly inappropriate, apply to that Cabinet member as they apply to amemberoftheAssemblyortheCouncil.

6. Public participation(�) MembersofthepublicmayparticipateinthejointbusinessoftheHouses by- (a) attendingjointsittingsoftheHousesormeetingsofjoint committees; (b) responding to public or specific invitations — (i) tocommentinwritingonBillsorothermattersbeforea jointcommittee;or (ii) togiveevidenceortomakerepresentationsor recommendationsbeforejointcommitteesonsuchBills orothermatters,eitherinpersonorthrougharepresentative.

(2) Publicparticipationintermsofsubrule(�)issubjectto,andmustbe exercisedinaccordancewith,theapplicableprovisionsoftheJointRules.

CHAPTER 2

JOINT SITTINGS OF THE HOUSES

7. Calling of joint sittings(�) ThePresidentmaycallajointsittingoftheHouseswhenitisnecessary for— (a) thePresidenttodelivertheannualoraspecialaddressto Parliament;or (b) a purpose mentioned in section 42(5) or 203 of the Constitution.

(2) TheSpeakerandtheChairpersonoftheCouncil,actingjointly,maycalla jointsittingoftheHouseswhennecessary.

8. VenueJointsittingsareheldintheChamberoftheAssembly.

9. Day and timeThedateandtimeofajointsittingmustbemadeknowntothemembersoftheAssemblyandtheCouncil- (a) byplacingitontheOrderPapersoftheHouses; (b) by way of an announcement by the officer presiding at a sitting of aHouse;or (c) bygivingnoticetothemembersinawaydeterminedby theSpeakerandtheChairpersonoftheCouncilfortheirrespective Houses.

Part 1: Order in joint sittings

14A. Conduct of members(�) Everymember,whenheorsheentersorleavestheChamberormovesto

any other part of the Chamber during a debate, unless the presiding officer

directsotherwise,shallbowtotheChairinpassingtoorfromhisorher

seat.

(2) NomembershallpassbetweentheChairandthememberwhoisspeaking

14B. Members not to converse aloudDuringdebatenomembershallconversealoud.

14D. Order at adjournmentWhenajointsittingrises,membersshallriseandremainintheirplacesuntilthe

presiding officer has left the Chamber.

14E. PrecedenceofpresidingofficerWhenever the presiding officer addresses members during a debate, any member

thenspeakingorseekingtospeakshallresumehisorherseatandthepresiding

officer shall be heard without interruption.

14F. Irrelevance or repetitionThe presiding officer, after having called attention to the conduct of a member whopersistsinirrelevanceorrepetitionofarguments,maydirectthemembertodiscontinuehisorherspeech.

14G. Member ordered to withdrawIf the presiding officer is of the opinion that a member is deliberately contravening aprovisionoftheseRules,orthatamemberisincontemptoforisdisregardingtheauthorityoftheChair,orthatamember’sconductisgrosslydisorderly,heorshemayorderthemembertowithdrawimmediatelyfromtheChamberfortheremainderofthesitting.

14H. Referral of member’s conduct to HouseIf a presiding officer is of the opinion that a contravention committed by a member ofeitherHouseisofsoseriousanaturethatanordertowithdrawfromtheChamber for the remainder of the sitting is inadequate, the presiding officer may referthemattertotheSpeakerortheChairpersonoftheCouncil,whicheverisrelevant,forappropriateaction.

14I. Expression of regret(�) AmemberwhohasbeenorderedtowithdrawfromtheChambermay submittotheSpeakerortheChairpersonoftheCouncilawritten expressionofregret.

(2) AwrittenexpressionofregretapprovedbytheSpeakerortheChairperson oftheCouncilshallberecordedintheMinutesofProceedings.

14J. Reflectionsuponjudges,etcNo member shall reflect upon the competence or honour of a judge of a superior court or of the holder of any other office (other than a member of the Government) whose removal from such office is dependent upon a decision of either House.

14K. Grave disorderIn the event of grave disorder at a sitting, the presiding officer may adjournthesittingormaysuspendtheproceedingsforaperiodtobestatedbyhimorher.

Part 2: Rules of debate

14L. Member to address ChairAtaJointSittingamembermayonlyspeakfromthepodium,except— (a) toraiseapointoforderoraquestionofprivilege; (b) tofurnishapersonalexplanationintermsofRule�4R; (c) ifthememberisunabletodosoduetoaphysicaldisability;or (d) with the prior consent of the presiding officer,when he or she may address the Chair from a microphone on the floor of the Chamber.

14M. Calling of membersA member shall be called in a debate by the presiding officer in accordance with a listofscheduledspeakers.

14N. Time limits for speechesMembersshallberestricted,inregardtothelengthoftimetheyspeak,tothetimesallocatedtotheminthelistcontemplatedinRule�4M.

14O. Reference to member by nameNo member shall refer to any other member by his or her first name or names only.

14P. Offensive languageNomembershalluseoffensiveorunbecominglanguage.

14Q. Matters sub judiceNo member shall reflect on the merits of any matter on which a judicial decision is pending.

14R. Explanations(�) Anexplanationduringdebateisallowedonlywhenamaterialpartofa member’sspeechhasbeenmisquotedormisunderstood,butsuch membershallnotbepermittedtointroduceanynewmatter,andnodebate shallbealloweduponsuchexplanation.

(2) Amembermay,withtheprior consent of the presiding officer, also explain mattersofapersonalnature,butsuchmattersmaynotbedebated,andthe member shall confine himself or herself strictly to the vindication of his or herownconductandmaynotspeakforlongerthanthreeminutes.

14S. Points of order(�) Whenapointoforderisraised,themembercalledtoordershallresume hisorherseat,andafterthepointoforderhasbeenstatedtothepresiding officer by the member raising it, the presiding officer shall give his or her rulingordecisionthereoneitherforthwithorsubsequently.

(2) Arulingtobegivenafterthesittinghasadjournedshallbegiveninthe NationalAssemblyorintheNationalCouncilofProvinces,dependingon whichHousetheoffendingmemberbelongsto.

(3) A ruling to be given in accordance with Subrule (2) may, by agreement of the presiding officers, be delivered and enforced by a presiding officer of theHousetowhichtheoffendingmemberbelongsonbehalfofapresiding officer from the other House.

14T. Acting for absent memberAmembermaytakechargeofanorderofthedayintheabsenceofthememberincharge,providedheorshehasbeenauthorizedtodosobytheabsentmember.

14U. Right of members to speakAmembermayspeak— (a) when called upon to do so by the presiding officer; or (b) toapointoforder.

19. (2) Subrule(�)(a)onlyappliesifthenumberofmembersintheAssembly componentofthejointcommitteeallowsforallpartiestoberepresented.

20. Appointment procedures (�) ExceptwheretheJointRulesprovidefortheappointmentofthemembers of a joint committee in a specific case - (a) theSpeakerappointsthemembersoftheAssemblycomponentofa jointcommitteeafterconsulting- (i) theChiefWhipofthemajoritypartyintheAssembly,whena memberrepresentingthemajoritypartyisappointed;or (ii) themostseniorwhipofaminoritypartyintheAssembly,when amemberrepresentingthatparticularpartyisappointed;and (b) theChairpersonoftheCouncilappointsthemembersofthe Councilcomponentofajointcommitteeafterconsultingtheheadofa provincialdelegation,whenamemberrepresentingthatdelegationis appointed.

(2) ThenamesofthemembersappointedmustbeannouncedintheATC withoutdelay.

21. Alternates (1) Alternates may be appointed for one or more specific members of a joint committeeinaccordancewiththesameprocedureprescribedfor committeemembersintermsofjointrule20.

(2) Analternateactsasamemberwhenthememberforwhichthealternate wasappointed— (a) isabsent;or (b) has vacated office, until the vacancy is filled.

22. Termofoffice(�) Membersofajointcommitteeandalternatesformembersareappointed untiltheAssembly’stermexpiresortheAssemblyisdissolved,whichever occurs first.

(2) Amemberofajointcommitteeceasestobeamemberandanalternatefor amemberceasestobeanalternate— (a) ifawhipofthepartytowhichthatmemberoralternatebelongs— (i) inthecaseofanAssemblymember,givesnoticetothe Speaker,inwriting,thatthememberoralternateistobe replacedorwithdrawn;or (ii) inthecaseofaCouncilmemberrepresentingapartyina committee,givesnoticetotheChairpersonoftheCouncil,in writing,thatthememberoralternateistobereplacedor withdrawn;or (b) ifawhipoftheprovincialdelegationtowhichthatmemberor alternatebelongs,inthecaseofaCouncilmemberrepresentingaprovince inacommittee,givesnoticetotheChairpersonoftheCouncil,inwriting, thatthememberoralternateistobereplacedorwithdrawn.

23. Chairpersons (�) Ifajointcommitteehasco-chairpersons,theco-chairpersonsmustco- chairmeetingsofthecommitteeexceptwhenoneofthemtakesthechair byagreementbetweenthem.Ifacommitteehasasinglechairperson,that personmustchairmeetingsofthecommittee.

(2) Theco-chairpersonsorthechairpersonofajointcommittee,asthecase maybe- (a) mayactinanymatteronbehalfofandinthebestinterestsofthe committeewhenitisnotpracticaltoarrangeameetingofthecommitteeto discussthatmatter,ifthatmatterconcerns— (i) arequestbyapersontogiveevidenceormakeoral representationstothecommittee; (ii) anyotherrequesttothecommittee;and (iii) theinitiationofanystepsordecisionsnecessaryforthe committeetoperformitsfunctionsorexerciseitspowers;and (b) performthefunctions,tasksanddutiesandexercisethepowers thatthecommittee,resolutionsadoptedbyboththeAssemblyandthe Councilorlegislationmayassigntotheco-chairpersons.

(3) The co-chairpersons or chairperson of a joint committee must report to the committeeonanystepstakenintermsofsubrule(2).

(4) (a) Ifajointcommitteehasasinglechairperson,thechairperson, intheeventofanequalityofvotesonanyquestionbeforethecommittee, mustexerciseacastingvoteinadditiontothechairperson’svoteas amember. (b) IfajointcommitteeconsistsofHousecomponentsanddecides questionsbeforeitbywayofagreementbetweenthemajoritiesinthe respectivecomponents,theco-chairpersonofthecommitteeappointed fromacomponent,intheeventofanequalityofvotesonanyquestion beforethecomponent,mustexerciseacastingvoteinadditiontothat person’svoteasamember.

(5) Theco-chairpersonsorthechairpersonofajointcommittee,asthecase maybe,performthefunctionssetoutinsubrules(�)and(2)subjecttothe otherprovisionsoftheJointRulesandthedirectionsofthecommittee.

24. Acting chairpersons (�) Ifajointcommitteehasco-chairpersonsandoneoftheco-chairpersons isabsentorunabletoperformthefunctionsofco-chairperson,the relevantcomponentofthecommitteemayelectanotherofitsmembersas actingco-chairpersontoperformthefunctionsandexercisethepowersof thatco-chairperson.

(2) Ifajointcommitteehasasinglechairpersonandthatchairpersonisabsent orunabletoperformthefunctionsofthechairperson,thedeputy chairpersonactsaschairpersontoperformthefunctionsandexercisethe powersofthechairperson.

25. First meetings (1) The Secretary must call a meeting of a joint committee within five working daysafterthenamesofthecommitteemembershavebeenannouncedin theATC.

(2) IfbothoreitheroftheHousesareinrecesstheSecretarymustnotifythe membersofthecommittee,theChiefWhipofthemajoritypartyandthe mostseniorwhipofeachoftheotherpartiesintheAssemblyandtheChief Whipof,andthedelegationwhipsin,theCouncil,ofthetimeandplaceof themeetingatleast�4daysbeforethemeeting.

26. Meetings (�) Jointcommitteesmeetwhenevernecessaryandasdeterminedin accordancewiththeJointRulesandthedecisions,directivesand guidelinesoftheJointProgrammeCommittee.

(2) Ameetingofajointcommitteemaybecalledintermsofsubrule(�)by- (a) thechairpersonorco-chairpersonsofthejointcommittee;or (b) theJointRulesCommittee.

(3) If one of the co-chairpersons of a joint committee is not available, the other co-chairpersonmaycallameetingofthecommittee.

27. Matters relating to quorum and decisions (�) Ajointcommitteemayproceedwithbusinessirrespectiveofthenumberof memberspresent.

(2) Whenajointcommitteehastodecideaquestionandthenumberof members present is insufficient for a decision to be taken, the member or members presiding may either suspend business until a sufficient numberofmembersispresent,oradjournthemeeting.

(3) If a joint committee consists of House components and decides questions beforeitbywayofagreementbetweenthemajoritiesintherespective componentssubrule(2)appliesalsotosuchacomponentwhenthe numberofmembersinthatcomponentwhoarepresentatthemeeting,is insufficient for a decision to be taken by the component.

28. Co-option when members and alternates not available Ifamemberofajointcommitteeandthatmember’salternatearebothabsentfromameetingofthecommittee,thechairpersonorco-chairpersonsmayco-optanyotherAssemblyorCouncilmember,asmaybeappropriate,toactasamemberofthecommitteeuntilthatcommitteememberorthealternatememberisnolongerabsent.

29. Interruption,suspensionoradjournmentThememberormemberspresidingatameetingofajointcommitteemay

interruptorsuspendtheproceedingsoradjournthemeeting,andmaychangethe

datefortheresumptionofbusiness.

30. Charges against members IfanyinformationcharginganAssemblyorCouncilmembercomesbeforeajointcommittee,thecommitteemaynotproceeduponthatinformation,butmustreportitwithoutdelaytotheSpeakerortheChairpersonoftheCouncil,asmaybeappropriate.

31. Reporting to Houses(�) AjointcommitteemustreporttobothHousesonamatterreferredtothe committee- (a) whentheHousesaretodecidethematterintermsof- (i) theJointRules; (ii) therespectiveHouseRules; (iii) aresolutionadoptedinbothHouses;or (iv) legislation; (b) ifthecommitteehastakenadecisiononthematter,whetherornot theHousesaretodecidethematterascontemplatedinparagraph(a);or (c) ifthecommitteeisunabletodecideamatterreferredtoitfora report.

(2) AjointcommitteemustreporttobothHouseson— (a) allotherdecisionstakenbyit,exceptthosedecisionsconcerningits internalbusiness;and (b) itsactivitiesatleastonceperyear.

(3) A report of a joint committee - (a) mustbesubmittedtoaHousebytheco-chairpersonofthe committeewhoisamemberofthatHouse,orbyanothermemberofthe committeewhoisamemberofthatHouseanddesignatedbythe committee;and

(b) mayrequestthatthatco-chairperson,oranothermemberofthe

committeewhoisamemberoftherelevantHouseanddesignatedbythe

committee,introducesorexplainsthereportintheHouse.

(4) Ajointcommitteemaynotsubmitaminorityreportexceptwhereprovided

forintheseRules.

(5) Ifajointcommitteereportsonamatterotherthanamattermentionedin

subrule (1) (a) and is of the view that its report, or a specific matter

mentionedinthereport,shouldbeconsideredbytheHouses,itmaymake

arequesttothateffectinthereport.

32. General powers (�) Forthepurposesofperformingitsfunctionsajointcommitteemay,

subjecttotheConstitution,legislation,theotherprovisionsoftheJoint

RulesandresolutionsoftheHouses—

(a) summonanypersontoappearbeforeittogiveevidenceonoathor

affirmation, or to produce documents;

(b) receivepetitions,representationsorsubmissionsfrominterested

personsorinstitutions;

(c) conductpublichearings;

(d) permitoralevidence,includingevidenceonpetitions,representations

andsubmissions;

(e) determineitsownprocedure;

(f) meetatavenuedeterminedbyit,whichmaybeavenuebeyondthe

seatofParliament;

(g) meetonanydayandatanytime,including- (i) onadaywhichisnotaworkingday; (ii) onadayonwhichaHouseorbothHousesarenotsitting; (iii) atatimewhenaHouseorbothHousesaresitting;or (iv) duringarecessofaHouseorbothHouses;and (h) exerciseanyotherpowersassignedtoitbytheConstitution, legislation,theotherprovisionsoftheJointRulesorresolutionsadoptedin bothHouses.

(2) Nojointcommitteemay— (a) initiatelegislationforintroductioninaHouse;or (b) considerlegislationinthelegislativeprocessexceptwhenexpressly empoweredtodoso.

(3) Subject to the approval of the Speaker and Chairperson, the Secretary may paytowitnessessummonsedintermsofsection�4(�)oftheActorrule 32(1)(a) oftheJointRulesareasonablesumfortravellingandattendance timeandfortransportexpensesactuallyincurred.

(4) PriortoawitnessgivingevidencebeforeaHouseorcommittee,the memberpresidingshallinformthewitnessasfollows:

‘‘Pleasebeinformedthatbylawyouarerequiredtoanswerfullyandsatisfactorilyallthequestionslawfullyputtoyou,ortoproduceanydocumentthatyouarerequiredtoproduce,inconnectionwiththesubjectmatteroftheenquiry,notwithstandingthefactthattheanswerorthedocumentcouldincriminateyouorexposeyoutocriminalorcivilproceedings,ordamages.Youare,however,protectedinthatevidencegiven under oath or affirmation before a House or committee may not beusedagainstyouinanycourtorplaceoutsideParliament,exceptincriminalproceedingsconcerningachargeofperjuryorachargerelatingtotheevidenceordocumentsrequiredintheseproceedings.’’

33. Conferring powers (�) Ajointcommitteemayconferwithanyotherjointcommitteeorwitha committeeofeitherHouse.

(2) Jointcommitteesmustconfer— (a) ifaresolutionadoptedinbothHousesinstructsthemtoconfer;or (b) duringarecessofbothoranyoftheHouses,iftheSpeakerandthe ChairpersonoftheCouncil,actingjointlyandwiththeconcurrence oftheChiefWhipofthemajoritypartyintheAssemblyandtheChief WhipoftheCouncil,instructthemtoconfer.

(3) When joint committees meet to confer the respective chairpersons or co- chairpersonsofthecommitteesco-chairthemeetingexceptwhenoneof themtakestheChairbyagreementbetweenthem.

Part 3: Rules applicable to joint subcommittees generally

34. Application of this PartTheprovisionsofthisPartapplytoalljointsubcommitteesestablishedbyorintermsoftheJointRulesexceptinsofarasanyoftheseprovisionsisinconsistentwith— (a) another provision of the Joint Rules applicable in a specific case; or (b) aresolutionadoptedinbothHouses.

35. General rules(�) AjointsubcommitteeestablishedbyorintermsoftheJointRules— (a) isaccountabletoitsparentcommittee; (b) mustcarryoutitstaskandresponsibilitieswithinapolicyframework determinedbyitsparentcommitteeandinaccordancewiththeJoint Rulesandanydirectives,guidelinesorregulationsissuedbytheparent committee; (c) mayconsultanyjointcommitteeorsubcommittee,oranyHouse committeeorsubcommittee; (d) maydetermineitsownprocedure,subjecttotheJointRules,any directivesoftheparentcommitteeorresolutionsadoptedinbothHouses; and (e) mayonlymakerecommendationstoitsparentcommittee;and (f) mustreporttoitsparentcommitteeregularlyorwhenrequestedby theparentcommittee.

(2) Theparentcommitteeofajointsub-committee— (a) mustappointthemembersofthesubcommitteefromamongits members;

(b) may,ifappropriate,determineaperiodwithinwhichthe subcommitteemustcompleteitstask; (c) mustdeterminetheextent,natureandformofthesubcommittee’s reportstothecommittee,andtimelimitforthesubmissionofareport; (d) maydelegateanyofitspowerstothesubcommitteenecessaryfor thesubcommitteetoperformitstask;and (e) mayinstructthesubcommitteetoperformanyofitsfunctions.

36. Alternates(�) Aparentcommitteemayappointalternatesfromamongitsmembersfor one or more specific members of a joint subcommittee.

Termofoffice(�) Themembersofajointsubcommitteeestablishedbyaprovisionofthe JointRulesandanyalternatesforthosemembers,areappointeduntilthe Assembly’stermexpiresortheAssemblyisdissolved,whicheveroccurs first.(2) Ajointsubcommitteeestablishedbyajointcommitteeintermsofa provisionoftheJointRulesceasestoexist— (a) whenithascompletedthetaskforwhichitwasestablished;or (b) ifitisdissolvedbytheparentcommitteeearlier.

(3) A member of a joint subcommittee ceases to be a member and an alternate foramemberceasestobeanalternateifthatmemberceasestobea memberoftheparentcommittee.

38. Chairpersons (�) Ifajointsubcommitteehasco-chairpersons,theco-chairpersonsmust co-chairmeetingsofthesubcommitteeexceptwhenoneofthemtakesthe chairbyagreementbetweenthem.Ifasubcommitteehasasingle chairperson,thatpersonmustchairmeetingsofthesubcommittee.

(2) Theco-chairpersonsorthechairpersonofajointsubcommittee,asthe casemaybe- (a) mayactinanymatteronbehalfofandinthebestinterestofthe subcommitteewhenitisnotpracticaltoarrangeameetingofthe subcommitteetodiscussthatmatter,ifthatmatterconcerns— (i) arequestbyapersontogiveevidenceormakeoral representationstothesubcommittee; (ii) anyotherrequesttothesubcommittee;and (iii) theinitiationofanystepsordecisionsnecessaryforthe subcommitteetoperformitsfunctionsorexerciseitspowers; and (b) performsthefunctions,tasksanddutiesandexercisesthepowers thattheparentcommittee,aresolutionadoptedinbothHousesor legislationmayassigntotheco-chairpersons.

(3) The co-chairpersons or chairperson of a joint subcommittee must report to thecommitteeonanystepstakenintermsofsubrule(2).

(4) Theco-chairpersonsorthechairpersonofajointsubcommittee,asthe casemaybe,performthefunctionssetoutinsubrules(�)and(2)subject totheotherprovisionsoftheJointRulesandthedirectionsoftheparent committee.

39. Acting chairpersons (�) Ifajointsubcommitteehasco-chairpersonsandoneoftheco-chairpersons isabsentorunabletoperformthefunctionsofco-chairperson,therelevant componentofthesubcommitteemayelectanotherofitsmembersas actingco-chairpersontoperformthefunctionsandexercisethepowersof thatco-chairperson.

(2) Ifajointsubcommitteehasasinglechairpersonandthatchairperson isabsentorunabletoperformthefunctionsofthechairperson,thedeputy chairpersonactsaschairpersontoperformthefunctionsandexercisethe powersofthechairperson.

40. Meetings (�) Jointsubcommitteesmeetwhenevernecessaryandasdeterminedin accordancewiththeJointRulesandthedecisions,directivesand guidelinesoftheProgrammeCommittee.

(2) Ameetingofajointsubcommitteemaybecalledintermsofsubrule(�)by- (a) theco-chairpersonsofthesubcommittee; (b) theparentcommittee;or (c) theco-chairpersonsoftheparentjointcommittee.

41. Matters relating to quorum Ajointsubcommitteemayproceedwithbusinessirrespectiveofthenumberofmemberspresent.

42. Decisions(�) AquestionbeforeajointsubcommitteeconsistingofHousecomponents,is decidedbyconsensusbetweenthetwocomponentsandwithineach component.(2) Ifconsensuscannotbereachedallviewsinthejointsubcommitteeonthe questionmustbereportedtotheparentcommittee.

43. General powers of joint subcommitteesA joint subcommittee has the powers listed in rule 32 only when assigned to it in termsoftheJointRulesoraresolutionadoptedinbothHouses.

Unusual meetings of committees and subcommittees(�) Ajointcommitteeorsubcommitteemaysitonadaywhichisnotaworking day,oratavenuebeyondtheseatofParliament,orduringarecessofboth oranyoftheHouses,oratatimewhenbothoranyoftheHousesis sitting,butonlywiththepermissionoftheChiefWhipofthemajorityparty intheAssemblyandtheChiefWhipofthemajoritypartyintheCouncil.

(2) IfajointcommitteeorsubcommitteeappliestotheChiefWhipstositona daywhichisnotaworkingday,oratavenuebeyondtheseatof Parliament,theChiefWhipsmaygivetheirpermissionintermsofsubrule (�)onlyafterhavingconsultedtheSpeakerandtheChairpersonofthe Council.

46. Persons appearing before joint committees and subcommitteesAnyperson,includingcounselandattorneys,appearingbeforeajointcommitteeorsubcommitteemustobservethedirectionsandconformtotheproceduresdeterminedbythechairpersonorco-chairpersonsofthejointcommitteeorsubcommittee.

47. Admission of the public(�) Meetingsofjointcommitteesandsubcommitteesareopentothepublic, includingthemedia,andthememberormemberspresidingmaynot excludethepublic,includingthemedia,fromthemeeting,exceptwhen—

(3) The Speaker and the Chairperson of the Council, acting jointly, must — (a) setasideplacesforthepublicinthecommitteerooms;and (b) determinetheentrancesandroutesthroughwhichthepubliccan obtainaccesstotheseplaces.

measures-

48. Participation of Assembly and Council members(�) AnyAssemblyorCouncilmemberwhoisnotamemberofthejoint committeeorsubcommitteemaybepresentatameetingofajoint committeeorsubcommittee.

(2) Amembermentionedinsubrule(�)whoispresentatameetingofajoint committeeorsubcommittee— (a) mayspeakonamatterbeforeajointcommitteeorsubcommittee subjecttoanyreasonablerestrictionsthechairpersonorco-chairpersons mayimpose;and (b) maynotvoteexceptwhenthevoteiscastasanalternateorasaco- optedmember.

49. Exclusion of members of the public from meetingsThememberormemberspresidingatameetingofajointcommitteeorsubcommitteemay– (a) orderamemberofthepublictoleavethemeeting— (i) whenthepublicisexcludedfromameetingintermsofjoint rule47(�);or (ii) whennecessarytogiveeffecttothemeasurestakenunder joint rule 47 (3); or (b) orderapersonreferredtoinjointrule46toleavethemeetingifthat persondoesnotcomplywitharulingofthepresidingmemberor members.

50. Exclusion of other persons from meetingsWhenthepublicisexcludedfromameetingofajointcommitteeorsubcommitteeintermsofrule47(�),thememberormemberspresidingmayorderastaffmember, a member or official of the executive or an Assembly or Council member whoisnotamemberofthecommitteeorsubcommittee,alsotoleavethemeeting.

Removal of personsWheninstructedbythememberormemberspresiding,theSerjeant-at-ArmsoftheAssemblyortheUsheroftheCouncilmustremoveorarrangefortheremovalofanyperson- (a) who,withoutpermission,ispresentinthatpartofacommitteeroomdesignatedformembersofthejointcommitteeorsubcommitteeonly;or (b) whodisruptstheproceedingsofajointcommitteeorsubcommittee, causesanuisanceordoesnotleavewhenorderedtoleaveunderjointrule 49or50.

52. Publicationofproceedings,evidence,reports,etc.(1) All documents officially before, or emanating from, a joint committee or subcommitteeareopentothepublic,includingthemedia,butthefollowing documentsmaynotbepublished,andtheircontentsmaynotbedisclosed, exceptwiththepermissionofthecommittee,ortheparentcommitteeinthe caseofasubcommittee,orbyorderoftheSpeakerandtheChairpersonof theCouncil,actingjointly,orbyresolutionsadoptedinbothHouses: (a) Theproceedingsof,orevidencetakenbyorplacedbefore,the committeeorsubcommitteewhilethepublicwereexcludedfromameeting intermsofjointrule47(�). (b) Anyreportonorsummaryofsuchproceedings orevidence. (c) Anydocumentplacedbefore,orpresentedto,thecommitteeor subcommittee as a confidential document and declared by it as a confidential document. (d) Anydocument— (i) submittedortobesubmittedtomembersofthecommitteeor subcommittee as a confidential document by order of the chairpersonorco-chairpersonsofthecommitteeor subcommittee;or (ii) afteritssubmissiontomembersdeclaredbythechairperson or co-chairpersons as a confidential document.

(2) Thepermission,orderorresolutionauthorisingthepublication,orthe disclosureofthecontents,ofdocumentsmentionedinsubrule(�)may provide that specific parts of, or names mentioned in, the document may notbepublishedordisclosed.

(3) For the purposes of subrule (1) a document is officially before a joint committeeorsubcommitteewhen- (a) thepresidingmemberormembersplacethedocumentorpermitthe documenttobeplacedbeforethecommitteeorsubcommittee;or (b) apersonappearingbeforethecommitteeorsubcommitteeas awitnessortomakerepresentations,presentsthedocumenttothe committeeorsubcommittee.

57. Decisions(�) AquestionbeforetheJointRulesCommitteeisdecidedwhenthereis agreementonthequestionbetween- (a) themajorityofthemembersoftheAssemblycomponent;and (b) themajorityofthemembersoftheCouncilcomponent.

(2) If the Joint Rules Committee reports to the Houses in terms of joint rule 31 onadecisiontakenbytheCommitteeonanyquestionwithinitspowers andtheoneHouseacceptsthedecisionandtheotherHouserejectsthe decision,thequestionmustbereconsideredbytheCommittee.

(3) On reconsideration, the question is decided by the Joint Rules Committee whenitissupportedbythemajorityofthevotescastjointlyprovidedthat thevotesareweightedinsuchawaythattheAssemblyandCouncil componentshaveanequalnumberofvotes.

(4) A decision in terms of subrule (3) on a matter other than a matter mentionedinjointrule5�,isbindingonbothHouses.

58. New joint rules and amendments to the Joint Rules lftheJointRulesCommitteeamendstheJointRules,ormakesanewjointrule,intermsofsection45oftheConstitutionandeithertheAssemblyortheCouncil,orboth,rejecttheamendmentornewrule,theCommitteemustreconsidertheamendmentornewruleandeither— (a) withdrawtheamendmentornewrule;or (b) rephraseitinawayacceptabletobothHouses.

59. Minority party participation ApoliticalpartyrepresentedintheCouncilthatisnotrepresentedintheCouncilRulesCommitteemaydesignateoneofitsCouncilmemberstoattend,andtospeakin,theJointRulesCommittee,butthatmembermaynotvote.

153. Operating procedure(1) Whenever the JTM must rule on the classification of a Bill or on a question whetheraBilloranamendmenttoaBillisconstitutionallyorprocedurally inorderintermsofjointrule�6�,theBill,andalegalopiniononits classification or on the relevant question, must be submitted to the membersoftheJTM.

(2) The JTM decides the classification of a Bill or the question concerned by consensus.ConsensusisreachedwhenallavailablemembersoftheJTM agree,providedthatatleastonefromeachHouseagrees.

(3) lf there is no consensus the JTM must obtain a second legal opinion preferablyfromaconstitutionalexpertapprovedbytheJTM.

(4) Whenamatterisre-submittedtothemembersoftheJTMtheymust without delay take a final decision on the matter, but are not bound by any legaladvice.

(5) lftheJTMisunabletoreachconsensusonthematter,themattermustbe reportedtotheAssemblyandtheCouncil.

(6) lftheHousescannotresolvethematterthroughanyothermechanisms attheirdisposal,aHousemaybyresolutiondeclareadisputeandapplyto theConstitutionalCourttoresolvethedispute.

154. Submission of views to JTM(�) AssemblyandCouncilmembersandcommitteesandprovinciallegislatures may submit their views on the classification of a Bill to the JTM in writing withintheperiodstatedintheATCwhichmaynotbelessthanthree workingdays.

(2) TheJTMmaynotclassifyaBillbeforetheexpiryoftheperiodstatedinthe ATC.

155. JTM to be available at short noticeTheJTMmustbeavailableatshortnotice,alsoduringarecessofbothoreitheroftheHouses.

156. Time limitsTheJointProgrammeCommitteemay— (a) set a time limit for the JTM to make a final ruling on a Bill referred to it;or (b) extendanytimelimitsetunderparagraph(a).

157. NotificationofclassificationsandfindingsThe JTM’s classification of and, when appropriate, its findings on a Bill must withoutdelaybe- (a) tabledintheAssemblyandtheCouncil;and (b) conveyedtoanyAssemblycommittee,Councilcommitteeorjoint committeetowhichtheBillmayhavebeenreferred.

158. BindingforceofJTM’sclassificationsandfindingsFor the purposes of all parliamentary proceedings the JTM’s classification of and findings on a Bill are final and binding on both Houses.

Note: Presidingofficerstogiveguidancewhetherrulesonchairing and calling of JTM meetings are necessary.

JOINT LEGISLATIVE PROCESS

Part 1: Steps prior to introduction of Bills

159. Submission of draft Bills as approved by Cabinet to Speaker and Chairperson of Council(�) ACabinetmemberorDeputyMinisterwhointendsintroducingaBillinthe AssemblyorwhoinitiatestheintroductionofaBillintheCouncil,must assoonaspossibleaftertheBillhasbeenapprovedbyCabinet,submitto theSpeakerandtheChairpersonoftheCouncil- (a) thedraftoftheproposedBillasapprovedbyCabinet,whetherornot thedrafthasbeenlegallyortechnicallyformalisedasaproperdraftBill; and (b) amemorandumexplainingtheobjectsoftheproposedlegislation.

Note: It is highly desirable that portfolio and select committees be informed of the content of proposed legislation well before the introduction of the legislation in order to assist them in planning and developing views on the legislation.

(2) TheSpeakermustreferthedraftoftheproposedBillandthememorandum totheresponsibleportfoliocommitteeandtheChairpersonoftheCouncil mustreferthedraftoftheproposedBillandthememorandumtothe responsibleselectcommitteeandtheprovinciallegislaturesinorder- (a) toassistthecommitteeandlegislaturesinplanningtheirwork;and (b) toenablethecommitteemembersandlegislaturestoacquaint themselveswithandtodeveloptheirpositionswithregardtotheproposed legislation.

(3) The Leader of Government Business in Parliament must liaise with Cabinet memberstofacilitatetheimplementationofthisrule.(4) Thisruledoesnotapplyto- (a) amoneyBillinrespectofwhichtheresponsibleMinisterfollowsthe specialintroductoryproceduresetoutinAssemblyrule2��;or (b) anyotherBillsinrespectofwhichprematuredisclosureoftheir contentsmayresultinprejudicetothestateorthegeneralpublic.

Part2:ClassificationofBills

160. Referral of Bills to JTM(�) WhenaBillisintroduceditmustwithoutdelaybereferredtotheJTMfor classification in terms of this rule.

(2) WhenaBillintroducedasaconstitutionamendmentBillisreferredtothe JTM, it must make a finding on whether - (a) theBillisinfactaconstitutionamendmentBill; (b) theBillisintermsofsection74oftheConstitutionrequiredtobe passedbybothHousesoronlybytheAssembly; (c) theBilloranyofitsprovisionsisintermsofsection74requiredtobe passedbytheAssemblywithasupportingvoteofatleasttwothirdsorwith asupportingvoteofatleast75percentofthemembers; (d) theBilloranyofitsprovisionsisintermsofsection74(�)requiredto beapprovedbyanyprovinceorprovincesbeforeitispassedbythe Council;and (e) theBillisconstitutionallyandprocedurallyinorder.

(3) When a Bill introduced as a section 75 Bill is referred to the JTM, it must make a finding on whether the Bill- (a) isinfactasection75Bill; (b) includesanyprovisionstowhichtheprocedureprescribedinsection 76oftheConstitutionapplies;and (c) isconstitutionallyandprocedurallyinorder.

(4) WhenaBillintroducedasasection76BillisreferredtotheJTM,itmust make a finding on whether the Bill — (a) is in fact a section 76 Bill and if so, which of subsections (3), (4) or (5)ofthatsectionappliestotheBill; (b) includesanyprovisionstowhichtheprocedureprescribedinsection 75applies;and (c) isconstitutionallyandprocedurallyinorder.

(5) WhenaBillintroducedasamixedsection75/76BillisreferredtotheJTM, it must make a finding on whether the Bill - (a) isinfactamixedsection75/76Bill;and (b) isconstitutionallyandprocedurallyinorder.

(5A) The JTM must also make a finding whether a Bill pertains to customary laworcustomsoftraditionalcommunitiesinaccordancewithsection��(�) of the Traditional Leadership and Governance Framework Act, 2003.[Rule 160 (5A) inserted, 13 September 2005 (NA);14 September 2005 (NCOP)]

(6) Once it has made its findings, the JTM must classify the Bill as- (a) aconstitutionamendmentBill; (b) asection75Bill;or (c) amoneyBill; (d) asection76Bill; (e) amixedsection75/76Bill;or (f) aBillthatisconstitutionallyorprocedurallyoutoforder.

161. When Bills are out of order(�) ABillisconstitutionallyoutoforderifitisinbreachof— (a) section 73(2) or (4) of the Constitution, in that it was incorrectly introducedbyanunauthorisedpersonorcommittee; (b) section 73(3), in that the Bill was incorrectly introduced in the wrong House;

(2) ABillisprocedurallyoutoforderif- (a) theprocedureprescribedineithertheAssemblyorCouncilrulesasa preconditionfortheintroductionofaBillintheparticularHousehasnot beencompliedwith; (b) itisinbreachofjointrule�72inthatitisaconstitutionamendment Billthatcontainsbothconstitutionalamendmentsthatmaybepassedby theAssemblyaloneandconstitutionalamendmentsthatarerequiredto bepassedalsobytheCouncil; (c) it is in breach of joint rule 193 in that it is a mixed section 75/76 Bill thatwasintroducedintheCouncil;or (d) it is in breach of joint rule 93 (b) in that a deadline set for the introductionoftheBillwasnotmetandlateintroductionwasnotauthorised

(3) Except as provided for in subrule (1) the JTM may not make a finding on theconstitutionalvalidityofthecontentsofaBill.

162. ConsequenceofclassificationofBillasconstitutionallyor procedurally out of order(1) lf the JTM classifies a Bill as constitutionally or procedurally out of order the Billmaynotbeproceededwith.

(2) Subrule(�)doesnotpreventaBill- (a) frombeingcorrectedandre-introduced,ifitwasfoundtobe defectivebecauseofitscontents;or (b) frombeingre-introducedinaccordancewiththecorrectprocedure,if itwasfoundtobedefectiveonaproceduralpoint.

(3) The JTM must without delay report to both Houses on any decision taken in termsofsubrule(�).

Part 3: Consideration of Bills by Joint Committees

165. Part 7: Procedure for mixed section 75/76 Bills

Note: The procedure for mixed section 75/76 Bills suggested below, is based on the following premises:

(1) A procedure can be provided only for mixed Bills introduced in the Assembly. Mixed Bills introduced in the Council are unconstitutional in that they contain section 75 provisions which cannot be introduced in the Council.

(2) Mixed Bills bound to lead to procedural confusion should be identifiedanddisallowedatanearlystageintheAssembly proceedings. A “screening “ process for this purpose is essential.

(3) Procedural confusion can only occur - (a) in the event of disagreement between the Houses; in other words when mediation, special NA majorities, etc., come into play; or (b) when the two voting procedures in the Council lead to different results (see par. 7 below).

(4) Proper consultation between the Houses throughout the process (through conferring committees and joint committees) may minimise the likelihood of disputes between the Houses.

(5) The screening process should also apply to amendments.

(6) The Assembly and the Council should be able to convert mixed Bills into pure section 75 or section 76 Bills when a disagreement or a likelihood of a disagreement between the Houses arises.

(7) When a mixed Bill is referred to the Council, the Council should decide the Bill by a vote of provinces as well as by a vote of individual delegates.

(8) If this is done there is no need for the Council to distinguish between section 75 and section 76 provisions in the Bill.

(9) Provinces can give their mandates on the Bill as a whole.

(10) If procedural complications arise because of a disagreement between the Houses or when the two voting procedures in the Council lead to different results, the mixed Bill should be split into separate section 75 and section 76 Bills and be dealt with accordingly.

(11) Each Bill should be considered and decided separately the Council and then proceeded with in terms of the relevant rules applicable to section 75 and section 76 Bills respectively.

(12) If a procedure for mixed section 75/76 Bills is politically acceptable, it would be advisable to refer the rules contained in this Part to the Constitutional Court for a ruling on their constitutionality. If the Court rules against this procedure, a constitutional amendment to authorise rules for such a procedure should be considered.

Note: The Joint Rules Committee approved Part 7 but decided that implementation should be held in abeyance pending legal clarity on its validity.

STOPPING OF FUNDS TO PROVINCES

223. Tabling of motion to approve stopping of funds(�) Ifthenationaltreasurystopsthetransferoffundstoaprovinceintermsof section2�6oftheConstitution,theMinisterofFinancemustwithout delay— (a) tableamotionintheAssemblyseekingparliamentaryapprovalfor thestoppingofthefunds;and (b) explainthereasonswhyfundsfortheprovincehavebeenstopped.

(2) SuchproceedingstakeprecedenceoverotherbusinessoftheAssembly.

(3) No debate is allowed.

Note: In terms of section 216 of the Constitution the stopping of the transfer of funds to a province is an executive initiative for which parliamentary approval is required. The section requires the parliamentary process to be completed within 30 days. If Parliament is in recess when the funds are stopped it might be a proper case for the President to summon Parliament to an extraordinary sitting in terms of section 42(5) of the Constitution.

224. 1. Definitions(�) InthisSchedule,unlessthecontextotherwiseindicates—

“Committee”meanstheJointCommitteeonEthicsandMembers’Interestsestablishedbyjointrule�2�;

“member”means— (a) amemberoftheAssembly;or (b) apermanentmemberoftheCouncil;

“permanentcompanion”meansapersonwhoispubliclyacknowledgedbyamemberasthatmember’spermanentcompanion;

“registrable interests” means financial interests listed in item 7, and, in relation to a member, includes the financial interests of that member’s spouse, dependentchildandpermanentcompanion;

“Registrar”meanstheRegistrarofMembers’Interestsappointedintermsofitem3;

“Register”meanstheRegisterofMembers’Interestsopenedintermsofitem4(a);

“remuneration” means receipt of benefits in cash or in kind;

“thisCode”meanstheCodeofConductforAssemblyandpermanentCouncilmemberssetoutinthisSchedule.

Part l: Disclosure of registrable interests

2. Role of CommitteeTheCommitteeperformsthefunctionsmentionedinjointrule�24inaccordancewiththisCode.

3. Registrar of Members’ Interests(1) The Committee must be served by a senior official on the staff of ParliamentappointedbytheSpeakerandtheChairpersonoftheCouncil, actingjointly,afterconsultingtheleadersofpartiesrepresentedinthe AssemblyandtheCouncil.

(2) TheRegistrarmustbeassistedbystaffassignedbytheSecretaryforthe workoftheCommittee.

4. Registrar’s functions(�) TheRegistrarmust- (a) openandkeeparegisterforthepurposesofthisCode,calledthe RegisterofMembers’Interests; (b) recordintheRegisterparticularsofmembers’registrableinterests; (c) amendanyentriesintheRegisterwhennecessary;and (d) performtheotherdutiesinconnectionwiththeimplementationofthis CodeasrequiredbytheCommittee.

(2) The Registrar performs the functions of office in accordance with the directionsoftheCommittee.

5. Register of Members’ InterestsTheRegistermust— (a) have a confidential part and a public part; (b) containtheinformationregardingthemembers’registrableinterests astheCommitteemaydetermine;and (c) beinaformatapprovedbytheCommittee.

6. Disclosure of registrable interests(�) MembersmustdisclosetotheRegistrar,ontheformprescribedforthis purposebytheCommittee,particularsofalltheirregistrableinterests.

(2) The first disclosure must be within 30 days of the opening of Parliament afteranelection,inthecaseofanAssemblymember,orofamember’s appointmentasamember,inthecaseofapermanentCouncilmember.Ifa memberhasnoregistrableinterests,a“nil”returnmustbesubmitted.

(3) After the first disclosure, members must annually disclose particulars of theirregistrableinterestsatatimedeterminedbytheCommittee.

7. Kinds of interests to be disclosedThe following kinds of financial interests are registrable interests: (a) shares and other financial interests in companies and other corporateentities; (b) remuneratedemploymentoutsideParliament; (c) directorshipsandpartnerships; (d) consultancies; (e) sponsorships; (f) giftsandhospitalityfromasourceotherthanafamilymemberor permanentcompanion; (g) any other benefit of a material nature; (h) foreigntravel(otherthanpersonalvisitspaidforbythemember, businessvisitsunrelatedtothemember’sroleasapublicrepresentative and official and formal visits paid for by the state or the member’s party); (i) ownershipandotherinterestsinlandandproperty;and (j) pensions.

8. Details of registrable interests to be disclosedThefollowingdetailsofregistrableinterestsmustbedisclosed: (a) Shares and other financial interests in companiesandother corporateentities:

(i) Thenumber,natureandnominalvalueofsharesofanytypein anypublicorprivatecompany; (ii) thenameofthatcompany;and (iii) the nature and value of any other financial interests held in a privateorpubliccompanyoranyothercorporateentity. (b) RemuneratedemploymentoutsideParliament: (i) Thetypeofemployment; (ii) thename,andtypeofbusinessactivity,oftheemployer;and (iii) theamountoftheremunerationreceivedforsuch employment. (c) Directorshipsandpartnerships: (i) Thename,andtypeofbusinessactivity,ofthecorporateentity orpartnership;and (ii) theamountofanyremunerationreceivedforsuchdirectorship orpartnership. (d) Consultancies: (i) Thenatureoftheconsultancyoranyretainershipofanykind; (ii) thename,andtypeofbusinessactivity,oftheclient concerned;and (iii) the amount of any remuneration or other benefits received for suchconsultancyorretainership. (e) Sponsorships: (i) The source and description of direct financial sponsorship or assistancefromnon-partysources;and (ii) thevalueofthesponsorshiporassistance. (f) Gifts and hospitality: (i) Adescriptionandthevalueandsourceofagiftwithavaluein excessofR�500; (ii) adescriptionandthevalueofgiftsfromasinglesourcewhich cumulativelyexceedthevalueofR�500inanycalendar year;and (iii) hospitalityintendedasagiftinkind.

(g) Benefits: (i) The nature and source of any other benefit of a material nature;and (ii) the value of that benefit. (h) Foreigntravel: (i) Abriefdescriptionofthejourneyabroad;and (ii) particularsofthesponsor. (i) Landandproperty,includinglandandpropertyoutsidetheRepublic: (i) Adescriptionandextentofthelandorproperty; (ii) areainwhichitissituated;and (iii) natureofinterest. (j) Pensions: (i) Thesourceofthepension;and (ii) thevalueofthepension.

9. Entries in Register(�) TheRegistrarmustrecordalldetailsofregistrableinterestsinthe publicpartoftheRegister,exceptthefollowingwhichmayberecordedin the confidential part: (a) The value of financial interests in an entity other than a private or publiccompany. (b) Theamountofanyremunerationforanyemploymentoutside Parliament. (c) Theamountofanyremunerationforanydirectorshiporpartnership. (d) Detailsofforeigntravelwhenthenatureofthevisitrequiresthose details to be confidential. (e) Detailsofprivateresidences. (f) Thevalueofanypensions. (g) Details of all financial interests of a member’s spouse, dependent childorpermanentcompaniontotheextentthatthememberisawareof those financial interests.

(2) Whereanydoubtexists as to whether any financial interests must be disclosed,thememberconcernedmustactingoodfaith.

(3) Despite subitem (1) the Committee may on good cause instruct the Registrartorecordanydetailsofanyofamember’sregistrableinterestsin the confidential part of the register.

10. ConfidentialpartofRegister(�) OnlyaCommitteemember,theRegistrarandstaffassignedtothe Committee have access to the confidential part of the Register.

(2) No person who has access to the confidential part of the Register may, exceptwhenacourtsoorders,discloseparticularsofanyentryinthe confidential part to anyone other than the member concerned or another personwhohassuchaccess.

(3) A Committee member who contravenes subitem (2) - (a) is liable to a reduction of up to 30 days’ salary; and (b) becomesineligibletocontinueasaCommitteemember.

(4) TheRegistrarorastaffmemberwhocontravenessubitem(2)issubjectto disciplinaryactionapplicabletoparliamentarystaff,includingdismissal.

11. Public part of Register(�) AnypersonhasaccesstothepublicpartoftheRegisteronaworkingday during office hours.

(2) TheRegistrarmustpublishthepublicpartoftheRegisterduringAprilof eachyearinamannerdeterminedbytheCommittee.

Part 2: Ethical conduct

12. Declaration of private interests to parliamentary committees and forumsAmembermust- (a) declare any personal or private financial or business interest that that memberoranyspouse,permanentcompanionorbusinesspartnerof thatmembermayhaveinamatterbeforeajointcommittee,committeeorotherparliamentaryforumofwhichthatmemberisamember;and (b) withdrawfromtheproceedingsofthatcommitteeorforumwhenthat matterisconsidered,unlessthatcommitteeorforumdecidesthatthe member’sinterestistrivialornotrelevant.

13. Declaration of private interests when making representationsIfamembermakesrepresentationsasamembertoaCabinetmemberoranyotherorganofstatewithregardtoamatterinwhichthatmemberoranyspouse,permanentcompanionorbusinesspartnerofthatmemberhasapersonalorprivate financial or business interest, that member must declare that interest to thatCabinetmemberororganofstate.

14. Lobbying for remunerationNomembermaylobbyforremuneration.

15. Remunerated employment outside ParliamentAmembermayonlyengageinremuneratedemploymentwhensuchemploymentis— (a) sanctionedbythepoliticalpartytowhichthememberbelongs;and (b) compatiblewiththatmember’sfunctionasapublicrepresentative.

Part 3: Breaches of the Code

16. What constitutes a breachAmemberbreachesthisCodeifthemember— (a) contravenesorfailstocomplywithaprovisionofthisCode; (b) whendisclosingregistrableinterests,wilfullyprovidestheRegistrar withincorrectormisleadingdetails.

17. Investigations by Committee(�) TheCommittee,actingonitsownoronacomplaintbyanypersonthrough the office of the Registrar, may investigate any alleged breach by a member ofthisCode.

(2) TheCommitteemaydetermineitsownprocedurewheninvestigatingany allegedbreachbutmustatleasthearthecomplainantandthemember againstwhomthecomplaintislodged.

(3) If the matter concerns a registrable interest recorded in the confidential part of the Register or which is regarded as confidential by the Committee, theproceedingsoftheCommitteemaybeheldinclosedsession.

Note: As a joint committee, the Committee has all the powers vested in joint committees in terms of joint rule 32.

18. Findings(1) At the conclusion of its investigation, the Committee must make a finding supportedbyreasons,ontheallegedbreachofthisCode.

(2) The finding and the reasons for the finding must be made public.

(3) If the hearing was in closed session a summary of the facts must be disclosed.

19. PenaltiesTheCommitteemustrecommendtheimpositionofoneormoreofthefollowingpenaltieswhereithasfoundthatamemberhasbreachedaprovisionofthisCode

(a) areprimand; (b) a fine not exceeding the value of 30 days’ salary; (c) areductionofsalaryorallowancesforaperiodnotexceeding�5 days;or (d)thesuspensionofprivilegesoramember’srighttoaseatin Parliamentarydebatesorcommitteesforaperiodnotexceeding�5days.

20. Committee to report to appropriate Houses(1) Within 7 days of making a finding, the Committee must report its finding anditsrecommendationastopenalties,ifany,totheappropriateHouse.

(2) IftheCommitteerecommendsapenalty,theHousemusteither— (a) acceptorrejecttherecommendation;or (b) referthematterbacktotheCommitteeforfurtherconsideration.

(3) If the House has accepted the Committee’s recommendation, the Speaker ortheChairpersonoftheCouncilmustactonsuchdecisionpromptly.

SCHEDULE B

RULES OF JOINT STANDING COMMITTEE ON INTELLIGENCE

1. Definitionsandinterpretation(1) All expressions or words used in this Schedule and which are defined in theIntelligenceServicesOversightAct,�994(ActNo.40of�994)shall bearthesamemeaningaccordedtotheminthatAct,unlessthecontext indicatesotherwise.

(2) OtherexpressionsorwordsusedinthisSchedulewillhavethefollowing meaning,unlessthecontextindicatesotherwise:

(a) “theAct”meanstheIntelligenceServicesOversightAct,�994(Act No.40of�994),asamendedfromtimetotime,andincludesregulations madeintermsoftheAct;

(b) “annualreport”meansthereportpreparedannuallyandsubmittedin termsofsection6(�)oftheAct;

(c) “committeeroom”meanstheroomorsuchotherplaceasthe chairpersonmaydesignateforthepurposesofameetingoftheCommittee;

(d) “document”meansanywritteninstrumentandincludesany electronicorotherdeviceinoronwhichinformation,includingvisual material,isrecorded,storedorkept;

(e) “Inspector-General” means the person appointed by the President in accordancewithsection7oftheAct;

(f) “JointRules”meanstheJointRulesofParliamentasapprovedbythe

JointRulesCommitteepursuanttosection45oftheConstitutionofthe RepublicofSouthAfrica,�996,includingthisSchedule; (g) “member”meansamemberofParliamentappointedtothe Committeeintermsofsection2oftheAct,includingthechairperson,and “members”hasacorrespondingmeaning;

(h) “office manager” means the person designated as the most senior officer assisting the Committee in its functions in terms of section 2(8) of the Act, and includes a member of staff acting for the office manager;

(i) “person”meansamember,includingthechairpersonandany memberofstaffdesignatedintermsofsection2(�)oftheAct;

(j) “President”meansthePresidentoftheRepublicofSouthAfricaas contemplatedbysection�6oftheConstitutionofSouthAfrica,�996;

(k) “Presiding Officers” means the Speaker of the National Assembly andtheChairpersonoftheNationalCouncilofProvinces;

(l) “specialreport”meansareportpreparedbytheCommitteeatthe requestofParliament,thePresidentortheMinisterresponsibleforeach Service,orwhentheCommitteedeemsitnecessary,andtabledor submittedasprovidedforinsection6(2)oftheAct;

(m) “standingrules”meanstherulesmadebytheNationalAssembly ortheNationalCouncilofProvincesundersection57orsection70ofthe Constitution,aswellastheJointRules;and

(n) “staffoftheCommittee”meanspersonsdesignatedfromthe parliamentaryserviceortheServicesasenvisagedinsection2(�)ofthe

Act,and“memberofstaff”hasacorrespondingmeaning.

(3) The functions and activities of the Committee shall be conducted in accordancewiththeJointRulesofParliament,includingthisSchedule, butintheeventofaninconsistencybetweenaprovisioninthisSchedule andanotherprovisionoftheJointRules,aninterpretationreconciling theapparentinconsistencymustbepreferred,failingwhichtheprovision ofthisScheduleprevailsinmattersrelatingtothefunctionsandactivitiesof theCommittee.

2. Appointment of chairpersonThechairpersonmustbeappointedintermsofsection2(4)oftheActwheneveritisnecessarytoappointachairpersonoftheCommittee.

3. Functions of chairpersonSubjecttothisScheduleanddecisionsordirectivesoftheCommittee,thechairperson: (a) convenesandpresidesatmeetingsoftheCommittee; (b) takesdecisionsinrespectofanyrequestdirectedtotheCommittee incaseswhereitisnotreasonablypracticabletoarrangeaCommittee meetinginordertodiscusssuchrequests,afterconsultationwitha designatedmemberofeachpartyrepresentedontheCommittee;and (c) exercisessuchotherpowersorperformssuchfunctions,tasksand dutiesasmaybeconferreduponorassignedtohimorherbyorunderthe Constitution,theActoranyotherlaw,theJointRulesoraresolutionof Parliament.

4. Acting chairperson(�) Assoonasispracticableaftertheappointmentofthechairperson,the Presiding Officers, acting with the concurrence of the President, who shall actafterconsultationwiththeleadersofthepoliticalpartiesrepresented ontheCommittee,mustappointamemberoftheCommitteeastheacting chairpersonoftheCommittee.

(2) Wheneverthechairpersonisunabletoperformhisorherfunctions,the actingchairpersonmustactaschairperson.(3) The acting chairperson has the same responsibilities andfunctionsasthe chairpersonhasintermsoftheAct.(4) AllfunctionsperformedintermsofthisSchedulebytheactingchairperson in the absence of the chairperson must be ratified by the chairperson within a reasonable time from his or her appointment or return to office, as the caserequires.

5. Workplace of committeeTheCommitteemustconductitsworkinanenvironmentthathasbeensatisfactorily secured to ensure maximum protection of classified documents and informationentrustedtoit.

6. General powers and duties(�) TheCommitteemaydetermineitsownmeetingproceduresandexercise anypowersassignedtoitbytheConstitution,theAct,otherprovisionsof theJointRulesorresolutionsadoptedbybothHouses.

(2) TheCommitteeanditsmembersmustperformtheirfunctions,including those listed in section 3 of the Act, in a manner consistent with the protectionofnationalsecurity.

7. Conferral with other committees(1) Meetings with other committees in terms of Joint Rule 33 may take place in accordancewiththeprovisionsofitem�6(�).

(2) Duringsuchmeetings,allmemberspresentareboundbytheprovisionsof item�7.

8. Reports of committee(�) Anannualreport,preparedinaccordancewithaproceduretobe

determinedbytheCommittee,mustbecompiledintermsofsection6(�)of theAct.(2) TheCommitteemaynotsubmitaminorityreport,exceptwhereprovidedfor intheJointRules.

(3) The annual report must be tabled in Parliament and copies thereof be submittedtothePresidentandtheMinisterresponsibleforeachServiceas contemplatedbysection6(�)oftheAct.

(4) In the event of a report being debated in either House, classified informationmaynotberevealed.

(5) TheCommitteemaypreparesuchotherreports,includingspecialreports, asitdeemsnecessary.

(6) No report that is classified as confidential or secret by the Committee may bemadepublic.

(7) NothingmaybeincludedinanyreportoftheCommittee,theinclusionof whichwillbemoreharmfultothenationalsecuritythanitsexclusionwillbe tothenationalinterest.

9. Quorum for meetings(�) AmajorityofthemembersoftheCommitteeconstitutesaquorum,subject tosubitem(2).

(2) TheCommitteemayproceedwithbusinessirrespectiveofthenumberof memberspresent,butmaydecideaquestiononlyifaquorumispresent.

(3) When the Committee has to decide a question and a quorum is not present,thechairpersonmayeithersuspendbusinessuntilaquorumis

presentoradjournthemeeting.

10. Decisions of committee(�) DecisionsoftheCommitteearetakenbyashowofhandsunlessthe chairpersondirectsthatasecretballotmustbetaken.(2) Adecisionorresolutionisreachedbyasimplemajorityofthemembers present.

(3) The chairperson must communicate decisions of the Committee affecting thenationalexecutiveauthorityortheServicestothePresidentorthe HeadoftheServiceconcerned,asthecasemaybe.

11. Appointment of subcommittees(�) TheCommitteemayappointasubcommitteetoperformanyfunction providedforinthisScheduleoragreedtobytheCommittee.

(2) AsubcommitteeestablishedbyorintermsofthisSchedule– (a) isaccountabletotheCommittee; (b) mustcarryoutitstaskandresponsibilitieswithinapolicyframework determinedbytheCommitteeandinaccordancewiththisScheduleand anydirectives,guidelinesorregulationsissuedbytheCommittee; (c) mayonlymakerecommendationstotheCommittee;and (d) mustreporttotheCommitteeregularlyorwhenrequestedtodoso bytheCommitteeorthechairperson.

12. Staff(�) StaffoftheCommitteemusttakeanoathofsecrecyasprescribedinthe Act.AnycontraventionoftheoathispunishableintermsoftheAct,the provisionsofthisSchedule,andasprovidedforinthecontractof employment.

(2) StaffmustundergothevettingprocessconductedbytheServices.(3) The Committee may request the removalofanystaffmemberdesignated intermsofsection2(�)oftheActfromtheservicesoftheCommitteeif theCommitteeisoftheopinionthatitisconsistentwiththeprotectionof nationalsecurity.(4) The office manager is responsible for assisting the Committee to perform itsfunctions,subjecttothedirectivesofthechairpersonand/orthe Committee.

13. Security of documents and record-keeping(�) Nomemberofthecommitteemayenterthecommitteeroomfororduring meetingswithpapers,documentsorrecordingmechanisms,savewiththe expresspermissionoftheCommitteeorthechairperson.

(2) Members may record, make notes and file all documents received but may not remove files or any other documents from the committee room, except withtheexpresspermissionofthechairperson.

(3) The office manager has custody of all records and documents tabled in the CommitteeorsubmittedtotheCommittee.

(4) Allrecordsandminutesmustbekeptinaccordancewiththewritten securityguidelinesandmeasuresof,orconditionsprescribedor determinedby,thechairpersonwiththeconcurrenceoftheHeadsofthe Servicesasprovidedforinsection4(�)(b)oftheActandinthisSchedule.

14. Disclosure of information(�) NomemberoftheCommitteemaydiscloseanyinformation,thedisclosure ofwhichrequiresaCommitteevotepriortosuchdisclosure,exceptin accordancewiththisSchedule.

(2) Nopersonmaydiscloseanyintelligence,informationordocument,the publicationofwhichisrestrictedbylaw,except– (a) totheextenttowhichitmaybenecessaryfortheproper administrationoftheAct; (b) toanypersonwhoofnecessityrequiresitfortheperformanceofany functionintermsoftheAct; (c) with the written permission of the chairperson, subject to subitem (3); or (d) asprescribedbytheAct.

(3) The chairperson may not grant permission for the disclosure of information ascontemplatedbytheprovisionsofthisScheduleunlessheorshehas first obtained leave to do so in writing from the Head of the relevant Service and the Inspector-General, and provided that this is in accordance with the law.

(4) WheneveradecisionoftheCommitteeisrequiredpriortodisclosingany informationunderthisSchedule,thequestionmustbeconsideredat ameetingconvenedinaccordancewiththeCommittee’sagreedmeeting procedure,wheredueconsiderationmustbegiventothePromotionof AccesstoInformationAct,2000(ActNo.2of2000)andanyother applicablelegislation.

15. Procedureforhandlingofclassifiedmaterial(�) TheCommitteemusthandleintelligence,informationanddocuments towhichithasaccessinaccordancewiththewrittensecurityguidelines andmeasuresof,ortheconditionsprescribedordeterminedby,the chairpersonwiththeconcurrenceoftheHeadsoftheServicesas prescribedinsection4(�)(b) oftheAct.

(2) The handling and storage of all classified, secret and confidential documentsandinformationmustbedealtwithbyapplyingtheprocedures containedinthedocumentonMinimumInformationSecurityStandards

(“MISS”)orasdecidedbythechairpersonwiththeconcurrenceofthe HeadsoftheServices.16. Admission of public and media(�) MeetingsoftheCommitteeandsubcommitteesarenotopentothepublic, includingthemedia,andneitherthechairpersonnortheCommitteemay includethepublicormediainameeting,exceptinaccordancewith legislation,theprovisionsofthisScheduleorresolutionsoftheCommittee.

(2) ThechairpersonoftheCommitteeorsubcommitteemayatanytimeafter thecommencementofameetingopenthemeetingtothepublicorthe mediaifthisisinaccordancewithsubitem(�).

17. Publication of proceedings(1) All documents officially before, or emanating from, the Committee or a subcommitteearenotopentothepublic,includingthemedia.Inaddition, thefollowingdocumentsandrecordingsmaynotbepublishedandtheir contentsmaynotbedisclosed,exceptwiththepermissionofthe Committeeorsubcommittee,orbyorderofthechairperson: (a) Theproceedingsof,orevidencetakenbyorplacedbeforethe Committeeorsubcommitteewhilethepublicwasexcludedfromameeting intermsoftheprovisionsofthisSchedule. (b) Anyreporton,orsummaryof,suchproceedingsorevidence. (c) Anydocumentplacedbefore,orpresentedto,theCommitteeor subcommittee as a confidential or secret document and accepted by it as a confidential or secret document. (d) Anydocument– (i) submittedortobesubmittedtomembersoftheCommitteeor subcommittee as a confidential or secret document by order of thechairpersonoftheCommitteeorsubcommittee;or (ii) declared by the chairperson as a confidential or secret documentafteritssubmissiontomembers.

(2) Thepermission,orderorresolutionauthorisingthepublication,orthe disclosureofthecontents,ofdocumentsmentionedinsubitem(�),may

provide that specific parts of, or names mentioned in, the document or recordingmaynotbepublishedordisclosed.

(3) For the purposes of subitem (1) a document is officially before the Committeeorasubcommitteewhen– (a) thechairpersonplacesthedocumentorpermitsthedocumenttobe placedbeforetheCommitteeorsubcommittee;or (b) apersonappearingbeforetheCommitteeorsubcommitteeas awitnessortomakerepresentations,presentsthedocumenttothe Committeeorsubcommittee.

(4) Subitems(�)(c)and(d)applytoalldocumentsthat– (a) containprivateinformationthatisprejudicialtoaparticularperson; (b) areprotectedunderparliamentaryprivilege,orforanyotherreason areprivilegedintermsofthelaw; (c) are confidential in terms of the law; (d) aresubjecttoamediaembargo,untiltheembargoexpires;or (e) are of such a nature that their confidential treatment is for any reason reasonable and justifiable in an open and democratic society.

18. Suspension and replacement of member(�) Anymemberwhohasreasonablegroundstosuspectthatanother memberhasconductedhimselforherselfinamannerwhichconstitutesa threattonationalsecuritymustimmediatelybringthisfacttotheattention ofthechairpersonand/ortheCommittee.

(2) Thechairperson,afterhavingconsultedtheCommittee: (a) maysuspendfromtheproceedingsoftheCommitteethemember whoisonreasonablegroundssuspectedofhavingconductedhimselfor herselfinamannerwhichconstitutesathreattonationalsecurity,after givingthememberanopportunitytoindicatewhyheorsheshouldnotbe suspended, pending the final resolution of the matter; and

(b) mustconveneasubcommitteeconsistingofthechairperson andsuchothermembersapprovedbytheCommittee,toreporttothe Committeewhetherthematterconstitutesathreattonationalsecurity.

(3) If the Committee decides that the matter constitutes a threat to national security,theChairpersonmustaffordthememberaffectedanopportunity toexplainwhyhisorherconductdoesnotconstituteathreattonational security.

(4) IftheCommitteedecidesthattheaffectedmemberconductedhimselfor herselfinamannerwhichconstitutesathreattonationalsecurity,the Committeemustinformtheleaderofthepartyofthememberaffectedand referthemattertotheSpeakerortheChairperson,asthecasemaybe.

(5) IftheSpeakerortheChairperson,asthecasemaybe,withthe concurrenceofthePresident,actingafterconsultationwiththeleaderofthe partyconcerned,isoftheopinionthatthedefendantconductedhimselfor herselfinamannerwhichconstitutesathreattonationalsecurity,the defendantmustbereplacedwithamemberofhisorherpartyin accordancewithsection2(5)oftheAct.
