Product preservation continues to be a hot topic for cosmetic and drug manufacturers. Although troublesome microorganisms continue to remain the same, the increased sensitivity of test methods and the use of in vitro test models suggest that some chemical preservatives may have toxicological/hormonal properties that were previously unrecognized. This has resulted in manufacturers looking for alternative means of product preservation, and in many cases this has caused difficulties in achieving adequately preserved products. Besides reviewing preservative efficacy testing and creation of self-preserving products, this presentation will take a new look at and interpreting test results to determine whether a product is adequately preserved.

Canada’s Natural Health Products That Are Also Cosmetics

Even if a company doesn’t market Dietary Supplements, they may have Natural Health Products’ (NHPs) subject to Health Canada’s unique regulations. Some examples of NHPs are:

SPF products with Titanium Dioxide and/or Zinc Oxide Toothpastes containing Fluoride Skin protection products (such as Diaper Rash Creams) and many more.

Any topical or ingested products that have health claims and benefi ts which are attributed to non-synthetic chemicals or compounds are considered to be NHPs.

This concept is somewhat confusing from both Industry’s and Government’s perspective. These regulations, as is evident above, cover not just botanicals and organic products. There are many other items included in this defi nition, such as probiotics, minerals amino acids, and some vitamins including synthetic duplicates of these naturally occurring ingredients.

The net effect of this complexity has resulted in:

1. Companies that are not registering products and risk enforcement action

2. Companies submitting applications that are not complete and/or compliant

3. Health Canada becoming overwhelmed with both:

A. Very large numbers of applications

B. Many non compliant applications that cannot be processed or approved, resulting in products that cannot be sold in Canada which slow the process for everyone.

There are some relevant facts which help provide a snapshot of the status of this program. As of March 1, 2007, 18176 applications have been made for NHP licenses, and for those:

2803 Licenses (approvals) have been issued. (15.4%)

4312 Licenses have been refused (23.7%). Many of the refusals are due to incorrect, inappropriate or incomplete applications

Another major concern from Industry is the length of the queue for approvals. Recently the queue was publicly acknowledged to be approximately 15 months. In addition, Health Canada will reject any applications that are incomplete or incorrect. After these are corrected, they are resubmitted and start again at the beginning of the queue.

Currently approximately 35 applications are being processed per working day, out of over 8000 applications in the queue. It is clear that even though Health Canada is trying to speed the process, there is still a long way to go to make the process less unwieldy.

Clearly these timeframes don’t work well with our go-to-market timelines. It is extremely important to make any applications accurate and complete and clear, which will minimize the impact of timing on product launch.
