Contractor Public Works Registration Fee Program Starts July 1, 2014

Public Works Registration For ALL Contractors Starts Today Take heed! As I have written numerous times over the past several months, ANY contractor wishing to even bid on ANY type of public work contract in California MUST go online, pay your annual $300 fee and register starting today, July 1, 2014. While the final requirement won’t fully take effect until next March 1, 2015, registering now will ensure you are covered. Following is the official announcement from the Department of Industrial Relations which includes the address to their website.

Department of Industrial Relations Launches Public Works Contractor Online Application System

Oakland—The Department of Industrial Relations (DIR) today launched an online application for public works contractors to meet the requirements of Senate Bill 854. SB 854, which became effective June 20, establishes a new public works program to replace the Compliance Monitoring Unit and Labor Compliance Program requirements for bond-funded and other public works projects.

The new program will cover all public works in the state rather than just selected categories of projects. The Labor Commissioner’s Office will continue to monitor and enforce prevailing wage requirements.

“DIR always looks for ways we can improve our services. This new online system for public works contractors and agencies makes it easier and faster to meet their legal requirements,” said DIR Director Christine Baker. The Labor Commissioner’s Office, also known as the Division of Labor Standards Enforcement (DLSE), is a division of DIR.

before bidding on public works contracts in California. The application also provides agencies that administer public works programs with a searchable database of qualified contractors.

"The new system levels the playing field for the public works community. We want California taxpayers to know that we are committed to ensuring only responsible and qualified contractors are competing for public works contracts,” said Labor Commissioner Julie A. Su.

Contractors’ requirements include that they maintain workers’ compensation coverage for all employees and only hire subcontractors who are registered public works contractors. They must also hold a Contractors State License Board license, if required for their trade.

In addition, contractors must not be debarred from working on public works by the state or federal government and have no delinquent wage or penalty assessments due to any enforcement agency or employee. Once registration becomes mandatory early next year, contractors will also be subject to penalties for bidding or working on public works without being registered with DIR.

Using any internet-connected computer, public works contractors can create an account, pay the fee and complete the application securely, at their convenience. Application and renewal is completed entirely online with a non-refundable fee of $300.

Agencies that administer public works projects may select from a pool of qualified contractors. They will no longer be charged fees for prevailing wage compliance monitoring and enforcement. Additional information on SB 854 and the new public works program is available on DIR’s website.

Among its wide-ranging enforcement responsibilities, the Labor Commissioner’s office inspects workplaces for wage and hour violations, adjudicates wage claims, enforces prevailing wage rates and apprenticeship standards in public works projects, investigates retaliation complaints, issues licenses and registrations for businesses and educates the public on labor laws. The most recent information related to California labor law is available on the Labor Commissioner’s website as well as on Facebook and Twitter pages. “Wage Theft is a Crime”, a multilingual campaign initiated statewide earlier this year, provides detail on how to identify and report wage theft, retaliation and other labor law violations. Employees with work-related questions or complaints may also call the toll-free California Workers’ Information Line at (866) 924-9757 for recorded information in English and Spanish. Conclusion Yes, it is another bureaucratic pain to deal with, but be thankful that my colleagues and I were able to eliminate some of the more onerous (can you say, entrapment) provisions that were originally proposed but since removed. Again, although the final enforcement requirements don’t begin until March 1st, registering now will be one less issue to worry about next February.

CA contractor has learned in seeking a license in AZ. With real ‘conviction’ in his plea, another contrac-

tor seeks to replace his RME, without losing the license…

Q: I’m in the process of putting my application together to obtain an Arizona Contractor’s License. I’m

applying for reciprocity because I have been licensed in California since 1984. The instructions for recip-

rocity ask for a copy of the passing test results. I do not still have my test records from 1984. Is there a

way that you would be able to assist me with obtaining a copy of my test results from the CSLB?

A: As you are finding, the Arizona Registrar of Contractors (ROC) has new requirements as of July 1,

2014 for requesting reciprocity. While we can obtain license verifications, license histories, and copies of

CSLB files, the CSLB will not release copies of test results. I spoke with someone in the CSLB’s records

unit and they suggested that you send them something stating that Arizona needs proof of your passing

test results in order to qualify for reciprocity, and they will provide you with a response that the exam

was passed. It would be on CSLB letterhead as well so hopefully that should be sufficient. The Arizona

ROC also requires a license history in order to qualify for reciprocity so let me know if you’d like us to

obtain that for you.

Q: I obtained my Sole Owner license back in 2003 and I used a Responsible Managing Employee (RME)

because I didn’t have the required experience. I do now and I’d like to replace my RME on the li-

cense. I’m nervous to do this though because back in 2007 I had a DUI and I didn’t notify the CSLB. I

was told that any time you have a conviction you are required to notify the CSLB. I am afraid that if I

apply now it will raise a red flag and they will pull my license for failure to notify them. Any advice you

have would be greatly appreciated.

A: The CSLB doesn’t concern itself much with just one DUI. I would recommend applying to replace

your RME, answering “yes” to the question #11 regarding convictions, and providing a disclosure state-

ment detailing the conviction. If you do this it is highly unlikely that the CSLB would not approve you as

the new Qualifier based on one DUI from 2007. Unless a conviction is something that the CSLB deter-

mines to be very serious or substantially related to the contracting business, it seldom affects your con-

tractor’s license.

In a recent column, I responded to a contractor who was concerned that his license showed -- on the

CSLB web site -- an approximately one month gap between the disassociation of the old qualifier and

qualification of the new one. To clarify, as explained, since the license remains in good standing for 90-

days once a Qualifier leaves the license this gap does not exist. To prove to the Prime Contractor --

which is withholding payment -- there is no official Suspension, the contractor may want to secure a

Verified License History from the CSLB.

Spray Painting SafetySpray painting is a common and effective way to protect and beautify parts, products, vehicles, and buildings. Spray painting allows coverage of large areas with even coats of primer, paint, sealers, and other coatings. However, workers in spray painting operations need to recognize and guard against the hazard associated with spray painting processes.

Many paints, coatings, catalysts, sealers, hardeners, and solvents contain hazardous chemicals. Exposure to chemicals can occur during mixing of the coating, spraying the material, and grinding or sanding it. Even some surface preparation and cleanup solvents can pose a hazard, if not handled properly. As such, workers should avoid using solvents for cleaning paint from hands or skin. They should use water-based cleansers that are meant for personal cleanup.

Hazardous chemicals in coatings and solvents can enter the body several ways. Workers can inhale chemical vapors from spraying, absorb the chemical by skin contact or inject the chemical with high pressure spray painting equipment. Symptoms of overexposure to hazardous chemicals include nausea, rashes, and long term illnesses like asthma, lung cancer, and sensitization (becoming severely allergic to the paint). Before work begins, spray painters should read the Material Safety Data Sheet (MSDS) of the chemical they’ll be using then wear the appropriate personal protective equipment such as safety glasses, a respirator (if medically qualifi ed, properly fi t-tested, and trained), gloves or coveralls to protect themselves against its hazards.

As proper ventilation is important when working with paint coatings, a spray booth is an excellent way to remove spray paint vapors and debris from a worker’s breathing zone. Many coatings contain fl ammable substances that are aerosolized when sprayed through powered equipment and without proper ventilation, such as in a spray booth, these vapors can build up and create an explosion and fi re danger. But to provide maximum protection, the spray booth must be properly maintained, including regular cleaning of fi lters and overspray. And to prevent sparking a fl ammable substance, smoking and other sources of fl ame near spray painting operations should be prohibited and tools should be properly rated and grounded for work in a spray painting area.

Because much of the equipment used for spray painting and surface preparation uses compressed air, workers should be aware that noise can be a risk, so should wear hearing protection when working with air powered tools. Grinding and sanding equipment not only generates noise, they also create fi ne dust particles so, workers should be advised to use safety glasses and a dust mask or

a respirator, if required and qualifi ed to do so. Consider ergonomics when spraying coatings. Often, workers must hold full paint pots and maneuver heavy, awkward objects while spraying. Balanced spray guns that fi t comfortably in the hand or using hoists and dollies to move objects can reduce the chance of accidents and injuries. Also, workers should be encouraged to take frequent breaks and stretch often to avoid strains and sprains. If workers can think about safety in and around spray paint operations , they can avoid painting themselves into a hazardous corner.
