Patrick D. Deem has served on the Executive Council of The West Virginia Bar Association for the past six years, retiring from the EC as our 128th President on August 17, 2013.
During Pat’s leadership, The WVBA flourished. Being on the Executive Council is a huge volunteer commitment requiring hours of time fulfilling leadership responsibilities and considerable financial expenditure traveling to meetings and events.
The Bar Association is very fortunate to have members, such as Pat, who take a keen interest in the pursuits and success of The WVBA. Pat and his lovely wife, Alison, are to be commended for their efforts. We thank the Deems for all they have done for The WVBA and their continued support.

During the 127th Annual Meeting, The WVBA presented its prestigious Award of Merit for “…outstanding lifetime of distinguished service to the legal profession and/or the judiciary in West Virginia,” to Franklin D. Cleckley, Arthur B. Hodges Professor of Law at WVU College of Law. Presenting The WVBA’s highest award was The WVBA’s President, Patrick D.
Deem, with assistance from Past Award of Merit recipients, Forest J. “Jack” Bowman and John W. Fisher II, both of whom made introductory remarks about Prof. Cleckley.
Frank was born and raised in Huntington. He received his undergraduate education at Anderson College in Anderson, Indiana, and his Juris Doctor degree from Indiana University School of Law at Bloomington in 1965. Upon graduation from law school, Frank served three years as a
Navy JAG officer, and soon earned the reputation as “the most requested lawyer in Vietnam.”
Upon the completion of his military service, he attended Harvard University in Cambridge, Massachusetts, where he received his L.L.M. in 1969, before pursuing further post-graduate studies at Exeter University in England.
Professor Cleckley joined the faculty at the West Virginia University College of Law in 1969 where he became the first recipient of the Arthur B. Hodges Chair of Law, which he continues to hold. Professor Cleckley is the author of Evidence Handbook for West Virginia Lawyers and West Virginia Criminal Procedure Handbook, both considered “the bibles” for West Virginia lawyers and judges. In 1990, he began the Franklin D. Cleckley Foundation, a non-profit organization designed to help former convicts with educational
and employment opportunities. In 1994, Governor Gaston Caperton appointed Professor Cleckley to the West Virginia Supreme Court of Appeals where he served with distinction for two years. Following his term, he returned to his love of teaching. Frank Cleckley lives a life in service to others. As a lawyer, he has been a one-man legal aid society. Students and faculty members report witnessing the stream of people who have appeared waiting outside Frank Cleckley’s office to confer with him concerning cases that many other lawyers would not take. As one observer noted, “There were those who came because they had nowhere else to go; many who showed up in winter months with little warm clothing and even less money, but with great hope in the stories they had been told about Frank Cleckley. They were not disappointed.”
The awards and honors bestowed upon Frank Cleckley have been many. They include the Civil Libertarian of the Year Award from the West Virginia Civil Liberties Union, the Thurgood Marshall Award from the West Virginia NAACP, the West Virginia Common Cause Award for Public Service, the Public Citizen of the Year Award from the West Virginia Chapter of the National Association of Social Workers, the West Virginia Human Rights Commission Civil Rights Award and the 2011 Liberty Bell Award.After 44 years of tirelessly serving on the faculty of the College of Law and West Virginia University, Professor Cleckley retired at the end of the spring semester 2013.

Young Lawyers Have Winter Getaway at Greenbrier February 2014
In February 2014, the Young Lawyers Division took advantage of reduced rates at The Greenbrier and hosted their first “Getaway” for young lawyers. The purpose of this two day event was to attract young lawyers to a WVBA event and give them a taste of what they can expect at The WVBA’s 128th Annual Meeting in August 2014. This event offered several informative seminars with content particularly appealing to young lawyers. During the Saturday evening cocktail reception, several prizes were awarded. Among the winners was Hampton Rose’s wife, Whitney, who won a free registration for two to the 128th Annual
Meeting at The Greenbrier, August 7-9, 2015 -- a $560.00 value.The organizers of this getaway were YLD President Lee Floyd and the newly appointed Special Events and Social Media Coordinator, Danielle Waltz Swan, a Member of Flaherty Sensabaugh Bonasso PLLC.
If the turnout and positive response from attendees and sponsors are any indication, this event should enjoy a long and popular existence. Be on the lookout for the 2015 Young Lawyers Getaway!

In our constant effort to improve our program content and take maximum advantage of social medial in advancing The WVBA and its agenda, we have created a new leadership position: Special Events and Social Media Coordinator. In doing so, we were fortunate to recruit Danielle Swann who
volunteered to fill this position. Danielle has been onboard with
this challenge since the fall of 2013 and has exceeded all expectations assisting with special events programing and with the setup of our Facebook Page and Twitter Handle. Her efforts and input are greatly appreciated.Danielle Swann is a member at the law firm of Flaherty Sensabaugh Bonasso PLLC, where she practices in the area of government relations, construction and
commercial litigation. Danielle is a registered lobbyist and is well-versed in dealing with the West Virginia legislative and executive branch. Danielle has also defended engineers, architects and contractors in complex construction matters and represents a national lending institution in commercial litigation matters.
She is an active member of the Chamber of Commerce Government Relations Committee and the Business Industry Council. She is the national chair of the 2014 Defense Research Institute Construction Law Seminar. Danielle is currently Vice-Chair of the Board of Special Olympics WV and a member of the YWCA Public Policy Committee. She is a four time winner of the Super Lawyers Rising Star Award, a 40 Under 40 Generation Next Recipient, and a graduate of Leadership WV.
Mary Sanders, a defense lawyer and partner of Huddleston Bolen LLP, was elected to the Executive Council during the annual business meeting of The WVBA at the 127th Annual Meeting. Mary practices in the areas of general liability, bad faith and coverage, transportation
and construction claims. Her appellate work has established insurance case law in many areas of coverage, bad faith, and damages.
Mary is a member of the Trucking Industry Defense Association. In 2009, she was invited to join the Litigation Counsel of America, an honor conveyed on less than 5 percent of lawyers, nationwide. She is also recognized in The Best Lawyers in America, in the areas of Insurance Litigation, Personal Injury Defense, and Product Liability Litigation.A graduate of West Virginia University College of Law, Mary also holds a degree in journalism from the University of Oregon. Edgewood County Club was, again, the venue for the very popular Legal Ease/Pig Roast. This event first took on the trappings of a pig roast back in 2006 when Nate Tawney was President of the Young Lawyers Division. Nate’s idea to roast a pig for the dinner was the delight of all who attended, and it has been a staple at this event ever since, which is why the recognized title for this event has evolved from its original “Legal Ease” moniker to “Pig Roast.” Edgewood’s Chef Still does an outstanding job preparing the pigs and delicious accompaniments. This year’s CLE presentation prior to cocktails and dinner was given by Dean Boland of Boland Legal LLC. Dean is a superior orator who gave an engaging and informative talk titled “Work Smarter,
Live Happier – Technology Can Make it Happen.” From digital record keeping, communication, scheduling and general practice management, Dean illustrated effective use of the internet, smart phones, tablets, lap tops and desk top computers specific for the practice of law. Dean also made a most interesting presentation at the Young Lawyers Getaway on the many legal implications of drones, and he even put his own drone in flight during his seminar inside the meeting room to emphasize their effectiveness. Dean Boland will make another one of his outstanding presentations at the 2014 Business Law Conference at Oglebay Resort, May 3, 2014 – you don’t want to miss this!

While traveling the coastal area of North Carolina
in the fall of 2013, Julie and I met up with a few
West Virginia transplants along the way. Stopping
first in New Bern, NC, we visited Dick and Sally
Rowe, who have a beautiful home they recently
built on the banks of the Neuse River. The view of
the three mile wide Neuse River from their patio
is extraordinary!
From New Bern, we journeyed further south past
Wilmington to Southport, NC where we enjoyed a
delightful visit with Connie and John Neuner, Mary
Ann and Tom Battle and Jacki and Tom Krieger at
St. James Plantation. Retirement appears to be
working out just fine for all these folks!
