EXECUTIVE DIRECTOR'S REPORT
Executive Director Sarah Moore reported on the following: 1) Ashley Hamlett, Director of
Licensure, was introduced to the Board. 2) The agency's satellite office located at 3300 Cahaba
Road, Birmingham, AL is now occupied by the Board's General Counsel E. Wilson Hunter and
Associate General Counsel J. Matthew Hart. The office suite has four individual offices, a
reception area, and a conference room that can be utilized by Board members and other staff to
conduct Board business. A PowerPoint presentation was made showing the office location and
layout. 3) Board members, who are not members of the Credentials Committee, will be called
upon by Board investigators as expert reviewers from time to time to provide medical expertise
to investigators. Mr. Randy Dixon, Deputy Chief Investigator, gave examples of what types of
information will be solicited from the physicians to assist in directing interviews and the resulting
investigations. Mr. Dixon then introduced the investigators who were present at the meeting.
MINUTES
Public Minutes of May 15, 2019 The Credentials Committee recommended that the Public
Minutes of May 15, 2019, be approved. The motion was adopted without objection.

Committee recommended approval for final adoption. The motion was adopted without
objection.
Pain Management Rules Re: Medical Director: Administrative Rules 540-X-19-.02; 540-X-
19-.04; 540-X-19-.05 The Credentials Committee recommended approval for final adoption. The
motion was adopted without objection.
Quorum of Members for Hearings: Administrative Rule 540-X-6-.04 The Credentials
Committee recommended approval for final adoption. The motion was adopted without
objection.
Risk and Abuse Mitigation Strategies: Administrative Rules 540-X-4-.09; 540-X-12-.18;
540-X-18-.15; 540-X-20-.09 The Credentials Committee recommended deferring for discussion
by the full Board.
After consideration by the full Board, a motion was made and was seconded to approve
the rules for final adoption with the following statement. The motion was adopted without
objection.
After consideration of public comments received concerning Administrative Rule
540-X-4-.09(6), regarding the exemption from the requirement to query the
Prescription Drug Monitoring Database (PDMP) in certain cases, the Board
declined to adopt the exemption recommended by the commenters, concluding
that the regulatory burden placed on palliative care practitioners by the PDMP
query requirement does not outweigh the benefit to the public health and safety

associated with querying the PDMP, the purpose of which is to mitigate the risk of
diversion, misuse, and abuse of controlled substances.
Administrative Rules - Proposed
Nurse Practitioner Rules Re: Multistate Nurse License Compact: 540-X-8-.03; 540-X-8-
.05.1; 540-X-8-.06; 540-X-8-.12; 540-X-8-.17: 540-X-8-.19.1; 540-X-8-.20 The Credentials
Committee recommended approval for publication for public comment in the Alabama
Administrative Monthly. The motion was adopted without objection.
ASBME Employee's Pension Plan - Money Purchase Plan The Credentials Committee
recommended that the Resolution terminating the Money Purchase Plan and authorizing the
Executive Director, the Associate Executive Director, or the General Counsel to take such action
to effect the termination of the plan be adopted. The resolution was adopted without objection.
COMLEX Attempts and Timeframe The Credentials Committee recommended that, as a
requirement for licensure, the Legal Department research the establishment of a set number of
attempts and a time period in which a license applicant must have passed all three levels of the
Comprehensive Osteopathic Medical Licensing Examination (COM LEX). The motion was adopted
without objection.
Legislation Impacting Board of Medical Examiners The Credentials Committee
recommended that this item be received as information. The motion was adopted without
objection.

Pursuant to Act 2019-500, The MAT Act of 2019, a motion was made and was seconded
to appoint Dick Owens, M.D., and Amanda J. Williams, M.D., to represent the Alabama State
Board of Medical Examiners as members of the standing working group, which is required to be
convened pursuant to the Act. The motion was adopted without objection.
PANCE Attempts and Time Frame A motion was made by Gary F. Leung, M.D., and was
seconded by Beverly F. Jordan, M.D, that, as a requirement for physician assistant licensure, the
Legal Department research the establishment of a set number of attempts and a time period in
which a license applicant must have passed the Physician Assistant National Certification
Examination (PANCE). The motion was adopted without objection.

investigators, as selected by the Search Committee, and the elimination of the Records
Processing Department be ratified. The motion was adopted without objection.
The Credentials Committee recommended that the addition of positions for Investigation
Analyst and Medical Licensure Commission administrative assistant be approved. The motion
was adopted without objection.
Retirement / New Hires for Licensing and Investigations After consideration of a
memorandum from Executive Director Sarah Moore, the Credentials Committee recommended
that the retirement of the ACSC Coordinator be received as information, and that the addition of
