ABOUT THE COLLEGE
Legal education and legal profession have been held in high esteem throughout the world since time
memorial. Undisputedly legal education has a cardinal role to play in the matter of ensuring legal justice to
the citizens. Herein lays the pivotal role of law colleges and law schools. The last few decades have
witnessed the due importance being given to legal education in India. An element of professionalism is writ
large in the contemporary legal education in India. Rashtrasant Tukadoji Maharaj Nagpur University’s Dr.
Babasaheb Ambedkar College of Law, a premier legal institution of Central India is a name familiar to the
legal fraternity all over India and needs no introduction. Yet as a matter of sheer delight a few words about
the college will not be unwarranted.
Rashtrasant Tukadoji Maharaj Nagpur University’s Dr. Babasaheb Ambedkar College of Law
(BACL), formerly known as University Law College, established in the year 1925 is the conducted college
of the University. The college has the glorious beginning as Sir Vivian Bose who went on to become the
Judge of Supreme Court of India was the first Principal of this college. The college, over the years, has
attracted talent from all over India. Even today when the college is facing competition from the private law
colleges, it is attracting young and talented students not only from the area within the jurisdiction of the
University but even beyond. There are students not only from the adjoining areas of Chhattisgarh and
Madhya Pradesh States but even from the far flung areas of Delhi and North Eastern states a. This is
testimony of the reputation and rock solid standing of the college in the society and also from various
foreign countries.
The popularity, standing, credibility and reputation of the college has been built over the years
through the dedicated and selfless service of the successive Vice-Chancellors of the University, Principals
and teaching and non-teaching staff of the college. The contribution of the students of the college in building
the edifice of its reputation is no less significant. The alumni of the college is awesome and star studded one.
It includes the stalwarts in almost all important walks of public life. The spectrum is as broad as it could be.
If on one hand it includes the most notable politicians like former Prime-Minister of India late Shri
Narsimha Rao, on the other hand it includes legal luminaries like, Hon’ble Shri Justice S.A. Bobde (Judge,
Supreme Court of India), Hon’ble Smt. Justice Ruma Pal, Hon’ble Shri Justice V.S. Sirpurkar (former
Judges of the Supreme Court of India), Hon’ble Shri Justice Ashok Desai (former Chief Justice of

At BACL, the emphasis is on overall development of personalities of the law students. The emphasis
is also on value education. With the motto of producing lawyers who are socially sensitive and citizens of
high moral values the college has been organizing various events including the most prestigious and popular
“JUSTA-CAUSA” which will be entering its 12th year. Students from the prestigious law schools and
colleges from all corners of India make it a point to participate in this event and eagerly await the same. The
event includes a national level seminar on topics of contemporary significance, National Moot Court
Competition, National Legal Essay Competition, National Drafting Competition and National Quiz
Competition.
ABOUT THE NATIONAL SEMINAR
India, one of the leading developing countries of the world, in furtherance of its constitutional
commitment of social and economic justice is presently intensely engaged in the process of development.
The development programs include construction of dams, roads, highways, airports, power plants, etc. The
ever increasing population of the country is creating increasing demands for food, shelter, education, health,
etc. To meet these needs of the society, the natural resources of the country are required to be exploited in a
judicious and prudent manner. This calls for development of new methods and techniques of production and
distribution. For example, to meet the increasing demand over food articles new methods and techniques of
agricultural production are called for and answer is perhaps provided by bio-technology. Similarly, to meet
the ever increasing demand of energy the country is required to shift to nuclear energy in addition to
enhancing the traditional hydro, thermal and wind energy sources. The demand for the faster modes of
communication and storage of data in an environmental friendly manner has seen the emergence of
information technology.
The narration of the above few facts amply demonstrate the inter-play between development and
technology. The third dimension of the issue, however is law. The discourse on development and technology
naturally and automatically takes one to the province of law. If development is necessary to fulfill some of
the human rights like right to food, shelter, education, health, etc. it is not without adversely impacting some
other human rights like right to clean environment. For example, whereas construction of a dam may be
necessary to provide drinking water, irrigation facility and power generation yet the same can cause
uprooting of plants and people from their natural habitat.
Whereas new technology may provide solution to some of the existing problems. yet the same may
not be free from throwing new challenges. In such scenario, the empire of law is called upon to provide
solution to human problems. The present seminar on law, technology and development is expected to
provide a platform to the law faculties and students to deliberate and discuss some of the contemporary legal
issues arising out of the process of material development and also the emergence of new technologies.

EVENTS ORGANISED IN JUSTA CAUSA
JUSTA CAUSA NATIONAL LEGAL DRAFTING COMPETITION
The legal drafting competition aims to provide this opportunity. By this competition, an effort will be made
to tap the drafting ability of the students. In this competition, a legal problem will be given to the
participants along with the research material. The participants will have to draft the case within the
stipulated time. These written submissions will then be judged by a panel of judges and marked.
JUSTA CAUSA NATIONAL SEMINAR
Seminars have unique characteristics of bringing things to discussion, they inspire the delegates to view the
topics from all the angles and give their observations basing on their scientific study. This as compared to
simple study of the subject better improves both the curiosity and the understanding of the subject.
With a similar objective of kindling the ever-needed thirst for knowledge and proper understanding of the
current trends in the field of law and legal education, this year we are organizing two-days National
Seminar.
JUSTA CAUSA NATIONAL LAW QUIZ COMPETITION
The Quiz is an event, which provides adrenaline rush not only for the participants but also for the spectators,
and with College Prides at stake, it promises to be one mega event not worth passing up. It forms an
essential part of B.A.C.L.’s JUSTA CAUSA LAW FEST.
JUSTA CAUSA NATIONAL MOOT COURT COMPETITION
The term Moot Court comes from English. To moot means to bring something to a discussion. In a
figurative sense, Moot Court means “Hypothetical case or hearing/ trial”.The aim of Moot Court is to groom
the budding lawyers. It trains the students of law to create links between theory and practice. Thus, we
include this competition in this Law Festival to provide an opportunity to the students to participate and
develop the requisite skills of a lawyer.The judges for the preliminary and semi final rounds of the
competitions are eminent practicing lawyers. The final round of the moot court competition will be judged
by the Hon’ble Judges of the Bombay High Court.
JUSTA CAUSA GUEST LECTURE
Every year we organize this interactive session with a motive to enable the free interaction between the law
students from all over India and the experts not just from the elite legal fraternity but with all descriptions of
men on those topics that form their own peculiar professions and pursuits. This activity is basically aimed at

giving the budding lawyers a chance to put forward their queries before the renowned learned people who
have in depth knowledge of the subject.
THE JUSTA CAUSA LATE SHRI VIJAY BHONDE MEMORIAL GUEST LECTURE SESSION
Apart from these competitions, we also organize the Guest Lecture Sessions wherein every year we are
fortunate to have Luminaries from the legal fraternity to bless the students of law with their enlightening
lectures.
These lecture sessions play the role of a guiding light for the students and certainly help them give a correct
direction to their efforts; make their efforts productive and fruitful. These edifying lectures were certainly
helpful in elevating the students and the audience.The presence of the luminaries from the elite fraternity of
law in this extravagant event makes it the highlight of this festival.
JUSTA CAUSA NATIONAL LATE SHRI. R.H. DONGAONKAR LEGAL ESSAY WRITING
COMPETITION
The National Legal Essay Writing Competition is aimed to provide a Nation-Wide platform to the law
students and helps them to test their skills of research, language and presentation of their ideas on a
particular topic relating to the legal profession. The said Essay Competition was proposed by Hon’ble Shri.
Justice S.R. Dongaonkar (Former Judge, Bombay High Court), in the memory of his father Late Shri. R.H.
Dongaonkar Sir. With this motive of testing the mettle of law students at the National Level.

CONFIRMATION OF REGISTRATION:
The last date for the confirmation of registrations is Friday, 10th
January 2014 by an e-mail
containing the details of the participating college, the team members (including the number of
male and female students), their contact numbers and their email ids to confirm your
registration on [email protected].
Participants have to send Registration Fees of Rs.2500 through NEFT (National Electronic Fund

TEAM COMPOSITION:
It is to be noted that the participants of the National Law Quiz can be any of the students
participating in the Moot Court or Drafting Competition but not the student participating in the Seminar
who will be an exclusive representative for the National Seminar only. MORE THAN 5 STUDENTS
PER TEAM SHALL NOT BE ENTERTAINED. Faculty member of the college are allowed only for the
Seminar. Observers or additional researcher/members shall not be entertained. If any additional member
or researcher intends to attain the National fest, he/she will have to bare their own expenses.
a) All the team members will be given an unique Team Code, through a system of draw of lots at the
time of the Orientation Program, which will thereafter be the identity of the team and its members.
b) Teams should not disclose the identity of their institution at any time during the competitions. Such
disclosure shall invite penalties including disqualification. The discretion for the same will be with the
organizers.

RULES FOR THE JUSTA CAUSA NATIONAL LEGAL DRAFTING COMPETITION
Primarily drafting is a very important aspect of the legal profession. This competition will test the
participant’s use of legal language in drafting of legal document.
TOPIC:
CRIMINAL LAW.
TEAM COMPOSITION:
Only one team member shall participate in this competition.
THE ROUND:
The drafting competition shall consist of only one round.
The participants shall be given one common problem on the said topic.
The participant will be given one hour to draft the document.
On basis of the drafting skill as judged by the judges the ‘winner’ and ‘runner up’, will be
declared.
The participants will be judged on the following parameters.
1. Language.
2. Brevity of the document.
3. Formatting.
Laptops are not permitted.
The participants are free to add certain clauses in their legal documents as they deem fit, provided
that the clauses so added, do not defeat, contradict or nullify the intention of the problem given.
The decision of the judges shall be final and binding on all participants.

RULES FOR THE SEMINAR 1. Maximum word limit for the paper is 3000 words (excluding footnotes).
2. A summary extract of the paper (max 300 words) should be sent to the organizers
on the prescribed date.
3. Selection of papers for presentation shall be made on the basis of the summary
extract of the paper and the results of the same shall be conveyed to the
participants.
4. Page: A4, Margins: 1” all sides, Font: Times New Roman size 14 for Headings,
Times New Roman Size 12 for the main body and Times New Roman size 10 for the
footnotes. The main body must be typed in 1.5 line spacing and the footnotes shall
be in single line spacing.
5. All pages are to be numbered serially and the page number must be placed in the
footer section of the page.
6. The articles should conform to the rules of research paper and should reach the
organizer on or before 15th January, 2014. The participants are requested to email
the entire material on the email id - [email protected]

RULES FOR THE JUSTA CAUSA NATIONAL LAW QUIZ COMPETITION
The National law quiz competition is designed to test the general legal knowledge of law students. It
would also test spontaneity and presence of mind of the participating teams.
TEAM COMPOSITION:
Any two team members from the four students can participate in this competition.
TOPICS:
The quiz shall be conducted on the following topics:
Intellectual Property Right.
ROUNDS:
The quiz competition consists of two rounds as follows:
1. Preliminary Round:
This round is an elimination round which would consist of a written quiz of 50 questions which are to be
answered in 30 minutes. On basis of this round, top four scoring teams will qualify for the Final Round.
In case of a tie, a tie breaker round shall be conducted which shall also be written.
2. Final Round:
This is an oral quiz round with four teams. This would consist of three stages. On basis of the score of
these stages, the winning team and the runners up team will be declared.
Both the rounds will be presided over by an UMPIRE.
In case of any dispute, the decision of the UMPIRE shall be final and binding.

RULES FOR THE JUSTA CAUSA NATIONAL MOOT COURT COMPETITION
1. Team Composition:
a) Each team shall comprise of 3 members i.e. 2 speakers and 1 researcher.
b) Each team shall have a maximum number of 2 speakers.
2. Rounds:
a) The Moot Court Competition shall comprise of the following three rounds:
A. Preliminary Round divided into I-A & I-B on 15th February 2014.
B. Semi-Final Round on 16th February 2014.
C. Final Round on 16th February, 2014.
b) All the rounds are knockout rounds. For the Preliminary Round i.e. Round I, the teams will be divided
into two leagues by a draw of lots.
c) Each team will have to argue from both sides in the Preliminary Round (Comprising of I-A & I-B).
This order will be decided by draw of lots at the time of the orientation on 12th February, 2014.
d) The teams which have won both their Preliminary Rounds, will be eligible for qualification in the
Semi-final Round which shall consist of 4 teams. In case there are 5 or more teams who have won
both their preliminary rounds, the aggregate marks shall be considered and the top 4 teams (who
have won both their rounds) on the basis of their aggregate marks in both the preliminary rounds
shall qualify for the Semi-Final Round. In case there are 3 teams who have won both their
preliminary rounds, the fourth place in the Semi-Final shall be occupied by the team, which has
won one round in the preliminaries and also has the highest aggregate marks in both the
preliminary rounds. In case there are 2 teams who have won both their preliminary rounds, the
third and fourth place in the Semi-Final shall be occupied by the teams which have won one round
in the preliminaries and also have the highest aggregate marks in both the preliminary rounds. In
case there is only one team which has won both its rounds, similar procedure as mentioned above
shall be followed. In case of a tie in the above procedure, the marks scored for the memorials shall
be the deciding factor.
e) The sides for the Semi-Final round will be decided by draw of lots immediately after
the results of Round I. The round will be held on 16th February, 2014.
f) The top 2 teams shall then argue the case in the Final Round on 16th February, 2014.
3. Memorials:
a) The memorial shall necessarily consist of the following:
(a) Cover Page (one page)
(b) Table of Contents (one page)
(c) List of Abbreviations (one page)
(d) Index of Authorities (not more than three pages)
(e) Statement of Jurisdiction (one page)
(f) Statement of Facts (one page)
(g) Issues Raised (not more than two pages)
(h) Summary of Arguments (not more than three pages)
(i) Body of Pleadings (not more than fifteen pages)
(j) Prayer (one page)
b) All the teams shall submit fourteen (14) copies of the memorials of each side (i.e. 14 copies
from petitioner’s sides and 14 copies from the respondent’s side), which makes a total of 28
memorials, at the time of the orientation on 12th February, 2014. The copies do not need to be
sent in advance.
c) The memorials, however, should not contain any kind of identification whatsoever; else
they may be subject to disqualification.
d) The Petitioner memorials MUST have light blue paper covers while the Respondent
MUST have light red. Use of plastic binding is prohibited. Memorials should be stapled or
stitched by cotton thread. Teams are advised not to use spiral or comb binding.
e) All memorials submitted must conform to the following general rules:
(i) Memorials must be printed on white A4 size paper with black ink only.
(ii) The font used must be Times New Roman, size 12.
(iii) The Harvard Blue Book style of footnoting must be followed as far as practicable.
(iv) The font of footnotes must be Times New Roman, Size 10, single line spacing.
(v) Each page of the memorial must have a margin of one inch on all sides, excluding its page
number. Page numbers must be given on the top right hand corner.
(vi) The Body of Pleadings must not exceed fifteen (15) pages in total.
4. Oral Submissions:
a) Each team should have two speakers who shall divide the oral submissions between
them. Rebuttals are permitted. Sur-rebuttals are at the discretion of the judges.

b) For the preliminary round each team shall have a maximum of 15 minutes to present their oral
submissions. In the semi-final round each team shall have a maximum of 30 minutes to present
their oral submissions. For the final round, a maximum time of 45 minutes shall be given to each
team. However, granting more time will be at the discretion of the judges. The aforesaid time
would include the time that each team may want to reserve for their rebuttals.
c) No speaker shall be permitted to address the court for more than 10 minutes in the preliminary
round, for more than 20 minutes in the semi-final round and for more than 30 minutes in the final
rounds.
d) At the commencement of each session of the oral submissions each team shall notify the court
officer as to the division of time between the 2 speakers.
e) Any extension of the prescribed time limit shall be at the sole discretion of the Judges and no
complaints/appeals regarding the same will be entertained.

• Each mooter shall be marked out of 100. Thus the total team marks, per judge, will be out of
200. All the rounds shall be before a Full Bench, making the team marks out of a total of 600.
So total team marks in the Preliminary Round are out of 1200.
• Whichever team secures more marks as against its opponent, shall be considered as having won
its round.
• The decision of the judges shall be final and binding.
• So as to ensure uniformity in the marking system all the judges shall be provided
with marking guidelines.
Scouting:
Scouting by the student counsels, researcher or any one affiliated with the team will lead to the
disqualification of the team.

FACTS FOR JUSTA CAUSA NATIONAL MOOT COURT COMPETITION
Bruneasia is a democratic Country. The country is a developing Nation. It is mostly involved in the
mining business along with the other businesses. It is abundantly endowed with the Natural heritage.
There are Green Mountains situated in the middle of the land which adds feathers to the crown of
Natural Heritage of Bruneasia. It is a secular nation comprising of people of different castes and
religions. There is unity in diversity in the culture of Bruneasia. Varana is the capital of Bruneaisa.
To promote the art and the culture of the Bruneasian heritage the country has always encouraged
various entrepreneurs. The Bruneasian film industry is also flourishing and developing along with the
business sector. The government has also set up an independent Ministry of Information &
Broadcasting to organise and arrange award functions.
The Directorate of Film Festivals under the Ministry of Information & Broadcasting organizes
National Film Awards ('NFA' for short) every year, on behalf of the Government of Bruneasia. The
awards are given to feature films as also non-feature films. The Directorate lays down certain
Regulations for the films to get entry into these NFAs.
Ms. Daisy De’Costa is a dynamic film maker. She is well known for her documentary films and has
also won many awards for the same. In the year 2013 the Directorate of Film Festivals under the
Ministry of Information & Broadcasting had organise the National Film Awards.
Many eminent film makers and production houses also applied for the entry of their films in the
NFAs. The entries were allowed only to those films which followed the National Film Awards
Regulations. Ms. De’Costa had also applied for the same. But the entry of her film was rejected as it
did not fulfill the Regulations decided by the Directorate.
According to Ms. De’Costa the Regulations laid down by the Directorate were unconstitutional and it
infringed her fundamental rights. Films are accepted as entries for awards and for exhibition in
International Film Festivals all over the world, without any kind of censorship so that the select
audience can view the films in their pristine form and appreciate the creative talent of the film makers
as also the theme and content of the films. The Directorate has exempted films produced by Film
Institutes and entries made by Doordarshan from certification while insisting on such certification by
the Board in the case of other films for entry for NFAs amounted to hostile discrimination.
The Ministry evolved a policy in respect of non-commercial Film Festivals and exempted all entries
from the requirement of certification by the Board. As the entries for National Film Awards did not
involve any public exhibition, and were viewed only by a select jury (consisting of persons
distinguished in the fields of cinema and allied arts and humanities), there was no need for
certification by the Board under the Cinematograph Act, 1952. If films could be entered in Film
Festivals (where the audience consist of not only Juries, but also film-makers, film media students,

critics, film theorists, film lovers) without certification from the Board, there is no reason why they
should not be so entered for NFAs (where the audience consisted of only the Jury).
According to the Ms. De’Costa, most non-feature films are shot and released in digital format, a far
superior technology when compared to film format. Non-feature films, being non-commercial, are
rarely screened in cinema theatres. They are mostly screened on television or to select audiences,
which does not require conversion into film format. It is, therefore, a sheer waste of resources to
convert non-feature films shot in digital format into film format, only for the purpose of entry in
National Film Awards.
Therefore she filed a petition in the High Court of Varana. When the said writ petition was taken up
for hearing by the High Court, the appellants submitted that the Directorate had decided to accept the
entry of non-feature films on digital format. Therefore, the sole issue that required consideration
related to the requirement of a certificate by the Central Board for NFA entries.
The High Court held that there was no difference between films entered for awards in Film Festivals
and films entered for National Film Awards; that there was also no difference between films produced
by Film Institutes/Doordarshan and films produced by others, for purposes of entry for National Film
Awards; and that the requirement relating to certification by Board in respect of film makers other
than Film Institutes and Doordarshan amounted to hostile discrimination. It, therefore, allowed the
writ petition by its judgment dated 22.8.2013 holding that the words "and certified by the Central
Board of Film Certification" in Regulations were violative of Article 14 and void, and the said two
clauses should be read without those words.
The High Court directed the Directorate of Film Festivals to permit film-makers to enter their films in
digital format without any certification from the Central Board of Film Certification. As the High
Court found that the requirement relating to certification by the Board was violative of Article 14 and
therefore, invalid.
Therefore aggrieved by the decision of High Court of Varna, the Directorates have moved to the
Supreme Court of Brunesia.
*The laws of Bruneasia are in pari material with the Indian Laws.
Annexure I
The relevant provisions of the National Film Award Regulations, which regulated the eligibility
for entry for awards and the procedure for selection for Awards, are:

"Aims
2. The Awards aim at encouraging the production of films of aesthetic, and technical excellence and
social relevance contributing to the understanding and appreciation of cultures of different regions of
the country in cinematic form, thereby also promoting integration and unity of the nation."
Eligibility
"10. (a) Only those persons whose names are on the credit titles of the film and are normally residing
and working in Bruneasia shall be eligible for the Awards. The film should have been produced in
Bruneasia. In the case of co- productions involving a foreign entity, the following conditions should
be fulfilled :-
(a) ..
(b) The film should have been certified by the Central Board of Film Certification between 1st
January 2012 and 31st December 2012.
(c) The Director of the film should be an Bruneasian national.
(d) Films made in any Bruneasian language, shot on 16 mm, 35 mm or in a wider gauge or digital
format but released on a film format and certified by the Central Board of Film Certification as a
feature film or featurette are eligible for feature film section. In the case of award for Best Children's
Film only such films shall be eligible as have been certified by the Central Board of Film Certification
as Children's films.
(e) Films made in any Bruneasian language, shot on 16 mm, 35 mm or in a wider gauge or digital
format but released on film format and certified by the Central Board of Film Certification as a
Documentary/Newsreel/Non-Fiction/Short-Fiction are eligible for non- feature film section.
(f) A film produced by a film institute running diploma/degree courses run by it which are recognized
by the Government of Bruneasia shall be eligible even without certification by the Central Board of
Film Certification, provided a specific certificate from the Head of the organization to the effect that
the film has been produced within the eligibility period, is sent along with the entry form.
(g) Entries made by Doordarshan for the non feature film section shall be eligible without certification
by Central Board of Film Certification provided that a specific certificate, from Director General,
Doordarshan to the effect that the non feature film has been produced within the eligibility period, is

sent along with the entry form.
(h) & (i) ..
(j) All entries should be in the version certified by the Central Board of Film Certification, except
films as per provisions of clause (f) and Clause (g) above."
Last date for receipt of entry :
13. Last date for receipt of the application along with the print in the Directorate of film Festivals
shall be the 19th May, 2013.
Procedure for selection :
"19. (a) The Awards shall be decided by two juries, one for feature films and other for non-feature
films, duly constituted by the Directorate with the approval of the Government of Bruneasia.
(b) The Jury for Feature films shall comprise a Chairperson and not more than 16 members
distinguished in the field of cinema, other allied arts and humanities.
(c) The Jury for Non Feature Films shall comprise a Chairman and not more than 6 members
distinguished in the field of cinema, other allied arts and humanities.
The juries shall have the discretion to recommend that an award in any particular category may not be
given if they are of the opinion that the entries in that category are not of the required standard."
