I, Michael Crooks, declare as follows:

1. I am over the age of 18 and competent to give testimony in this matter based on

personal knowledge.

2. I was the prior owner of one of the propenies included in the pending application with

the City of Kirkland known as "Bridlestone Estates". I sold the property on October 1, 201S.

3. I previously operated "Evergreen Equestrian Center" ("EEC") on the property for over 20

years. The stables included SO stalls of which I rented approximately 40 stalls and used approximately

10 stalls for my own horses.

4. EEC offered boarding but no training. Renters of the stalls would have to bring in their

own trainer. Consequently, EEC generated revenue from only horse boarding, not from training.

Providing training services would have increased the cost of operating EEC as I would have had to hire

additional employees to provide those services.

S. In order to run EEC I incurred costs for, among other things, property taxes, insurance,

shavings, hay and grain, and a full-time employee to provide boarding services.

6. In addition, the equestrian structures/facilities on the property were built very cheaply

in approximately 1969 by my parents with materials that had a life expectancy of approximately SO

years. The structures/facilities are near the end of their useful life and in need of being re-built. The net

revenue after expenses from boarding operations at Evergreen Stables was not generating the

substantial amount of money that would have been needed to re-build the structures/facilities in order

to continue boarding operations.

7. I was barely breaking even from operating EEC. I therefore decided to shut down EEC

and sell the property because in my opinion continuing boarding operations was no longer financially

viable. I shut down operations of EEC on September 1, 201S prior to closing the sale of the property.

My name is Jennifer Duncan and I am President of Lake Washington Saddle Club. LWSC was formed in 1945 by equestrians that live around Bridle Trails State Park. We are stewards of the park and provide horse shows and activities for members that live around the park and others who come from other areas. Our 70 year legacy of support has contributed to Bridle Trails being considered a vital equestrian facility across the State and one of 15 favorite equestrian places across the nation as depicted in the May 2015 issue of Horse and Rider magazine. Keeping Bridle Trails a vibrant and safe equestrian area is of critical importance to LWSC and its members.

Personally, I also keep my horse in Kirkland at one of the private horse properties around the park. It is important to me that I, and others like me, have the ability to keep our horses within safe riding distance of the park.

I agree with all of the points made by those against this rezone. The applicant does not have the right to a rezone and has not met the criteria. I specifically want to address one area of the staff report that we believe is misleading.

On page 15 of the staff report it states: "The most compelling reason to retain the current RS 35 zone would be for the ability for a homeowner to keep a horse on site. All lots located to the south of the subject property, within the City of Kirkland, have lot sizes that exceed 35,000 square feet. Only one of the 40 lots has a paddock area and within the past 10 years another a barn and paddock area was removed."

o The staff report is talking about the Cor-Sun Ranch Estates. What the staff report fails to acknowledge is that the Cor-Sun Ranch Estates CCRs recorded against the lots and the HOA effectively prohibits horses. To conclude that because of that one area in Bridle Trails horse keeping is no longer desirable is incorrect. Other neighborhoods have covenants that protect horse keeping but those were not considered.

o The staff report also fails to acknowledge that the Cor-Sun properties were not originally laid out in a manner to support horse-keeping. So even if the CCRs and HOA did not prohibit it, it would be a challenge to have horses there. Other properties such as Silver Spurs, Bridlewood Circle, Bridleview, Flying Horseshoe, Kirkland Hunt Club were designed for horse keeping and have horses living in them.

The proposed plat design does not allow for any horse keeping. We believe the zoning should be left as is (RS 35 and RSX 35} and require the applicant to come back in with a lot design that enables horse keeping. We believe that when the applicant begins to market the property for horse use- like the other properties around the Park- they will find a substantial market for their product.

o The statement by the staff report makes it sound like there is no demand or interest in horse properties but horse properties are being purchased and used routinely. A new barn was built on a property in Flying Horseshoe within the last few years as one example. The property that houses my horse was recently purchased, remodeled and was purchased specifically because it provides for horse keeping. As President of LWSC I am routinely asked about available horse properties and work to connect people with any properties I know of. So to imply that horse properties are not in demand and therefore not needed is just incorrect.

o The staff report is correct that the City has not mandated that these properties contain horses. But the city absolutely can dictate the type of uses that it wants to be developed on particular properties- commercial in commercial zones, parks on recreationally zoned property. Here the City has said -and repeated just last year when the Council reaffirmed the Bridle Trails Neighborhood Plan- that it wants this property to be EQUESTRIAN-ORIENTED. The proposed rezone will effectively PROHIBIT that outcome.

Bridle Trails State Park is a thriving equestrian facility and enabling equestrians to live around the park is a critical element of that overall environment. The access for equestrians to Bridle Trails State Park will be essentially useless without horses on the property to use that access. This is equivalent to building a bridge while eliminating all of the people who might have used it. Instead, keep the property horse-oriented and then the access will be meaningful.

I would also like to mention that this development will replace two boarding stables. Those stables were very important to the equestrian community and it is a blow to the community to lose them. Retaining the R35 zoning at least keeps horses in this area viable. We understand that this property has sold and will be developed. But this rezoning kills all opportunity to retain this as equestrian oriented and eliminates any possibility of horse keeping on the property.

LWSC respectfully asks that the long history of horse keeping on this property be honored by upholding the Bridle Trails Neighborhood Plan and ensuring that this development remains zoned R35 and provides the ability to support horse keeping.
