Kishwaukee College offers many free programs and services to help students achieve academic success.

Learning Skills Center (LSC)The LSC provides academic support for all full- and part-time Kishwaukee College students. Students must have their Kishwaukee College I.D. to use the LSC’s services:• Tutoring - FREE walk-in tutoring in mathematics,

chemistry, physics, biology, accounting, English, reading, & Spanish. One-on-one assistance in study skills is also available.

• Writing Center - One-on-one or small group assistance with all writing-related questions.

Library• Books, CDs, and videos to check out, obviously, but also:• Reference Librarians - they know everything and

if they don’t know, they know where to find the answer. Ask them questions!

• Reserved Texts - instructors put the volumes they want you to read bits from but not buy here, behind the circulation desk.

• Career Corner - great resource to do a little exploration on careers and what you need to do to become whatever you want to become.

• Interlibrary Loan - If you need something & the KC Library doesn’t have it, they can get it from another Library fast!

Tips, Tricks, & HintsSyllabus - your instructor’s personal gift to you! Includes all the assignments; due dates; policies on late work, extra credit, grading, and attendance expectations; plus how to contact your instructor. Why wouldn’t you keep it handy and refer to it regularly? Your instructor is assuming you are!

Instructor Office Hours - take advantage of instructors’ office hours to ask questions, receive extra help, or just talk about anything and everything! Got a question about something the instructor said? Get the correct explanation and clarification DIRECTLY FROM THE INSTRUCTOR! Plus, you should get to know instructors so they get to know you — it makes it easier if circumstances change in your life and you need an understanding ear... or when you need a reference letter!

Where to study on campus? The Library offers study carrels and tables on the first and second floors; the fireplace pits near A-200, A-300, and B-400 are comfy spots and each has nearby lounges with tables; and the cafeteria is a great place that can be quiet in morning or mid- to late-afternoon. In nice weather, go outside A-400 to the patio or outside B-400 to Kuhl Terrace. Take time to explore campus — you may find your own special place!

Adding/Dropping a CourseAfter you have registered and before classes begin, you can add or drop classes from your schedule through KishSOS or in the Admissions, Registration, and Records Office.

After classes begin, you may change your registration according to the following guidelines:

If you are receiving Financial Aid it is recommended that you check with the financial office before dropping a course to determine if your award will be affected.

Adding a ClassWith the signature of the instructor, students may register for a 16 week course through the second Tuesday of the term. Adding students to a class after it has begun is at the discretion of the Dean in consultation with the instructor or the instructor alone.

There is no late registration in courses that are less than 16 weeks in length.

Dropping a ClassTo drop a class during the refund period, you can drop through KishSOS or must complete an Add/Drop/Withdrawal Form. Refunds of tuition and fees for dropped courses are processed according to Kishwaukee College’s refund policy. The exact refund/drop dates for each of our courses can be found on your schedule, bill and online using KishSOS.

Courses can be dropped during the refund period. A dropped course will not appear on a student transcript.Withdrawing From a ClassIf you wish to withdraw from a class or from all your classes after the refund period, you must complete an Add/Drop/Withdrawal Form and must have the withdrawal processed in the Admissions, Registration, and Records Office. Deadlines for withdrawing from classes are listed on your class schedule which can be accessed on your KishSOS account. Class drops or withdrawals may not be initiated after the established deadlines. A grade of “W” will be given to all withdrawn classes. If you do not officially drop or withdraw from classes, you will be assigned the letter grade (A, B, C, D, F) earned.

Adult Student ConnectionsThis program offers personal and practical support to both men and women who are single parents, displaced homemakers or are pursuing nontraditional training in a career/occupational program. Nontraditional occupations are those with less than 25% made up of one gender. Assistance is provided with career planning and class scheduling. Financial assistance may include tuition and fees, textbook loan, child care, and mileage reimbursement. Counseling and referral to social service agencies for additional support services and assistance are available, as needed. There is an income eligibility guideline for participation in Adult Student Connections.

Athletics OfficeIn its intercollegiate athletic program, the College sponsors basketball, baseball, and soccer for men; volleyball, basketball, and softball for women. Kishwaukee is a member of the National Junior College Athletic Association (NJCAA). Division II Regional winners are advanced for national competition. Students interested in participating in intercollegiate athletics should contact the Athletic Office.

AttendanceThe student is responsible for prompt attendance and participation in all scheduled class and laboratory sessions. Instructors may consider attendance in determining student achievement in their courses. Students should consult with their instructors and read course syllabi for any statements regarding attendance. However, absences caused by approved college activities (e.g. course field trips; athletic, club, and student curricular organization competitions; required military service) are not counted in determining student achievement standards by outside board or state agencies.

Students are advised to notify their instructors in advance of any absences they know will occur. No absence excuses students from making up missed assignments, including tests. Students are responsible for arranging with their instructors the completion of work missed due to absence. Student absences due to prolonged illness/hospitalization should be reported to the Vice President of Student Services Office.

Blackboard/Online Classes/HybridBlackboardThis is the online learning system where you will log in for all online, hybrid and enhanced classroom instruction.

OnlineOnline courses are taught using the Internet as the means of delivery. Students who enroll in online classes are not required to travel to campus as their course materials, discussions, tests, etc., are available through an Internet connection. While convenient, online courses are not for everyone. Students who are most successful in these courses are good time managers, able to work independently, and are comfortable with technology. In addition, online students must have access to an Internet link that can meet the technical requirements of the course.

HybridA hybrid course takes place in both a traditional on-campus classroom and on the Internet in an online classroom environment with required visits to the College campus (and sometimes off campus) which are determined by the specific course. These required visits are listed in the course schedule and during the first meeting time of class. A hybrid course will be identified in the course schedule as “Hybrid” for the meeting times along with dates and times for required meetings.

Bus ServiceDeKalbKishwaukee College, in cooperation with Voluntary Action Center of DeKalb, provides limited bus transportation between the College and the DeKalb area. Buses arrive on campus by 8 a.m., 9 a.m., and 10 a.m. each day Monday – Friday. Students must register for one of these arrival times, but are allowed to choose a departure time of 1, 2, or 3:30 p.m. on a daily basis. Seats are limited on each bus run. A separate evening bus route is available with arrival to campus by 6:00 p.m. and a departure time of 9:20 p.m. Monday - Thursday.

Student riders are charged $120 for a full 16-week semester round trip bus pass. If seats are available, those students needing only one-way bus passes or those who have lost their private means of transportation may apply for the remaining seats. Fees for these passes will be determined by the number of weeks used and the degree of need (one way or round trip).

RochelleLee-Ogle Transportation System will provide a route between Rochelle and the College. Arriving twice daily, by 8 a.m. and 9 a.m. and have a departure time of 1 p.m., 2:30 p.m. or 4:10 p.m.

Also available for the summer semester starting June 14th, the LOTS bus picks up at 8:00 a.m. ONLY and returns at 1:00 and 4:10 p.m.

PaymentStudents should register for the bus during their regular course registration in the Admissions, Registration & Records Office. Refunds for Bus fares are: 100% during the first week of classes; 50% during the second week of classes; and no refunds after the second week of classes.

Career ServicesCareer counseling is available at the Counseling and Student Development Center and is designed to assist Kishwaukee students, graduates, and area residents in their career planning.

Individual career counseling and information about occupational trends and a variety of careers is available through this office. Students may take interest and personality inventories, and participate in workshops and classes. Interactive computerized career information systems including Career Cruising are also available for student use. These systems allow exploration of various career fields and research into specific career and college information.

Child Care/Early Childhood CenterThe Kishwaukee College Early Childhood Center provides high-quality early childhood care and education for young children and their families.

The Early Childhood Center provides care for children between the ages of two and five. Students attending the program are children of Kishwaukee College students and staff as well as community residents. Families DO NOT have to be affiliated with Kishwaukee College to use the program. Part-time and full-time enrollment is offered to meet individual family needs.

The Early Childhood Center is licensed by the Department of Children and Family Services and a member of Community Coordinated Child Care (4-C).

Counseling/Academic AdvisingEducational planning and academic advisement provides information and supportive assistance to students as they develop and pursue life goals. Advisement is a continuous process of clarification and evaluation. The ultimate responsibility for making decisions about life goals and educational plans rests with the individual student. The Counselor and Faculty Advisor assist by helping to identify and assess alternatives and their implications.

Faculty Advisors assigned to students enrolled in Career/Technology programs are posted to the student’s KishSOS account on the “My Application” page.

Advising for Career/Transfer Credit CoursesStudents registering for more than 18 hours for fall or spring semester or more than 9 total credit hours in any combination of summer sessions are REQUIRED to meet with a counselor or faculty advisor for overload approval.

Additionally, the following students are REQUIRED to meet with a counselor in the Counseling and Student Development Center for each term of registration:

1. First time, full-time enrollees (12 hours or more)2. Classified as being on “Restricted Standing” (see

the “Academic Standing” section of the catalog) 3. International students on F-1 Visas 4. All students transferring in credit from another

college and pursuing a degree at Kishwaukee College

Degree Options/Educational PlanTransfer Degrees A.A., A.S., A.E.S., A.F.AStudents can spend their first two years at Kishwaukee College and then complete a bachelor’s degree at a public or private four-year school. Thanks to the Illinois Articulation Agreement, Kishwaukee College associate degree courses transfer easily to all public universities in Illinois. The College’s Transfer Center and counselors can help students create a customized transfer plan to any other school they choose — anywhere in the country, public or private.

Career/Occupational Degrees A.A.S.The Associate of Applied Science (A.A.S) degree prepares students to enter the workforce right after graduation. Most A.A.S. degrees take about two years to complete and require fewer general education courses than transfer-oriented degrees.

CertificatesChoosing a Certificate Program will also prepare students to enter the workforce after graduation. Certificate programs are shorter in duration (many can be completed in less than one year) and consist of courses more directly focused on specific career areas. Certificate programs often do not require the general education requirements (such as math and English) required for the A.A.S. degree. (See page 59)

Work Study ProgramKishwaukee College provides employment opportunities to students in order to enhance their educational experience, promote their involvement with the College and to enable the College to function in an effective and cost-efficient manner. The Employment Resources Center (ERC) acts as Human Resources for student employment. On-campus student jobs are posted on the boards outside of the ERC (U-135) for students to view. Students apply within those areas on campus that have posted open positions. Specific requirements/classes may apply for certain on-campus positions. Student workers are paid minimum wage and are limited to a maximum of 20 hours per week. Available hours vary by department needs and budgets.

Financial Aid1. Each school year, fill out an electronic Free

Application for Federal Student Aid (FAFSA) online or in the Financial Aid Office. The FAFSA becomes available January 1 each year. You can pick up a paper FAFSA in the Financial Aid Office or call (800) 433-3243 to have one emailed to you.

FAFSA Tips• Apply as soon after January 1 as possible. • Apply online for faster processing. • Use actual figures from your federal 1040 tax form. • Round up figures to the nearest dollar. • Indicate numbers less than 10 with a zero (0) first. • Answer questions referring to the “school year” as

2. Fill out all Kishwaukee College Financial Aid Forms. Forms are available in the Financial Aid Office or online at the Financial Aid Forms page. After your FAFSA has been received by the College, all additional forms will be sent to you.

3. If you are applying for a loan, arrange to have official academic transcripts from all post-secondary institutions attended sent to the Admissions, Registration, and Records Office. A separate loan information form is required and is available in the Financial Aid Office.

4. Review your Student Aid Report (SAR). Your SAR will be mailed to you within four weeks after you apply. The Financial Aid Office will make necessary corrections for you. If you apply online, you can print the SAR after it has been processed using your PIN.

5. Once you receive an award letter from Kishwaukee College, review the information and keep a copy for your records. You can print a copy of your award letter by accessing your KishSOS account: My Application/ Fin Aid Info; Financial Aid Award Letter.

Learning Skills CenterThe Learning Skills Center at Kishwaukee College provides academic support for all full- and part-time Kishwaukee College students. Students must have their Kishwaukee College I.D. to use the LSC’s services. I.D.s are available in the Kishwaukee College Library.

Tutoring ServicesTutoring is regularly available in the following academic areas: mathematics, chemistry, physics, biology, accounting, English, reading, and Spanish. One-on-one assistance in study skills is also available. Tutoring schedules are available in the Learning Skills Center. The tutoring service is free, and no appointment is necessary.

Writing LabThe Writing Lab answers all of your writing-related questions regardless of the class or assignment. No appointment is necessary, and students can get help individually or in small groups. Also available are workshop opportunities for any size group.

Computer LabThe Learning Skills Center has a 12-station open computer lab. All computers are Windows PCs and run a variety of programs, including Internet Explorer, and Microsoft Word and Excel. In addition, several tutorials to enhance classroom performance are also available, including Derive. No food or drinks are allowed in the lab. The lab is open during regular Learning Skills Center hours.

LibraryThe Kishwaukee College Library provides quality information sources in traditional and electronic formats to all district users. A student photo ID or a Library Community Card is required for all check outs.

Payment/KIPP/Refund PolicyKIPP is an installment payment plan. In order to enroll in KIPP, you must have a checking account or credit card as payments are automatically withdrawn from your chosen account.

To enroll in KIPP log on to KishSOS and select “My KIPP” under the Financial Information heading, enter your 7-digit student ID and birthday and follow the on-screen instructions. There is a $50 fee to enroll in KIPP, this fee is non-refundable, even if you pay your account early. Also, you will be charged a $25 fee for any payments that are unsuccessful (for non-sufficient funds or closed bank accounts, for example).

If you enroll in KIPP early and agree to make payments before the start of classes, a down payment may not be required. However, if you enroll in KIPP later, you may be required to make a down payment. For more information on specific dates, see the KIPP promotional bookmark, available outside the Business Office.

Refunds of tuition and fees for dropped courses are processed according to the college refund policy.

Kishwaukee College partners with the DeKalb County Sheriff to provide security on campus. Kishwaukee College campus is well patrolled by DeKalb County Sheriff Deputy officers who conduct regular foot and vehicle patrols of campus buildings and grounds from 8:00 a.m. - 10:30 p.m. Monday through Friday and 7:30 a.m. - 3:30 p.m. on Saturday.

The deputies are a visible presence on campus and enjoy getting to know students and staff — feel free to talk with them! In addition, there are red security phones in hallways across campus for the exclusive use of calling 9-1-1. Each classroom and office is also equipped with a phone on which calls may be dialed out or received during an emergency. The classroom and office phones also double as an intercom system to receive information during an emergency situation. The campus parking lots have emergency phones (indicated by a blue light) if there is a safety or security issue outside the building. Access to the building is only available through twelve doors around the building. Although other doors may be used to exit the building, entrance is controlled for additional security. There are security cameras at all entrance points. Kishwaukee College strives to maintain a balance of providing a safe and secure campus without infringing on or curtailing the activities of students and staff.

ScholarshipsKishwaukee College Foundation ScholarshipsFinancial assistance is offered through the scholarships available through the Kishwaukee College Foundation. The Foundation houses many endowments established by donors to fund over 150 different scholarships available each year for Kishwaukee College students. Annually, the Foundation distributes over $200,000 to eligible students. Foundation scholarships are established with varying criteria — some are for students in specific programs, some are need-based, some are earmarked for alumni of specific high schools, and others are for general student use.

The Foundation has developed an online application process that will allow you to apply for multiple scholarships with one application. It has also provided a handbook for you to download, which includes specific information on the web application, scholarship process, dates, deadlines, notices and agreements, as well as the projected dollar amount available for each scholarship.

As a member of the Illinois Consortium for International Studies and Programs (ICISP), Kishwaukee offers a variety of cost-effective study abroad opportunities. Formed in 1986 through an initiative of several Illinois community colleges, ICISP currently offers semester-long programs at Canterbury Christ Church University, England; Salzburg College in Salzburg, Austria; Carlow College in Carlow, Ireland; and International College of Seville in Seville, Spain. Shorter summer programs are available in San Jose, Costa Rica; Sydney, Australia; Dijon France; and Salzburg, Austria. Study abroad students select their courses from an approved list of classes specific to each destination. Transfer credit-usually 15 hours for a semester program and 6 hours for a summer program-is typically awarded through Kishwaukee College.

TranscriptsThe Admissions, Registration, and Records Office will provide an official transcript of a student’s academic record upon written request by the student. Official transcripts are $5.00 per each copy ordered. Transcripts will not be released without the written permission of the student. Transcript requests by telephone or e-mail will not be processed by Kishwaukee College.

1. Code of Student Conduct and DisciplineKishwaukee College has an obligation to clarify those standards of behavior which it considers essential to its educational mission and its community life. The Code of Student Conduct and Discipline addresses student behaviors for which disciplinary sanctions may be imposed by the College.

These general behavioral expectations and the resultant specific regulations should represent a reasonable regulation of student conduct, but students should be as free as possible from imposed limitations that have no direct relevance to their education.

Offenses are clearly defined below and will be interpreted in a manner consistent with principles of relevancy and reasonableness. Disciplinary proceedings will be instituted only for violations of standards of conduct formulated with student participation and published in advance.

A student who wishes to examine the Code of Student Conduct and Discipline or any other policies of the College should arrange for an appointment with the Vice President of Student Services.

Proscribed ConductGenerally, disciplinary measures by Kishwaukee College shall be limited to conduct which adversely affects the College’s pursuit of its educational objectives. The following misconduct is subject to disciplinary action:

1. All forms of academic dishonesty, including cheating and plagiarism. Knowingly furnishing false information to the institution. Forgery, alteration or use of institutional documents or instruments of identification with intent to defraud.

See Policy on Academic Dishonesty for further information and description of sanctions that may be imposed by instructors in addition to sanctions resulting from charges being brought under this Code of Student Conduct and Discipline.

2. Individual or group activities which directly disrupt or obstruct services for which students have contracted with the institution.

3. Physical abuse of any person on institution premises or at institutionally sponsored functions. 4. Theft from or damage to institution premises or theft from or damage to property of a person on institution

premises. 5. No person shall possess or consume alcoholic beverages on campus and no person under the age of 21 shall

possess or consume alcoholic beverages at any college sponsored function. Alcoholic beverages are prohibited at all college functions except where specifically sanctioned by the president, or in his absence by a vice president, subject to proper licensing and insurance.

6. Items included in the Illinois Criminal Code, including on campus gambling, drug use, and drug dealing. Additional information concerning misconduct and sanctions specified by the Federal Drug-Free Schools and Communities Act Amendment of 1989, Public Law 101-226, Sec. 1213, is contained elsewhere in this catalog under the heading Alcohol and Substance Abuse.

NOTE: Students who incidentally violate institutional regulations in the course of their off-campus activities, such as those relating to class attendance, should be subject to no greater penalty than would normally be imposed. Institutional action should be independent of community pressure.

Committee on Student Conduct and DisciplineThe Committee on Student Conduct and Discipline is instituted to insure that each student against whom the College brings charges which warrant disciplinary action will be guaranteed due process in the execution of justice. The authority for student discipline derives from the Board of Trustees of the College, who resolved at its meeting of April 13, 1971, that the president of the College or approved delegate be granted the authority to suspend a student for disciplinary reasons upon the recommendation of the Committee on Student Conduct and Discipline (or without the recommendation of the committee in those cases in which the student waives the hearing) for stated periods not to exceed one semester or for an indefinite period. Alternatively, the committee can make rehabilitative recommendations.

The Committee on Student Conduct and Discipline shall be composed of five members or their delegates as follows:

1. An administrative Vice President shall act as chair. 2. Chair or designee, Academic Standards Committee. 3. Vice President of the Student Association. 4. A student elected at large during the Student Association fall elections who meets the requirements of a

sophomore senator. 5. An at-large representative from professional staff.

Any member of the Kishwaukee College community may bring violations to the attention of the Vice President of Student Services or approved delegate. All charges against a student will be made by the Vice President of Student Services in the name of the college. The Vice President of Student Services, upon finding due cause for disciplinary action, must adhere to the following procedures:

1. A written statement of specific charges and the time and place of the scheduled hearing will be presented to the student at least 24 hours prior to the hearing.

2. Students are entitled to additional time to prepare their case, but a delay should not exceed a 48-hour period beyond this one-day notice.

3. Students have the right to waive the hearing, answer the charges in person to the Vice President of Student Services, and accept the disciplinary action meted out by the president of the College or approved delegate.

4. The hearing shall be opened with a reading of the charges by the Vice President of Student Services. The hearing must provide a full opportunity to review both sides of the issue.

5. Students are free to seek legal counsel or the counsel of any other person of their choice who can represent them at the hearing.

6. Students should be given full opportunity to present to the hearing body their defense against the charges and to produce oral testimony and/or written affidavits of witnesses in their behalf.

7. Students or their counsel should have the opportunity to question witnesses who appear against them and make statements in answer to statements against them.

8. The hearing body shall be impartial and no voting member shall bee a witness for or against students. The hearing body shall examine all relevant facts and circumstances.

9. The hearing body will inform students of its decision within 72 hours after the end of the hearing.

10. A record of the proceedings and the disposition of the case shall be kept in the office of the Vice President of Student Services and a copy provided to the student. In accordance with the Crime Awareness and Campus Security Act of 1990 and the 1998 Amendments to the Higher Education Act of 1965, the College will disclose the name of the perpetrator, violation committed, and sanction(s) imposed for any crime of violence or non-forcible sex offense which violates the College’s rules or policies and for which the perpetrator was found in violation as a result of a disciplinary proceeding without the prior consent of the perpetrator. The institution will also disclose the results of disciplinary hearings to the parents or legal guardians of the students less than 21 years of age who have been found responsible for violating campus rules regarding the use or possession of alcohol or controlled substances.

11. Failure on the part of the student to appear at the hearing or to appear before the Vice President of Student Services may result in automatic dismissal from Kishwaukee College and forfeiture of subsequent attendance at the College.

An appeal of any decision of the Vice President of Student Services or the Committee on Student Conduct and Discipline may be made to the president of the College, who may choose to refer the appeal to the Board of Trustees.

The aforementioned procedures may be waived in those cases where a clear and present danger to persons or property exists, at which time the president or approved delegate may summarily suspend a student or students, not before five minutes after the student or students have been sternly warned and ordered to cease and desist their proscribed conduct. The suspension shall be temporary and shall be followed by a hearing within 48 hours. In those situations which are so out of control that a measure of authority must be asserted, the following or similar steps should be followed. The school official shall:

1. Issue a warning or invitation to draft a list of complaints. 2. Request dissenting group to choose a leader so complaints may be discussed. 3. Request a court injunction or declare a campus curfew. 4. Issue a stern warning of the consequences, allow a five-minute waiting period, which may be followed by

summary suspension. 5. As a last resort, request police intervention.

Any student wishing to clarify the policies regarding student conduct and discipline should arrange for an appointment with the Vice President of Student Services.

2. Academic DishonestyForms of Academic DishonestyAcademic dishonesty is a serious offense, which includes but is not limited to the following: cheating, complicity, fabrication and falsification, forgery, and plagiarism. Cheating involves copying another student’s paper, exam, or quiz. It also involves the unauthorized use of notes, calculators, and other devices or study aids. In addition, it also includes the unauthorized collaboration on academic work of any sort. Complicity, on the other hand, involves the attempt to assist another student to commit an act of academic dishonesty. Fabrication and falsification, respectively, involve the invention or alteration of any information (data, results, sources, identity, and so forth) in academic work. Another example of academic dishonesty is forgery, which involves the duplication of a signature in order to represent it as authentic. Lastly, plagiarism involves the failure to acknowledge sources (of ideas, facts, charts, illustrations, and so forth) properly in academic work, thus falsely representing another’s ideas as one’s own.

Penalties for Academic DishonestyIn individual cases of academic dishonesty, sanctions may range from a written warning to a failing grade for the course; the severity of the penalty is left to the discretion of the instructor. Additional sanctions may be imposed up to and including dismissal from the college when circumstances warrant it.

Procedure for Handling Academic DishonestyIn a case of academic dishonesty, the instructor should collect all proof of academic dishonesty (photocopies, etc.) and document the incident. Next, the instructor must inform his or her student of the offense, and any sanctions, in a timely and confidential manner. If a student wishes to appeal the charge, he or she should first try to resolve the issue with his or her instructor. If the student is not satisfied with the outcome of that meeting, he or she may take his or her case to the instructor’s dean. In that case, the student, the instructor, and the dean will meet to discuss and hopefully resolve the issue. If the student does not agree with the outcome of the meeting, the student may further appeal the charge to the Vice President of Career/Transfer Instruction. Following the completion of all appeals, the instructor should forward documentation of the offense and sanctions to the office of the Vice President of Student Services. This documentation will be kept in a confidential file in the VPSS office.

Note: Once the file has been created, the instructor’s dean will send a letter to the student, referencing this policy and informing him or her that the file exists.

3. Harassment PolicyThe College will not tolerate harassment by any of its employees or students. For general policy purposes, sexual harassment may be described as unwelcome sexual advances, requests for sexual favors, and other physical and expressive behavior of a sexual nature where: (1) submission to such conduct is made either explicitly or implicitly a term or condition of an individual’s employment or education; (2) submission to or rejection of such conduct by an individual is used as the basis for academic or employment decisions affecting the individual; or (3) such conduct has the purpose or effect of substantially interfering with an individual’s academic or professional performance or creating an intimidating, hostile or demeaning employment or educational environment. These Procedures (a) provide the means of prompt and equitable hearing of employee and/or student affirmative action grievances on both an informal and formal basis; and (b) permit the College administration and the Board to become aware of situations which may require remedial action.

These Procedures are available to all employees of, applicants for employment by, students in, and applicants for admission to Kishwaukee College (collectively called “employees” and “students”).

These Procedures offer claimants the means of bringing their grievances to the attention of those persons who can take quick action to remedy any discrimination or action found to exist at the College. Even the formal review procedures are informal in nature-they are not intended to be court-type procedures. While employees and students are encouraged to do so, they are not required to make use of these Procedures. The right to use these Procedures is intended to supplement, not to replace, any other rights which employees and students may have.

No claimant’s status as an employee or student will be adversely affected in any way because he or she utilizes these Procedures. All employees and students are advised that any retaliation or attempt to retaliate against a claimant for the use of these Procedures or against any employee or student for participating in any manner in proceedings hereunder constitutes a violation of these Procedures and may also be a violation of law.

Any applicant for employee or student status is invited to bring any grievance to the attention of the Director of Human Resources, who has been approved by the President as the institution’s Affirmative Action officer. Communication of this has been and continues to be made via the College’s non-discriminatory policy statement.

Informal Review of Grievances. An employee or student is encouraged to “speak up” when a problem relating to discrimination or sexual harassment arises. The flexibility of informal discussions often results in solutions to problems more easily and quickly than do formal procedures.

If in doubt as to how to proceed, an employee or student should contact the Director of Human Resources. In any event, an employee or student who believes that he or she has been sexually harassed or discriminated against because of sex, race, color, religion, age, national origin, disability status or sexual orientation is strongly encouraged to discuss his or her problem with the Director of Human Resources before pursuing formal review procedures.

4. Procedure for Resolution of Student ComplaintsStudents may encounter a variety of conflicts during their course of study at Kishwaukee College that may require review by appropriate administrative or academic personnel. The purpose of the following procedures is to provide an equitable system for resolving conflicts between students and faculty or staff members when a review of the issue is not otherwise available under established college policies and procedures. The college has already established appropriate procedures for conflict resolution (Final Grade Appeal, Academic Forgiveness and Judicial Procedures).

Questions regarding these procedures or guidance on the applicability of any Kishwaukee policy or procedure to a student’s specific problem should be directed to the office of the Dean of Student Services.

ApplicabilityThis procedure applies to all registered Kishwaukee students (full-time, part-time, special programs, Community Education/Continuing Professional Education) and is applicable in the review of problems such as the following:

1. All aspects of the degree granting process, including grading, evaluation or status (unless established policies are already available).2. Alleged professional misconduct toward a student by a faculty or college staff member while in the scope of college employment.3. Alleged intimidation, discrimination, and harassment based on sex, race, religion, age, disability, national origin or sexual orientation, and the College specifically prohibits such intimidation, discrimination, and harassment, including sexual harassment. (Title IX and 504 complaints are included.)4. Allegations concerning the application or propriety of college regulations, policies, and procedures regarding student rights and behavior.

ProceduresNo student shall be penalized by the college for filing or participating in the complaint process when the student has acted reasonable and in good faith. All complaints must be initiated within 60 days of the date of the incident or after the student should have become aware of the incident giving rise to the complaint. The college reserves the right to waive the 60 day rule based on the facts and circumstances of the complaint and after giving due consideration to the protection of the rights of both parties.

Informal ProceduresAll students are encouraged to first utilize informal discussion to resolve any problems encountered at the college.

1. When appropriate the student is encouraged to talk directly to the faculty or staff member prompting the complaint in an effort to resolve the issue.2. If the student prefers to talk to someone other than the direct faculty or staff member involved, they are encouraged to present the complaint to the immediate supervisor of the person involved.

Each student, faculty member, administrative and staff member has an obligation to resolve problems fairly and informally through discussion between the aggrieved student(s) and the specific college person immediately involved with the problem. Although students are strongly encouraged to use informal discussion for problem solution, it is not a requirement for the filing of a formal complaint.

Formal ProceduresStudents should always first attempt to resolve issues through an informal process with the faculty or staff person. If a student is unable to resolve the issue informally they can choose to file a formal complaint.

1. Student must first consult with the Dean of Student Services before filing a written complaint. a. Where a previously established grievance procedure already exists the Dean will refer the complaint to the appropriate process. b. In cases of alleged illegal discrimination based on race, gender, religion, age, marital status, creed, or disability, the Dean will contact the Vice President of Student Services prior to advising the student about a course of action.

2. After consultation with the Dean of Student Services, the student may submit to the Dean a written statement of the problem in order to continue the formal resolution process. a. The written statement must be signed and dated and must clearly state the nature and basis of the alleged offense, the name(s) of the person(s) committing the alleged offense, the specifics of the incident(s) in question and the names of any known witnesses. b. The Dean will submit the complaint to the immediate supervisor who will conduct an investigation and respond in writing to the student, with a copy to the Dean within 30 days of the filing date of the complaint. An extension for additional review may be granted by agreement of the Dean.3. If the student feels that the decision of the immediate supervisor is arbitrary or capricious or if he/she has new evidence to present, he/she may appeal the decision in writing to the next level of supervision or an individual designated by the Dean of Student Services within 10 days of the decision. a. A copy of the appeal must be submitted to the Dean. b. Upon appropriate review, the appellate determination must be communicated in writing to all parties involved within 30 days of the date of the appeal.

4. The decisions of the Dean of Student Services or appointed designee regarding review and appeal shall be final.

As appropriate, the Dean of Student Services may designate different persons to review cases or may consolidate complaints when such action is consistent with administrative efficiency and a fair resolution of the problem. In cases where the complaint itself is frivolous, harassing in nature, or not specific, the Dean may refuse to process the complaint. Written notification will be provided.
