    I the court orders your ex to pay youspousal support afer your divorce, it’simportant you protect your rights to thosepayments. You should keep your lawyer inthe loop beore agreeing to any changesand take needed action promptly – or youmay lose out. A recent case decided by ourBC appeal court shows what can happen i

    you don’t.Cindy and Mark (names changed) were

    married or 20 years beore divorcing in1997. Tey had two children, both withdevelopmental and learning challenges.While married, Cindy stayed home to lookafer the children. When she and Markdivorced, Mark was ordered to pay Cindy$800 a month in spousal support goingorward indenitely.

    Mark made those payments until the start

    o 2001. But afer meeting with Cindy late2000 or early 2001, he started paying heronly $200 a month, intended as supportor their children. In 2010 (some 10 yearslater), Cindy’s lawyer sent Mark a lettersaying Mark had unilaterally decided tocut his payments back to $200 a month. Hedemanded Mark pay $70,000 (plus interest)in “arrears” or back payments and also startpaying Cindy the $800 a month the courthad originally ordered. Mark’s lawyer wrote

    back that Cindy had agreed to the $200reduced amount.

    Afer that, Cindy did nothing more until2014, when she went to court. She nowclaimed about $99,000 in arrears, and askedor $800 a month (or more) in supportgoing orward. Mark in turn asked the court

    to cancel the arrears and stop any uturesupport payments.

    Tere was some dispute about whathappened at the meeting in 2000 or 2001.But the court decided Cindy had, in act,agreed to a reduction o the supportpayments to $200 a month at the time.Because Cindy got nothing in return, this

    wasn’t a legally binding contract. Still, Cindyhad “waived” (given up) her legal right tothe $800 a month until she withdrew thatwaiver.

    Because she didn’t do anything afer the2010 letter exchange between the lawyers,she had not denitively taken back herwaiver then. She could withdraw her waiverby giving reasonable notice – but she onlydid that by going to court over this in 2014.

    So because she’d waived her legal rightstill then, Cindy’s claim or $99,000 inarrears (dating rom 2001) ailed. She hadn’tsuffered nancially, and the courts leanagainst “hoarding.” For Mark, it would be anunair hardship to have to pay such a largeamount due to Cindy’s delay.

    As to what spousal support payments, iany, Mark should pay rom 2014 on, thisneeded to be dealt with under the ederalDivorce Act rules or “varying” (changing)

    support orders. Tere had been a materialchange in Mark and Cindy’s circumstancessince the original 1997 support order.Te court decided Cindy was entitled toongoing spousal support and awarded her$424 a month going orward, in line withguidelines the court ound helpul here.
