Alter application to include creation of carriageway easement Please see attached the altered application form. 2. Additional fee of 1 / 2 of $1318.10 (an invoice will be forward to you shortly) Payment has been made. 3. Owner to acknowledge that all repairs and maintenance of the bridge will be the landowner's responsibility. A brief written description of why this site was chosen for the bridge. Please see attached an attached letter of acknowledgement from the owner that all repairs and maintenance of the bridge will be the landowner's responsibility. The letter also clarifies the rationale regarding the proposed siting of the bridge. 4. Revised plans showing: - the bridge and driveway needs to be shown as 3.5 metres wide to allow for CFA access. - showing location of existing easements and the proposed easement, including dimensions from lot boundaries. more detail on the length and width of each angle of the easement. Please see attached revised plans with additional detail regarding the bridge design and easement details. We write in response to your email of which requires additional information regarding the abovementioned planning permit application.

1. Alter application to include creation of carriageway easement

5. Please provide a flood report for the bridge and easements or written advice from CCMA that this is not required.

Please see the attached response from the COMA which does not require a Flood Impact Report and also note the site chosen is outside the Flood Overlay.

6. Provide copy of instrument/dealing no. AT100817E 23/4/20 as described on title for TP180997V & TP106695H

7. How does the easement and proposed bridge link up with the existing easements created? Only creating easement for the house lot and not the other lot? It is considered appropriate to review the easements for the 3 lots and 'clean up' and remove unnecessary easements and create the appropriate access easements now. If you do this, please update the application form and also provide copy of title for the 3rd lot as well as providing the revised plan.

Noted please see the attached plan which provides a logical easement location to access all three lots.

8. An application for a permit by a person other than the relevant public land manager must be accompanied by the written consent of the public land manager, indicating that the public land manager consents generally or conditionally either:

- To the application for permit being made.

- To the application for permit being made and to the proposed use or development. - Where there is no public land manager, an application for a permit must be accompanied by

the written consent of the Secretary to the Department of Environment, Land, Water and Planning.

We have discussed this matter with Geoff Brooks of DELWP who has not objected to the requirement for a bridge however he has advised that DELWP is unable to provide long term tenure over the land. He has suggested that Council extend the road reserve over the land and enter into a maintenance agreement with the landowner. As you are aware we have already requested Council's view regarding this matter and await your reply.
