Commissioner of Industries. A meeting of the Industrial Land Management Advisory Committee (ILMAC) was convened on 11.07.2011 at 11.30 A.M. under the Chairmanship of Sh. A.R. Talwade, Add!. Commissioner/Chairman ILMAC which was attended by the following members::" 1. Sh. A.R. Talwade, Chairman. 2. Sh. Vinod Kumar, DCI. 3. Sh. V.K. Garg, Dy. G.M.(DSIIDC). 4. Sh. Ashok Kumar, F.O., Industries Deptt. The cases discussed were as under:- I' , 1\ 1. The case of Shed NO.-93, Okhla Industrial Estate, Phase-III, New Delhi for mutation and conversion from leasehold to freehold was before ILMAC and Sh. Ramesh Kumar Miglani, partner appeared before ILMAC. On 09.06.1965, the shed was originally allotted to M/s White Wood Sports through its Prop. Sh. Ajit Singh for manufacturing of sports goods. Thereafter, certain changes have taken place in the constitution of the firm and finally Sh. Ramesh Kumar Miglani and Sh·. Rajat Miglani remained as continuing partners having equal shares. As per Estate Manager report, the unit is engaged in manufacturing of cutting and slitting of steel coils. The other requisite documents have also been submitted by the firm for conversion of the shed into freehold. But it has been observed that multiple changes have taken place in the constitution of the firm .. Hence, ILMAC recommends change in constitution of the firm in favour of M/s White Wood Sports with Sh. Rajat Miglani and Sh. Ramesh Kumar Miglani, partners on payment of 50% UEI charges and submission of required documents accordingly as per Land Management Guidelines. 2. The case of Plot No. 125, FIE, Patparganj, Delhi-110092 As per recommendations of the concerned branch, the case of Plot No. 125, FIE, Patparga~j, Delhi-92 was placed before the ILMAC for conversion of Industrial

convened on 18.07.2011 at 11.30 A.M. under the Chairmanship of Sh. A.R. Talwade,

The cases discussed were as under:-

1. The case of Plot No.A-6S, FlEE, Okhla Industrial Area, Phase-II was

placed before ILMAC for grant of extension of time period for construction of factory

building.. Earlier, the case was placed before ILMAC on 27.06.2011. Sh. ShyamSunder Aggarwal, the claimant has not appeared before ILMAC and a message has

been received from him that he is ill. Sh. Paramjeet Singh Kohli, the Special Power of

Attorney holder of original allottee Sh. K. Oberoi appeared before ILMAC and produced

the original registered Power of Attorney in his favour. A copy of e-mail from Sh. K.

Oberoi was also produced whereby it has been intimated that the plot in question has

not been sold to Sh. Shyam Sunder Aggarwal. Keeping in view the facts of the case,

ILMAC is of the view that both Sh. Shyam Sunder Aggarwal and Sh. Paramjeet SinghKohli may be directed to produce the original documents related to the plot beforeILMAC in its meeting on 08.08.2011.

2. The case of Plot No. A-16, FlEE, Okhla Industrial Area, Phase-II was

placed before ILMAC for conversion from leasehold to freehold. Sh. C. Lal, the

subsequent purchaser through registered GPAand Agreement to Sell dated 14.09.2006

appeared before ILMAC. The plot was leased out to Sh. Jitender Sekhri on 26.09.2003.The present applicant(s) i.e. Sh. C. Lal and Smt. Anju Wadhwa are subsequent

purchasers. The manufacturing activities of repairing of computers are being carried

out at the premises of the plot as reported by concerned Estate Manager vide report

dated 30.05.2011. The completion of factory building is supported by Form B-2 dated

20.07.2010 and composition charges accordin,glystands paid. 'No Dues' has also been

accorded by AAO(Land). Accordingly, ILMAC recommends to allow conversion of Plot

No. A-16, FlEE, Okhla Industrial Area, Phase-II, New Delhi in favour of Sh. C. Lal and

Smt. Anju Wadhwasubject to payment of outstanding dues, if any as per the Land

Management Guidelines.

3. The case of Plot No. A-49, FlEE, Okhla Industrial Area, Phase-II was

placed before ILMAC for conversion from leasehold to freehold. Sh. Praveen Khanna,

the subsequent purchaser through registered GPA and Agreement to Sell dated

21.04.2010 appeared before,ILMAC. The plot was leased out to Sh. Ashok Kumar Jain

on 29.01.2004. The manufacturing activities of repairing of electronic goods are being

carried out at the premises of the plot as reported by concerned Estate Manager vide

report dated 30.05.2011. The completion of factory building is supported by Form B-2

dated 23.12.2010. Composition charges accordingly stands paid. No Dues has also

been accorded by AAO(Land). Accordingly, ILMAC recommends to allow conversion of

Plot No. A-49, flEE, Okhla Industrial Area, Phase-II, New Delhi in 'favour of Sh. Praveen

Khanna subject to payment of outstanding dues, if any as per the Land ManagementGuidelines.

4. The case of Plot No. 5-23, FlEE, Okhla Industrial Area was placed before

ILMAC for consideration of demand of interest on sub-letting charges amounting to

Rs.1,82,836j-. In this regard, it has been observed that in the meeting of ILMAC held

on 24.01.2011 while considering the case of Plot No.-187, FIE, Patparganj, the decision

of Hon'ble LG is there based on the recommendations of Law Department and also seenby Finance Department, no interest is to be levied when no demand has been raised.

Similar methodology was adopted in the case of 5-99, FlEE, Okhla Industrial Area while

considering the case in ILMAC on 07.03.2011 whereby no interest was levied since no

demand was raised. Accordingly, ILMAC recommends that interest on sub-letting

charges is not required to be levied in the instant case as no demand was, ever raisedon this account.
