     -&". 158. 1isitorial and enforcement power  , (a) "he 4e+retary of La#or andE%ploy%ent or his d!ly a!thori?ed representatives* in+l!ding la#or reg!lation offi+ers*shall have a++ess to e%ployerHs re+ords and pre%ises at any ti%e of the day or nightwhenever worA is #eing !ndertaAen therein* and the right to +opy therefro%* to!estion any e%ployee and investigate any fa+t* +ondition or %atter whi+h %ay #ene+essary to deter%ine violations or whi+h %ay aid in the enfor+e%ent of this Codeand of any la#or law* wage order or r!les and reg!lations iss!ed p!rs!ant thereto.

    (#) >otwithstanding the provisions of -rti+les 159 and 51 of this Code to the+ontrary* and in +ases where the relationship of e%ployer,e%ployee stilleFists* the 4e+retary of La#or and E%ploy%ent or his d!ly a!thori?edrepresentatives shall have the power to iss!e +o%plian+e orders to giveeffe+t to the la#or standards provisions of this Code and other la#or legislation #ased on the findings of la#or e%ploy%ent and enfor+e%entoffi+ers or ind!strial safety engineers %ade in the +o!rse of inspe+tion. "he4e+retary or his d!ly a!thori?ed representatives shall iss!e writs of eFe+!tionto the appropriate a!thority for the enfor+e%ent of their orders* eF+ept in+ases where the e%ployer +ontests the findings of the la#or e%ploy%ent andenfor+e%ent offi+er and raises iss!es s!pported #y do+!%entary proofswhi+h were not +onsidered in the +o!rse of inspe+tion.      -n order iss!ed #y the d!ly a!thori?ed representative of the 4e+retary of La#or and E%ploy%ent !nder this -rti+le %ay #e appealed to the latter. $n+ase said order involves a %onetary award* an appeal #y the e%ployer %ay#e perfe+ted only !pon the posting of a +ash or s!rety #ond iss!ed #y arep!ta#le #onding +o%pany d!ly a++redited #y the 4e+retary of La#or andE%ploy%ent in the a%o!nt e!ivalent to the %onetary award in the order appealed fro%. (-s a%ended #y &ep!#li+ -+t >o. 7* 2!ne 5* 1993).+hanro#lesvirt!allawli#rary

    (+) "he 4e+retary of La#or and E%ploy%ent %ay liAewise order stoppage of worA or s!spension of operations of any !nit or depart%ent of an

    esta#lish%ent when non,+o%plian+e with the law or i%ple%enting r!les andreg!lations poses grave and i%%inent danger to the health and safety of

    worAers in the worApla+e. 6ithin twenty,fo!r ho!rs* a hearing shall #e+ond!+ted to deter%ine whether an order for the stoppage of worA or s!spension of operations shall #e lifted or not. $n +ase the violation isattri#!ta#le to the fa!lt of the e%ployer* he shall pay the e%ployees+on+erned their salaries or wages d!ring the period of s!+h stoppage of worAor s!spension of operation.

    (d) $t shall #e !nlawf!l for any person or entity to o#str!+t* i%pede* delay or otherwise render ineffe+tive the orders of the 4e+retary of La#or andE%ploy%ent or his d!ly a!thori?ed representatives iss!ed p!rs!ant to thea!thority granted !nder this -rti+le* and no inferior +o!rt or entity shall iss!ete%porary or per%anent in!n+tion or restraining order or otherwise ass!%e !risdi+tion over any +ase involving the enfor+e%ent orders iss!ed ina++ordan+e with this -rti+le.

    (e) -ny govern%ent e%ployee fo!nd g!ilty of violation of* or a#!se of a!thority* !nder this -rti+le shall* after appropriate ad%inistrativeinvestigation* #e s!#e+t to s!%%ary dis%issal fro% the servi+e.

    (f) "he 4e+retary of La#or and E%ploy%ent %ay* #y appropriate reg!lations*re!ire e%ployers to Aeep and %aintain s!+h e%ploy%ent re+ords as %ay #ene+essary in aid of his visitorial and enfor+e%ent powers !nder this Code.

     -&". 159. &ecovery of wages, simple money claims and other *enefits   , Upon+o%plaint of any interested party* the &egional Dire+tor of the Depart%ent of La#or and E%ploy%ent or any of the d!ly a!thori?ed hearing offi+ers of the Depart%ent ise%powered* thro!gh s!%%ary pro+eeding and after d!e noti+e* to hear and de+ideany %atter involving the re+overy of wages and other %onetary +lai%s and #enefits*in+l!ding legal interest* owing to an e%ployee or person e%ployed in do%esti+ or ho!sehold servi+e or ho!sehelper !nder this Code* arising fro% e%ployer,e%ployeerelations Provided* "hat s!+h +o%plaint does not in+l!de a +lai% for reinstate%ent

    Provided f!rther* "hat the aggregate %oney +lai%s of ea+h e%ployee or ho!sehelper does not eF+eed =ive tho!sand pesos (P0*.). "he &egional Dire+tor or hearingoffi+er shall de+ide or resolve the +o%plaint within thirty (7) +alendar days fro% thedate of the filing of the sa%e. -ny s!% th!s re+overed on #ehalf of any e%ployee or ho!sehelper p!rs!ant to this -rti+le shall #e held in a spe+ial deposit a++o!nt #y* andshall #e paid on order of* the 4e+retary of La#or and E%ploy%ent or the &egionalDire+tor dire+tly to the e%ployee or ho!sehelper +on+erned. -ny s!+h s!% not paidto the e%ployee or ho!sehelper #e+a!se he +annot #e lo+ated after diligent andreasona#le effort to lo+ate hi% within a period of three (7) years* shall #e held as aspe+ial f!nd of the Depart%ent of La#or and E%ploy%ent to #e !sed eF+l!sively for the a%elioration and #enefit of worAers.

     -ny de+ision or resol!tion of the &egional Dire+tor or hearing offi+er p!rs!ant to this

    provision %ay #e appealed on the sa%e gro!nds provided in -rti+le 557 of this Code*within five (0) +alendar days fro% re+eipt of a +opy of said de+ision or resol!tion* tothe >ational La#or &elations Co%%ission whi+h shall resolve the appeal within ten(1) +alendar days fro% the s!#%ission of the last pleading re!ired or allowed !nder its r!les.+han ro#les virt!al law li#rary

     -ny provision of law to the +ontrary notwithstanding* any +ri%inal offense p!nished inthis Code* shall #e !nder the +on+!rrent !risdi+tion of the !ni+ipal or City Co!rtsand the Co!rts of =irst $nstan+e. (-s a%ended #y 4e+tion 7* Batas Pa%#ansa Bilang).

     -ll %oney +lai%s a++r!ing prior to the effe+tivity of this Code shall #e filed with theappropriate entities esta#lished !nder this Code within one (1) year fro% the date of effe+tivity* and shall #e pro+essed or deter%ined in a++ordan+e with the i%ple%entingr!les and reg!lations of the Code otherwise* they shall #e forever #arred.

    6orA%enHs +o%pensation +lai%s a++r!ing prior to the effe+tivity of this Code andd!ring the period fro% >ove%#er 1* 193 !p to De+e%#er 71* 193* shall #e filedwith the appropriate regional offi+es of the Depart%ent of La#or not later than ar+h71* 190 otherwise* they shall forever #e #arred. "he +lai%s shall #e pro+essed and

    ad!di+ated in a++ordan+e with the law and r!les at the ti%e their +a!ses of a+tiona++r!ed.

     -&". 595.  %nstitution of money claims , oney +lai%s spe+ified in the i%%ediatelypre+eding -rti+le shall #e filed #efore the appropriate entity independently of the+ri%inal a+tion that %ay #e instit!ted in the proper +o!rts.

    Pending the final deter%ination of the %erits of %oney +lai%s filed with theappropriate entity* no +ivil a+tion arising fro% the sa%e +a!se of a+tion shall #e filedwith any +o!rt. "his provision shall not apply to e%ployees +o%pensation +ase whi+hshall #e pro+essed and deter%ined stri+tly in a++ordan+e with the pertinent provisionsof this Code.

    4e+tion 3. 5efinition of 8asic -erms  , "he following ter%s as !sed in these &!les* shall%ean

    (a) 60ontracting6 or  6su*contracting6 refers to an arrange%ent where#y a prin+ipal agrees top!t o!t or far% o!t with a +ontra+tor or s!#+ontra+tor the perfor%an+e or +o%pletion of aspe+ifi+ o#* worA or servi+e within a definite or predeter%ined period* regardless of whether s!+h o#* worA or servi+e is to #e perfor%ed or +o%pleted within or o!tside the pre%ises of the prin+ipal.

    (#) 60ontractor or su*contractor6   refers to any person or entity engaged in a legiti%ate+ontra+ting or s!#+ontra+ting arrange%ent.

    (+) 60ontractual employee6   in+l!des one e%ployed #y a +ontra+tor or s!#+ontra+tor toperfor% or +o%plete a o#* worA or servi+e p!rs!ant to an arrange%ent #etween the latter anda prin+ipal.

    (d) 6"rincipal6   refers to any e%ployer who p!ts o!t or far%s o!t a o#* servi+e or worA to a+ontra+tor or s!#+ontra+tor.

    "he 6right to control6  shall refer to the right reserved to the person for who% the servi+es of the +ontra+t!al worAers are perfor%ed* to deter%ine not only the end to #e a+hieved* #!t alsothe %anner and %eans to #e !sed in rea+hing that end.

    4e+tion ;. "rohi*itions. , >otwithstanding 4e+tion 0 of these &!les* the following are here#yde+lared prohi#ited for #eing +ontrary to law or p!#li+ poli+y

    (a) Contra+ting o!t of a o#* worA or servi+e when not done in good faith and not !stified #ythe eFigen+ies of the #!siness and the sa%e res!lts in the ter%ination of reg!lar e%ployeesand red!+tion of worA ho!rs or red!+tion or splitting of the #argaining !nit

    (#) Contra+ting o!t of worA with a 6ca*o6  as defined in 4e+tion 1 (ii)* &!le $* BooA @ of these&!les. 60a*o6  refers to a person or gro!p of persons or to a la#or gro!p whi+h* in the g!ise of a la#or organi?ation* s!pplies worAers to an e%ployer* with or witho!t any %onetary or other +onsideration whether in the +apa+ity of an agent of the e%ployer or as an ostensi#leindependent +ontra+tor

    (+) "aAing !nd!e advantage of the e+ono%i+ sit!ation or la+A of #argaining strength of the+ontra+t!al e%ployee* or !nder%ining his se+!rity of ten!re or #asi+ rights* or +ir+!%venting

    the provisions of reg!lar e%ploy%ent* in any of the following instan+es

    4e+tion . +istence of an employer7employee relationship. , "he +ontra+tor or s!#+ontra+tor shall #e +onsidered the e%ployer of the +ontra+t!al e%ployee for p!rposes of enfor+ing theprovisions of the La#or Code and other so+ial legislation. "he prin+ipal* however* shall #esolidarily lia#le with the +ontra+tor in the event of any violation of any provision of the La#or Code* in+l!ding the fail!re to pay wages."he prin+ipal shall #e dee%ed the e%ployer of the +ontra+t!al e%ployee in any of the

    following +ases as de+lared #y a +o%petent a!thority

    (a) where there is la#or,only +ontra+ting or

    4e+tion 8. &ights of 0ontractual +mployees. , Consistent with 4e+tion of these &!les* the+ontra+t!al e%ployee shall #e entitled to all the rights and privileges d!e a reg!lar e%ployeeas provided for in the La#or Code* as a%ended* to in+l!de the following

    (a) 4afe and healthf!l worAing +onditions

    4e+tion 9. 0ontract *etween contractor or su*contractor and contractual employee. ,>otwithstanding oral or written stip!lations to the +ontrary* the +ontra+t #etween the+ontra+tor or s!#+ontra+tor and the +ontra+t!al e%ployee* whi+h shall #e in writing* shallin+l!de the following ter%s and +onditions

    (a) "he spe+ifi+ des+ription of the o#* worA or servi+e to #e perfor%ed #y the +ontra+t!ale%ployee

    (#) "he pla+e of worA and ter%s and +onditions of e%ploy%ent* in+l!ding a state%ent of thewage rate appli+a#le to the individ!al +ontra+t!al e%ployee and

    (+) "he ter% or d!ration of e%ploy%ent* whi+h shall #e +oeFtensive with the +ontra+t of theprin+ipal and s!#+ontra+tor* or with the spe+ifi+ phase for whi+h the +ontra+t!al e%ployee isengaged* as the +ase %ay #e.

    "he +ontra+tor or s!#+ontra+tor shall infor% the +ontra+t!al e%ployee of the foregoing ter%sand +onditions on or #efore the first day of his e%ploy%ent.

    4e+tion 1. +ffect of -ermination of 0ontractual +mployment 7  $n +ases of ter%ination of 

    e%ploy%ent prior to the eFpiration of the +ontra+t #etween the prin+ipal and the +ontra+tor or s!#+ontra+tor* the right of the +ontra+t!al e%ployee to separation pay or other related #enefitsshall #e governed #y the appli+a#le laws and !rispr!den+e on ter%ination of e%ploy%ent.

    6here the ter%ination res!lts fro% the eFpiration of the +ontra+t #etween the prin+ipal andthe +ontra+tor or s!#+ontra+tor* or fro% the +o%pletion of the phase of the o#* worA or servi+efor whi+h the +ontra+t!al e%ployee is engaged* the latter shall not #e entitled to separationpay. owever* this shall #e witho!t pre!di+e to +o%pletion #on!ses or other e%ol!%ents*in+l!ding retire%ent pay as %ay #e provided #y law or in the +ontra+t #etween the prin+ipaland the +ontra+tor or s!#+ontra+tor.

    4e+tion 11. &egistration of 0ontractors or 9u*contractors. , Consistent with the a!thority of the 4e+retary of La#or and E%ploy%ent to restri+t or prohi#it the +ontra+ting o!t of la#or

"he appli+ant +ontra+tor or s!#+ontra+tor shall provide in theappli+ation for% the following infor%ation

    (a) "he na%e and #!siness address of the appli+ant and the area or areas where it seeAs tooperate

    (#) "he na%es and addresses of offi+ers* if the appli+ant is a +orporation* partnership*+ooperative or !nion

    (+) "he nat!re of the appli+antJs #!siness and the ind!stry or ind!stries where the appli+ant

    seeAs to operate

    (d) "he n!%#er of reg!lar worAers the list of +lients* if any the n!%#er of personnel assignedto ea+h +lient* if any and the servi+es provided to the +lient

    (e) "he des+ription of the phases of the +ontra+t and the n!%#er of e%ployees +overed inea+h phase* where appropriate and

    "he appli+ation shall #e s!pported #y

    "he appli+ation shall #e verified and shall in+l!de an !ndertaAing that the +ontra+tor or s!#+ontra+tor shall a#ide #y all appli+a#le la#or laws and reg!lations.

    4e+tion 17. ;iling and processing of applications. , "he appli+ation and its s!pportingdo+!%ents shall #e filed in tripli+ate in the &egional ffi+es where the appli+ant prin+ipally

    operates. >o appli+ation for registration shall #e a++epted !nless all the foregoingre!ire%ents are +o%plied with. "he +ontra+tor or s!#+ontra+tor shall #e dee%ed registered!pon pay%ent of a registration fee of P1. to the &egional ffi+e.

    6here all the s!pporting do+!%ents have #een s!#%itted* the &egional ffi+e shall deny or approve the appli+ation within seven () worAing days after its filing.

    Upon registration* the &egional ffi+e shall ret!rn one set of the d!ly,sta%ped appli+ationdo+!%ents to the appli+ant* retain one set for its file* and trans%it the re%aining set to theB!rea! of Lo+al E%ploy%ent.
