The dog days of summer are upon us. My English bulldog, Dudley, takes one step out onto the front porch for his walk, realizes the temp has increased 30 degrees, and promptly drops with an audible splat, but with August heat comes the anticipation of fall events. For LBA, that means the Bench Bar Conference, to be held once again at the magnifi cent Roosevelt Hotel in New Orleans from Thursday September 8th to Saturday, September 10th. Roger Goodell with the NFL accommodated our request to schedule the Saints for Thursday night to coincide with our opening party at the outdoor pool area of the Roosevelt. Football, cool drinks, hot food and good friends. What a way to open the event.

The Friday CLE promises to be entertaining as well as informative. We will still start with breakfast with the Judges, but Event Chairman Joe Giglio came up with a great idea. A Judicial Round Robin will take place with practitioners staying put at their tables and the Judges moving around the room. The CLE will continue with Professionalism Issues from the Bench hosted by Magistrate Judges Michael Hill and Pat Hanna. We will get Senatorial Yarns from local Senators Fred Mills and Mike Michot. For people like me who don’t know what Facebook is or why I should care, there will be a presentation on the use of Social Networking sites for attorneys. There will be a Divorce/Criminal law 101 presentation to help with those basic questions our biggest clients call us with after hours. The day will end with an Ethics presentation to assist all of us in recognizing and dealing with drug and alcohol problems before they can ruin a practice or career. Speaking of the website, check out our newest addition, the membership directory. Now you can locate all our members, along with their contact numbers, practice areas, website addresses, etc. Kudos to Ruthie Toce for making this a reality.

Along with Bench Bar, we have a general membership meeting scheduled on October 5th at the Petroleum Club. The candidates for the Family Court seat on the District Bench will join us for a forum. There is much more already on the calender for the fall. The Young Lawyers Section will change leadership at a LaFonda gathering. Incoming President Larry Curtis will be installed on November 3rd. The year-end CLE extravaganza is being planned. All this is made possible by a committed, active and responsive membership. I’m proud to be part of this Association.

Greetings members! How was your Summer? Hope it was great! In June, I had the opportunity to attend the Louisiana State Bar Association’s annual meeting in Las Vegas where our very own, Mr. Jimmy Davidson was sworn as President of LSBA, Ms. Maggie Simar was sworn in as Secretary of the LSBA Young Lawyer Section and Mr. Will Montz received the Young Lawyers Section Pro Bono Volunteer of the Year award. While Vegas was great, and staying at the Wynn was amazing, the icing on the cake was being able to proudly introduce myself as the Executive Director of the Lafayette Bar Association!

This issue of the Promulgator features marketing information for various events on the horizon at your local bar association. Mr. Steven Ramos will be sworn in as President of our Young Lawyers Section on August 25th at LaFonda’s, Judge Haik will open his Cypremort Point Camp, Camelot to hold our annual Maritime CLE on August 25th and 26th, we head to NOLA on September 8th for our annual Bench Bar Conference and fi nally we will host a judicial candidates forum on October 5th for the judges running for the open family court seat. All of these events off er you an opportunity to get more involved with your local bar association, something that you will fi nd is good for your well being!

As I close this issue’s column I am reminded of a recent article I read on changes in the way people communicate. Either cell phones, texting, email and the ever important facebook. I want to let each of you know that we enjoy hearing from you and encourage you to communicate with us. Whether it be on a membership issue, a new idea, or “friending” the LBA on facebook so we can track the important happenings in your life. Our members are the lifeblood of this organization and I know I speak for my staff when I say this that this more than a job for us; we consider each of you a part of our extended family.

This November will mark the 3rd anniversary of the opening of the Lafayette Bar Headquarters. Purchasing a building was a milestone in the history of the Lafayette Bar Association. Ownership comes with a price and it would not have been possible without the generosity of local law fi rms and the dedication of numerous bar leaders.

Having our own facility has forever changed our organization. It has brought about so many positive changes. A few of which need to be shared with the membership.

The building has increased access to justice for residents in Lafayette Parish. On a monthly basis the Lafayette Bar Association has approximately 150 people who access the offi ce for various legal needs and issues. That breaks down to about 6 people a day that we are able to serve in some manner every day. Whether they accessing our Pro Se Kiosk, need to look something up in the library on Westlaw (free service to members and the public), or wanting pro bono representation from Lafayette Volunteer Lawyers our building provides them with a vital resource that is unmatched in our community.

The building has also increased benefi ts to our members. All committee and section meetings are held at the LBA offi ce. This equates to about 5-7 standing monthly meetings. These meetings are comfortable, effi cient and more cost eff ective than meeting at a local restaurant or alternate venue in town as was the norm previously.

Rental fees from mediation and depositions fees have steadily increased. On average the offi ce hosts 4-6 mediations and 2-6 depositions per month. These fees have all been used to pay down the building note and help to bring us closer to a paid for facility.

The facts and statistics do not even account for the increased visibility of our organization to members of the Lafayette Community.

The Bar Headquarters has become the symbol for the legal community in Lafayette. Each one of us should take pride that the building was indeed a good investment for our Association and will serve our organization’s needs for many years to come.

Everyone has heard the saying, “What happens in Vegas stays in Vegas”, well I am proudly breaking tradition to share with each of our members the happenings at the recent Louisiana State Bar Association’s (LSBA) annual meeting in June at the Wynn Resort. Lafayette’s own, James Davidson III, with Davidson, Meaux, Sonnier, McElligott, Fontenot, Gideon & Edwards was sworn in as the 71st President of Louisiana State Bar Association. A special brunch was held in Jimmy’s honor to celebrate the momentous occasion complete with mimosas, bloody mary’s and a heartfelt video tribute to Davidson which included photos from his younger days of fishing, hunting and spending time with his children.

Other LBA members in attendance included: Andre’ Doguet, Nora Stelly, Joel Gooch, Joe Giglio, Buzz Durio, Maggie Simar, Tricia Pierre, Cynthia Simon, Joe Oelkers, Pat Ottinger, Lisa Hanchey, Barbara Olinde, Franchesca Hamilton-Ackers and Ariel Campos.

Lafayette was also honored to have LBA Board member, Maggie Simar installed at the Secretary of the Young Lawyers Section for the Louisiana State Bar Association. As Secretary, Maggie will represent the needs of younger attorneys and encourage participation in the LSBA. Maggie and other LSBA offi cers were installed by the Honorable D. Kent Savoie.

In addition to Maggie’s installation as an LSBA young lawyer offi cer, LBA member Will Montz with Laborde and Neuner received Outstanding Pro Bono Award. This award is given out annually to only one young lawyer in the state of Louisiana who has demonstrated an outstanding commitment to pro bono service. Montz was honored for his tireless eff orts in working with Lafayette Volunteer Lawyers assisting more than 60 clients in the last fi ve years.

The LSBA annual meeting concluded with an elegant dinner reception topped off by an appearance from old blue eyes himself, Mr. Frank Sinatra. Music carried throughout the elegant ballroom while Frank entertained and delighted us as we all became dancing strangers in the night.

It is with great joy (and sadness)that I write my last LYLA President’s Message. They say time fl ies when you are having fun. For all of you who have made it out to our fabulous LYLA events this year, you know just how much fun we are having. Our social committee outdid themselves for our LYLA Summer Law Clerk Social on July 21st at Jeff erson Street Pub. Summer law clerks and lawyers, young and young at heart, enjoyed refreshing drinks and splendid conversation during our evening of live social networking. I encourage you to support our sponsors by utilizing their services. LYLA events are so successful due to the generous backing of our various sponsors. I extend special thanks to Teche Federal bank for serving as our headline sponsor and to Adam and Jean Paul for a fantastic fi nale to their reign as social chairs. Members and non-members alike are locked and loaded for the 2011 Shoot for Justice Sporting Clay tournament benefi ting the Lafayette Parish Bar Foundation’s LVL program on August 6th

at GOL Shooting Range. LYLA applauds Jacob Hargett for his assistance in getting us on target for this event.

The Louisiana State Bar Association Young Lawyers Section, joined by the Lafayette Young Lawyers Association, will host another Wills for Heroes event in September benefi ting the Lafayette Police and Fire Departments. Free wills and other estate planning documents will be provided. Volunteers are needed once again. Please be on the lookout for details.

Speaking of local heroes, our very own Steven Ramos will be taking over the leadership of LYLA. Please join us for his

installation banquet at La Fonda’s on August 25th from 6:30 to 8:30 pm. This LYLA tradition is always a crowd pleaser so be sure to save the date and get there early to make the most of the margaritas and camaraderie!

Thank you to all of our members for your participation and support of LYLA events and programs. I encourage all of you to get involved in some way with LYLA. It is a terrifi c opportunity to meet wonderful people, do great things and gain valuable leadership experience. LYLA meetings are held on the second Tuesday of the month at noon at the LBA offi ce and are always open to the general membership.

It has been an amazing year and I have thoroughly enjoyed serving as your president. I am extremely grateful for the hard work and dedication of our Bar staff . A special thanks to Susan and Ruthie for their never-ending support and assistance. Thanks for making me look marvelous, darlings!

On Thursday, July 21st, Lafayette attorneys, law clerks and judges gathered at Jeff erson St. Pub downtown for drinks, camaraderie and networking. Thanks to sponsorship from Teche Federal Bank and their Young Professionals loan program and many other generous sponsors, the event was a success with over 60 people attending and just under 20 of those being law clerks coming to learn more about the bar association and to meet other attorneys and their guests. If you represent injured clientsin connection with either Workers’ Compensation or personal injury claims, the question of whether and when a client should apply for Social Security Disability Insurance Benefi ts (“Disability Benefi ts” or “Benefi ts”) is sure to arise. This article briefl y addresses several signifi cant, albeit relatively obscure, federal statutes and regulations that should be considered in deciding when to fi le an application for Disability Benefi ts under Title II of the Social Security Act (the “Act”). The Act

provides for payment of Disability Insurance Benefi ts, and just like an insurance contract, the Act has strict parameters limiting coverage. Failure to consider these parameters can cause an applicant to be time-barred from receipt of Benefi ts, to sacrifi ce a period of entitlement to Benefi ts, or to experience a lengthy delay in Medicare eligibility.

Title II of the Social Security Act, 42 U.S.C. § 401, et seq., provides for payment of Disability Benefi ts to individuals who are disabled within the meaning of the Act and who are insured under the Act by virtue of their contributions to the Social Security trust fund through Federal Insurance Contributions Act (FICA) taxes. In general, to be found disabled under the Act, a claimant must be unable to perform his or her past work or a signifi cant number of other jobs in the national economy because of medically-determinable mental or physical impairments that will last for at least one year. 42 U.S.C. § 423(d); 20 C.F.R. § 404.1520. If it appears likely that a client’s injuries will keep him or her out of work for a full year, the question then becomes when he or she should fi le an application for Benefi ts.

Workers remain eligible for Benefi ts for only a limited period of time after leaving the workforce. 20 C.F.R. § 404.130. To be eligible for Benefi ts, a worker must be insured under the Act. Attaining disability insured status for those over 31 years of age requires 20 quarters of coverage out of the 40 calendar quarters before they became disabled. Id. A worker maintains eligibility for Benefi ts through consistent employment and payment of FICA taxes, but even with consistent employment for the 5 year period prior to being injured, a worker maintains eligibility for Benefi ts for a maximum of 5 years after leaving

the workforce. Id. The eligibility period may be shorter for workers who become disabled under the age of 31, have a previous period of disability, have not maintained consistent employment, or have not consistently paid FICA taxes. If there is any doubt about how long your client remains insured for Benefi ts, the client can inquire as to the duration of his or her disability insured status at the local Social Security Administration (SSA) offi ce.

Workers who fi le for Disability Benefi ts more than 17 months after becoming disabled may sacrifi ce one or more months of Benefi ts due to restrictions on retroactive Benefi ts. Disability Benefi ts can be paid up for up to one year prior to the application date. 42 U.S.C. § 423(b). In addition, there is a 5-month waiting period following the date of disability during which Disability Benefi ts are not payable. 42 U.S.C. § 423(c)(2). In other words, for the fi rst 5 months after a worker is deemed disabled, no Benefi ts are paid. Benefi ts start in the sixth full month of disability. The 5-month waiting period operates with the one-year retroactivity period to create the 17-month fi ling

When Should Injured Clients Apply for Social Security Disability Insurance Benefits?

benchmark, which can cause unaware applicants to sacrifi ce benefi ts to which they would otherwise be entitled. For example, an insured worker who sustains disabling injuries on January 1, 2011, and who fi les an application for Benefi ts no later than 17 months thereafter could begin receiving Benefi ts on June 1, 2011. In contrast, if the same worker fi les an application 24 months after the injury, or on January 1, 2013, the worker could begin receiving benefi ts only as of January 1, 2012. In the second example, the worker sacrifi ced 7 months in Benefi ts due to the delay in fi ling.

If an injured worker is receiving Workers’ Compensation (WC) benefi ts, then Disability Benefi ts otherwise due for the same period may be off set or reduced. 20 C.F.R. § 404.408. The application of the off set provision is a fact-specifi c inquiry that depends on the worker’s past earnings and the amount of WC being received. Regardless of whether a worker’s Disability Benefi ts would be off set by receipt of WC, it remains important to establish the earliest possible disability onset date with SSA to avoid jeopardizing your client’s eligibility for Medicare.

Medicare is government health insurance available to those over 65 years of age or who are disabled under the Act. After receiving Disability Benefi ts for 24 months,

workers are eligible for Medicare. 42 U.S.C. § 426(b)(2)(A). Of course, due to the 5-month waiting period for receipt of Disability Benefi ts, eligibility for Medicare begins 29 months after the established onset of a worker’s disability. Thus, even if the WC off set may reduce a worker’s monthly Disability Benefi ts, it is still important to timely fi le in order to start the clock on the 29-month waiting period for Medicare eligibility.

In conclusion, in advising disabled clients when to apply for Social Security Disability Insurance Benefi ts, in is important to know when their disability insured status expires, that fi ling for Benefi ts more than 17 months after becoming disabled may lead to the loss of a period of Benefi ts, and that even if subject to off set, establishing eligibility for Disability Benefi ts commences the lengthy waiting period for Medicare eligibility. Dodge, Dip, Duck, Dive and Dodgeball! The Giles Automotive Lafayette Corporate Dodgeball Tournament was held on Saturday June 18, 2011 at the Cajun Dome. The Lafayette Bar Association held its annual bowling tournament, this year with a fun “Jamaican Me Crazy” theme, on Friday, June 3rd. Lafayette area judges, legal staff, lawyers, and their families were invited to the event in order to help raise over $5,000 to benefit the community through the Lafayette Parish Bar Foundation programs. Through funds raised at events like the bowling tournament, these programs help underprivileged members of our community with legal matters they would otherwise be powerless to handle.

New Orleans - The Louisiana State Bar Association (LSBA), in conjunction with the Louisiana Supreme Court, hosted the 26th Annual Pro Bono Awards Ceremony on May 24th. The ceremony was held in the Louisiana Supreme Court Building in New Orleans, and was followed by a reception. The Pro Bono Awards Ceremony honors attorneys and other public interest legal professionals from around the state who provided exceptional pro bono services to Louisiana’s indigent, who may not otherwise have received adequate

representation or access to the legal system.For the second year, the Pro Bono Century Award was also handed out. This award recognizes attorneys that have shown consummate pro bono leadership by completing o n e - h u n d r e d hours of service from January 2010 through December 2010.

History of Vermilion Parish Told Through

Author Warren A. Perrin, local historian and cultural preservationist, served as president of the Council for the Development of French in Louisiana (CODOFIL) from 1993 to 2010 and is a native of the parish. He presents the history of Vermilion Parish through its citizens: families, farmers, students, ranchers, fi shermen, educators, musicians, and politicians. Always friendly and often colorful, the people who make up the intricate tapestry of the area tell the beautiful story of Vermilion Parish’s rich history.

The newest addition to Arcadia Publishing’s popular Images of America series is Vermilion Parish from local author Warren A. Perrin. The book boasts more than 200 vintage images and memories of days gone by.

Vermilion Parish is a region with fascinating history and culture.
