The past 2 months have flown by for me. Our wonderful community has so much to offer that it seems to help accelerate time. An outdoor activity as simple as biking or fishing helps tick time away. I hope you have had an opportunity to get out and enjoy all our community has to offer. We truly live in a very special place! All our wonderful amenities do come at a cost. The Board of Directors, Management, and Committees have been looking at the next budget year. Projects and priorities are being established as we speak. Your input is very important in this process. You, the member, will have several opportunities to have input at individual committee meetings, the Finance Committee budget meeting, and as always, the Board of Directors Meeting. I hope you take some time and review the proposed budget and provide your input. We are also seeking members to serve on the Nominations Committee. I had made this request in the last edition and we are still seeking members to serve. This short-term commitment plays a pivotal role in who will represent the members for a 3-year term on the Board of Directors. If you are

willing to assist your association with this task, please contact the office. Have you considered being a member of the Board? Now is a great time to submit your name to the office so that the Nomination Committee can contact you. The Board of Directors each chair one committee and then represent that committee at the Board level. Meetings will vary, but on average, you would have 2-3 meetings per month. Working to ensure solid policy, sound financial decisions, and working with the membership are a few of the roles of a Board member. Your Board of Directors are hard at work and we would like to hear from you. Please consider joining us for a Board meeting on the 3rd Monday of the month at 8:00 p.m. in the conference room. If you are unable to join us send an email or letter and we will review and respond in our minutes. We also have many Committee meetings and those dates and times can be found on lakemeade.org.

Budget Review: The proposed 2020-2021 Operating and Capital Budgets will be reviewed with the members on Monday, December 9, 2019 at the Finance Committee meeting held in the Community Center starting at 6:30 p.m. Save the date and take advantage of this opportunity to ask questions of the budgets.

When guests arrive at the gatehouse, they are to provide the name of the resident they are visiting and their address. If that checks out, the gate employee will open the gate and the guests will be able to proceed and follow the posted traffic signs. Periodically the gate employee will call you to confirm that your guest has arrived.Two specific times you need to contact the gatehouse 717-259-0823:• IF GUESTS are arriving between

midnight and 6:00 a.m. Please call the

gatehouse ahead to advise of your guests’ arrival time. If this doesn’t happen, the employee will try to contact with the number on file or if the guest has a number to reach you. If they cannot connect, your guest will be turned away.

• Also, if a towing company is scheduled to arrive at your residence, please call the gatehouse. Most times they arrive at the request of the owner, but there are times that towing companies attempt to come in to repossess. If there is no prior notification and the gate employee cannot reach you to confirm admittance, the towing company will be turned away.

Gate Employees ask that you take precautions and obey the traffic control signs:• Leaves on the road and inclement weather

could make for slick road conditions.• Drivers in the left lane must yield to the

right lane.• NO Right Turn from the left lane. If travels

take you to McClellan Drive and other roads to the right of the entrance area, you need to go to the bottom of the hill and turn right. Please notify your guests prior to arriving.

MANAGER’S REPORT:

Attention: Annual Lake Draw Down is November 15, 2019.

The PA Department of Environmental Protection, Wetlands and Waterways Program (DEP-WWP) requires lake front properties planning shoreline, seawall or dock projects to obtain a general permit from the DEP-WWP office prior to starting the project. These types of projects also require LMPOA Lake Committee review and approval by the LMPOA Building Committee. When the Building Committee approves the project, a Letter of Compliance is issued to the member. Depending on the scope of the project, the property owner may then be required to submit the plans to the township for a building permit and also obtain an Adams County permit. Property owners considering any type of shoreline, seawall or dock projects should plan well in advance, as the approval process with the various entities will take time to complete. The lake level will be lowered beginning November 15 this year. It takes approximately two weeks to draw down the lake to its winter level. The LMPOA Rules and Regulations state the following: “The lake will be drawn down to 494 feet above sea level (lowered six feet) on November 1st in years ending in 5 and 0 and November 15th in other years. This level will be maintained by opening and closing of the valve. The valve may be opened after February 1st only by approval of the Board of Directors.”

NOTE: Please be sure to remove your watercraft before the lake level starts to drop. Lake Meade Rules and Regulations IV, 2. Docks, d. states, “All boats must be removed from docks, boat racks, and launches by November 15 and cannot be moored at docks or put on boat racks and launches until March 1.”

Lakefront property owners - The time to do shoreline work is while the lake level is down. Prevent soil erosion into the lake by using concrete, rock or heavy stone that is environmentally safe, especially to aquatic life. Riprap must extend a minimum of twelve 12” above the normal high water mark and at least 12” below low water mark or to the bottom of the lake. Construct docks to be able to withstand ice. Property owners considering any type of shoreline, seawall or dock projects should plan well in advance. Department of Environmental Protection (DEP) approval is required, and the process takes time to complete. Each project is different. Dealing with the property owner one-on-one, DEP-Wetlands and Waterways Program can better assist you with figuring out which permit you will need for your project. Shorewood Retreat Docks Stabilization and Expansion Project: A project will get underway during the winter months to reconstruct and stabilize the docks at Shorewood Retreat and to add eight (8) dock slips.

The leaf collection dumpsters are back! NEW LOCATION AT FIREHOUSE PARKING LOT. Please remember to only dump leaves and small bundles of yard brush (bushes, plants, etc.) Sticks cannot exceed 1” diameter and 12” length. No bags or trash are permitted in the leaf collection dumpsters.

Snow Plowing: LMPOA plow trucks and snow bucket clear the roads for traffic flow. Property owners are reminded to clear around your mailbox for the benefit of the postal carrier to deliver your mail and to clear the entrance to your driveway.

Republic Services, Inc. will pick up Christmas Trees as part of regular weekly trash pick-up. Simply place your Christmas tree next to your household trash at the road. You can also contact Dean Shank to pick up your tree (717-476-3501). Dean’s goats enjoy munching on Lake Meaders’ Christmas trees!

COLLECTION/DISPOSAL/BURNING: In conjunction with Pennsylvania State law and Adams County regulations, no person(s) shall burn or permit to be burned any substances out-of-doors (including leaf and yard waste) on any residential lot or LMPOA recreation area except for cooking and recreational fires confined to a fire ring, fireplace, charcoal or gas grill, or other similar fireproof container.

~ Lake Meade Garden Club ~ Lake Meade Garden Club is a well-established organization that meets once a month on the fourth Wednesday of the month, usually at 10:00 a.m. We have ten meetings every year which are all educational except for our October Herbal feast. This year we learned about ground covers, ornamental grasses, soil organisms, native plants, fall foliage plants, and container gardening among others. We also did field trips to two local garden centers, and a native plant nursery. If you are a garden enthusiast, but need to learn more about it, please join us. New members are always welcome. Veterans Day, originally named Armistice Day, is a federal holiday in the United States observed annually on November 11 following the cessation of the fighting of World War I. A year after the war ended, Woodrow Wilson declared Armistice Day in remembrance of the signing of the Armistice with Germany on November 11, 1918 at the 11th hour. President Wilson signed a proclamation that, in part read…“A year ago today our enemies laid down their arms in accordance with an armistice which rendered them impotent to renew hostilities and gave to the world an assured opportunity to reconstruct its shattered order and to work out in peace a new and juster set of international relations. The soldiers and people of the European Allies had

fought and endured for more than four years to uphold the barrier of civilization against the aggressions of armed force. We ourselves had been in the conflict something more than a year and a half. The war, now over, gave new meaning of what it was to be an American and to give full honor to those veterans who had fought the battle along with their families and the rest of the nation, the proclamation continued… “Out of this victory there arose new possibilities of political freedom and economic concert. The war showed us the strength of great nations acting together for high purposes, and the victory of arms foretells the enduring conquests which can be made in peace when nations act justly and in furtherance of the common interests

Over nine million U.S. Soldiers served on active duty during the Vietnam era conflict August 5, 1964 to May 7, 1975. Our Veterans Plaque in the community center lists nearly 400 veterans. We are very grateful to our Lake Meade veterans and all veterans for your service. Thank you.

It’s budget time! We will be keeping the Recreation budget at a bit less than the previous year but still trying to stay within the responsibilities of our committee. Much of the budget is devoted to MUSTS rather than needs or wants. In line with the prioritization of LMPOA actions, the October meeting will review and amend the 2020 budget to recommend to the Board. Topping the list are several remediation projects necessary to ensure the safety and quality of our popular swimming pool. Next, in an extra-ordinary request, we hope to receive reasonable bids to remove and replace identified dead or dying Ash trees in the recreation areas. We are establishing the framework for completing the renovation of the sports complex, spring planting for the Entrance sign, and continuing maintenance of the 10 lake-access recreation areas. As time permits, we will be working with two other committees to design signs that reflect the LMPOA mission. Our hope is that October, November, and December meetings will result in a functional roadmap for keeping all recreation areas delightful in 2021. Please join us with your ideas and energies for keeping LMPOA a vibrant community.

Lake Management CommitteeDam Update Over the summer the Board voted unanimously to approve option 3A for our dam rehabilitation and remediation project. Option 3A maintains the existing spillway and adds an auxiliary labyrinth spillway as part of the overall project. This option was the least expensive of the three viable options. We are now in Phase II of a three phase project. Phase II Part I includes geotechnical exploration, lab tests, evaluations/reporting, and additional hydraulic analysis, work that is necessary for developing a preliminary design. Final reports including subsurface exploration, lab tests and evaluations will be forwarded to the PA Department of Environmental Protection (DEP) for review and concurrence prior to Schnabel Engineering preparing the preliminary design. The work involved with Phase II Part I is highly specialized and costly. Costs for this part of our project could approach $300,000. While this part of the project is expensive, LMPOA has been aware of these coming expenses and continues to plan for these and future costs associated with the project. The Lake Management Committee will continue to monitor activity associated with this phase of our project and provide updates through the Lake Meader in the coming year.

GREEN INFRASTRUCTURE WORKGROUP NEWS: LEAVES, LEAVES, LEAVES!

Ash Trees in Lake Meade Ash trees have lived and thrived in Pennsylvania for millions of years. In fact, the Green Ash (Fraxinus pennsylvanica) was named for our State. According to the Department of Natural Resources (DCNR) Pennsylvania has 308 million Ash trees. This invasive insect from Asia, Emerald Ash Borer (EAB), will push our tree population to the brink of extinction because there is no defense against this Asian predator.

What to Do Dying or dead Ash trees are hazardous because the bark becomes very brittle and when the bark falls is can cause injury to buildings and people. Early on, the EAB attacks downward from the top so the roots and lower portion of the tree will be unharmed and will often try to grow new branches, what is called epicormic sprouting. Unfortunately, if treatments are not started the tree should be removed.

Getting Help Other tree species also have 5-9 compound leaves and look similar to all three types of Ash trees, green, white, or black. With the EAB invasion so large, many websites provide details

about how to identify the tree and how to determine if a tree has been infected. When removing a tree, plan to have it replaced with a native tree that fights attacks by invasive insects. Many choices can be found in the pamphlets provided by the Green Infrastructure Workgroup in the Lake Meader and available at the Lake Meade office. The Lake Meade Homemakers club is a fun gathering where you can meet new friends and socialize with your neighbors. At every monthly meeting (held on the second Monday of each month from September through May at the Northeast Adams Fire & EMS – Co. 32 Station 2 building on Lake Meade Drive), we start off with a social time and lunch at 12:30 pm, followed by a business meeting and a program. Topics for our programs vary, and are generated from club members’ suggestions. You are invited to come to any meeting to see if membership might interest you. Dues are a modest $10.00 a year.

UPCOMING PROGRAMS Our 2019-2020 program year began with our September 9 meeting at the fire house and it was well attended. At the Oct 14 meeting our speaker brought us information from the PA Department of Aging. In November we will step back in history to meet a Civil War re-enactor. Our December 9 Christmas party meeting will take place in the Community Center multipurpose room instead of the fire house. The time for this get together will also be different in that we will gather at 10:45 a.m. and begin the meeting promptly at 11:00. Those planning to attend are asked to bring their own table service as well as a covered dish or dessert to share. We will once again be entertained by the Bermudian Springs Eagle Singers.

DANCES The Unforgettable Big Band will serenade us at our annual Fall Dance held in the Community Center multipurpose room.

Tickets are $10.00/person. The date for this event is Saturday November 30, 7 – 10:00 p.m. Proceeds from this dance are donated to local charities designated by the Homemaker club membership. Lake Meade Homemakers will also sponsor a New Year’s Eve Party at the Community Center again this year.

Communications and Technology Committee: Ever Changing Our web site is looking a bit antiquated, right? And, its functionality is limited you say. We hear you, and, fortunately (or not) for us, the company which hosts our web site, and whom we pay for a subscription, is both revamping their software, and planning to substantially increase our monthly charge. So, in keeping with one of our most important goals, budgeting responsibly, we are looking at alternatives to this company. We do have a few months to come up with a plan before this increase is to take effect. The first and most obvious direction is to build a new, more functional and easier to navigate site. Another alternative is to sign on with a company, of which there are many, which specializes in H.O.A. (homeowners association) management software. This would include a highly functional and interactive web site. These packages are standardized to some extent, and we fill in our information, branding, (logos, colors, fonts), and our photos as well as modifying menus to suit our needs. Some of the added functionality may include amenity reservations, a mobile app, community-wide notices, customer service/process tracking, interactive classifieds, and easier to navigate document management than we now have. For our office, there is increased document storage, voting and survey options, voice–automated messages, and role-based access. We continue to compare these options and are now discussing costs and benefits to determine which direction is most appropriate

for Lake Meade. Please consider visiting our committee meetings, scheduled for the first Monday of each month. Also, remember that we are always looking for photos of our community for our Lake Meader covers, and we try to keep them seasonal. We are planning covers well into next year, so we are accepting photos from any season for consideration.

What is a Resale Certificate?

I. What is a Resale Certificate? This article provides general information about Resale Certificates as well as information about the governing documents of LMPOA. Resale Certificates have been required by state law for the sale and purchase of Lake Meade properties since 1997 when the Pennsylvania Uniform Planned Community Act or UPCA became effective. The UPCA specifies what information is to be included in Resale Certificates. Resale certificates are requested from the Association by the person who is selling a Lake Meade property and is supposed to be given by the seller to the buyer of the property sometime after the sales contract is signed but well before closing.

Association Membership and Governing Documents: When someone buys a property in a planned community like Lake Meade, the buyer automatically becomes a member of the Community Association, and in Lake Meade the buyer also pays an initiation fee. All Association members agree to comply with the governing documents of the community; copies of certain governing documents are included in the Resale Certificate along with other information. The community’s governing documents include Deed Covenants (now called the Declaration), and the Association’s corporate documents - Articles of Incorporation, Bylaws, Regulations, and Building Regulations and policies. Association members in good standing are entitled to use the amenities in the community such as use of the lake, pool, recreation areas, community center, and more. It is also important that members participate in the community’s governance, and vote for candidates for the Board of Directors each year. Directors oversee the funding, operation and management of the community; investigate, deliberate and vote on most Association business matters; and lead the strategic planning effort for the community.

Amended and Restated Declaration of Protective Covenants, Restrictions and Easements for Lake Meade, a Planned Community. The Declaration is the community’s most important governing document. It is a real estate document and automatically applies to all lots and owners. Among other things, it includes legal requirements regarding governance, conditions of membership, lot use, ownership restrictions, easements on lots,

use of common facilities, and finances. The Declaration is recorded in the Adams County Courthouse and has been enforced in the courts of Adams County and in Pennsylvania’s appellate courts. It includes covenants and restrictions which are limitations and other standards that relate to use of lots and the community’s common facilities.

Corporate Documents. The community’s other governing documents are the corporate documents of the Association, rather than real estate documents. The most often utilized corporate document is the Bylaws of the Association. The Bylaws cover numerous meeting-related topics, definitions and procedures as well as the powers and responsibilities of Directors and members. The Bylaws include details that explain legal issues and establish standards about voting, membership, meetings, Board of Directors, officers, committees, contracts and funds, records, initiation fees, dues and assessments, amendment procedures, and more. The Bylaws in large part address the governance and operating standards of the community association. The Regulations of the Association contain additional details and procedures needed to implement the requirements addressed only generally in the Declaration and in the Bylaws.

How the Resale Certificate Process Works: The Sales Agreement for a property between seller and buyer gets signed before a Resale Certificate is requested from the Association. State law specifies what must be included in the Resale Certificate, who requests it, and the consequences. A buyer who doesn’t like what is disclosed in the Resale Certificate may terminate the Sales Agreement within a specified time. LMPOA currently charges a $100 fee for issuance of the Resale Certificate, payable by the seller.

What needs to be disclosed in a Resale Certificate? The UPCA contains a list of requirements for Resale Certificates. As part of that list, LMPOA will disclose violations known to the Association to be true at that time. This disclosure is just a notice to a buyer and is not a mandate for the buyer to correct anything. It provides the buyer an opportunity to evaluate future plans for the property. No exceptions or variances are issued based on existing non-compliance.

II. Example - Nonconforming Structures on Lots.

Resale Certificates and Nonconforming Structures: As required by the UPCA, the Association must state in a Resale Certificate anything it actually knows does not comply with the standards imposed by the community’s governing documents. Typical disclosures may relate to the financial obligations that sellers owe to the Association. The Association may also have information confirming that a structure on the lot may be out of compliance, meaning part of a structure is located outside the allowable building area. Certain existing structures may not meet the mandatory setback requirements and encroach into a setback area. Such structures are called nonconforming structures whose owners may be restricted from making certain changes in the future.

Who is responsible for determining or disclosing whether there are any Nonconforming Structures?

• The owner is ultimately responsible. An owner must disclose any known problems on the property to a potential buyer, including any nonconforming structure known to the seller. On occasion, however, an owner may not know about the encroachment by a nonconforming structure.

• The Association does not inspect resale properties. If the Association has reliable information about any compliance problems on a lot, the Association would disclose that information to the buyer in a Resale Certificate. LMPOA would only list known noncompliance issues in a Resale Certificate for any lot. This requirement applies to all planned communities, not just to Lake Meade.

• To be certain about the condition of a property to be purchased, it is highly recommended that all buyers hire licensed professionals to inspect the property thoroughly and to have a field survey done. When a property changes ownership, new property owners are responsible for establishing and knowing the location of their property’s boundary lines.

• A Letter of Compliance was issued for one addition, one garage makeover, one front porch, one deck, one dock, one roof over deck. Letters of Approval were issued for one deck replacement, two fences, one modification to front steps/door, two storage sheds, one window, one garage door, one heat pump replacement, one driveway entry modification, two roof replacements, one storage shed, one underground pet fence. The total number of homes is 1,087.

The Executive committee reports fourteen new members and no new renters for the period July 12, 2019 through September 13, 2019.

Reading Township residents cast their ballots at the Hampton Fire Company just south of the Stoney Point Road and Rt. 94 intersection. The Township is divided into two lists, one for Lake Meade residents and those outside of Lake Meade. For addional information, contact the Voter Registration office at 337-9832. Latimore Township voting place is at the Latimore Township Office. Take Rt. 94 North to Rt. 15 North until you pass the convenience store/gas station and then make the first right turn to the Township Office.

LMPOA Finance Committee Update November 2019 It is hard to believe that we are more than

halfway through your association’s fiscal year. There has been a lot of planned items impacting the financial status of LMPOA. I am sure you notice most of them as you drive around the community and while using its amenities. While these upgrades cost your association money, they bring value to you and your community. The good news is that your association plans for these items to ensure your money is spent wisely. The even better news is that your association remains financially strong while maintaining a great place to live. The planning for our community never stops. This is the time of year that we start to budget for the next fiscal year. As a reminder, our fiscal year runs from April 1 – March 31. Community upgrades and needs are already being discussed at the committee level. Committee members recommend items they would like to see considered for next year’s budget. Those items are compiled by the finance committee and ultimately vetted by the board of directors. Community input is encouraged at any time during this process and meetings are open for members to attend.

The following is an outline of the budget process:• September & October – all committees discuss their

budget requests and send to finance committee• October & November – finance committee compiles

requests into capital and operating budgets• November & December – finance committee and the

board of directors create a preliminary budget• December – finance committee presents the preliminary

budget to members• January – additional input from members is reviewed and

a final budget is approved by the board

If you want to learn more about where your money is spent, please come to a finance committee meeting or a board meeting. Your input is always welcome and receiving firsthand knowledge of the association’s finances is strongly encouraged.

Boating Safety Education Certificates are required for persons born on or after January 1, 1982 to operate boats powered by motors greater than 25 horsepower. LMPOA is offering a course on Saturday, January 11, 2020. It will be held in the Community Center from 9:00 a.m. to 3:00 p.m. Please sign up at the office (717-259-9625) by providing your name, address and phone number. The instructor will be Rachael L. Thurner-Diaz, Waterway Conservation Officer Southcentral Region, Pennsylvania Fish & Boat Commission. There is no cost to attend the course. At the end of the course there is a test. If passed, a form is given to complete and mail to the state along with a $10 fee for the certificate. Practicing safe boating in Lake Meade is very important.

LMPOA has three types of governing documents: Declaration of Covenants that are “attached” permanently to the property as part of the deed, By-Laws that define how LMPOA is organized and governed, and Rules and Regulations that spell out the details of what is permitted within Lake Meade.

The initiation fees paid by new LMPOA members are used to fund capital investments and their repairs and replacements. Capital items include major items that last many years, such as buildings, equipment, pool, roads, bridges, and the dam.
