The Landfill Alternatives Financial Assistance Program is intended to reduce the amount of solid

this is through providing financial assistance for the purpose of implementing waste reduction, recycling and reuse, research and development, demonstration, market development and other types of solid waste management projects.

There is a preference for projects involving regionahtion. That is, projects involving two or more units of local government or public or private groups. Through the cooperative provision of alternative solid waste management services, a project's impact may have a sigdlcant influence on such factors as, but not limited to, operational efficiency, materials diversion, and materials market value.

Through public - private partnership, we can create an effective and lasting recycling system in the State of Iowa.

The predecessor of the Landfill Alternatives Financial Assistance Program, the Landfill Alternatives Grant Program, has assisted in the elimination and diversion of approximately 225,000 tons of solid waste fkom Iowa landfills between 1990 and 1993. The impact of the Landfill Alternatives Grant Program will continue as projects that received h d i n g continue and expand operations. The program promoted recycling and source reduction and assisted in altering peoples attitudes about managing solid wastes. Funds were also committed for education projects, composting projects, combustion projects and market development projects. Through December 1993, the Landfill Alternatives Grant Program provided approximately $16.5 million in grant assistance to 144 projects. The Landfill Alternatives Grant Program has had an impact on the solid waste stream in every Iowa county.

The L a n m Alternatives Financial Assistance Program provides hancial assistance for the implementation of education programs, waste reduction projects, and solid waste management projects for the purpose of reducing the amount of solid waste generated and the amount of solid waste disposed of through landfilling.

The Landfill Alteynatives Financial Assistance Program was developed in response to the evolution of waste reduction, recycling, and other landfill diversion activities currently in place across the state. The Department of Natural Resources established an advisory committee with members representing the Environmental Protection Commission, counties, municipalities, business and industry, regional councils, and solid waste associations. The objective of this advisory committee was to offer input on how the former Landfill Alternatives Grant Program could best reflect current and fiture solid waste management issues and market development for recycled materials through landfill alternatives projects. The resulting Landfill Alternatives Financial Assistance Program is administered by the department of Natural Resources and replaces the Landfill Alternatives Grant Program.

Roots of the Landfill Alternatives Financial Assistance Program are found in the 1987 Groundwater Protection Act that established a solid waste policy which includes a hierarchy of solid waste management options. The solid waste hierarchy places waste reduction at the source as the most preferred method of solid waste management. Recycling and reuse are the next most preferred methods followed by combustion with energy recovery, combustion for volume reduction, and landfilling as the least desired methods.

The 1989 Waste Reduction and Recycling Act took solid waste management objectives fiuther by establishing the goal of reducing the amount of solid waste being landfilled by twenty-five percent (25%) by 1994 and M y percent (50%) by the year 2000 through implementing waste reduction and recyclinglreuse initiatives.

The Landfill Alternatives Financial Assistance Program is governed by Iowa Administrative Code 567-Chapter 209. A copy of Chapter 209 is attached as Appendix B, Page 51, of this booklet. Copies of Chapter 209 are also available upon request fiom the Records Department, Iowa Department of Natural Resources, Wallace State Office Building, 900 East Grand Avenue, Des Moines, Iowa 503 19.

This program is fbnded with landfilled in the State of Iowa.

Amlications:

Applications for financial assistance must be made through the Waste Management Assistance Division and must use the application forms provided in this booklet. There are four (4) separate applications included in this booklet and applicants should follow application instructions for the type of application to be submitted. Application types include: Education Projects; Waste Reduction Projects; Research and Development and Demonstration Projects; and Loan Projects. Application Instructions begin on Page 9. Req~ired forms for all application types are found in Appendix A, Page 3 1. In preparing applications, applicants should follow the format provided for each application type.

Photocopies of the application forms are acceptable, facsimiles are not. An original plus two (2) copies of the fblly completed application must be submitted to the Waste Management Assistance Division by the application deadline identified below. Applications submitted for financial assistance consideration are not guaranteed funding. Financial assistance offers may be less than the 111 amount requested in the application. The Department reserves the right to offer loan assistance to applicants requesting grant assistance.

Prior to developing an application, applicants are encouraged to review the entire application booklet and Iowa Administrative Code 567-Chapter 209, the administrative rules governing this program. A copy of IAC Chapter 209 is attached as Appendix B on Page 51.

Deadlines:

There are two (2) funding cycles per year. Application deadlines are 4:30 p.m. the first Monday in June and 4:30 p.m. the first Monday in December. Fully completed applications must be received by the Department of Natural Resources by the identified deadline to be considered for financial assistance in that round. Only applications received by the deadline will be considered for financial assistance during that funding cycle. A new application must be fled for any application that did not receive hding in a previous funding cycle. Applications must be completed following the application procedures identifled in this booklet. Applications are open to the public for review upon request.

Eligiile applicants include any unit of local government, public or private group, business, or individual with an interest in or having responsibility for solid waste management in Iowa. EligMe applicants must be in compliance with all applicable Department statutes and regulations at the time applications are submitted to the Department.

Ifan applicant is selected to receive financial assistance through the Landfill Alternatives Financial Assistance Program, the financial assistance may later be denied ifit is determined that:

e3 the project will be located or implemented in an area or areas that do not have an approved solid waste comprehensive plan;

r23 the project will be located or implemented in an area or areas that have not submitted a subsequent solid waste comprehensive plan by the assigned deadline;

The goal of the Landfill Alternatives FinanciaI Assistance Program is to reduce the amount of solid waste generated and the amount of solid waste lanmed. Therefore, with the exception of certain waste reduction and composting projects, projects targeting solid waste materials currently under a state landfill ban are not eligible for funding through this program. Local landfill bans will not affkct eligiblity of a project or the eligibility of targeted solid waste materials.

ADRlication Review and Selection Process:

The review of applications will be conducted by a three (3) person committee comprised of staff fiom the Department of Natural Resources. The review team evaluates each application based on the criteria identified in this application booklet for each application type and the completeness of the application forms. Application review and selection process is conducted as follows:

Review team members individually evaluate applications received by the established deadline. Ifan application is determined to be incomplete, the review team may reject the application.

Once individual application review has been completed, members of the review team meet to discuss each application. A list of recommended projects is forwarded to the Administrator of the Waste Management Assistance Division.

Recommendations are finalized, applicants are notified and contract negotiations may begin. Contracts for financial assistance in excess $25,000 must be approved by the Environmental Protection Commission prior to the Department holding a contract meeting with the applicant.

Applicants not selected for financial assistance will be notitied as soon as possible after award decisions have been made.

Award Disbursement and Contract Reauirements For Selected ADDlicants:

The Department and the applicant will enter into a contractual agreement. The length of the contractual agreement will vary depending on the type of project to be implemented. As part of this agreement, the recipient agrees to provide project updates and a final report. Project management guidelines will be provided in the contract. Reporting requirements include, but are not limited to, project expenditures, activities, and accomplishments. All information gained through the project will be considered public information.

Some projects may require obtaining or mending a sanitary disposal project permit through the Department. This permitting process may involve the completion of a solid waste comprehensive plan addressing the State of Iowa's solid waste management hierarchy For information on sanitary disposal project permits and solid waste comprehensive plans, call 515-281-8941.

Grant funds will be awarded on a reimbursement basis after a correctly completed state claim voucher and supporting documentation has been received by the Department. The Department will issue reimbursement payments to the grant recipient only. Grant recipients are responsible for making necessary payments. Project costs incurred prior to an executed contractual agreement for which reimbursement will be sought, is considered ineligible for funding. Five percent (5%) of each claim voucher submitted for reimbursement will be retained by the Department until all obligations identified in the contractual agreement have been satisfied, as determined by the Department, and the final report has been approved. At that time, a claim for payment may be submitted and the retained fiinds will be released.

Loan finds will be made available periodically as project implementation progresses and as identified by the milestones set forth in the contractual agreement between the recipient and the Department. Loan funds will be released upon the Department's receipt of a correctly completed claim voucher, supporting documentation and project implementation is progressing to the satisfaction of the Department and as identified in the contractual agreement.

The term of all loans will be established on a case by case basis. Repayment of loan h d s will begin within one year after the first claim for loan moneys has been submitted to the Department and loan moneys have been released to the recipient as a result of that claim. Loan funds will be repaid, at a minimum, in equal quarterly payments made to the Department until the loan is retired.

If, at the time of the contract meeting, the applicant negotiates to substantively alter the project as proposed in the application, any financial assistance offer may be rescinded by the Department. Projects selected to receive financial assistance must be initiated within one year fiom the application deadline for the finding cycle in which the application was submitted. Ifthe project is not initiated within this time fiame, any financial assistance offer may be rescinded.

The following are the minimum local cost share requirements as a percentage of the total project cost for each type of application.

Applicants agree to provide a cost share of funds committed to the project. The above table outlines the minimum cost share percentages of the project's total cost. Applicants may provide cash as their cost share of the total project cost. Applicant's cost share may include project expenses for which the applicant will not be seeking financial assistance fiom the Department. Applicants may also use "in-kind" items as cost share of the total project cost that are directly related to implementation and operation of the project. Examples of in-kind items commonly

used as cost share include: existing buildings, existing vehicles, and existing equipment. Applicant cost share can not include funds previously awarded through the L a n a Alternatives Grant Program, the Landfill Alternatives Financial Assistance Program or the Waste Reduction and Recycling Loan Program.

Forms should be placed at the fi-ont of the application when compiling and submitting your application to the Department for consideration. When preparing the evaluation criteria narrative, follow the order the evaluation criteria are presented in the application booklet.

Remonsible Agency Review and Comment:

Every city and county shall provide for the establishment and operation of a comprehensive solid waste reduction program and a sanitary disposal project for final disposal of solid waste by its residents. Comprehensive waste reduction programs and sanitay disposal projects may, be established either separately or through cooperative efforts for the joint use of the participating public agencies. Cities and counties may execute with public or private agencies the implementation of solid waste management programs, collection of solid waste, establishment and operation of sanitary disposal projects.

The agency responsible for providing a comprehensive solid waste reduction program and a sanitary disposal project for final disposal of solid waste by its residents is responsible for preparing a Solid Waste Comprehensive Plan to be submitted to the Department detailing solid waste management initiatives implemented or to be implemented. The Solid Waste Comprehensive Planning Area is the geographical area whose solid waste is accounted for in the responsible agency's Solid Waste Comprehensive Plan.

The applicant must provide a complete copy of the application for review and comment to the agency responsible for submitting an approved solid waste comprehensive plan. The responsible agency is not to screen applications but simply provide comments on the appropriate form included in this booklet. Photocopies of this form may also be used. To receive fufl consideration for hding, a completed Responsible Agency Review and Comment Form must be received by the Department by the deadline identified below.

It is strongly enmuraged that the applicant include the Responsible Agency Review and Comment Form, properly completed by the Responsible Agency, at the time the application is submitted to the Department. However, Responsible Agency Review and Comment Forms will be accepted by the Department until 4:30 p.m., thirty (30) CaIendar days after the stated application deadline. If the Responsible-Agency Review and Comment Form has not been received by this deadline, points will be subtracted &om the overall application evaluation score.

Budpet Information And Guidelines For All ADDlications

Please be clear and concise yet as thorough as possible when completing your application. It is the applicant's responsibility to provide all required information. Applications must follow the order identified for each application type. Deficiencies in project applications may disqualify the project fiom review during the current funding cycle. All required forms are included in this booklet. Be sure to complete all requested information.

The maximum amount DNR will fund for equipment, including fkeight and installation, and supplies is 90% of the actual purchase price. The maxi" amount DNR will fund for construction and buildings is 80%. All other eligible costs are bdable up to 100% of the actual purchase price. Funds will be provided on a reimbursement basis to grant recipients for eligible expenses. Funds will be provided to loan recipients as project implementation progresses.

Eligible costs for reimbursement include, but are not limited to the following: equipment including fkeight and installation, supplies directly related to the project, materials and labor for construction or renovation of buildings, development and distribution of education materials, planning and implementation of educational forums, laboratory analysis costs, and salaries directly related to the implementation and operation of the project. Salaries are an eligible expense but not considered a high priority for fUnding.

Ineligible costs for reimbursement include, but are not limited to the following: rent, taxes, vehicle registration, interest payments, overhead expenses, indirect costs, legal costs,

administration, land acquisition, and insurance premiums. Costs for which payment has or will be received under another state, federal, local or private financial assistance program

contingency funds, office equipment, application preparation, contractual project ~

are ineligible costs. Costs incurred before a contractual agreement has been executed between the applicant and the Department are ineligible for reimbursement. Items previously purchased or constructed for which payments continue to be made are not eligible for hding.

d. Applicant cost share may include items directly related to the implementation and operation of the project funded entirely by the applicant. Applicant cost share may also include in- kind items. In-kind cost share may consist of existing equipment, existing buildings, land, existing vehicles and other in-kind costs directly associated with implementation and operation of the project.

e. Funds previously awarded through the Landfill Alternatives Grant Program, the Landfill Alternatives Financial Assistance Program or the Waste Reduction and Recycling Loan Program can not be used as cost share in a subsequent application.

The following pages discuss application procedures and evaluation criteria for each of the four (4) applications: Education Projects; Waste Reduction Projects; Research and Development and Demonstration Projects; and Loan Projects, Applicants need only provide information required for the type of application to be submitted. Forms to be completed and submitted with the application are found in Appendix A, Page 31. Follow the format outlined for each application type.

Education projects must have as their primary focus, educating the public on such topics as source reduction, recycling and reuse. Education projects must have as a goal, the diversion of solid waste from the landfill.

1. Application Cover Sheet On Form A, complete all information requested.

2. Project Summary On Form By complete requested information and provide a brief description of the project, project justification, project service area, and specific project goals.

3. Project Timetable On Form Cy provide beginning and ending dates for each task or activity required for project completion. Assume that hnc ia l assistance moneys will be available four (4) months after the application deadline when establishing task or activity dates.

4. Budget Summary Sheet On Form D, complete the requested information and supply an accompanying narrative directly behind Form D as identified below. There are limitations to the amount of funding available for certain budget items and there is an overall mini" cost share required of the applicant of 35% for education projects. Refer to Page 10 for h d i n g limitations and guidelines and apply to Form D (Budget Summary Sheet) and the Budget Summary Narrative.

Budget Summary Narrative Provide a concise narrative that provides detail and justification for all items the applicant is seeking financial assistance. The Budget Summary Narrative should include the following Wormation, where applicable. This narrative should be attached to the application directly behind Form D.

a. Discuss equipment needs including, but not, limited to, the rationale or justification for equipment purchases, the type and quantity of equipment, and the capacity of the equipment. Bid documents or price quotes showing the actual cost of the item or items to be purchased with funding assistance must be attached to this section of the application.

b. Discuss building or construction needs for the project. Details on capacity of the structure, a description of the structure and an 8.5" by 11" drawing of the building's floor plan showing materials receiving, flow pattern and storage should be provided. Bid documents or price quotes showing the actual cost of the building or construction involving funding assistance must be attached to this Section of the application.

~- c. Discuss the purpose and need for supplies that will be used in the project including

quantities required.

d. Discuss financial assistance requested for salaries or wages including the number of individuals, tasks to be performed by these individuals, and the rate of pay. Identifjl whether these individuals will be hired specifically as a result of this project or if existing staff will be utilized. Identitj. how the salaries or wages for these individuals will be h d e d after the contract between the applicant and the Department has expired.

e. Discuss and provide justification for financial assistance requested for budget items not identified above.

5. Project Planning, Experience, and Commitment (5 points)

The application must detail all previous planning efforts that have gone into the project. This includes a discussion of all previous planning activities, the parties involved in the project's planning process, conclusions reached during the planning process, and the relationship of the proposed project to other public education programs and solid waste management measures implemented or proposed in the project service area.

The Review Team will evaluate the qualifications and experience of the project staff as it directly relates to the proposed project. A discussion of relevant experience and the function each of the project stafTwill provide in the development, implementation, and operation of the project should be provided.

The applicant's commitment toward continuing the project after the grant should be discussed in detail. This could include a discussion of how the proposed project will be fimded, implemented, anticipated program changes, and changes in the target audience.

6. Project Compatibility and Support (20 points)

LANDFILL ALTERNATIVES FI"CTAL ASSISTANCE PROGRAM

567-209.1(455B, 4553) God. The goal of this program is to reduce the amount of solid waste being generated and the amount of solid waste being landfilled through implementation of solid waste management projects. This goal will be achieved utilizing the following hierarchy of waste management priorities in descending order of preference:

1. Waste reduction; 2. Recycling and reuse; 3. Combustion with energy recovery; and 4. Combustion for volume reduction.

567-209.2(455B, 4553) Purpose. The purpose of this program is to provide financial assistance to eligible applicants for the purpose of implementing education programs and solid waste management projects, to achieve a reduction in solid waste generation and a reduction in solid waste landfilling. Projects receivingfiwxial assistance must address the program's goal as described in 209.1.

567-209.3(455B, 4553) Definitions. '!Applicant" means any unit of local government, public or private group, business or individual

with an interest in or having responsibility for solid waste management in Iowa and is currently in compliance with all applicable Department statutes and regulations.

" W d e management assiskmce" means the waste management assistance division of the department of natural resources established by 455B.483.

"Wbrste re&ction" means practices which reduce, avoid, or eliminate the generation of solid waste at the source and not merely the shiftiig of a waste stream fiom one medium to another medium.

567-209.4(455B,-455E) Role of the department of natural resources. The department is responsible for the administration of fhds for projects receiving h c i a I assistance under these rules. The department will assure that funds disbursed meet guidelines established by the groundwater protection Act and the waste management authority Act.

567-209.5(455B, 4553) Funding sources. The department will use funds appropriated by the legislature and other sources that may be obth-ed-for the purpose of achieving the goals outlined in these rules. The department will ensure that moneys appropriated meet both federal and state guidelines pertaining to their use.

567-209.6(455B, 4553) Eligible projects. The department may provide financial assistance to applicants for the following types of projects that are consistent with the goal and purpose of this program:

1. Public education; 2. Waste reduction; 3. Recycling and reuse; 4. Research and development; 5. Demonstration; 6. Market development for recyclable materials; 7. Projects that manufacture products with recycled content. 8. Environmental testing related to various landfill alternatives for solid waste. Such projects

shall include, but are not limited to, testing air emissions generated by the combustion of municipal solid waste, analysis of the ash generated as a result of the combustion of municipal solid waste, analysis of alternative materials to be used in leachate control.

9. Production of enerm through combustion, including production of tire-derived fuels and refhe-derived fuels; and

10. Combustion for volume reduction;

567-209.7(455B, 4553) Type of financial assistance. The type of financial assistance offered to an applicant is dependent on the type of project and application submitted:

1. Grants will be offered to applicants for waste reduction projects; public education projects; research and development projects; and demonstration projects that are innovative or new to the state of Iowa. 2. Loans will be offered to applicants for all other eligible projects.

567-209.8(455B, 4553) Loans. The tem of all loans, executed under these rules, shall vary on a case by case basis and shall be based on the specific capital costs f'manced, as well as the terms of other financing provided for the project. The written agreement will establish other conditions or terms needed to manage or implement the project.

567-209.9(455B, 455E) Reduced award. The department reserves the right to offer financial assistance in an amount less than that requested by the applicant. In the event that hancial assistance is offered that is less than the amount requested by an applicant, the applicant may be asked to document the impact on the proposed project. Reduced awards shall be offered where it has been determined by the department that:

1. Program resources are insufficient to provide the level of financial assistance requested to all applicants to which the department intends to offer fbncial assistance.

2. The department has determined that the applicant could implement the project at a reduced level of financial assistance and achieve project objectives and this program's goals.

567-209.10(455B, 4553) Fund disbursement limitations. No funds shall be dispersed until the department has:

1. Determined the total estimated cost of the project; 2. Determined that h c i n g for the cost share amount is assured by the recipient; 3. The recipient has submitted thal design plans, if applicable; 4. Received commitments fiom the recipient to implement the project; 5. Executed a written agreement with the recipient; and 6. Determined that the recipient is currently in compliance with all applicable federal, state, and

local statutes and regulations.

567-209.11(455B, 455E) Minimum applicant cost share. An applicant for fhancial assistance shall agree to provide a minimum cost share of funds committed to the project. Financial assistance moneys received by the applicant under these rules or through the Landfill Alternatives Grant Program, are ineligible to be utilized for any portion of the required applicant cost share. Minimum cost share of h d s shall be in accordance with the following schedule:

567-209.13(455B, 4553) Ineligible costs. Financial assistance shall not be provided or used for costs including, but not l i i ted to, the following:

1. taxes; 2. vehicle registration; 3. overhead expenses; 4. indirectcosts; 5. legal costs; - 6. contingency finds; 7. application preparation; 8. contractual project administration; 9. land acquisition; 10. costs for which payment has or will be received under another federal, state or private

11. costs incurred before a written agreement has been executed between the applicant and the financial assistance program; and

To receive consideration under these rules, applications submitted to the Department for financial assistance must be provided to the agency responsible for submitting an approved solid waste comprehensive plan or subsequent plan for agency review and comment. Responsible agency review and comments are required from the area in which the proposed project is located or the area or areas in which the proposed project will be implemented.

Separate selection criteria and separate application forms will be used to evaluate projects. The separate selection criteria .are identified below for the four applications: education projects; waste volume reduction projects; research and development and demonstration projects; and projects eligible for loans as identified in 209.7.2. For each application type, points assigned to the selection criteria total 100 points. The Department shall evaluate applications and applicants will be awarded financial assistance based on the following selection criteria:

209.14(1) Education Project Selection Criteria a. Project planning, experience, and commitment. Previous planning efforts, experience of

involved parties, other public education programs implemented or proposed, and commitment toward continuing the project after the grant (5 points);

b. Project compatibility and support. Documented consistency with local and regional solid waste comprehensive plans, responsible agency review and comment forms correctly completed and received, compatibility with existing and proposed solid waste management programs, the degree to which the proposed project reflects the state solid waste management hierarchy, and documented project support (20 points);

567-209.15(455B, 4553) Written agreement. Recipients shall enter into a contract with the department for the purposes of implementing the project for which financial assistance has been awarded. The contract shall be signed by the department director, the administrator of the waste management assistance division, and the authorized officer of the recipient. In cases where the Department has awarded a loan, the recipient will be required to make regularly scheduled installment payments to retire the loan as identified in the executed contract. The recipient will be required to submit periodic progress reports as identified in the executed contract. Progress reports are considered part of the public record. The department may terminate any contract and seek the return of any fhds released under the contract for failure by the recipient to perform under the terms and conditions of the contract. Amendments to contracts may be adopted by written consent of the department director, the administrator of the waste management assistance division, and the authorized officer of the recipient.

567-209.16(455B, 4553) Applications. Applicants shall submit applications on forms provided by the Department. Applications will be due the first Monday in June and the first Monday in December each year at 4:30 p.m., unless otherwise designated by the waste management assistance division. Applications received by the waste management assistance division d e r the stated deadline will not be considered for funding during the current finding period, will not be retained for future consideration, and will not be returned to the applicant. It is the applicant's responsibility to resubmit a completed application for fhding consideration during a subsequent funding period. Applications must be submitted on forms supplied by the department and applications submitted are considered part of the public record.

567-209.17(455B, 4553) Financial assistance denial. An applicant may be denied financial assistance for any of the following reasons: 1. Funds are insufficient to award financial assistance to all qualified applicants; 2. An applicant may not be eligible to receive financial assistance if the area in which the proposed

project is located or the area or areas in which the proposed project will be implemented does not have an approved solid waste comprehensive plan, or if the area in which the proposed project is located or if the area or areas in which the proposed project will be implemented have not submitted a subsequent solid waste comprehensive plan by the assigned deadline, or if the area in which the proposed project is located or the area or areas in which the proposed project will be implemented has a landfill which is not legally permitted;

3. An applicant does not meet the definition of "Applicant", as defined in 209.3; 4. An applicant does not meet eligibility requirements pursuant to provisions of rules 209.8(455BY

5. An applicant does not provide sufficient information requested in the application forms

6. An applicant that has previously received a loan under these rules and is determined, by the
