Decree on

The Endorsement of the [Business Activities under] the Controlled Business List and the

Concession List of Lao PDR

- Pursuant to the Law on Government of Lao PDR (Amendment) No. 04/NA, dated 08

November 2016;

- Pursuant to the Law on Investment Promotion No. 14/NA, dated 17 November 2016;

- Reference to the Proposal Letter from Ministry of Planning and Investment No. 2994/

MPI.INV4, dated 29 November 2018.

Prime Minister of Lao PDR Decrees:

Article 01: To endorse the Controlled Business List and Concession List of Lao PDR as per

Annex “A” of this Decree.

Article 02: The Controlled Business List is the list of business activities affecting the national

security; the social order; the good and beautiful national tradition and culture and

environment; society and nature in order to ensure the stable growth of the socio-

economic development. The investment under the Controlled Business List shall

be considered and recommended by the relevant [governmental] agencies. Then,

the Investment Promotion and Supervision Committee, in accordance with the

division of administrative levels, is to approve [such] investment.

As for the Concession List is the list of business activities which the investor is

approved the concession by the Government, mainly, the land concession, the

development of special economic zone and the industrial processing zones for

export, the mining, the development of energy sources, the aviation concession

and telecommunication.

Article 03: The Government promotes the investment in all sectors, business activities under

or outside the Controlled Business List and the Concession List of Lao PDR

throughout the country, except the business activities and areas affecting the

national security and peace; and seriously affecting the environment at present

and long-term, public health and good and beautiful national tradition and culture,

including the Prohibited Business List.

The procedures of application submission for the Controlled Business List: To

submit the application to the One-Stop Service Office at central and provincial

level in accordance with the division of administrative levels determined under

the Annex “A” of this Decree. The One-Stop Service Office shall coordinate with

the relevant [governmental] agencies at central and local level to review and then

propose [the application] to the Investment and Management Committee to

consider and approve it in accordance with division of administrative levels no

later than twenty-five working days from the date which the One-Stop Service

Office has received all complete documents in the application. After receiving the

approved investment license, such individual or legal entity can operate the

investment in accordance with the law, in case the business activities are required

by laws or regulations of relevant sectors to obtain the specific license prior to

operating such business activities, such enterprise shall apply for that business

operating license in accordance with the legislation.

As for the domestic and foreign individual enterprises or legal entities having

already received the Business Registration Certificate in accordance with the Law

on Enterprise of Lao PDR, If they wish to ask for the investment license or new

business operation or to add more business activities under the Controlled

Business List, they shall submit the application to the One-Stop Service Office

directly as mentioned above.

With respect to the investment in the Concession List: The domestic and foreign

legal entities wishing to invest in the business activities under the Concession List

in Lao PDR, they shall submit the application for the investment in the One-Stop

Service Office at central or provincial level to review and propose it to the

Investment Promotion and Supervision Committee in accordance with the

division of administrative levels (as stipulated in the Annex “A” of this Decree) to

consider no later than sixty-five days from the date which the One-Stop Service

Office has received all complete documents in the application.

Article 04: The relevant governmental agencies shall improve or develop the legislation

[regulations] regarding the requirement of documents and the procedures on

consideration for investment license approval relating to its own sector in details,

transparency and simplicity and send those [regulations & procedures] to the One-

Stop Service Office in order to inform the investors.

Article 05: The relevant governmental agencies can propose any improvement, addition or

reduction of the business activities under their responsibilities in the Controlled

Business List and Concession List, as necessary, in accordance with their policies

from time to time, to the Investment and Management Committee at central level

for consideration and submission for the Government’s approval.

Article 06: To assign the Ministry of Planning and Investment to be a focal point to

implement, disseminate, to advise, follow-up, monitor and encourage the

implementation of this Decree for the good outcomes.

Article 07: All Ministries, ministry-equivalent agencies and local authorities in all levels shall

strictly implement this Decree.

Article 08: This Decree enters into force from the date of its signature, all previous Decrees,

Decisions and Regulations conflicting to this Decree are nullified.
