III. INCIDENT DETAILS Jezabel Lara and Carlos Ibarra had been in a relationship and shared three children in common. On 05-15-2017 the two had an argument and Lara called 911. Lara stated Ibarra had threatened her and the children and she believed he was going to kill one of the children. Ibarra left the residence and took with him the keys to the vehicle where he kept a large handgun. Lara locked the door behind him. Lara took the children to the back of the apartment and they hid in a closet. Officers Chambers and Rivera arrived and observed a Hispanic male, later identified as Carlos Ibarra. Ibarra appeared to come from the stairwell and informed officers they were there for him. The officers observed Ibarra holding a handgun in his right hand, and issued commands for Ibarra to drop the weapon. Both officers conversed with Ibarra for almost four minutes in an attempt to have him drop the firearm, but Ibarra did not comply. While officers issued verbal commands to Ibarra, he pointed the firearm in their direction. Ibarra was told by officers, if he did that again they would shoot. Ibarra again pointed the firearm in the direction of Officer Rivera. Officer Chambers fired one round, which struck Ibarra in the right upper chest. Ibarra was taken into custody and transported to University Medical Center of Southern Nevada (UMC) by AMR.

Upon arrival of investigators, Sergeant Downie conducted a briefing. Detectives Alsup, Colon and Jex were assigned to interview available witnesses and conduct weapon countdowns. Detectives Patton and Penny were assigned responsibilities at the hospital, which included interviewing any possible witnesses. IV. BODY WORN CAMERAS (BWC) Officer Travon Chambers Officer Chambers was wearing a body worn camera at the time of the incident, and the camera was activated. The camera was collected by Sergeant MacDonald and secured. The video footage captured was later viewed by Officer Chambers on 05-15-2017 at 0350 hours. Officer Chambers' camera footage depicted Officers Chambers and Rivera as they approached from the west side of the building. Ibarra descended a staircase and turned toward them when Officer Chambers drew his firearm and yelled, "Hey, put your hands up!" Officer Chambers then used his department radio to broadcast they needed a Code Red and the suspect had a gun. Officer Chambers took cover behind a stairwell near his location and continued to give verbal commands. Officer Rivera was heard on camera also giving commands, and told Ibarra, "We don't want to shoot you," and to “put that gun down please." This interaction continued for almost

four minutes until Officer Chambers fired one round from his handgun. Officers Chambers and Rivera gave commands to Ibarra to lay on the ground as they moved forward and placed him into custody. Officer Josue Rivera Officer Rivera was wearing a body worn camera at the time of the incident, and the camera was activated. The camera was collected by Sergeant MacDonald and secured. The video footage captured was later viewed by Officer Rivera on 05-15-2017 at 0410 hours. Officer Rivera's camera footage depicted Officers Rivera and Chambers as they approached from the west side of the building. Ibarra stepped onto the sidewalk from a staircase, turned to face them and told them, "That was me." Officer Rivera drew his firearm and ordered Ibarra to "show me your hands" as he moved toward cover behind parked vehicles to the north. Ibarra yelled at officers to shoot him, and Officer Rivera responded, "We don't want to shoot you." Officer Rivera later told Ibarra, "We're here to help you out." The interaction between Ibarra and officers lasted for almost four minutes. The sound of a gunshot was heard. Both officers continued to issue verbal commands as they moved toward Ibarra and placed him into custody. V. HOSPITAL On 05-15-2017, at approximately 0320 hours, Detectives Patton and Penny responded to UMC Trauma to document Ibarra and locate possible witnesses. Upon arrival Detective Patton made contact with Officer Hinkel who was guarding Ibarra. Officer Hinkel stated he rode in the ambulance with Ibarra from the scene of the incident to the hospital. Officer Hinkel stated Ibarra was combative while inside the ambulance and had to be restrained. At no time did Ibarra make any comments reference the incident with officers; he only repeatedly said the name “Carlos.” Location and Description of the Body Ibarra was located in Trauma bay 11. He was unconscious and lying supine on a hospital gurney. An oxygen mask was applied to his nose and mouth, and a large bandage covered his upper right chest. The bandage was covering a gunshot wound and also helped secure a chest tube that was inserted into the right side of Ibarra’s chest. At the time Detective Patton observed Ibarra, blood was draining from the tube. Photographs documenting Ibarra’s condition and injuries were taken by SCSA King. The following items were impounded by SCSA King: 1) One (1) patient belonging bag 2) One (1) pair of cut, grey, DR Dream brand, size 3XL sweat shorts bearing apparent blood 3) One (1) pair of cut, blue, Hanes brand boxer briefs, size XL bearing apparent blood stains 4) One (1) pair of white, Reebok brand shoes (unknown size) bearing apparent blood stains

VI. SCENE WALK-THROUGHS The purpose of the scene walk-through is to help investigators develop an understanding of the scene, including identifying officer locations at the time deadly force was used, identifying potential physical evidence, and re-creating a timeline of the incident. Officer Rivera On 05-15-2017, at approximately 0423 hours, Officer Rivera provided a walk-through of the scene in the presence of the following persons:

1) Lieutenant O’Brien 2) Detective Jex 3) Detective Leavitt 4) Director McLaughlin 5) CSA Supervisor Nemcik 6) LVPPA representative Steve Grammas

During the walk-through, which was not video or audio recorded, Officer Rivera relayed the following information: Officer Rivera stated they [Officers Rivera and Chambers] approached the apartment from the west near the stairway on the west end of the building. When they approached they observed Ibarra walking down the middle set of stairs. Officer Rivera observed Ibarra holding a handgun in his right hand. Officer Rivera moved to cover behind a white SUV that was parked nearby and drew his handgun. Officer Rivera stated he gave verbal commands to Ibarra to put the gun down and observed Ibarra indexing the handgun. He stated Ibarra raised up his handgun and pointed it toward him. Officer Rivera then heard a single gunshot that came from Officer Chambers’ location. Officer Chambers On 05-15-2017, at approximately 0433 hours, Officer Chambers provided a walk-through of the scene in the presence of the following persons:

Officer Chambers stated he was at the corner of the building and observed Ibarra on the sidewalk. Ibarra stopped and was looking at the officers [Officers Chambers and Rivera]. Officer Chambers observed a black semi-automatic handgun in Ibarra’s hand. Officer Chambers drew his handgun and took a position of concealment near the stairway and maintained visual of Ibarra through the railing. Ibarra walked up the sidewalk near a white car and pointed the handgun at Officer Rivera. Officer Chambers fired one shot at Ibarra because he was in fear for his partner. Ibarra turned and laid down on the sidewalk and Officers Chambers and Rivera moved forward and took Ibarra into custody. VII. PUBLIC SAFETY STATEMENT (PSS) On 05-15-2017, at approximately 0314 hours, Detective Alsup interviewed Sergeant Kyle Downie, P# 9487, in reference to the Public Safety Statement he obtained from Officer Chambers. Also present for the interview was Sergeant Kurt McKenzie, P# 6746. Below is the transcript of the interview. Note: Detective Alsup is designated by (TA) and Sergeant Downie is designated by (KD). TA: Operator, this is Detective Trever Alsup, P# 5782, with the Las Vegas Metropolitan Police

Department Force Investigation Team, conducting an interview with Sergeant K. Downie,

D-O-W-N-I-E, P# 9487, reference a Public Safety Statement for Officer J. Rivera, R-I-V-

E-R-A, P# 15842.

KD: 482.

TA: I’m sorry, 15…

KD: 482.

TA: …482. Call was a, uh, domestic violence call which resulted in an officer-involved

shooting under Event# 170515-0155. Date is May 15, 20…May 15, 2017; time is 0314

hours. And also present is Sergeant Kurt McKenzie with the PMSA. All right, Sarge, um,

just read the questions and the responses.

KD: Okay. Question 1: “Did you discharge your firearm?” Officer Rivera’s response was, “No.”

Um, question 2: “Is anyone injured?” Um, his response was, “Only the suspect.”

Um, question 3: “Are there any outstanding suspects?” His response was, “No.”

Question 4: “Is it possible the suspect fired rounds at you?” His response was, “No.”

Question 5: “Do you know if any other officers discharged their firearm?” His response

was, “Just Officer Chambers.”

Question 6: “Are there any weapons or evidence that need to be secure?” And he said,

“The suspect’s firearm.”

Um, question 7: “Are you aware of any other witnesses?” And his response was, “No.”

And that concluded the Public Safety Statement.

TA: Okay. And that was conducted, um, at approximately 0140?

KD: Yes.

TA: All right. I’ll Go ahead and stop the tape. Date is May 15, 2017; time is 0315 hours; same

people present.

VIII. OFFICER WEAPON COUNTDOWNS On 05-15-2017 Officer Chambers had his duty weapon counted down at LVMPD headquarters, Involved and witness officers were photographed by CSI personnel for appearance purposes and their weapons were photographed for identification purposes. Officer Chambers The following persons were present during the countdown: 1) Officer Chambers 2) Detective Patton 3) SCSA King 4) LVPPA representative Bryan Yant Officer Chambers was dressed in a standard LVMPD short sleeve uniform. He wore LVMPD patches on each shoulder and an LVMPD badge over his left breast. Officer Chambers wore a black duty belt with attached tools and equipment as part of his position in Patrol. Officer Chambers' handgun was carried on the right side of his body and secured in a holster. Prior to countdown Officer Chambers stated he carried 15 cartridges in the magazine loaded in his firearm and one cartridge in the chamber (15+1, 16 total).

At the completion of the countdown, it was determined Officer Chambers discharged his firearm one time during this incident. Officer Chambers' firearm, magazines, and cartridges were photographed and impounded by SCSA King. IX. CONSENT TO SEARCH An LVMPD Consent to Search Card was explained to Lara by Detective Colon, then signed by Lara to search her 2005 silver Nissan Sentra bearing Nevada license plate 708YBE. The following personnel searched the vehicle and documented the results: 1) Detective Colon 2) SCSA Herring The following items were photographed and impounded as part of the search: 1) One (1) silver colored spherical BB from the driver’s seat 2) One (1) silver colored spherical BB from the driver’s floorboard SCSA Herring took overall photographs of the interior of the vehicle and photographed the items in place prior to recovering them. GENERAL INFORMATION:

On the above listed date and time, I arrived to the Apache Pines apartment complex, at

9552 W. Tropicana Ave., in reference to a non-fatal officer involved shooting investigation.

The scene was secured with yellow and red crime scene tape and uniformed LVMPD patrol

officers present.

The involved subject was transported from the scene prior to my arrival.

The above listed address is a multiple building apartment complex, with building #13 located

at the north side of the property.

SCENE

The scene location was the exterior north side of building 13, an east/west oriented two-

story building consisting of ground level units and second-level units. The second level units

were accessible by two (2) north/south oriented stairways with vertical metal railings on

each side of the stairway. The east-most stairway accessed two (2) upper units to include

unit #2074.

An east/west sidewalk extended along the north-most end of the aforementioned stairways.

Rock and shrubbery landscaping were located throughout the area between the sidewalk and

building. A parking lot area was north of the east/west sidewalk and consisted of covered

parking spaces adjacent to the sidewalk, an east/west driveway north of the covered parking

spaces, and garage units north of the driveway.

A cartridge case with headstamp "SPEER 9mm LUGER +P" (Item 1) was located on the

walkway ground, adjacent to the front door of unit #1075, a ground level unit at the west end

of the building.

A black "XBG" BB gun bearing serial #16D45674 (Item 2), an "LG" cell phone (Item 3), a

grey sleeveless T-shirt bearing one (1) defect in the front right side, apparent blood, and

medical cuts (Item 4), one (1) black baseball hat (Item 5), apparent blood and a partially eaten

beef jerky stick, were located on the above described sidewalk, west of the stairway accessing

unit #2074.

A black BB gun magazine (Item 2A) containing ten (10) silver colored spherical BBs (Item

2B) was inserted into the above described BB gun. The safety of the BB gun was in an "OFF"

position.

Apparent blood (Item 8)(labeled AB1) was located on the sidewalk, west of medical debris,

multiple pairs of black gloves, and the above described BB gun and personal belongings

located on the sidewalk. A pair of metal handcuffs were adjacent to the curb, north of the

above described items on the sidewalk.

Vehicle #1 was parked in a covered parking space, northwest of the stairway accessing unit #2074. The vehicle was facing south, with all doors in a closed position. A silver colored

spherical BB (Item 6) was located on the front driver seat of the vehicle. A silver colored spherical BB (Item 7), a "Miller High Life" bottle cap, and a receipt dated "5/14/2017 11:31:48

PM", were located on the front driver side floorboard of the vehicle.

A white Ford Explorer vehicle (NV/659YUE) facing south, was parked in a covered parking

space, north of the west-most stairway of the building. A white Toyota Prius vehicle

(NV/70E681) facing south, was parked in a covered parking space, two (2) spaces east of

VEHICLE(S):

GENERAL INFORMATION:

On May 15, 2017 at approximately 0305 hours, CSA I K. Biwer #16190 and I arrived at UMC Trauma, in reference to a Follow Up to an Officer Involved Shooting (Non-fatal) investigation. Arriving shortly thereafter were FIT detectives J. Patton #8289 and B. Penny #6042.

Subject Carlos Ibarra DOB: /1976 was lying on a gurney in trauma bay 11. He was covered with blankets and was restrained (to the gurney) at the wrists and ankles. Multiple injuries in various stages of healing were on both of subject Ibarra's lower legs. Scars were noted on his lower left abdomen and on his mid-line. In addition, a bandaged injury was on his upper right chest. The bandage was removed, by medical staff, and a gunshot-injury was observed. A patient belonging bag (Item 4) was on the floor of trauma bay 11. The bag contained: a pair of cut, grey, DR Dream brand sweat shorts (Item 5), a pair of cut, blue, Hanes brand boxer briefs (Item 6), and a pair of white Reebok brand shoes (Item 7). All of the clothing items were stained with apparent blood and a Global Cash Credit Card brand Visa card (Item 8) was in the front right pocket of the sweat shorts. Photography Digital images were taken showing: subject Ibarra for condition, identification (to include tattoos), and the above described area of injury (photographed with and without scale); the patient belonging bag and contents for identification. LVMPD Headquarters At approximately 0347 hours, I arrived at LVMPD Headquarters with the previously described personnel. PPA, and PEAP representatives arrived shortly thereafter. The following officer was involved in the incident: Officer T. Chambers #15476 Officer Chambers was dressed in a short sleeve patrol uniform. His primary weapon was in a holster on his right hip. Two ammunition magazines were in a holder on the front, left side of his duty belt. He did not have a back-up firearm on his person. Primary weapon: HK brand, VP9 model, 9mm caliber, semi-automatic pistol, serial [Item 1]. A Surefire X300 Ultra light was functioning and mounted below the barrel. One (1) cartridge bearing head stamp “Speer 9mm Luger +P” [Item 2] was in the chamber and fourteen (14) cartridges [Item 3] were in the magazine (15 round capacity) [Item 1a].

Both magazines were returned to Officers Chambers. Photography Digital images were taken showing: Officer Chambers for condition, identification, and the locations of firearms/magazines on his person; the above listed firearm for condition, contents, and identification; the above described ammunition magazines for contents. Evidence Officer Chambers’ primary firearm and the contents of the firearm were recovered, along with the patient belonging bag/contents. All items were impounded into evidence. Witnesses Jezabel Lara On 05-15-2017, at approximately 0325 hours, Detectives Colon and Alsup conducted an audio recorded interview with Jezabel Lara at 9552 W. Tropicana Avenue. Below is a summary of the interview; for complete details refer to the interview transcript. Ibarra and Lara had been in a relationship for approximately sixteen years and had three children together. Ibarra and Lara had not gotten along during the prior two years. Ibarra and Lara had broken up, and Lara moved into an apartment at 9552 W. Tropicana Avenue with their three children. Ibarra quit his job and did not have money to pay his rent and asked Lara if he could move in with them until he got back on his feet. Lara told him he could stay with them for one month so he could get a job and an apartment. Ibarra did get a job but never left. Lara and Ibarra constantly argued about the situation. Recently Ibarra had recently told Lara he was not leaving and never going to let her go. On the morning of 05-14-2017, Lara advised Ibarra she was moving out in two weeks. Ibarra told her she only had two options: Ibarra could take Lara or Ibarra would take one of the children. Lara told him if she had to choose she would pick Ibarra to take her. Ibarra told her the only option was that he would take one of the children to make Lara “cry blood.” Initially Lara thought Ibarra meant he was physically going to take custody of one of the children. Ibarra clarified that when he took one of the children he was “going to take it to the end.” Lara believed Ibarra was going to murder one of the children. After that conversation, at approximately 1100 hours, Lara and the children left the apartment. They returned at approximately 1800 hours and Ibarra was asleep. Lara cleaned the apartment and got the children ready for bed and school the next day. Ibarra woke up and left at approximately 2000 hours. Lara and the children were asleep when Ibarra returned to the apartment at approximately 2030 hours. Ibarra appeared agitated when he discovered their twelve-year-old daughter was sleeping with Lara in the living room. Once again, Ibarra asked Lara, “You or the kids?” He repeated this multiple times, to which Lara told him she had already answered. She said if it is going to come to that she chose herself. Ibarra told her, “No, it’s not going to be you. It’s going to be one of the kids to go to the end.” Lara called 911 in front of Ibarra, which angered him. Ibarra stated, “I can’t believe you did that. You’re going to see what’s going to happen. Watch. It’s going to be your fault.” Ibarra asked where the car keys were. Lara had hidden them because she knew he kept a gun in that car. Ibarra left the apartment and soon after Lara heard the police yelling. Lara took her children into the rear bedroom and did not witness the incident.

Renauld Lewis On 05-15-2017, at approximately 0354 hours, Detectives Colon and Alsup conducted an audio recorded interview with Renauld Lewis at . Below is a summary of the interview; for complete details refer to the interview transcript. Lewis had been watching a movie in his bedroom and heard yelling coming from outside his apartment. Lewis turned the movie off and went to the sliding glass door in his living room and observed flashlights and heard someone yell multiple times, “Put the gun down!” Lewis opened the front door of his apartment and heard someone say, “Put the gun down!” approximately twenty times. Lewis then heard, “If you point that gun at me I’m going to shoot you!” Shortly after Lewis heard one gunshot. Lewis shut the door and remained inside his apartment. Officer Josue Rivera On 05-15-2017, at approximately 0438 hours, Detectives Colon and Alsup conducted an audio recorded interview with Officer Josue Rivera at 9552 W. Tropicana Avenue. Also present for the interview was LVPPA representative Steve Grammas. Below a summary of the interview; for complete details refer to the interview transcript. Officer Rivera, along with Officer Chambers, responded to a domestic disturbance at 9552 W. Tropicana Avenue. Upon arrival Officer Rivera observed Ibarra, who advised the officers he had called the police. Ibarra was holding a black semi-automatic firearm in his right hand. Officer Rivera described that Ibarra held the gun in a non-combative, non-threatening manner. Officer Rivera told Ibarra numerous times to drop the gun. Officer Rivera stated both officers tried to de-escalate the situation verbally. Officers were approximately thirty feet from Ibarra as they issued commands. Ibarra told officers, “Shoot me!” Ibarra ignored officers’ commands to drop the gun and walked away. Officer Rivera advised Ibarra they were not there to hurt him and to drop the gun. Ibarra refused commands and finger indexed the gun, placing his index finger in close proximity to the trigger. Officer Rivera felt threated by the action as Ibarra appeared more aggressive. Ibarra walked towards the officers and raised the gun at the officers. Officer Rivera stated he was moments away from firing his gun when he heard Officer Chambers shoot. Officers approached Ibarra, who was still standing, and again told him to put down the gun. Ibarra complied and the officers placed Ibarra in custody and requested medical personnel to the scene.

Suspect Carlos Ibarra On 05-22-2017, at approximately 0956 hours, Detectives Leavitt and Jex conducted an audio recorded interview with Carlos Ibarra at University Medical Center. Below is a summary of the interview; for complete details refer to the interview transcript. Ibarra was in custody while being treated at UMC for the gunshot wound sustained during his encounter with officers. Ibarra was advised of his Miranda rights, which he stated he understood, and willingly spoke with detectives. Ibarra explained to detectives he and Lara had been having relationship issues, which resulted in a verbal argument on the evening of 05-15-2017 and Lara contacting the police. Ibarra exited the residence and went to his vehicle where he retrieved a BB gun. He told detectives he retrieved the BB gun with intentions to hide it before the police arrived. After the police arrived, Ibarra stated he heard their commands to drop the weapon, but chose not to obey the commands. Ibarra further explained he had been drinking and that may have affected his judgment. Ibarra stated he raised his arm up, though not with the intention of pointing the gun toward the officers, when he was shot. Ibarra did not recall what happened once he had been shot. Ibarra stated he felt badly for what had happened. XIII. TIMELINE The below timeline is a reconstruction of events which transpired on Monday, 05-15-2017, in relation to the non-fatal officer-involved shooting that occurred at 9552 W. Tropicana Avenue.

XIV. FORENSICS REQUESTS/RESULTS On 05-25-2017 an LVMPD Forensic Laboratory Request was submitted on Officer Chamber’s firearm for a function test and ballistic comparison evidence. On 06-08-2017 Forensic Scientist Anya Lester, P# 13771, submitted the Report of Examination: Firearms & Toolmarks. The following evidence was examined and the results are reported below.

Results and Conclusions: Firearm and Magazine The Heckler & Koch pistol was examined, test fired and found to be operational with no noted malfunctions. This pistol has a barrel length of approximately 4 ⅛ inches, an overall length of approximately 7 ⅜ inches without the light attached and approximately 8 11/16 inches with the light attached. This pistol has a trigger pull of 5 – 5 ¼ pounds. The submitted magazine fits and functions in this pistol and has a capacity of fifteen cartridges. Cartridge Case The evidence cartridge case was examined and microscopically compared to the test fired cartridge cases. Based on these comparative exams, the evidence cartridge case was identified as having been fired by the submitted pistol.
