FIVE KEY LEGAL CHANGES IMMINENT FORLANDLORDS

Five major legislativechanges are due to comeinto effect over the comingmonths that landlords in

England should be aware of.

1) Health and safety regulationsAt the time of writing, theseregulations are awaitingparliamentary approval and thefull details are yet to beconfirmed, however it is expectedthat, from 1 October 2015,landlords will be required to haveat least one smoke alarminstalled on every storey of theirproperties and a carbonmonoxide alarm in any roomcontaining a solid fuel burningappliance. In addition, the TPOand PRS Codes of Conductrequire co-detectors in propertieswith a gas appliance. Landlordsfound not to have installed thesedevices will face a fine of up to£5,000.

2) Right to rent – the IllegalImmigration Act

A trial of the ‘right to rent’scheme – in which landlords arerequired to check theimmigration status of theirtenants – has recently beencompleted and is expected to berolled out across the country bythe end of the year. New powerswill allow, in some cases, tenantswho do not have the right to liveand work in the UK to be evictedfrom a let property withoutrequiring a courtorder. Landlords who fail tocomplete the necessary checksto ensure their tenants arelegally able to rent their propertycould be prosecuted, withpotential punishments rangingfrom four-figure fines toimprisonment for repeatoffenders or those involved inorganised crime.

3) Serving Notice of Possession:Section 21Several changes are being madeto the Notice of Possession underSection 21. As part of anti-

retaliatory eviction measures,landlords will be prevented fromserving a valid Section 21 noticefor six months if their tenant hasrecently complained about thestate of their property and thelocal authority has issued anotice of improvement. There arealso a number of other pre-conditions for serving a Section21 due to be implemented whichwill prescribe whether and whena valid Section 21 notice can beserved to regain possession.

4) Houses in Multiple Occupationlicensing (HMOs)Currently, a house in multipleoccupation (HMO) is defined as aproperty in which three or morepeople live but do not form onehousehold, i.e. they are notrelated or in a relationship. Thisis commonly known as a houseshare. However, the governmenthas suggested it will look again atthe definition of an HMO so moreproperties fall within thisdesignation. In addition, many

local authorities have adopted‘selective’ licensing, requiringlicensing of all HMOs andsometimes all let property withintheir jurisdiction. Landlords needto stay up-to-date with anychanges being proposed by thelocal authority in whichtheir property is located asits status may be subject to achange in the future.

5) Rogue landlord crackdownThere have been clearindications the government isready to launch new measuresdesigned to penalise roguelandlords who blatantly floutexisting legislation, allowingtheir tenants to live in poor andunsafe conditions.

Conway Street in Hove was developed from the 1870s asterraced housing and industrial premises, but was quicklynotorious for overcrowding and the smell of manure. Mixed-use did not work in Victorian times. Albert Works demonstrates

that it certainly can today.The Conway Street Industrial Estate has been in the press as having

potential for serious redevelopment following the release of plans bydeveloper Andrew Lambor for towers, shops and a cinema. The nearbySackville Trading Estate was to be a housing scheme with supermarket.The Corralls coal yard below could be joined to it. The Goldstone RetailPark would have made a wonderful John Lewis.

For a variety of reasons, not oneof these big ideas, from a variety ofsources, has come to fruition.Piecemeal development may wellbe the way forward. I was recentlyshown around Albert Works, namedafter Albert Street that once ranbetween Conway Street and EllenStreet, by Andrew Gill to see how itcan be donewell.

The firstthird of thebuilding wasbuilt byHoveCouncilduring the1950s.Andrew’sfather, anelectricalengineer,workedthere and was involved with building the remaining two-thirds andended up buying it after a time as a tenant. At that point, heavyelectrical motors for the marine industry were serviced there. Lifts andcranes were in place for the purpose.

Prior to the recently-completed conversion, Rentokil occupied thebuilding (then called Gill House). It now consists of four flexible spacesfor creative types and four one-bedroom flats across two storeys to thedesigns of Worthing-based architect Gerald Moore. Finishes areimpressive and the overall design works well.

Andrew believes in transforming buildings one at a time, not leastbecause work is unlikely to be delayed. He may well have a point.www.buildingopinions.com

The most popularquestions I'm asked atthe moment are: Is thetower at full height now

and when is the glass podarriving? Well, the tower is at fullheight and the pod is due toarrive in early November.

The curved glass has alreadybeen manufactured in Italy andthe glass passenger pod iscurrently under construction inFrance by Poma. Poma isundertaking a trial assembly atpresent attaching the 48 piecesof glass – each a bit likesegments of an orange – to a"dummy" chassis; the real chassis is already attached to the i360 tower.Once we are happy it is in perfect working order, it will be shipped toBrighton in about 30 lorries.

Entirely hand made, the glass pod is already a striking structure. Ourarchitects, Marks Barfield, went out to watch this process and DavidMarks described the pod as a "perfect liquid bubble" and the undersideof the glass pod is mirrored glass, reminiscent of an Anish Kapoorsculpture.

The i360, in engineering terms, is a vertical cable – the first of its kindin the world. We turned to world-leading cable car experts to build this,Poma-Sigma. Poma is best known as ski lift and cable carmanufacturers, but they also built the 32 London Eye capsules anddrive system.

When completed the futuristic glass viewing pod will be incrediblyspacious – approximately 10 times the size of a London Eye capsule andhas the capacity to hold up to 200 people with plenty of space to movearound and see theview from differentangles. With a SkyBar, it will be theperfect entertainingspace to hostparties, weddingsand group visits.

Travelling fromstreet level (KingsRoad) up to 138metres, the viewingpod will provide a 360 degree view through curved glass, beforereturning to beach level. Among its other features, the i360 passengerpod will be heated and air-conditioned, is fully accessible forwheelchair users, and has bench seating for passengers.

Her Majesty’s Revenue &Customs (HMRC) saysthat more homes weresold in the UK in August

than in any month since Februarylast year.

The Revenue says itsseasonally-adjusted data – whichto the consternation of sometraditionalists is widely regardedas the best measure oftransactions, ironing outdiscrepancies caused by atypical

summer fluctuations – shows that106,480 homes were sold duringthe month.

HMRC says this is the thirdconsecutive month with a salestotal in excess of 100,000,although this remains well belowthe pre-downturn days whenmonthly sales of over 130,000were typical. 

The latest Revenue figuresshow that UK house prices rose byan average of 5.2 per cent in the

HOUSING MARKET UPDATEyear to the end of July. Whilst theprice of property coming tomarket during August has hit anew national record, up 0.9 percent to £294,834, borrowing is stillcheap and there is a positivesentiment aided by the ongoingpostponement of rate rises fromthe last six-year lows. There is stilla huge demand of all types ofproperties and there is a clearupturn of more properties comingto the market.

The number of letting agentsreporting rent increases fortenants has fallen month onmonth while the number of homesfor rent is also down, according tothe latest UK rental sector report.

The analysis from theAssociation of Residential LettingAgents (ARLA) shows that for thefirst time this year, the number ofARLA agents seeing rent hikes fortenants has decreased from theprevious month. The report alsoreveals only three in ten, some 33per cent, of agents reported anincrease in August. The lowestsince April this year and a drop

from 37 per cent in July.Overall the picture is still very

positive, more properties comingto the market and being sold, andrents staying stable givinginvestors a good return, so if youare wanting to move home now isthe time to put your property witha good local reputable agent. Social media – dismissal ofemployee who made disparagingcomments on Facebook was fair

An employee raised a grievanceabout his working situation – hesaid he felt stressed, was beingsingled out and he was unhappyabout the way in which matterswere being dealt with. HRresponded with arecommendation for mediation. Inorder that the mediation was not‘all one-sided’, one of theemployee’s colleagues providedcopies of his Facebook pages,where he had referred to hissupervisors in derogatoryterms. His comments included:

“why are gaffers such pr***s, isthere some kind of book teachingthem to be total wa****s”

He also made commentsreferring to drinking alcohol whileon standby, when employees are

required to remain teetotal.He admitted making the

statements on Facebook, but saidthat he had not intended to offendanyone and had been indulging inbanter. In mitigation, he said thathis Facebook account had beenhacked, his settings had beenchanged from ‘private’ to ‘public’and that his comments aboutdrinking were made in jest and infact, he had been sober.

The employee was dismissed forgross misconduct. The employerfound that whether true or not, thecomments had the potential toundermine confidence in theemployee. It found that makingoffensive remarks on Facebook wasunacceptable and amounted togross misconduct. 

The Employment Appeal Tribunalfound the dismissal to be fair. Theemployer had shown the reason fordismissal (conduct) and that reason

The employer in this case had aclear policy which the employeewas in breach of. The salutatorylesson is to be wary of work-related postings on social media,take care what settings are usedand in particular, to ensure thatthe employer’s policy is notbreached.

DIGGERS IN FORBETTER CIRCUSSTREET

Work begins this week onthe Circus Streetdevelopment inBrighton, which will

regenerate the area, injecting£200 million into the economyand create 400 jobs.

Partners in the schemecelebrated the start as the firstmachinery arrived to start thedemolition of the old municipalmarket building. The demolitioncontractors are Dorton Group,based in Burgess Hill, with 30years of experience in demolitionand 40 employees, many of themlocal. They will completedemolition towards the end of2015 and then construction willstart early in 2016.

All timber from the demolitionworks will be used for boardmaking and biomass fuel. All steelwill be re-used and all hard coreand concrete will be kept on siteto be used on the siteconstruction of the new CircusStreet development. Any wastewill go to a transfer station forfurther sorting.

Cathedral Group and DortonGroup met with neighbours lastweek to update them onupcoming works and answerquestions.

Said Richard Upton, ChiefExecutive of Cathedral Group(Holdings) Ltd: “Our neighboursare our first priority and we areworking with our partners andcontractors to be the mostconsiderate builders in the city todate, working to the bestpossible standards.”

Said Cllr Warren Morgan,Leader of Brighton & Hove CityCouncil, “The council is proud tohave played its part in helping tobring regeneration to the CircusStreet area. The Council car park onCarlton Hill is now permanentlyclosed and all parking bays onthe east side of Circus Street willbe closed permanently. Why, when I am installing an engineeredwood floor, do I have to worry aboutmoisture?

The biggest misconception people have about engineered woodflooring is that the products are invincible. When we look atstability as far as cupping or gapping, engineered wood flooringwill outperform solid wood flooring, meaning you can use a

wider-width product without seeing those dimensional changes as much. But that doesn’t mean we can just ignore moisture, especially relative

humidity when it comes to engineered wood flooring. If a solid wood floor experiences very dry conditions, it may cause

shrinkage resulting in some wide gaps appearing between the boards.But if an engineered wood floor experiences dry conditions outside theparameters defined by the manufacturer, the product may delaminate,show cracks in the face veneer, splits and dry-cupping. All of theseproblems would then more than likely require replacement of theaffected boards or, if the problems are throughout the floor, totalreplacement.

When buying an engineered wood floor to install, it is crucial to readthe manufacturers’ instructions regarding the relative humidityparameters necessary to maintain the floor. Although your floor willcome with a warranty, the relative humidity range for these warrantieswill vary between manyproducts. Any residentialand/or commercialproperties that aremaintained outside thesepermitted ranges for aconsistent period of time willvoid that floor’s warranty. Ofcourse, the quality of theproduct has a big role in howwell an engineered woodfloor will tolerate moistureswings, and there is a hugespectrum of quality intoday’s engineered woodflooring market.

Particularly in very dryclimates, as well asinstallations over radiantheat, an engineered floormust be chosen carefullyand the home must have ahumidification system thatcan maintain the floorwithin the required range.Engineered flooring isn’tappropriate for certainclimates, such asbathrooms, as it is too hardto regulate the moisture/humidity of this type of environment. Use inareas such as kitchens could be possible even though it is still a roomwith water risk as such, but you would need to ensure you do what’snecessary to maintain and protect the floor correctly as can be advisedby supplier and/or fitter.

Getting your deposit backat the end of yourtenancy is as importantto you as receiving the
