AnActtomakebetterprovisionsinthelawrelatingtotrademarksandforothermattersconnectedtherewith.BE ITENACTEDby theSeriPadukaBagindaYangdi‐PertuanAgongwith theadvice andconsent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by theauthorityofthesame,asfollows:

PARTIPRELIMINARY

Section1.Shorttitleandapplication(1)ThisActmaybecitedastheTradeMarksAct1976.

(2)ThisActshallapplythroughoutMalaysia.

Section2.Extentofapplication(1)ThisActshallapplytoapplicationsfortrademarksmadeafterthecommencementofthisActandtotrademarksregisteredonsuchapplications.(2)Subjecttosubsection6(4),thisActshallalsoapplytotrademarksregisteredundertherespectiverepealedOrdinances.

(3)Notwithstanding their repeal, the repealedOrdinances shall apply to applications fortrademarksmadebeforethecommencementofthisActandtotheregistrationsoftrademarksmadeonsuchapplicationsafterthecommencementofthisAct.

Section3.Interpretation(1)InthisAct,unlessthecontextotherwiserequires—“appointeddate”hasthesamemeaningasisassignedtothatexpressionintheIntellectualPropertyCorporationofMalaysiaAct2002[Act617];“assignment”meansassignmentbyactofthepartiesconcerned;“AssistantRegistrar”meansthepersonappointedordeemedtohavebeenappointedtobeanAssistantRegistrarundersubsection4(2)or(3);

“componentregionsofMalaysia”meanstheregionsofWestMalaysia,SabahandSarawak;

“Conventioncountry”meansacountrywhichisapartytoanymultilateraltreatyrelatingtotrademarkstowhichMalaysiaisalsoaparty;“Corporation”means the IntellectualPropertyCorporationofMalaysiaestablishedundertheIntellectualPropertyCorporationofMalaysiaAct2002;

“Court”meanstheHighCourt;

“DeputyRegistrar”meansthepersonappointedordeemedtohavebeenappointedtobeaDeputyRegistrarundersubsection4(2)or(3);

“geographicalindication”meansanindicationwhichidentifiesanygoodsasoriginatinginacountryorterritoryoraregionorlocalityinthatcountryorterritory,whereagivenquality,reputation or other characteristic of the goods is essentially attributable to theirgeographicalorigin;

“in the course of trade”, in relation to the provision of services,means in the course ofbusiness;

“limitations”meanslimitationsoftherighttotheexclusiveuseofatrademarkgivenbytheregistrationofthetrademarkincludinglimitationsofthatrightasto—

(a) modeofuse;(b) usewithinaterritorialareawithinMalaysia;or(c) use in relation togoods tobeexported toamarketoutsideMalaysiaoruse inrelationtoservicestobeprovidedinaplaceoutsideMalaysia;

“mark”includesadevice,brand,heading,label,ticket,name,signature,word,letter,numeraloranycombinationthereof;

“Minister” means the Minister for the time being charged with the responsibility forintellectualproperty;

“ParisConvention”meanstheParisConventionfortheProtectionofIndustrialPropertyof20March,1883asrevisedatStockholmon14July1967;

“permitteduse”inrelationtoaregisteredtrademarkmeanstheuseofthetrademarkbyaregistereduserthereof inrelationtogoodsorserviceswithwhichhe isconnectedinthecourse of trade and in respect of which the trade mark remains registered and he isregisteredasaregistereduser,beingusewhichcomplieswithanyconditionsorrestrictionstowhichhisregistrationissubject;

“prescribed”means, inrelationtoproceedingsbeforetheCourtorpreliminarytheretoorconnectedtherewith,prescribedbyrulesofcourtmadebytheRulesCommitteeconstitutedundertheCourtsofJudicatureAct1964[Act91],andinothercases,prescribedbythisActoranyregulationsmadethereunder;“prescribedforeigncountry”meansacountrydeclaredbytheMinister,byorderpublishedintheGazette,ashavingmadearrangementswithMalaysiaforthereciprocalprotectionoftrademarks;

“previousregisters”meanstheregistersoftrademarkskeptundertherepealedOrdinances;

“Register”meanstheRegisterofTradeMarkskeptunderthisAct;

“registered proprietor” in relation to a trademarkmeans the person for the time beingenteredintheRegisterasproprietorofthetrademarks;

“registeredtrademark”meansatrademarkwhichisactuallyupontheRegister;

“registereduser”meansapersonwhoisregisteredassuchunderPartIX;

“registrabletrademark”meansatrademarkwhichiscapableofregistrationundertheprovisionsofthisAct;

“Registrar”meanstheRegistrarofTradeMarksdesignatedinsubsection4(1);

“repealedOrdinances”meanstheTradeMarksOrdinance1950[Ord.26of1950],theTradeMarksOrdinanceofSabah[Cap.142]andtheTradeMarksOrdinanceofSarawak[Cap.62];

“specification”meansthedesignationofgoodsorservicesinrespectofwhichatrademarkoraregistereduserofatrademarkisregisteredorproposedtoberegistered;

“trademark”means,except inrelationtoPartXI,amarkusedorproposedtobeusedinrelationtogoodsorservicesforthepurposeofindicatingorsoastoindicateaconnectioninthecourseoftradebetweenthegoodsorservicesandapersonhavingtherighteitherasproprietororasregisteredusertousethemarkwhetherwithorwithoutanindicationoftheidentityofthatperson,andmeans,inrelationtoPartXI,amarkregistrableorregisteredunderthesaidPartXI;

“transmission” means transmission by operation of law, devolution on the personalrepresentativesofadeceasedpersonandanyothermodeoftransfernotbeingassignment;

“TRIPSAgreement”meanstheAgreementonTrade‐RelatedAspectsofIntellectualPropertyRights1994which constitutesAnnex1C to theAgreementEstablishing theWorldTradeOrganization;

“word”includesanabbreviationofaword.(2)InthisAct—

(a) referencestotheuseofamarkshallbeconstruedasreferencestotheuseofaprintedorothervisualrepresentationofthemark;

(b) references to the use of a mark in relation to goods shall be construed as

referencestotheusethereofupon,orinphysicalorotherrelationto,goods;and(c) references to the use of a mark in relation to services shall be construed as

referencestotheusethereofasastatementoraspartofastatementabouttheavailabilityorperformanceofservices.

PARTIIADMINISTRATION

Section4.Registrar,DeputyRegistrarsandAssistantRegistrars(1)TheDirectorGeneraloftheCorporationshallbetheRegistrarofTradeMarks.

(2)TheCorporationmayappoint,onsuchtermsandconditionsasitmaydetermine,fromamongstpersonsintheemploymentoftheCorporation,suchnumberofDeputyRegistrarsofTradeMarks,AssistantRegistrarsofTradeMarksandotherofficersasmaybenecessaryfortheproperadministrationofthisAct,andmayrevoketheappointmentofanypersonsoappointedordeemedtohavebeensoappointedundersubsection(3).

(3)ThepersonsholdingofficeasDeputyRegistrars,AssistantRegistrarsandotherofficersunderthisActbeforetheappointeddatewhoweregivenanoptionbytheGovernmentofMalaysiatoserveasemployeesoftheCorporationandhavesooptedshallontheappointeddatebedeemedtohavebeenappointedasDeputyRegistrars,AssistantRegistrarsandsuchotherofficersundersubsection(2).

(4)SubjecttothegeneraldirectionandcontroloftheRegistrarandtosuchconditionsorrestrictionsasmaybeimposedbytheRegistrar,aDeputyRegistraroranAssistantRegistrarmayexerciseanyfunctionoftheRegistrarunderthisAct,andanythingbythisActappointedorauthorizedorrequiredtobedoneorsignedbytheRegistrarmaybedoneorsignedbyanyDeputyRegistrarorAssistantRegistrarandtheactorsignatureofaDeputyRegistraroranAssistantRegistrarshallbeasvalidandeffectualasifdoneorsignedbytheRegistrar.

(5)TheRegistrarshallhaveasealofsuchdeviceasmaybeapprovedbytheCorporationandtheimpressionsofsuchsealshallbejudiciallynoticedandadmittedinevidence.

Section4A.ProtectionofofficersNoactionorprosecutionshallbebrought,institutedormaintainedinanyCourtagainst—

(a) theRegistrarofTradeMarks;

(b) aDeputyRegistrarofTradeMarks;or

(c)anAssistantRegistrarofTradeMarks,for any act or omission done in good faith in the performance of his functions and theexerciseofhispowersunderthisAct.Section5.Centralandregionaltrademarksoffices(1)ForthepurposesofthisActthereshallbeestablishedaCentralTradeMarksOfficewhich

shallbelocatedatKualaLumpur.(2)IneachoftheStatesofSabahandSarawakthereshallbeestablishedoneregionaltrademarksoffice.(2A) In addition to the regional trademarksoffice established in the State of Sabah andSarawak,theremaybeestablishedsuchnumberoftrademarksofficesasmaybenecessaryforthepurposesofthisAct.

(3)AdocumentrequiredorpermittedbythisActtobesubmittedattheCentralTradeMarksOfficemaybesubmittedatanytrademarksofficeandreferenceinthisActtothesubmissionat theCentral TradeMarksOffice includes reference to the submission at a trademarksoffice.

PARTIIITHEREGISTEROFTRADEMARKS

Section6.TheRegister (1)ThereshallbekeptandmaintainedattheCentralTradeMarksOfficeaRegisterofTrade

Markswhichshallcontain—

(a) allregisteredtrademarkswiththenames,addressesanddescriptionsoftheir proprietors, notifications of assignments and transmissions, thenames, addresses and descriptions of all registered users, disclaimers,conditions,limitations;and

(b) suchothermattersrelatingtothetrademarksastheMinistermayfromtimetotimeprescribe.

(3) The previous registers of trade marks kept under the repealed Ordinances shall beincorporated with and form part of the Register in accordance with the entries in thepreviousregistersimmediatelybeforethisActcomesintoforce.

(4)The incorporationof theprevious registers into theRegister shallhave the followingeffect:

(a) wherea trademarkhasbeenregisteredandentered inall theprevious

registersbyaproprietorforallthreecomponentregionsofMalaysia,suchatrademarkshallinitsincorporationintotheRegisterbedeemedtobearegisteredtrademarkinthenameofsuchproprietorunderthisAct;

(b) whereatrademarkhasbeenregisteredandenteredinanyoftheprevious

registersbyaproprietorforanyoneortwoofthecomponentregionsofMalaysia,suchatrademarkshallinitsincorporationintotheRegisterbedeemedtobearegisteredtrademarkinthenameofsuchproprietorunderthisActifonthedateonwhichthisActcomesintoforce—

(i) noidenticaltrademarkortrademarksonearlyresemblingthe

first‐mentioned trade mark in respect of the same goods orsame description of goods as is likely to deceive or causeconfusion has been registered and entered in the remainingpreviousregisterorregisterspriortothedateofthecomingintoforceofthisActbyadifferentproprietororproprietorsforanyoftheremainingcomponentregionsofMalaysia;and

(ii) noapplicationfortheregistrationofanidenticaltrademarkor

trademarksonearlyresemblingthefirst‐mentionedtrademarkinrespectofthesamegoodsorsamedescriptionofgoodsasislikelytodeceiveorcauseconfusionhasbeenmadepriortothedateofthecomingintoforceofthisActbyanotherpersonforanyoftheremainingcomponentregionsofMalaysiaor,whereit has been made, it is subsequently refused, abandoned orsuccessfullyopposed;

(c) whereatrademarkhasbeenregisteredandenteredinanyoftheprevious

registersbyaproprietorforanyoneortwoofthecomponentregionsofMalaysiaandanidenticaltrademarkortrademarksonearlyresemblingthe first mentioned trade mark in respect of the same goods or samedescriptionof goodsas is likely todeceiveor cause confusionhasbeenregistered and entered in any of the previous registers by a differentproprietororproprietorsforalloranyoneoftheremainingcomponentregionsofMalaysiaboththefirstmentionedtrademarkandtheidenticaltrademarkortrademarksonearlyresemblingthefirstmentionedtrade

mark in their incorporation into the Register shall be deemed to beregisteredtrademarksinthenamesoftherespectiveproprietorsunderthisActsubjecttoconcurrentuseofthetrademarksbytheirrespectiveproprietorsinaccordancewithsubsection20(1);

(d) whereatrademarkhasbeenregisteredandenteredinanyoftheprevious

registersbyaproprietorforanyoneortwoofthecomponentregionsofMalaysiaandonlyanapplicationorapplicationsfortheregistrationofanidentical trade mark or trade mark so nearly resembling the firstmentionedtrademarkinrespectofthesamegoodsorsamedescriptionofgoodsasislikelytodeceiveorcauseconfusionhasbeenmadepriortothedateofthecomingintoforceofthisActbyanotherpersonforanyoftheremainingcomponentregionsofMalaysia,thefirstmentionedtrademarkinitsincorporationintotheRegistershallbeeffectiveonlyinrespectofthecomponent region or regions of Malaysia in which it was originallyregistered unless the application or applications has or have beensubsequentlyrefused,abandonedorsuccessfullyopposed inwhichcasethefirstmentionedtrademarkshallbedeemedtobearegisteredtrademarkinthenameofsuchproprietorunderthisAct.

(5)Notwithstandingsection30thedateoftheentryofatrademarkinanyofthepreviousregistersincorporatedandformingpartoftheRegistershallbedeemedtobethedateoftheoriginalregistrationofthetrademark.Section7.NoticeoftrustNoticeofatrustexpress,impliedorconstructiveshallnotbeenteredintheRegisterorbereceivedbytheRegistrar.Section8.InspectionofRegister(1)TheRegistershallbeopentotheinspectionofthepublicatsuchtimesandinaccordancewithsuchconditionsasmaybeprescribed.(2) Certified copies or extracts of any entry in the Register sealed with the seal of theRegistrarshallbegiventoanypersonrequiringthesameonpaymentoftheprescribedfees.

(3) Certified copies of the Register shall be deposited in any trademarks office for thepurposeoffacilitatinganysearchtobemadebythepublicatsuchtimesastheMinistermaybyregulationsprescribeandnocopyorextractofanyentryinsuchcopiesshallbemadeorgiventoanyperson.Section9.FalseentriesinRegisterEverypersonwho—

(a) makesorcausestobemadeafalseentryintheRegister;

(b) makes or causes to bemade a false entry in any certified copy of the Registerdepositedinatrademarksoffice;

(c) makesorcausestobemadeafalsedocumentpurportingtobeacopyofanentry

intheRegister;(d) producesortendersorcausestobeproducedortenderedinevidenceanysuch

documentknowingsuchdocumentoranyentrythereintobefalse,isguiltyofanoffenceandisliable,onconviction,toafinenotexceedingfivethousandringgitortoatermofimprisonmentnotexceedingfiveyearsortoboth.

PARTIVREGISTRABLETRADEMARKS

Section10.Registrabletrademarks(1)Inorderforatrademark(otherthanacertificationtrademark)toberegistrable,itshall

containorconsistofatleastoneofthefollowingparticulars:

(a) thenameofanindividual,companyorfirmrepresentedinaspecialorparticularmanner;

(b) the signature of the applicant for registration or of some predecessor in hisbusiness;

(c) aninventedwordorwords;(d) aword having no direct reference to the character or quality of the goods or

services not being, according to its ordinarymeaning, a geographical name orsurname;or

(e) anyotherdistinctivemark.

(a) thetrademarkisinherentlycapableofdistinguishingasaforesaid;and

(b) byreasonoftheuseofthetrademarkorofanyothercircumstances,thetrademarkisinfactcapableofdistinguishingasaforesaid.

(3)AtrademarkmayberegisteredintheRegisterinrespectofanygoodsorservices.Section11(DeletedbyActA1078).Section 12.Use by proposed registered user to be considered for the purpose ofdeterminingdistinctiveness,etc.(1)Whereanapplicationforregistrationofatrademarkhasbeenmadebyaperson,andbeforethedateoftheapplicationthetrademarkhadbeenusedbyapersonotherthantheapplicantunderthecontrolofandwiththeconsentandauthorityoftheapplicant,andwhereanapplication ismadebytheapplicantandthatotherperson for theregistrationof thatotherpersonasaregistereduserofthetrademarkimmediatelyaftertheregistrationofthetrademarkandtheRegistrarissatisfiedthattheotherpersonisentitledtoberegisteredasa registered user of the trade mark, the Registrar may, for the purpose of determiningwhetherthetrademarkisdistinctiveoforcapableofdistinguishingthegoodsorservicesoftheapplicant,treatuseofthetrademarkbythatotherpersonasequivalenttouseofthetrademarkbytheapplicantandmaymakeanorderthatthetrademarkissodistinctiveorcapableofdistinguishing.(2)AnorderoftheRegistrarundersubsection(1)issubjecttoappealtotheCourt.(3)Whereanorderismadeundersubsection(1),theregistrationofthetrademarkshallceasetohaveeffectifattheexpirationoftheprescribedperiod,orsuchfurtherperiodnotexceeding six months as the Registrar may allow, that other person has not becomeregisteredastheregistereduserofthetrademark.Section13.Colouroftrademark(1)Atrademarkmaybelimitedinwholeorinparttooneormorespecifiedcoloursand,inanysuchcase,thefactthatthetrademarkissolimitedshallbetakenintoconsiderationforthepurposeofdeterminingwhetherthetrademarkisdistinctive.(2)Whereatrademarkisregisteredwithoutlimitationsastocolour,itshallbedeemedtoberegisteredforallcolours.

Section14.Prohibitiononregistration(1)Amarkorpartofamarkshallnotberegisteredasatrademark—

(a) iftheuseofwhichislikelytodeceiveorcauseconfusiontothepublicorwouldbecontrarytolaw;

(b) ifitcontainsorcomprisesanyscandalousoroffensivematterorwouldotherwisenotbeentitledtoprotectionbyanycourtoflaw;

(c) ifitcontainsamatterwhichintheopinionoftheRegistrarisormightbeprejudicialtotheinterestorsecurityofthenation;

(d) ifitisidenticalwithorsonearlyresemblesamarkwhichiswellknowninMalaysiaforthesamegoodsorservicesofanotherproprietor;

(e) ifitiswellknownandregisteredinMalaysiaforgoodsorservicesnotthesameastothoseinrespectofwhichregistrationisappliedfor:

Providedthattheuseofthemarkinrelationtothosegoodsorserviceswouldindicateaconnectionbetweenthosegoodsorservicesandtheproprietorofthewellknownmark, and the interestsof theproprietorof thewell knownmarkare likely tobedamagedbysuchuse;

(f) if it contains or consists of a geographical indication with respect to goods not

originating in the territory indicated, if useof the indication in themark for suchgoodsinMalaysiaisofsuchanatureastomisleadthepublicastothetrueplaceoforiginofthegoods;or

(g) if it is a mark for wines which contains or consists of a geographical indicationidentifyingwines,orisamarkforspiritswhichcontainsorconsistsofageographicalindication identifying spirits, not originating in the place indicated by thegeographicalindicationinquestion.

(2)Article6bisoftheParisConventionandArticle16oftheTRIPSAgreementshallapplyforthepurposeofdeterminingwhetheratrademarkisawellknowntrademark.Section14A.Whereregistrationshallnotberefused(1)Atrademarkshallnotberefusedregistrationbyvirtueofparagraphs14(f)and(g)iftheapplication for its registration had been made in good faith, or if it had been usedcontinuouslyingoodfaithinthecourseoftradebytheapplicantforitsregistrationorhispredecessorintitle,either—

(2)Atrademarkshallnotberefusedregistrationbyvirtueofparagraphs14(f)and(g)ifthegeographicalindicationinquestion—

(a)hasceasedtobeprotected;or(b)hasfallenintodisuse,

initscountryoforigin.Section15.WhereregistrationmayberefusedTheRegistrarshallrefusetoacceptanapplicationfortheregistrationofatrademarkwhichcontainsorconsistsofanyof the followingmarksoramarksonearlyresemblinganyofthosemarksasislikelytobetakenforthatmark:

(a) the word or words “Patent”, “Patented”, “By Royal Letters Patent”, “Registered”,“Registered Design” and “Copyright” or aword orwords to the like effect in anylanguagewhatsoever;or

(b) anymarkwhichisspecificallydeclaredbytheMinisterinanyregulationsmadeunderthisActtobeaprohibitedmark.

Section16.UseofnameofanotherpersonWhereapersonmakesanapplicationtoregisteratrademarkwhichconsistsoforincludesthenameor representationof anotherpersonwhether livingordead theRegistrarmayrequiretheapplicanttofurnishhimwiththeconsentofthatpersoniflivingorofthelegalrepresentativeofthatpersonifdeceasedbeforepermittingthenameorrepresentationtobeusedasatrademark.Section17.Registrationforparticulargoodsorservices(1)A trademarkmaybe registered in respect of anyor all of the goods comprised in aprescribedclassofgoodsorinrespectofanyoralloftheservicescomprisedinaprescribedclassofservices.(2) If any question arises as to the class inwhich goods or services are comprised thatquestionshallbedecidedbytheregistrarwhosedecisionshallbefinal.Section18.Disclaimer(1)Ifatrademark—

(a) containsanypart—

theRegistrar or theCourt, in decidingwhether the trademark shall be entered or shallremainintheRegister,mayrequireasaconditionofitsbeingupontheRegister,thattheproprietorshalldisclaimanyright to theexclusiveuseofanysuchpartormatter, to theexclusiveuseofwhichtheRegistrarortheCourtholdshimnot tobeentitledor thattheproprietor shallmake such other disclaimer as the Registrar or the Courtmay considernecessaryforthepurposeofdefininghisrightsundertheregistration.(2)Nodisclaimeron theRegister shall affectanyrightof theproprietorofa trademarkexcept a right arising out of the registration of the trade mark in respect of which thedisclaimerismade.Section19.Identicaltrademarks(1)Notrademarkshallberegisteredinrespectofanygoodsordescriptionofgoods—

(a) thatisidenticalwithatrademarkbelongingtoadifferentproprietorandenteredintheRegister in respectof the samegoodsordescriptionof goodsor in respectofservicesthatarecloselyrelatedtothosegoods;or

(b) thatsonearlyresemblessuchatrademarkasislikelytodeceiveorcauseconfusion.(2)Notrademarkshallberegisteredinrespectofanyservicesordescriptionofservices—

(a) thatisidenticalwithatrademarkbelongingtoadifferentproprietorandenteredintheRegisterinrespectofthesameservicesordescriptionofservicesorinrespectofgoodsthatarecloselyrelatedtothoseservices;or

(b) thatsonearlyresemblessuchatrademarkasislikelytodeceiveorcauseconfusion.(3) Where separate applications are made by different persons to be registered asproprietorsrespectivelyof trademarkswhichare identicalorsonearlyresemblingeachotherasarelikelytodeceiveorcauseconfusionand—

(a) suchapplicationsareinrespectofthesamegoodsordescriptionofgoods;or

(b) atleastoneofsuchapplicationsisinrespectofgoodsandtheotherorothersisorareinrespectofservicescloselyrelatedtothosegoods,

(a) suchapplicationsareinrespectofthesameservicesordescriptionofservices;or

(b) atleastoneofsuchapplicationsisinrespectofservicesandtheotherorothersisorareinrespectofgoodscloselyrelatedtothoseservices,

theRegistrarmayrefusetoregisteranyofthemuntiltheirrightshavebeendeterminedbytheCourtorhavebeensettledbyagreementinamannerapprovedbyhimorbytheCourt.Section20.Concurrentuse(1) Notwithstanding subsection 19(1), in the case of honest concurrent use or of thecircumstancesdescribedinparagraph6(4)(c)orofotherspecialcircumstanceswhich,intheopinionoftheCourtortheRegistrar,makeitpropersotodo,theCourtortheRegistrarmaypermit the registrationofmore thanoneproprietor in respectof trademarkswhichareidenticalorsonearlyresemblingeachotherasarelikelytodeceiveorcauseconfusionwheretheregistrationofthedifferentproprietors—

(a) isinrespectofthesamegoodsordescriptionofgoods;or

(b) inthecaseofatleastoneproprietor,isinrespectofgoods,andinthecaseoftheotheror others, is in respect of services closely related to those goods, subject to suchconditions, amendments, modifications or limitations, if any, as the Court or theRegistrar,asthecasemaybe,maythinkrighttoimpose.

(1A)Notwithstanding subsection19(2), in the caseof honest concurrentuseor of otherspecialcircumstanceswhich,intheopinionoftheCourtortheRegistrar,makeitpropersotodo,theCourtortheRegistrarmaypermittheregistrationofmorethanoneproprietorinrespectoftrademarkswhichareidenticalorsonearlyresemblingeachotherasarelikelytodeceiveorcauseconfusionwheretheregistrationofthedifferentproprietors—

subjecttosuchconditions,amendments,modificationsorlimitations,ifany,astheCourtortheRegistrar,asthecasemaybe,maythinkrighttoimpose.

(2)TheRegistrarshallnotrefusetoregisteratrademarkwhichisidenticaltoorsonearlyresemblinganothertrademarkintheRegisteriftheapplicantofthefirstmentionedtrademarkorhispredecessorinbusinesshascontinuouslyusedthattrademarkfromadatebefore—

(a) theuseofthatothertrademarkbytheregisteredproprietororhispredecessorinbusinessorbyaregistereduser;or

(b) the registration of that other trade mark by the registered proprietor or hispredecessorinbusiness,

whicheveristheearlier.Section21.Jointlyownedtrademark(1)Wheretwoormorepersonsareinterestedinatrademarkandnoneofthemisentitledasbetweenhimselfortheotherorotherstousethetrademarkexcept—

(a) onbehalfofbothorallofthem;or

(b) inrelationtogoodsorserviceswithwhichbothorallofthemareconnectedinthecourseoftrade,

bothorallofthemmayberegisteredasjointproprietorsofthetrademarkandthisActhaseffectinrelationtoanyrightsofsuchpersonstotheuseofthetrademarkasifthoserightswererightsofasingleperson.(2)Subjecttosubsection(1),nothinginthisActauthorizestheregistrationoftwoormorepersonswhouseatrademarkindependently,orproposesotouseit,asjointproprietorsofthetrademark.Section22.Associationoftrademarks(1)Whereatrademarkwhichisregisteredoristhesubjectofanapplicationforregistrationinrespectofanygoods—

(a) is identical with another trade mark which is registered or is the subject of anapplicationforregistrationinthenameofthesameproprietorinrespectofthesamegoodsordescriptionofgoodsorinrespectofservicesthatarecloselyrelatedtothosegoods;or

(b) issonearlyresemblingitasislikelytodeceiveorcauseconfusionifusedbyapersonotherthantheproprietor,

(a) is identical with another trade mark which is registered or is the subject of anapplicationforregistrationinthenameofthesameproprietorinrespectofthesameservicesordescriptionofservicesorinrespectofgoodsthatarecloselyrelatedtothoseservices;or

(b) issonearlyresemblingitasislikelytodeceiveorcauseconfusionifusedbyapersonotherthantheproprietor,

theRegistrarmayatanytimerequirethatthetrademarksbeenteredontheRegisterasassociatedtrademarks.(2)Onapplicationmadeintheprescribedmannerbytheregisteredproprietorof twoormoreassociatedtrademarkstheRegistrarmaydissolvetheassociationasrespectsanyofthem if he is satisfied that therewouldbeno likelihoodof deceptionor confusionbeingcausedifthattrademarkwereusedbyanotherpersoninrelationtoanyofthegoodsorservicesinrespectofwhichitisregisteredandmayamendtheRegisteraccordingly.(3)AdecisionoftheRegistrarundersubsection(2)issubjecttoappealtotheCourt.Section23.Assignmentofassociatedtrademarks(1)Associated trademarks shall be assignable or transmissible only as awhole andnotseparately but they shall for all other purposes be deemed to have been registered asseparatetrademarks.(2)WhereunderthisActuseofaregisteredtrademarkisrequiredtobeprovedforanypurpose,theCourtortheRegistrarmay,ifandsofarasitorheshallthinkright,acceptuseof an associated trade mark or of the trade mark with additions and alterations notsubstantiallyaffectingitsidentityasanequivalentforsuchuse.(3)Theforegoingprovisionsapplyinrelationtoproofofuseofanyregisteredtrademarkandnotinrelationonlytoproofofuseofatrademarkwhichisoneoftwoormoreassociatedtrademarks.Section24.Seriesoftrademarks(1)Whereseveral trademarks inrespectof thesamegoodsordescriptionofgoods inasingle classor in respectof the same servicesordescriptionof services in a single classresembleeach

(a) statementsorrepresentationastothegoodsorservicesinrespectofwhichthetrademarksareusedorproposedtobeused;

(b) statementsorrepresentationsastonumber,price,qualityornamesofplaces;

(c) othermatterwhichisnotdistinctiveanddoesnotsubstantiallyaffecttheidentityofthetrademarks;or

(d) colour,andapersonwhoclaimstobetheproprietorthereofseekstoregisterthetrademarks,thetrademarksmayberegisteredasaseriesinoneregistration.(2)Alltrademarksregisteredinaseriesshallbedeemedtobeandshallberegisteredasassociatedtrademarks.

PARTVAPPLICATIONFORREGISTRATION

Section25.Registration(1)AnypersonclaimingtobetheproprietorofatrademarkusedorproposedtobeusedbyhimmaymakeapplicationtotheRegistrarfortheregistrationofthatmarkintheRegisterintheprescribedmanner.(2)Anapplicationshallnotbemadeinrespectofgoodsorservicescomprisedinmorethanoneclass.(3)Subject to theprovisionsof thisAct, theRegistrarmayrefuse theapplicationormayacceptitabsolutelyorsubjecttosuchconditions,amendments,modificationsorlimitations,ifany,ashemaythinkrighttoimpose.(4) In thecaseof refusalor conditionalacceptance theRegistrar shall, if requiredby theapplicant, state in writing the grounds of his decision and the material used by him inarrivingatthesame.(5)AdecisionoftheRegistrarundersubsection(3)issubjecttoappealtotheCourt.(6)AnappealunderthissectionshallbemadeintheprescribedmannerandtheCourtshall,if required, hear the applicant and the Registrar, and shall make an order determiningwhether,andsubjecttowhatconditions,amendments,modificationsorlimitations,ifany,theapplicationistobeaccepted.

(7)TheappealshallbeheardonthematerialstatedbytheRegistrartohavebeenusedbyhiminarrivingathisdecisionandnofurthergroundsofobjectiontotheacceptanceoftheapplicationshallbeallowedtobetakenbytheRegistrarotherthanthosesostatedexceptbyleaveoftheCourt.(8)Where any further grounds of objection are taken the applicant shall be entitled towithdraw his application without payment of costs on giving notice in the prescribedmanner.(9)TheRegistrarortheCourt,asthecasemaybe,mayatanytime,whetherbeforeorafteracceptance, correctanyerror inor inconnectionwith theapplicationormaypermit theapplicanttoamendhisapplicationuponsuchtermsasheoritmaythinkfit.(10)Anyapplicationsubmittedandacceptedunderthissectionshallnotwithstandinganycorrection or amendment permitted by the Registrar or the Court to be made in suchapplicationbedeemedtohavebeenmadeonthedateofitsoriginalsubmission.(11)(RepealedbyActA1078).(12)Withoutprejudicetosubsection(10)whereaftertheacceptanceofanapplicationforregistrationofatrademarkbutbeforetheregistrationofthetrademarktheRegistrarissatisfied—

(a) thattheapplicationhasbeenacceptedinerror;or

(b) thatinthespecialcircumstancesofthecasethetrademarkshallnotberegisteredorshallberegisteredsubjecttoadditionalordifferentconditionsorlimitations,

theRegistrarmaywithdrawtheacceptanceandproceedasiftheapplicationhadnotbeenacceptedor,inrespectonlyofatrademarkwhichshallberegisteredsubjecttoadditionalor different conditions or limitations, reissue a new acceptance subject to additional ordifferentconditionsorlimitations.Section26.Applicationmaybeacceptedwheretrademarkistobeusedbyassigneeorregistereduser(1)Anapplicationfortheregistrationofatrademarkinrespectofanygoodsorservicesshallnotberefusednorshallpermissionforsuchregistrationbewithheldonthegroundthatitappearsthattheapplicantdoesnotuseorproposetousethetrademark—

(a) iftheRegistrarissatisfiedthatabodycorporateisabouttobeconstitutedandthattheapplicantintendstoassignthetrademarktothecorporationwithaviewtotheusethereofinrelationtothosegoodsorservicesbythecorporation;or

(b) ifanapplicationhasbeenmadefortheregistrationofapersonasaregistereduserofthetrademark,andtheRegistrarissatisfiedthattheproprietorintendsittobeused

bythatpersoninrelationtothosegoodsorservicesandtheRegistrarisalsosatisfiedthat that personwill be registered as a registered user thereof immediately afterregistrationofthetrademark.

(2)TheRegistrarmay,asaconditionoftheexerciseofthepowerconferredbysubsection(1)infavouroftheapplicant,requirehimtogivesecurityforthecostsofanyproceedingsbeforehimrelativetoanyoppositionand,indefaultofsuchsecuritybeingdulygiven,maytreattheapplicationasabandoned.(3)Whereatrademarkisregisteredinrespectofanygoodsorservicesunderthepowerconferred by subsection (1), then unless the corporation has been registered as theproprietorof the trademark in respectof thosegoodsor serviceswithin aperiodof sixmonths,theregistrationshallceasetohaveeffectinrespectthereofattheexpirationofthatperiodandtheRegistrarshallamendtheRegisteraccordingly.Section27.Advertisementofacceptanceofapplication(1) When an application for registration of a trade mark has been accepted whetherabsolutelyorsubjecttoconditions,amendments,modificationsorlimitations,theRegistrarshall,assoonasmaybeafteracceptance,causetheapplicationasacceptedtobeadvertisedintheprescribedmanner.(2) The advertisement shall set forth all conditions, amendments, modifications andlimitationssubjecttowhichtheapplicationhasbeenacceptedexceptthattheRegistrarmaycause an application for registration of a trademark to be advertised before acceptancethereofiftheconsiderationsinsubsection10(2B)orsubsection11(1A)applyorinanyothercasewhereitappearstohimthatitisexpedientbyreasonofanyexceptionalcircumstancestodoso.(3)Whereanapplicationhasbeenadvertisedundersubsection(2)theRegistrarmay,ifhethinksfit,advertiseitagainwhenithasbeenacceptedbutheshallnotbeboundtodoso.Section28.Oppositiontoregistration(1)Anypersonmay,withintheprescribedtimefromthedateoftheadvertisementofanapplicationfortheregistrationofatrademark,givenoticetotheRegistrarandapplicantofoppositiontotheregistration.(2) The notice shall be given in writing in the prescribed manner and shall include astatementofthegroundsofopposition.(3) The applicant shall, within the prescribed time after the receipt of the notice ofopposition,sendtotheRegistrarandtheopponentacounter‐statement,intheprescribedmanner,ofthegroundsforhisapplication,and,ifhedoesnotdoso,heshallbedeemedtohaveabandonedhisapplication.

(3A)Iftheapplicantsubmitsacounter‐statementundersubsection(3),theopponentandapplicantshallfileevidenceandexhibitsintheprescribedmannerandwithintheprescribedtimesupportoftheoppositionorthecounter‐statement,asthecasemaybe,tobeadducedintheprescribedmanner,andiftheopponentorapplicantfailstodoso,theoppositionorapplication,asthecasemaybe,shallbetreatedasabandoned.(3B)Iftheapplicantfilesevidenceandexhibitsundersubsection(3A),theopponentmay,within the prescribed time, send to the Registrar and applicant evidence in reply to beadducedintheprescribedmanner.(4A) After considering the evidence and exhibits and after giving the applicant and theopponent an opportunity of making written submissions, the Registrar shall decidewhether—

(a) torefusetoregisterthetrademark;

(b) toregisterthetrademarkabsolutely;or

(c) toregisterthetrademarksubjecttosuchconditions,amendments,modificationsorlimitationsashemaythinkfit.

(5)AdecisionoftheRegistrarundersubsection(4)issubjecttoappealtotheCourt.(6)AnappealunderthissectionshallbemadeintheprescribedmannerandtheCourtshall,ifrequired,hearthepartiesandtheRegistrar,andshallmakeanorderdeterminingwhether,andsubjecttowhatconditions,amendments,modificationsorlimitations,ifany,registrationistobepermitted.(7)On the hearing of an appeal under this section any partymay, either in themannerprescribed or by special leave of the Court, bring forward further material for theconsiderationoftheCourtbutnofurthergroundsofobjectiontotheregistrationofatrademarkshallbeallowedtobetakenbytheopponentortheRegistrarotherthanthosestatedbytheopponentexceptbyleaveoftheCourt.(8)Where any further grounds of objection are taken the applicant shall be entitled towithdrawhisapplicationwithoutpaymentofthecostsoftheopponentongivingnoticeasprescribed.(9)InanyappealunderthissectiontheCourtmayafterhearingtheRegistrar,permitthetrade mark proposed to be registered to be modified in any manner not substantiallyaffectingtheidentityofthetrademark,butinanysuchcasethetrademarkasmodifiedshallbeadvertisedintheprescribedmannerbeforebeingregistered.(10)Ifapersongivingnoticeofoppositionoranapplicantsendingacounter‐statementafterreceiptofsuchanotice,oranappellant,neitherresidesnorcarriesonbusinessinMalaysia,the

RegistrarortheCourtmayrequirehimtogivesecurityforcostsoftheproceedingsrelativetotheopposition,applicationorappeal,asthecasemaybe,andindefaultofsuchsecuritybeingdulygiven,may treat theopposition,application,orappeal, as thecasemaybe,asabandoned.Section29.Non‐completionofregistration(1)Whenan application for registrationof a trademark is not completedwithin twelvemonthsfromthedateoftheapplicationbyreasonofdefaultonthepartoftheapplicant,theRegistrarmay,aftergivingnoticeinwritingofthenon‐completiontotheapplicantintheprescribedmanner,treattheapplicationasabandonedunlessitiscompletedwithinthetimespecifiedinthatbehalfinthenotice.(2)WhereanappealunderanyoftheprovisionsofthisActhasbeeninstitutedinrespectofanapplication forregistrationofa trademark, theRegistrarshallnotgivenoticeofnon‐completionoftheapplicationuntiltheexpirationofthreemonthsafterthedeterminationoftheappealoruntiltheexpirationofsuchfurthertimeastheCourtmayallow.

PARTVIREGISTRATIONANDEFFECTOFREGISTRATION

Section30.Registrationoftrademark(1)WhenanapplicationforregistrationofatrademarkintheRegisterhasbeenacceptedandeither—

(a) theapplicationhasnotbeenopposedandthetimeforoppositionhasexpired;or

(b) theapplicationhasbeenopposedandtheoppositionhasbeendecidedinfavouroftheapplicant,

theRegistrarshall,unlesstheapplicationhasbeenacceptedinerror,registerthetrademarkintheRegisteronpaymentoftheprescribedfeesinthenameoftheproprietor,andthetrademarksoregisteredshallberegisteredasofthedateofapplicationforregistrationandthatdateshallbedeemedforthepurposeofthisActtobethedateofregistration.(2)OntheregistrationofatrademarktheRegistrarshallissuetotheapplicantacertificateoftheregistrationofthetrademarkintheprescribedformunderthesealoftheRegistrar.Section31.Timeforregistration(1)Subjecttosubsection(2)atrademarkshallnotberegisteredaftertwelvemonthsfromthedateoftheadvertisementoftheacceptanceoftheapplicationforregistrationofthetrademark.(2)Wheretheregistrationofatrademarkisdelayedby—

(c) anactiononthepartoftheCentralTradeMarksofficeoranytrademarksoffice,

thattrademarkmayberegisteredwithinsuchtimeasdirectedbytheRegistrarortheCourtrespectively.(3) Where a trade mark has not been registered within the time applicable to it theapplicationshalllapse.Section32.Durationofregistration(1)TheregistrationofatrademarkshallbeforaperiodoftenyearsbutmayberenewedfromtimetotimeinaccordancewiththisAct.(2)WhereatrademarkisregisteredundertherepealedOrdinancesandisincorporatedintoand formspart of theRegisterunder thisAct the registrationof such trademarkunlessrenewedunderthisActshallbeforaperiodequaltotheunexpiredportionoftheperiodforwhichthetrademarkwasregisteredorrenewedundertherepealedOrdinances.(3)TheregistrationofatrademarkmayberenewedfromtimetotimeinaccordancewithPartVII.Section33.Wordsusedasnameordescriptionofarticle,substanceorservice(1)Theregistrationofatrademarkshallnotbedeemedtohavebecomeinvalidbyreasononlyofanyuseafterthedateoftheregistrationofawordorwordswhichthetrademarkcontainsorofwhichitconsistsasthenameordescriptionofanarticle,asubstanceoraservice.(2)Ifitisprovedeither—

(a) thatthereisawellknownandestablisheduseofthewordorwordsasthenameordescriptionof thearticleor substancebyapersonorpersonscarryingona tradetherein,notbeinguseinrelationtogoodsconnectedinthecourseoftradewiththeproprietororaregistereduserofthetrademarkor,inthecaseofacertificationtrademark,goodscertifiedbytheproprietor;

(b) thatthearticleorsubstancewasformerlymanufacturedunderapatent,thataperiodoftwoyearsafterthecesserofthepatenthaselapsedandthatthewordorwordsisoraretheonlypracticablenameordescriptionofthearticleorsubstance;or

(c) thatthereisawellknownandestablisheduseofthewordorwordsasthenameordescriptionofsomeservicebyapersonorpersonsprovidingserviceswhichincludethatservice,notbeinguseinrelationtoservicestheprovisionofwhichtheproprietororregistereduserofthetrademarkisconnectedtointhecourseoftrade,

subsection(3)shallhaveeffect.(3)Whenthefactsmentionedinparagraph2(a),(b)or(c)areprovedwithrespecttoanywordorwordsthen—

(a) ifthetrademarkconsistssolelyofthatwordorthosewords,theregistrationofthetrademark,sofarasregardsregistrationinrespectofthearticle,substanceorserviceinquestionorofanygoodsorserviceofthesamedescription,shallbedeemedforthepurposeofsection45tobeanentrywronglyremainingintheRegister;

(b) ifthetrademarkcontainsthewordorthosewordsandothermatter,theCourtortheRegistrarindecidingwhetherthetrademarkshallremainontheRegistersofarasregardsregistrationinrespectofthearticle,substanceorserviceinquestionorofanygoodsorserviceofthesamedescriptionmayincaseofadecisioninfavourofitsremainingon theRegister require as a condition thereof that theproprietor shalldisclaimanyrighttotheexclusiveuseinrelationtothatarticle,substanceorserviceinquestionoranygoodsor serviceof thesamedescriptionof thatwordor thosewordsso,however, thatnodisclaimeron theRegister shall affectanyrightof theproprietorofatrademarkexceptsuchasarisingoutoftheregistrationofthetrademarkinrespectofwhichthedisclaimerismade;and

(c) forthepurposesofanyotherlegalproceedingsrelatingtothetrademark—

(i) if the trademark consists solely of thatword or thosewords, all rights of theregistered proprietor to theexclusiveuseof the trademark in relation to thearticle,substanceorservice inquestionortoanygoodsorserviceof thesamedescription;or

(ii) ifthetrademarkcontainsthatwordorthosewordsandothermatter,allrightsof

theregisteredproprietortotheexclusiveuseofthewordorthosewords,insuchrelationasinsubparagraph(1),

shallbedeemedtohaveceasedonthedateatwhichtheusementionedinparagraph(2)(a) or (c) first becamewell known and established or at the expiration of theperiodoftwoyearsmentionedinparagraph(2)(b).

(4)Nowordwhichisthecommonlyusedandacceptednameofanysinglechemicalelementorsinglechemicalcompound,asdistinguishedfromamixture,shallberegisteredasatrademarkinrespectofachemicalsubstanceorpreparationexceptthatthissubsectionshallnothaveeffectinrelationtoawordwhichisusedtodenoteonlyabrandormakeoftheelement

or compound as made by the proprietor or a registered user of the trade mark asdistinguishedfromtheelementorcompoundasmadebyothersandinassociationwithasuitablenameordescriptionopentothepublicuse.Section34.PowersofregisteredproprietorSubjecttotheprovisionsofthisAct,—

(a) thepersonfor thetimebeingenteredintheRegisterasregisteredproprietorofatrademarkshall,subjecttoanyrightsappearingfromsuchRegistertobevestedinanyotherperson,havepowertoassignthesameandgivegooddischargesforanyconsiderationfortheassignment;

(b) anyequitiesinrespectofatrademarkmaybeenforcedinlikemannerasinrespectofanyotherpersonalproperty.

Section35.Rightsgivenbyregistration(1)SubjecttotheprovisionsofthisAct,theregistrationofapersonasregisteredproprietorofatrademark(otherthanacertificationtrademark)inrespectofanygoodsorservicesshall,ifvalid,giveorbedeemedtohavebeengiventothatpersontheexclusiverighttotheuse of the trade mark in relation to those goods or services subject to any conditions,amendments,modificationsorlimitationsenteredintheRegister.(2)Wheretwoormorepersonsareproprietorsofregisteredtrademarkswhichareidenticalornearlyresemblingeachotherrightsofexclusiveuseofeitherofthosetrademarksarenot(exceptso faras theirrespectiverightshavebeendefinedby theRegistraror theCourt)acquiredbyanyoneofthosepersonsasagainstanyotherofthosepersonsbyregistrationofthetrademarkbuteachofthosepersonshavethesamerightsasagainstotherpersons(notbeingregisteredusers)ashewouldifhewerethesoleregisteredproprietor.Section36.RegistrationprimafacieevidenceofvalidityInall legalproceedings relating toa registered trademark (includingapplicationsundersection45)thefactthatapersonisregisteredasproprietorofthetrademarkshallbeprimafacie evidence of the validity of the original registration of the trade mark and of allsubsequentassignmentsandtransmissionsthereof.Section37.RegistrationconclusiveIn all legal proceedings relating to a trade mark registered in the Register (includingapplicationsundersection45)theoriginalregistrationofthetrademarkunderthisActshall,aftertheexpirationofsevenyearsfromthedatethereof,betakentobevalidinallrespectsunlessitisshown—

(a) thattheoriginalregistrationwasobtainedbyfraud;

(b) thatthetrademarkoffendsagainstsection14;or

(c) thatthetrademarkwasnot,atthecommencementoftheproceedings,distinctiveofthegoodsorservicesoftheregisteredproprietor,

except that this section shall not apply to a trade mark registered under the repealedOrdinances and incorporated in the Register pursuant to subsection 6(3) until after theexpirationofthreeyearsfromthecommencementofthisAct.Section38.Infringementofatrademark(1)Aregisteredtrademarkisinfringedbyapersonwho,notbeingtheregisteredproprietorofthetrademarkorregistereduserofthetrademarkusingbywayofpermitteduse,usesamarkwhich is identicalwith itor sonearlyresembling it as is likely todeceiveor causeconfusioninthecourseoftradeinrelationtogoodsorservicesinrespectofwhichthetrademark is registered in such amanner as to render theuse of themark likely to be takeneither—

(a) asbeinguseasatrademark;

(b) inacaseinwhichtheuseisuseuponthegoodsorinphysicalrelationtheretoorinanadvertisingcircular,orotheradvertisement,issuedtothepublic,asimportingareferencetoapersonhavingtherighteitherasregisteredproprietororasregistereduser touse the trademarkor togoodswithwhich theperson isconnected in thecourseoftrade;or

(c) inacaseinwhichtheuseisuseatorneartheplacewheretheservicesareavailableorperformedorinanadvertisingcircularorotheradvertisementissuedtothepublic,asimportingareferencetoapersonhavingarighteitherasregisteredproprietororasregisteredusertousethetrademarkortoserviceswiththeprovisionofwhichthepersonisconnectedinthecourseoftrade.

(2)(DeletedbyActA1078).Section39.Infringementoftrademarkbybreachofcertainrestriction(1)Where,bynoticeupongoodsoruponthecontainerofgoods,theregisteredproprietororaregistereduserofatrademarkregisteredintheRegistermakesastatementprohibitingthedoingofanacttowhichthissectionapplies,apersonwho,beingtheownerforthetimebeingofthegoods,doesthatact,orauthorizesittobedone,inrelationtothegoodsinthecourseoftradeorwithaviewtoadealingwiththegoodsinthecourseoftrade,shallbedeemedtoinfringethetrademarkunless—

(a) atthetimewhenheagreedtobuythegoodsheactedingoodfaithwithoutnoticethatthestatementappearedonthegoods;or

(a) theapplicationofthetrademarkupongoodsaftertheyhavesufferedalterationtotheirstate,conditions,get‐uporpacking;

(b) inacaseinwhichthetrademarkisuponthegoodsthealteration,partialremovalorpartialobliterationofthetrademark,theapplicationofsomeothertrademarktothegoodsortheadditiontothegoodsofothermatterinwritingorotherwisethatislikelytoinjurethereputationofthetrademark;and

(c) inthecaseinwhichthetrademarkisuponthegoodsandthereisalsoothermatter

uponthegoodsindicatingaconnectioninthecourseoftradebetweentheregisteredproprietoror registereduser and thegoods, the removalorobliteration,whetherwhollyorpartially,ofthetrademarkunlessthatothermatteriswhollyremovedorobliterated.

(3)Inthissectionreferencesinrelationtogoodstotheregisteredproprietor,toaregistereduser,andtotheregistrationofatrademarkshallbeconstrued,respectively,asreferencestotheregisteredproprietorofthetrademark,toaregistereduserofthetrademarkandtothe registration of the trademark in respect of those goods and the expression “upon”includes,inrelationtogoods,areferencetophysicalrelationtothegoods.Section40.Actsnotconstitutinginfringement(1)NotwithstandinganythingcontainedinthisAct,thefollowingactsdonotconstituteaninfringementofatrademark—

(a) theuseingoodfaithbyapersonofhisownnameorthenameofhisplaceofbusinessorthenameoftheplaceofbusinessofanyofhispredecessorsinbusiness;

(b) theuseingoodfaithbyapersonofadescriptionofthecharacterorqualityofhisgoodsorservices,andinthecaseofgoodsnotbeingadescriptionthatwouldbelikelyto be taken as importing any reference as ismentioned in paragraph 38(1)(b)orparagraph56(3)(b);

(c) theusebyapersonofatrademarkinrelationtogoodsorservicesinrespectofwhichhehasbyhimselforhispredecessorsinbusiness,continuouslyusedthetrademarkfromadatebefore—(i) the use of the registered trade mark by the registered proprietor, by his

predecessorsinbusinessorbyaregistereduserofthetrademark;or

oraregistereduserofthetrademarkif,astothosegoodsorabulkofwhichtheyform part, the registered proprietor or the registered user in conforming to thepermitted use has applied the trademark and has not subsequently removed orobliterateditorhasatanytimeexpresslyorimpliedlyconsentedtotheuseofthetrademark;

(dd)theusebyapersonofatrademarkinrelationtogoodsorservicestowhichtheregisteredproprietororregistereduserhasatanytimeexpresslyorimpliedlyconsentedto;

(e) theuseofthetrademarkbyapersoninrelationtogoodsorservicesadaptedtoform

partof,ortobeaccessoryto,othergoodsorservicesinrelationtowhichthetrademarkhasbeenusedwithout infringementof therightgivenormight for the timebeingbe soused, if theuseof the trademark is reasonablynecessary inorder toindicatethatthegoodsorservicesaresoadaptedandneitherthepurposenortheeffectoftheuseoftrademarkistoindicateotherwisethaninaccordancewiththefacts a connection in the course of trade between any person and the goods orservices;and

(f) theuseofatrademark,whichisoneoftwoormoreregisteredtrademarkswhicharesubstantiallyidentical,inexerciseoftherighttotheuseofthattrademarkgivenbyregistrationasprovidedbythisAct.

(2)Whereatrademarkisregisteredsubjecttoconditions,amendments,modificationsorlimitations,thetrademarkisnotinfringedbytheuseofthetrademarkinanymannerinrelationtogoodstobesoldorotherwisetradedininaplaceorinrelationtogoodstobeexported to amarketor in relation to services tobeprovided in aplaceor in anyothercircumstancestowhichhavingregardtothoseconditions,amendments,modificationsorlimitationstheregistrationdoesnotextend.

PARTVIIRENEWALOFREGISTRATION

Section41.Renewalofregistration(1)TheRegistrarshall,onapplicationmadebytheregisteredproprietorofatrademarkintheprescribedmannerandwithintheprescribedperiod,renewtheregistrationofthetrademarkforaperiodoftenyearsfromthedateofexpirationoftheoriginalregistration,orofthelastrenewalofregistration,asthecasemaybe,andthisdateshallhereinafterbereferredtoas“thedateofexpirationofthelastregistration”.

(2)AttheprescribedtimebeforethedateofexpirationofthelastregistrationofatrademarktheRegistrarshallsendnoticeintheprescribedmannertotheregisteredproprietorofthedateofexpirationofthelastregistrationandtheconditionsastopaymentoffeesuponwhichtherenewal of the registrationmay be obtained and if such conditions have not been dulycompliedwith,theRegistrarmayremovethetrademarkfromtheRegistersubjecttosuchconditions,ifany,astoitsrestorationtotheRegisterasmaybeprescribed,uponpaymentoffeesforrestoration.(3)Notwithstandingsubsection(2),theregistrationofatrademarkshallnotberenewedwhere the application for renewel is made after one year has lapsed from the date ofexpirationofthelastregistration.Section42.StatusofunrenewedtrademarkWherea trademarkhasbeenremoved fromtheRegister fornon‐paymentof the fee forrenewal,itshall,nevertheless,forthepurposeofanapplicationfortheregistrationofatrademarkwithinoneyearfromthedateofexpirationofthelastregistrationbedeemedtobeatrademarkwhich isalreadyontheRegisterexcept that thissectionshallnothaveeffectwhentheRegistrarissatisfiedeither—

(a) thattherehasbeennouseingoodfaithofthetrademarkwhichhasbeenremovedduringthetwoyearsimmediatelyprecedingitsremoval;or

(b) thatnodeceptionorconfusionislikelytoarisefromtheuseofthetrademarkwhichisthesubjectoftheapplicationforregistrationbyreasonofanyprevioususeofthetrademarkwhichhasbeenremoved.

PARTVIII

CORRECTIONANDRECTIFICATIONOFREGISTERSection43.CorrectionofRegister(1) The Registrar may, on request made in the prescribed manner by the registeredproprietorofatrademark,amendoraltertheRegister—

(a) bycorrectinganerrororenteringanychangeinthename,addressordescriptionoftheregisteredproprietorofatrademark;

(b) bycancellingtheentryofatrademarkintheRegister;

(c) byamendingthespecificationofthegoodsorservicesinrespectofwhichthetrade

mark is registered or entering adisclaimerormemorandum relating to the trademarkwithoutextendinginanywaytherightsgivenbytheexistingregistrationofthetrademark,

andmaymakeanyconsequentialamendmentoralterationinthecertificateofregistrationandforthatpurposemayrequirethecertificateofregistrationtobesubmittedtohim.(2)TheRegistrarmayontherequestmadeintheprescribedmannerbyaregistereduserofatrademarkcorrectanerrororenteranychangeinthename,addressordescriptionofthatregistereduser.(3)AdecisionoftheRegistrarunderthissectionissubjecttoappealtotheCourt.Section44.Alterationsofregisteredtrademark(1)TheregisteredproprietorofatrademarkmayapplyintheprescribedmannertotheRegistrarforleavetoaddtooralterthetrademarkinanymannernotsubstantiallyaffectingtheidentitythereofandtheRegistrarmayrefuseleaveormaygrantitonsuchtermsandsubjecttosuchlimitationsashemaythinkfit.(2) The Registrar may cause an application under this section to be advertised in theprescribedmannerinanycasewhereitappearstohimthatitisexpedienttodoso,andifwithintheprescribedtimefromthedateoftheadvertisementanypersongivesnoticetotheRegistrarintheprescribedmannerofoppositiontotheapplication,theRegistrarshall,afterhearingthepartiesifsorequired,decidethematter.(3)AdecisionoftheRegistrarunderthissectionissubjecttoappealtotheCourt.(4) Where leave under subsection (1) is granted the trade mark, as altered, shall beadvertised intheprescribedmannerunless ithasalreadybeenadvertised inthe formtowhichithasbeenalteredinanadvertisementundersubsection(2).Section45.RectificationoftheRegister(1)SubjecttotheprovisionsofthisAct—

(a) theCourtmayontheapplicationintheprescribedmannerofanypersonaggrievedbythenon‐insertioninoromissionfromtheRegisterofanyentryorbyanyentrymadeintheRegisterwithoutsufficientcauseorbyanyentrywrongfullyremainingintheRegister,orbyanyerrorordefectinanyentryintheRegister,makesuchorderformaking,expungingorvaryingsuchentryasifthinksfit;

(b) theCourtmayinanyproceedingunderthissectiondecideanyquestionthatmaybenecessaryorexpedienttodecideinconnectionwiththerectificationoftheRegister;

(2)(DeletedbyActA1078).Section46.Provisionsastonon‐useoftrademark(1) Subject to this section and to section 57, the Courtmay, on application by a personaggrieved,orderatrademarktoberemovedfromtheRegisterinrespectofanyofthegoodsorservicesinrespectofwhichitisregisteredontheground—

(a) thatthetrademarkwasregisteredwithoutanintentioningoodfaith,onthepartoftheapplicantforregistrationor,ifitwasregisteredundersubsection26(1),onthepartof thebodycorporateor registereduserconcerned, touse the trademark inrelationtothosegoodsorservicesandthattherehasinfactbeennouseingoodfaithofthetrademarkinrelationtothosegoodsorservicesbytheregisteredproprietoror registereduserof the trademark for the timebeingup to thedateonemonthbeforethedateoftheapplication;or

(b) thatuptoonemonthbeforethedateoftheapplicationacontinuousperiodofnotlessthan threeyearshadelapsedduringwhich the trademarkwasa registered trademarkandduringwhichtherewasnouseingoodfaithofthetrademarkinrelationtothosegoodsorservicesbytheregisteredproprietororregistereduserofthetrademarkforthetimebeing.

(2)Exceptwhereanapplicanthasbeenpermittedundersection20toregisteranidenticaloranearlyresemblingtrademarkinrespectofthegoodsorservicestowhichtheapplicationrelatesortheCourtisoftheopinionthattheapplicantcanproperlybepermittedtoregisterthetrademark,theCourtmayrefuseanapplicationmadeundersubsection(1)—

(a) in relation to any goods, if therehasbeen, before the relevantdate orduring therelevant period, as the case may be, use in good faith of the trade mark by theregisteredproprietorofthetrademarkforthetimebeinginrelationtogoodsofthesamedescription,beinggoodsinrespectofwhichthetrademarkisregistered;and

(b) inrelationtoanyservices,iftherehasbeen,beforetherelevantdateorduringtherelevant period, as the case may be, use in good faith of the trade mark by theregisteredproprietorofthetrademarkforthetimebeinginrelationtoservicesofthesamedescription,beingservicesinrespectofwhichthetrademarkisregistered.

(3)Whereinrelationtogoodsinrespectofwhichatrademarkisregistered—

(a) thematterreferredtoinparagraph(1)(b)areshownasfarasregardsfailuretousethetrademarkinrelationtogoodstobesoldorotherwisetradedininaparticularplaceinMalaysia(otherwisethanforexportfromMalaysia)orinrelationtogoodstobeexportedtoaparticularmarketoutsideMalaysia;and

resemblingtrademarkinrespectofthosegoodsunderaregistrationextendingtotheuseinrelationtogoodstobesoldorotherwisetradedininthatplace(otherwisethanforexportfromMalaysia)orinrelationtogoodstobeexportedtothatmarket,ortheCourtisoftheopinionthatthatpersonmightproperlybepermittedtoregisterthetrademark,

the Court may, on application by that person, direct that the registration of the first‐mentionedtrademarkshallbesubject tosuchconditions,amendments,modificationsorlimitationsastheCourtthinksproperforsecuringthatthatregistrationshallceasetoextendtouseofthetrademark inrelationtogoodstobesoldorotherwisetraded inthatplace(otherwise than for export fromMalaysia)or in relation to goods tobe exported to thatmarket.(3A)Whereinrelationtoservicesinrespectofwhichatrademarkisregistered—

(a) themattersreferredtoinparagraph(1)(b)areshownasfarasregardsfailuretousethetrademarkinrelationtoservicesprovidedinaparticularplaceinMalaysia;and

(b) apersonhasbeenpermittedunder section20 to register an identical or anearlyresemblingtrademarkinrespectofthoseservicesunderaregistrationextendingtotheuseinrelationtoservicesprovidedinthatplace,ortheCourtisoftheopinionthatthatpersonmightproperlybepermittedtoregisterthetrademark,

PARTIXREGISTEREDUSER

Section48.Registeredusers(1)Subjecttotheprovisionsofthissection,wheretheregisteredproprietorofatrademarkgrants,bylawfulcontract,arighttoanypersontousethetrademarkforalloranyofthegoods or services in respect of which the trademark is registered, that personmay beenteredontheRegisterasaregistereduserofthesaidtrademarkwhetherwithorwithoutanyconditionsorrestrictions,providedthatitshallbeaconditionofanysuchregistrationthattheregisteredproprietorshallretainandexercisecontrolovertheuseofthetrademarkandoverthequalityofthegoodsorservicesprovidedbytheregistereduserinconnectionwiththattrademark.(2)Whereitisproposedthatapersonshallberegisteredasaregistereduserofatrademark,theregisteredproprietorshallsubmitanapplicationtotheRegistrarfortheregistrationofthatpersonasaregistereduserofthetrademarkandsuchapplicationshallbeaccompaniedbytheprescribedfeeandthefollowinginformation:

(a) therepresentationoftheregisteredtrademark;

(b) thenames,addresses,andaddressesforserviceoftheparties;

(c) thegoodsorservicesinrespectofwhichtheregistrationisproposed;

(d) any conditions or restrictions proposedwith respect to the characteristics of thegoodsorservices,tothemodeorplaceofpermitteduseortoanyothermatter;and

(e) whetherthepermitteduseistobeforaperiodorwithoutlimitofperiod,andiffora

period,thedurationofthatperiod.(3) The registered proprietor shall furnish the Registrar with such further documents,informationorevidenceasmayberequiredbytheRegistraroranyregulationsmadeunderthisAct.(4)Onreceiptofanapplicationforregistrationofapersonasaregistereduserofatrademark under subsection (2), the Registrar shall enter on the Register all the particularsrequiredtobeprovidedthereunder.

(5)Whereapersonhasbeenregisteredasaregistereduserofatrademark,theuseofthattrademarkbytheregistereduserwithinthelimitsofhisregistrationshallbedeemedtobeusebytheregisteredproprietorofthetrademarktothesameextentastheuseofthetrademarkbytheregistereduserandshallbedeemednottobeusebyanyotherperson.(6)Subsection(5)shallceasetohaveeffectwithregardtoanyregistereduserofatrademark—

(a) ifthetrademarkceasestobearegisteredtrademarkforanyreason;

(b) if the goods or services for which the trademark is registered are subsequentlylimitedsoas toexcludeanyorallof thegoodsorservices inrespectofwhichtheregistrationoftheregistereduserhasbeenmade;

(c) iftheregisteredproprietorceasestoexercisecontrolovertheuseofthetrademark

and over the quality of the goods or services provided by the registered userconcernedinrelationtothattrademark;

(d) at the date of expiration of the last registration of the trademark unless a fresh

application under subsection (2) accompanies any application for renewal of theregistrationofthattrademark;

atthedateofanyassignmentortransmissionoftheregisteredtrademark,unlessanduntilthedevolutionoftitleisrecordedontheRegisterinaccordancewiththeprovisionsofthisActandthesubsequentproprietoroftheregisteredtrademarkmakesafreshapplicationundersubsection(2).(7)Iftheregisteredproprietorofatrademarkfailstoexerciseanyoftherightsconferredonhimbyhis registration to theprejudiceofanyregistereduserof that trademark, theregistered user may apply to the Court for such relief as the Court may consider just,includingrectificationoftheRegisterbyorderingthattheregistereduserberecordedastheregisteredproprietorofthetrademark,andinanycasewhereuseofthetrademarkbyanypersonentitledtouseitwouldbelikelytodeceiveorcauseconfusion,theCourtmayorderthatthetrademarkshallberemovedfromtheRegister,notwithstandingtheprovisionsofsection37.(8)Section62shallapplytoanyproceedingsundersubsection(7)thatmightleadtoanyalterationorrectificationoftheRegister.Section49.Powerstovary,extendorcancelregistrationofaregistereduser(1)Withoutprejudicetosection45,theregistrationofapersonasaregistereduser—

PARTXASSIGNMENTOFTRADEMARKS

Section55.Assignmentandtransmissionoftrademarks(1)Subjecttothissection,aregisteredtrademarkshallbeassignableandtransmissiblewithorwithout the goodwill of thebusiness concerned in the goodsor services in respect ofwhichthetrademarkisregisteredorinpartofthegoodsorservices.

(1A) Subsection (1) shall have effect in the case of an unregistered trademark used inrelation to any goods or services as it has effect in the case of a registered trademarkregisteredinrespectofanygoodsorservices,ifatthetimeoftheassignmentortransmissionoftheunregisteredtrademarkitisorwasusedinthesamebusinessasaregisteredtrademark,andifitisorwasassignedortransmittedatthesametimeandtothesamepersonasthat registered trademark and in respect of goodsor services all ofwhich are goodsorservicesinrelationtowhichtheunregisteredtrademarkisorwasusedinthatbusinessandinrespectofwhichthatregisteredtrademarkisorwasassignedortransmitted.(2) Notwithstanding subsection (1), an assignment of a registered trade mark withoutgoodwillwhetherbeforeorafterthecommencementofthisActisinvalidifthetrademarkhas not at any time before the assignment been in use in good faith inMalaysia by theassignororhispredecessorintitleexceptthatthissubsectiondoesnotapplywhere—

(a) thetrademarkwasregisteredwiththeintentionthatitshallbeassignabletoabodycorporateyettobeformedandthetrademarkhasbeenassigned;or

(b) thetrademarkwasregisteredwiththeintentionthatapersonshallbepermittedtouseitasaregistereduserandsuchregistereduserhasbeenregisteredinrespectofthetrademarkwithinsixmonthsaftertheregistrationofthetrademarkandhasusedthattrademarkwithinthatperiod.

(3) Notwithstanding subsections (1) and (1A), a trade mark shall be deemed not to beassignableortransmissibleif,asaresultoftheassignmentortransmission,whetherundercommon law or by registration, more than one of the persons concerned would haveexclusiverightstotheuseofanidenticaltrademarkortotheuseoftrademarkssonearlyresemblingeachotherasarelikelytodeceiveorcauseconfusion.(4)WhereanapplicationismadeintheprescribedmannerbytheregisteredproprietorofatrademarkwhoproposestoassignitorbyapersonwhoclaimsthatatrademarkhasbeentransmittedtohimortoapredecessorintitleofhissincethecommencementofthisAct,theRegistrar,ifheissatisfiedthatinallcircumstancestheuseofthetrademarksinexerciseofthe said rightswould not be contrary to the public interest,may inwriting approve theassignmentor transmissionandanassignmentor transmissionsoapprovedshallnotbedeemedtobeortohavebeeninvalidunderthissectionbutthisprovisionshallnothaveeffect unless application for the registration under section 47 of the title of the personbecomingentitledismadewithinsixmonthsfromthedateonwhichtheapprovalisgivenor,inthecaseofatransmission,wasmadebeforethatdate.

(5)Whereanassignmentinrespectofanygoodsorservicesofatrademarkwhichisatthetimeoftheassignmentusedinabusinessinthosegoodsorservicesismadeotherwisethaninconnectionwiththegoodwillofthatbusiness,theassignmentshallnotbedeemedtohavetakeneffectunlesstheassignmenthasbeenadvertisedintheprescribedmannerandthe

PARTXICERTIFICATIONTRADEMARKS

Section56.Certificationtrademarks(1)Amarkmustbecapable, inrelation toanygoodsorservices,ofdistinguishing in thecourseoftradegoodsorservicescertifiedbyanypersoninrespectoforigin,material,modeofmanufacture, quality, accuracy, or other characteristic, from goods or services not socertifiedshallberegistrableasacertificationtrademarkintheRegisterinrespectofthosegoodsorservicesinthenameofthatpersonasproprietorthereofexceptthatamarkshallnotbesoregistrableinthenameofapersonwhocarriesonatradeingoodsorservicesofthekindcertified.(2) In determiningwhether amark is capable of distinguishing, the Registrarmay haveregardtotheextenttowhich—

(a) themarkisinherentlycapableofdistinguishinginrelationtothegoodsorservicesinquestion;and

(b) by reason of the use of themark or any other circumstances, themark is in factcapableofdistinguishinginrelationtothegoodsorservicesinquestion.

(3) Subject to paragraphs 37(a) and (b), paragraphs 40(1)(a) to (c) and this Part, theregistrationofapersonasregisteredproprietorofacertificationtrademarkinrespectofanygoodsorservicesshall,ifvalid,givetothatpersontheexclusiverighttotheuseofthetrademarkinrelationtothosegoodsorservices,andwithoutprejudicetothegeneralityoftheforegoingwords,thatrightshallbedeemedtobeinfringedbyanypersonwho,notbeingtheregisteredproprietorofthetrademarkorapersonauthorizedbyhimundertherulesinthat behalf using it in accordance therewith, uses a mark identical with it or so nearlyresemblingitasislikelytodeceiveorcauseconfusion,inthecourseoftrade,inrelationtoanygoodsorservicesinrespectofwhichitisregisteredandinsuchmannerastorendertheuseofthemarklikelytobetakeneither—

(a) asbeinguseasatrademark;

(b) inthecaseinwhichtheuseisuseuponthegoodsorservicesorinphysicalrelationtheretoorinanadvertisingcircular,orotheradvertisementissuedtothepublic,asimportingareferencetosomepersonhavingtherighteitherasregisteredproprietor

(c) inacaseinwhichtheuseisuseatorneartheplacewheretheservicesareavailableorperformedorinanadvertisingcircularorotheradvertisementissuedtothepublic,as importing a reference to a person having a right either as proprietor or as aregisteredusertousethetrademarkortoserviceswiththeprovisionofwhichsuchpersonisconnectedinthecourseoftrade.

(4)Therighttotheuseofacertificationtrademarkgivenbyregistrationshallbesubjecttoanyconditions,amendments,modificationsorlimitationsenteredontheRegisterandshallnotbedeemedtobeinfringedbytheuseofanysuchmarkinanymode,inrelationtogoodstobesoldorotherwisetraded in inanyplace, inrelationtogoodstobeexportedtoanymarket, inrelationtoservicestobeprovidedinaplaceorinanycircumstancestowhichhaving regard to any such conditions, amendments, modifications or limitations, theregistrationdoesnotextend.(5)Therighttotheuseofacertificationtrademarkgivenbyregistrationshallnotbedeemedtobeinfringedbytheuseofanysuchmarkbyaperson—

(a) inrelationtogoodscertifiedbytheregisteredproprietorofthetrademarkif,astothosegoodsorabulkofwhichtheyformpart,theproprietororanotherinaccordancewithhisauthorizationundertherelevantruleshasappliedthetrademarkandhasnotsubsequentlyremovedorobliteratedit;

(aa)wheretheregisteredproprietorhasatanytimeexpresslyorimpliedlyconsentedtotheuseofthetrademark;or

(b)inrelationtogoodsorservicesadaptedtoformpartof,ortobeaccessoryto,other

goods or services in relation to which the trade mark has been used withoutinfringementoftherightgivenormightforthetimebeingbesoused,iftheuseofthemarkisreasonablynecessaryinordertoindicatethatthegoodsorservicesaresoadaptedandneitherthepurposenortheeffectoftheuseofthemarkistoindicateotherwisethaninaccordancewiththefactthatthegoodsorservicesarecertifiedbytheregisteredproprietor,

exceptthatparagraph(a)shallnothaveeffectinthecaseofuseconsistingoftheapplicationofanysuchmarktoanygoods,notwithstandingthattheyaresuchgoodsasarementionedinthatparagraph,ifsuchapplicationiscontrarytotherelevantrules.(6)Whereacertificationtrademarkisoneoftwoormoreregisteredtrademarkswhichareidenticalornearlyresemblingeachother,theuseofanyofthosetrademarksinexerciseoftherighttotheuseofthattrademarkgivenbyregistrationshallnotbedeemedtobeaninfringementoftherightsogiventotheuseofanyotherofthosetrademarks.

(7)Anapplicationfortheregistrationofatrademarkunderthissectionmustbemadetothe Registrar in writing in the prescribed manner by the person who proposes to beregisteredastheproprietorthereof.(8) Subsections 25(2) to (8) and subsection 25(10) shall have effect in relation to anapplication under this section as they have effect in relation to an application undersubsection(1)ofthatsection.(9)IndealingwithanapplicationunderthissectiontheRegistrarshallhaveregardtothelikeconsiderations,asfarasrelevant,asiftheapplicationwereanapplicationundersection25andtoanyotherconsiderationsrelevanttoapplicationsunderthissection,includingthedesirabilityofsecuringthatacertificationtrademarkshallcomprisesomeindicationthatitissuchatrademark.(10)AnapplicantfortheregistrationofatrademarkunderthissectionshalltransmittotheRegistrardraftrulesforgoverningtheusethereof,whichshallincludeprovisionsastothecasesinwhichtheproprietoristocertifygoodsorservicesandtoauthorizetheuseofthetrademarkandmaycontainanyotherprovisionsthattheRegistrarmayrequireorpermitto be inserted therein (includingprovisions conferring a right of appeal to theRegistraragainstanyrefusaloftheproprietortocertifygoodsorservicesortoauthorizetheuseofthetrademarkinaccordancewiththerules)andsuchrules,ifapproved,shallbedepositedwiththeRegistrarandshallbeopentoinspectioninlikemannerastheRegister.(11)TheRegistrarshallconsidertheapplicationwithregardtothefollowingmatters,thatistosay—

(a) whethertheapplicantiscompetenttocertifythegoodsorservicesinrespectofwhichthemarkistoberegistered;

(b) whetherthedraftrulesaresatisfactory;and

(c) whetherinallthecircumstancestheregistrationsappliedforwouldbetothepublicadvantage,

andmayeither—

(i) refusetoaccepttheapplication;or

(ii) accept the application and approve the rules, either without modification and

unconditionally or subject to any conditions, amendments, modifications orlimitationsoftheapplicationoroftherules,whichhemaythinkrequisite,

butexceptinthecaseofacceptanceandapprovalwithoutmodificationandunconditionally,theRegistrarshallnotdecidethematterwithoutgivingtotheapplicantanopportunityofbeingheardandtheRegistrarmay,attherequestoftheapplicant,considertheapplicationbeforeauthorizationtoproceedwiththeapplicationhasbeengiven,sothatheshallbeat

liberty to reconsider anymatter onwhich he has given a decision if any amendment ormodificationisthereaftermadeintheapplicationorinthedraftrules.(12)WhereanapplicationhasbeenacceptedtheRegistrarshall,assoonasmaybeaftersuchacceptance,causetheapplicationasacceptedtobeadvertisedintheprescribedmannerandsection28shallhaveeffectinrelationtotheregistrationofthemarkasiftheapplicationhadbeenanapplicationundersection25exceptthat,indecidingundersection28,theRegistrarshallhaveregardonlytotheconsiderationreferredtoinsubsection(9),andadecisionundersection28infavouroftheapplicantshallbeconditionalonthedeterminationinhisfavourby the Registrar under subsection (13) of any opposition relating to any of themattersreferredtoinsubsection(11).(13) When notice of opposition is given relating to any of the matters referred to insubsection(11),theRegistrarshall,afterhearingtheparties,ifsorequired,andconsideringanyevidence,decidewhether,andsubjecttowhatconditions,amendments,modificationsorlimitationsoftheapplicationoroftherules,ifany,registrationis,havingregardtothosematters,tobepermitted.(14)(a)Therulesdepositedinrespectofacertificationtrademarkmay,ontheapplicationoftheregisteredproprietor,bealteredbytheRegistrar.(b)TheRegistrarmaycauseanapplicationforhisconsenttobeadvertisedinanycasewhereitappearstohimthatitisexpedienttodoso,and,wheretheRegistrarcausesanapplicationtobeadvertised,ifwithintheprescribedtimefromthedateoftheadvertisementanypersongivesnoticetotheRegistrarofoppositiontotheapplication,theRegistrarshallnotdecidethematterwithoutgivingthepartiesanopportunityofbeingheard.(15)TheCourtmay,ontheapplicationintheprescribedmannerofanypersonaggrieved,orontheapplicationoftheRegistrar,makesuchorderasitthinksfitforexpungingorvaryinganyentryintheRegister,relatingtoacertificationtrademark,orforvaryingthedepositedrules,ontheground—

(a) thattheregisteredproprietorisnolongercompetent,inthecaseofanyofthegoodsorservicesinrespectofwhichthetrademarkisregistered,tocertifythegoodsorservices;

(b) thattheregisteredproprietorhasfailedtoobserveaprovisionofthedepositedrulestobeobservedonhispart;

(c) thatitisnolongertothepublicadvantagethatthetrademarkshouldberegistered;or

(d) thatitisrequisiteforthepublicadvantagethat,ifthetrademarkremainsregistered,therulesshouldbevaried,

buttheCourtshallnothaveanyjurisdictiontomakeanorderundersection45onanyofthesegrounds.(16)TheRegistrarshallrectifytheRegisterandthedepositedrulesinsuchmannerasmayberequisiteforgivingeffecttoanordermadeundersubsection(15).(17) Notwithstanding anything in subsection 63(2) the Registrar shall not have anyjurisdictiontoawardcoststooragainstanypartyonanappealtohimagainstarefusalofthe registered proprietor of certification trade mark to certify goods or services or toauthorizetheuseofthetrademark.(18)(DeletedbyActAA1078).(19)TheprovisionsofthisPartshallbeconstruedsubjecttosection19ofthe*StandardsAct1966[Act76of1966]*.

PARTXII

DEFENSIVETRADEMARKSSection57.Defensiveregistrationofwellknowntrademarks(1)Whereatrademarkconsistingofaninventedwordorwordshasbecomesowellknownasregardsanygoodsorservicesinrespectofwhichitisregisteredand,inrelationtowhichithasbeenused,thattheusethereofinrelationtoothergoodsorserviceswouldlikelytobetakenasindicatingaconnectioninthecourseoftradebetweentheothergoodsorservicesand a person entitled to use the trademark in relation to the firstmentioned goods orservices, then, notwithstanding that the proprietor registered in respect of the firstmentionedgoodsorservicesdoesnotuseorproposetousethetrademarkinrelationtotheothergoodsorservicesandnotwithstandinganythinginsection46thetrademarkmay,ontheapplication inaprescribedmannerof theproprietorregisteredinrespectof the firstmentionedgoods or services, be registered in his name in respect of the other goods orservicesasadefensivetrademarkandwhilesoregistered,shallnotbeliabletobetakenofftheRegisterinrespectofothergoodsorservicesundersection46.(2) The registered proprietor of a trademarkmay apply for the registration thereof inrespectofanygoodsorservicesasadefensivetrademarknotwithstandingthatitisalreadyregisteredinhisnameinrespectofthegoodsorservicesotherwisethanasadefensivetrademark,ormayapplyfortheregistrationthereofinrespectofanygoodsorserviceotherwisethanasadefensivetrademarknotwithstandingthatitisalreadyregisteredinhisnameinrespectofthegoodsasadefensivetrademark,inlieuineachcaseoftheexistingregistration.Section58.DefensivetrademarkdeemedtobeassociatedtrademarkA trade mark registered as a defensive trade mark and that trade mark as otherwiseregistered in the name of the same proprietor shall notwithstanding that the respective

registrations are in respect of different goods or services bedeemed to be, and shall beregisteredas,associatedtrademarks.Section59.RectificationofRegisterTheRegistrarmayatanytimecancel theregistrationofadefensivetrademarkofwhichthereisnolongeranyregistrationinthenameofthesameproprietorotherwisethanasadefensivetrademark.Section60.ApplicationofActSubject to this Part, this Act applies in relation to the registration of a trademark as adefensivetrademarkanda trademarkregisteredasadefensivetrademarkbut it isnotnecessaryfortheregisteredproprietorofadefensivetrademarktoproveuseofthetrademarkforthepurposeofobtainingrenewaloftheregistration.

PARTXIIILEGALPROCEEDINGS,COSTANDEVIDENCE

Section61.CertificateofvalidityInanylegalproceedingsinwhichthevalidityofaregisteredtrademarkcomesintoquestionandisdecidedinfavouroftheregisteredproprietorofthetrademark,theCourtmaycertifyto thateffect, and if it socertifies then inanysubsequent legalproceedings inwhich thevalidityoftheregistrationcomesintoquestiontheregisteredproprietorofthetrademarkonobtaininga finalorderor judgment inhis favourshallhavehis fullcosts,chargesandexpensesasbetweensolicitorandclient,unlessinthesubsequentproceedingstheCourtcertifiesthatheoughtnottohavethem.Section62.HearingofRegistrar(1)InanylegalproceedingsinwhichthereliefsoughtincludesalterationorrectificationoftheRegister,theRegistrarshallhavetherighttoappearandbeheard,andshallappearifsodirectedbytheCourt.(2)Unlessotherwisedirectedby theCourt, theRegistrar, in lieuof appearing andbeingheard,maysubmittotheCourtastatementinwritingsignedbyhim,givingparticularsoftheproceedingsbeforehiminrelationofthematterinissueorofthegroundsofanydecisiongivenbyhimaffectingthesameorofthepracticeoftheofficeinlikecases,orofsuchothermattersrelevanttotheissues,andwithinhisknowledgeasRegistrar,ashethinksfit,andsuchstatementshallbedeemedtoformpartoftheevidenceintheproceedings.Section63.Costs(1)InallproceedingsbeforetheCourtunderthisAct,theCourtmayawardtoanypartysuchcostsasitmayconsiderreasonableandthecostsasitmayconsiderreasonableandthecosts

oftheRegistrarshallbeinthediscretionoftheCourt,buttheRegistrarshallnotbeorderedtopaythecostsofanyoftheotherparties.(2)InallproceedingsbeforetheRegistrarunderthisAct,theRegistrarshallhavepowertoawardtoanypartysuchcostsashemayconsiderreasonableandtodirecthowandbywhatpartiestheyaretobepaid,andanysuchordermay,byleaveoftheCourt,beenforcedinthesamemannerasajudgmentororderoftheCourttothesameeffect.Section64.Modeofgivingevidence(1) Inallproceedingsbefore theRegistrarunder thisAct, theevidenceshallbegivenbystatutorydeclarationintheabsenceofdirectionstothecontrary,but,inanycaseinwhichhethinksfit,theRegistrarmaytakeevidencevivavoceinlieuoforinadditiontoevidencebydeclaration.(2)Anysuchstatutorydeclarationmay,inthecaseofappeal,beusedbeforetheCourtinlieuof evidence by affidavit, but if so used, shall have all the incidents and consequences ofevidencebyaffidavit.(3)Inanyactionorproceedingsrelatingtoatrademarkortradename,theRegistrarortheCourt, as the casemay be, shall admit evidence of the usages of the trade concerned orevidenceofbusinessusagesintheprovisionoftheservicesinquestion,andevidenceofanyrelevanttrademarksortradenameorbusinessnameorget‐uplegitimatelyusedbyotherpersons.Section65.Sealedcopiestobeevidence(1)PrintedorwrittencopiesorextractsoforfromtheRegisterpurportingtobecertifiedbytheRegistrarandsealedwithhissealshallbeadmissibleasevidence inanyproceedingsbeforeanycourtoflawwithoutfurtherprooforproductionoftheoriginals.(2)AcertificatepurportingtobeunderthehandoftheRegistrarastoanyactwhichheisauthorizedunderthisActtoperformandwhichhehasorhasnotperformed,asthecasemaybe,shallbeprimafacieevidenceinanyproceedingsbeforeanycourtoflawofhishavingornothavingperformedtheact.Section66.Ministermaydeclaredocumentsofforeignstatepertainingtotrademarkstobeadmissible(1)TheMinistermaybyorderpublishedintheGazettedeclareanydocumentsorclassofdocumentsofaforeignstatetobeadmissibleasevidenceinanyproceedingsbeforeaCourtif—

(a)thedocumentissealedwiththesealoftheauthorizedofficerorthegovernmentoftheforeignstateandthesealpertainstothetrademarksregisteredinorotherwiserecognized by the foreign country or if there is no such seal there is enclosed a

(b) theforeignstateorpartthereofhasenteredintoreciprocalarrangementswiththe

GovernmentofMalaysiainrespectoftheadmissibilityofthedocuments.

(2)Forthepurposeofthissection—“authorized officer” means a person or authority authorized by the government of theforeign state to keep andmaintain a register or other record of trademarks under anywrittenlawinforceintheforeignstaterelatingtotrademarks;“document”means—

(a) a printed or written copy of extract or other record of trade marks kept andmaintained in the foreignstateunderanywritten law in force in the foreignstaterelatingtotrademarks;or

(b) any other document pertaining to any matter or act in relation to trade marksregisteredinorotherwiserecognizedbytheforeignstateastrademarks;

“trademark”meansanydevice,brand,heading,label,ticket,name,signature,word,letter,numeraloranycombination thereofwhich isusedorproposed tobeused in relation togoodsorservicesforthepurposeofindicatingorsoastoindicateaconnectioninthecourseoftradebetweenthegoodsorservicesandapersonhavingtherighteitherasproprietororasregisteredusertousethetrademark(intheforeignstate)whetherwithorwithoutanyindicationoftheidentityofthatpersonandwhichisregisteredorotherwiserecognizedbytheforeignstateasatrademark(underanywrittenlawinforceintheforeignstaterelatingtotrademarks)butdoesnotincludethetrademarksofanotherforeignstateregisteredinorotherwiserecognizedbytheforeignstatebyvirtueofareciprocalarrangementbetweentheforeignstateandthatotherforeignstate.(3)ForavoidanceofdoubtthissectionshallnotbeconstruedtoconferrecognitionofthetrademarksofanyforeignstateforthepurposeofregistrationunderthisActbutshallbeconstruedonlywithreferencestotheadmissibilityofevidenceinanyproceedingsbeforeaCourtofthedocumentsoftheforeignstate.Section67.DiscretionarypowerIn anyappeal from thedecisionof theRegistrarunder thisAct theCourt shall haveandexercisethesamediscretionarypowersasareconferredupontheRegistrarunderthisAct.Section68.(DeletedbyActA881)Section69.AppealfromRegistrar

ExceptwhereexpresslygivenbytheprovisionsofthisActorregulationsmadethereunderthereshallbenoappealfromadecisionoftheRegistrarbuttheCourt,indealingwithanyquestionoftherectificationoftheRegister(includingallapplicationsundersection45),shallhavepowertoreviewanydecisionoftheRegistrarrelatingtotheentryinquestionorthecorrectionsoughttobemade.

PARTXIVCONVENTIONSANDINTERNATIONALARRANGEMENTS

Section70.RightofpriorityunderConvention,etc.(1)WhereanypersonhasappliedforprotectionofanytrademarkinaConventioncountryor prescribed foreign country, such person or his legal representative or assignee, afterfurnishingadeclarationwithintheprescribedtimeindicatingthedateoftheapplicationandthecountryinwhichitwasmade,shallinrespectoftheapplicationforregistrationofhistrademark,beentitledtoarightofpriorityandsuchapplicationinMalaysiashallhavethesame date as the date of the application for protection in the Convention country orprescribedforeigncountryconcerned,asthecasemaybe,subjecttothefollowing:

(a) that the application for registration is made within six months from the date ofapplicationforprotectionintheConventioncountryorprescribedforeigncountryconcerned,asthecasemaybe;andwhereanapplicationforprotectionismadeinmorethanoneConventioncountryorprescribedforeigncountry,theperiodofsixmonthsreferredtohereinshallbereckonedfromthedateonwhichtheearlierorearliestofthoseapplicationsismade;

(b) that the applicant shall be either a national or resident of, or a body corporateincorporatedunderthelawsof,theConventioncountryorprescribedforeigncountryconcerned,asthecasemaybe;and

(c) thatnothing in this section shall entitle theproprietorof a trademark to recoverdamages for infringements or any happening prior to the date on which theapplicationforprotectionofthetrademarkismadeinMalaysia.

(2)Notwithstanding any other provision of thisAct, the registration of a trademark inrespectofwhicharightofpriorityexistsshallnotberefusedorrevokedbyreasononlyoftheuseofthetrademarkbysomeotherpersoninMalaysiaduringthesaidperiodofsixmonths.(3)Theapplicationfortheregistrationofatrademarkinrespectofwhicharightofpriorityexists—

(a) shall bemade and dealt with in the samemanner as an ordinary application forregistrationunderthisAct;and

(b) shallspecifytheConventioncountryorprescribedforeigncountry,asthecasemaybe,inwhichtheapplicationforprotection,orthefirstsuchapplication,wasmadeandthedateonwhichsuchapplicationforprotectionwasmade.

(4)Asregardsprescribedforeigncountries,thissectionshallapplyonlyforthedurationoftheperiodtheordercontinuesinforceinrespectofthatcountry.(5)ForthepurposesofthisAct,theMinistermay,byorderpublishedintheGazette,declareacountryashavingmadearrangementswithMalaysiaforthereciprocalprotectionoftrademarks.Section70A.Temporaryprotectionof trademarks in respectofgoodsor serviceswhicharethesubjectmattersofinternationalexhibitions(1)NotwithstandinganythinginthisAct,temporaryprotectionshallbegrantedtoatrademark inrespectofgoodsorserviceswhicharethesubjectmattersofanexhibitionatanofficialorofficiallyrecognizedinternationalexhibitionheldinMalaysiaorinanyConventioncountryorprescribedforeigncountry.(2)Thetemporaryprotectiongrantedundersubsection(1)shallnotextendanyperiodofpriority claimedbyanapplicantandwherea rightofpriority is claimedbyanapplicantsubsequenttothetemporaryprotection,theperiodofpriorityshallremainsixmonthsbuttheperiodshallcommencefromthedateoftheintroductionofthegoodsorservicesintotheexhibition.(3)Anapplicant forregistrationofa trademarkwhosegoodsorservicesarethesubjectmatters of an exhibition at an official or officially recognized international exhibition inMalaysiaorinanyConventioncountryorprescribedforeigncountryandwhoappliesforregistrationofthatmarkinMalaysiawithinsixmonthsfromthedateonwhichthegoodsorservicesfirstbecamethesubjectmattersoftheexhibitionshall,onhisrequest,bedeemedtohaveappliedforregistrationonthedateonwhichthegoodsorservicesfirstbecamethesubjectmattersoftheexhibition.(4)Evidencethatthegoodsorservicesbearingthetrademarkarethesubjectmattersofanexhibition at an official or officially recognized international exhibition shall be by acertificateissuedbythecompetentauthoritiesoftheexhibition.Section70B.Protectionofwell‐knowntrademarks(1)TheproprietorofatrademarkwhichisentitledtoprotectionundertheParisConventionortheTRIPSAgreementasawellknowntrademarkisentitledtorestrainbyinjunctiontheuseinMalaysiainthecourseoftradeandwithouttheproprietor’sconsentofthetrademarkwhich,ortheessentialpartofwhich,isidenticalwithornearlyresemblestheproprietor’smark,inrespectofthesamegoodsorservices,wheretheuseislikelytodeceiveorcauseconfusion.

(2)Nothinginsubsection(1)shallaffectthecontinuationofanybonafideuseofatrademarkbegunbeforethecommencementofthisAct.(3)Inthissection,referencestoatrademarkwhichisentitledtoprotectionunderArticle6bisoftheParisConventionorArticle16of theTRIPSAgreementasawellknowntrademarkaretoamarkwhichiswellknowninMalaysiaasbeingthemarkofapersonwhetherornotthatpersoncarriesonbusiness,orhasanygoodwill,inMalaysia,andreferencestotheproprietorofsuchamarkshallbeconstruedaccordingly.

PARTXIVABORDERMEASURES

Section70C.InterpretationInthisPart,unlessthecontextotherwiserequires—“authorizedofficer”means—

(a) aproperofficerofcustomsasdefinedundertheCustomsAct1967[Act235];or

(b) anypublicofficeroranypersonintheemploymentoftheCorporationappointedbytheMinisterbynotification in theGazette toexercise thepowersandperformthedutiesconferredandimposedonanauthorizedofficerbythisPart;

“counterfeit trade mark goods” means any goods, including packaging, bearing withoutauthorizationatrademarkwhichisidenticalwithorsonearlyresemblesthetrademarkvalidlyregisteredinrespectofsuchgoods,orwhichcannotbedistinguishedinitsessentialaspectsfromsuchatrademark,andwhichinfringestherightsoftheproprietorofthetrademarkunderthisAct;“goods in transit”means goods imported,whether or not landedor transshippedwithinMalaysia, which are to be carried to another country either by the same or anotherconveyance;“import”meanstobringorcausetobebroughtintoMalaysiabywhatevermeans;“retentionperiod”,inrelationtoseizedgoods,means—

(a) theperiodspecifiedinanoticegivenundersection70Ginrespectofthegoods;or

(b) iftheperiodhasbeenextendedundersection70G,thatperiodsoextended;“security”meansanysumofmoneyincash;

“seizedgoods”meansgoodsseizedundersection70D.Section70D.Restrictiononimportationofcounterfeittrademarkgoods(1)AnypersonmaysubmitanapplicationtotheRegistrarstating—

(a) that he is the proprietor of a registered trademark or an agent of the proprietorhavingthepowertosubmitsuchapplication;

(b) that,atatimeandplacespecifiedintheapplication,goodswhich,inrelationtotheregisteredtrademark,arecounterfeittrademarkgoodsareexpectedtobeimportedforthepurposeoftrade;and

(c) thatheobjectstosuchimportation.

(2) An application under subsection (1) shall be supported by such documents andinformationrelatingtothegoodsastoenablethemtobeidentifiedbytheauthorizedofficer,andaccompaniedbysuchfeeasmaybeprescribed.(3)Uponreceiptoftheapplicationundersubsection(1),theRegistrarshalldeterminetheapplication,andtheRegistrarshallwithinareasonableperiodinformtheapplicantwhethertheapplicationhasbeenapproved.(4)Indeterminingthereasonableperiodundersubsection(3),theRegistrarshalltakeintoconsiderationallrelevantcircumstancesofthecase.(5)Anapprovalundersubsection(3)shallremaininforceuntiltheendoftheperiodofsixtydayscommencingonthedayonwhichtheapprovalwasgiven,unlessitiswithdrawnbeforetheendofthatperiodbytheapplicantbygivinganoticeinwritingtotheRegistrar.(6) Where an approval has been given under this section and has not lapsed or beenwithdrawn, the importation of any counterfeit trade mark goods into Malaysia for thedurationoftheperiodspecifiedintheapprovalshallbeprohibited.(7)Upongivinghisapprovalundersubsection(3)theRegistrarshallimmediatelytakethenecessarymeasurestonotifytheauthorizedofficer.(8) Where an authorized officer has been notified by the Registrar, he shall take thenecessaryactiontoprohibitanypersonfromimportinggoodsidentifiedinthenotice,notbeinggoodsintransit,andshallseizeanddetaintheidentifiedgoods.Section70E.Security(1)TheRegistrarshall,upongivinghisapprovalundersection70D,requiretheapplicanttodepositwiththeRegistrarasecuritywhichintheopinionoftheRegistrarissufficientto—

(a) reimbursetheRegistrarforanyliabilityorexpenseitislikelytoincurasaresultof

theseizureofthegoods;

(b) preventabuseandtoprotecttheimporter;or

(c) paysuchcompensationasmaybeorderedbytheCourtunderthisPart.Section70F.Securestorageofseizedgoods(1)SeizedgoodsshallbetakentosuchsecureplaceastheRegistrarmaydirectorastheauthorizedofficerdeemsfit.(2)Ifitisstoredonthedirectionoftheauthorizedofficer,theauthorizedofficershallinformtheRegistrarofthewhereaboutsoftheseizedgoods.Section70G.Notice(1) As soon as is reasonably practicable after goods are seized under section 70D, theauthorizedofficershallgivetotheRegistrar,importerandtheapplicant,eitherpersonallyorby registeredpost, awrittennotice identifying thegoods, stating that theyhavebeenseizedandthewhereaboutofthegoods.(2) A notice under subsection (1) shall also state that the goodswill be released to theimporter unless an action for infringement in respect of the goods is instituted by theapplicantwithinaspecifiedperiodfromthedateofthenotice.(3)Ifatthetimeofthereceiptofthenoticeanactionforinfringementhasbeeninstitutedbytheapplicant,theapplicantshallnotifytheRegistrarofthatfact.(4)Theapplicantmay,bywrittennoticegiventotheRegistrarbeforetheendoftheperiodspecifiedinthenotice(theinitialperiod),requestthattheperiodbeextended.(5)Subjecttosubsection(6),if—

(a) arequestismadeinaccordancewithsubsection(4);and(b) theRegistrarissatisfiedthatitisreasonablethattherequestbegranted,

theRegistrarmayextendtheintialperiod.

Section70H.Inspection,release,etc.,ofseizedgoods(1)TheRegistrarmaypermittheapplicantortheimportertoinspecttheseizedgoodsifheagreestogivetherequisiteundertakings.(2)Therequisiteundertakingsmentionedinsubsection(1)areundertakingsinwritingthatthepersongivingtheundertakingswill—

(a) return the sample of the seized goods to the Registrar at a specified time that issatisfactorytotheRegistrar;and

(b) takereasonablecaretopreventdamagetothesample.

(3)Iftheapplicantgivestherequisiteundertakings,theRegistrarmaypermittheapplicanttoremoveasampleoftheseizedgoodsfromthecustodyoftheRegistrarforinspectionbytheapplicant.(4)Iftheimportergivestherequisiteundertakings,theRegistrarmaypermittheimportertoremoveasampleoftheseizedgoodsfromthecustodyoftheRegistrarforinspectionbytheimporter.(5)IftheRegistrarpermitsinspectionoftheseizedgoods,ortheremovalofasampleoftheseizedgoods,bytheapplicantinaccordancewiththissection,theRegistrarisnotliabletotheimporterforanylossordamagesufferedbytheimporterarisingoutof—

(a) damagetoanyoftheseizedgoodsincurredduringthatinspection;or

(b) anythingdoneby theapplicantoranyotherperson to,or in relation to, a sampleremovedfromthecustodyoftheRegistraroranyusemadebytheapplicantoranyotherpersonofsuchasample.

Section70I.Forfeitureofseizedgoodsbyconsent(1)Subjecttosubsection(2),theimportermay,bywrittennoticetotheRegistrar,consenttotheseizedgoodsbeingforfeited.(2)Thenotice shallbegivenbeforeanyaction for infringement in relation to the seizedgoodsisinstituted.(3)Iftheimportergivessuchanotice,theseizedgoodsareforfeitedandshallbedisposedofinthemannerprescribedbyregulationsmadeunderthisPart.

Section70J.Compulsoryreleaseofseizedgoodstoimporter(1)TheRegistrar shall release the seizedgoods to the importeron theexpirationof theretentionperiodforthegoodsiftheapplicant—

(a) hasnotinstitutedanactionforinfringementinrelationtothegoods;and

(b) hasnotgivenwrittennoticetotheRegistrarstatingthattheactionforinfringementhasbeeninstituted.

(2)If—

(a) anactionforinfringementhasbeeninstitutedinrelationtotheseizedgoods;and

(b) attheendofaperiodofthirtydayscommencingonthedayonwhichtheactionforinfringementwasinstituted,thereisnotinforceanorderoftheCourtinwhichtheactionwasinstitutedpreventingthereleaseofthegoods,

theRegistrarshallreleasethegoodstotheimporter.(3)IftheapplicantgiveswrittennoticetotheRegistrarstatingthatheconsentstothereleaseoftheseizedgoods,theRegistrarshallreleasethegoodstotheimporter.Section70K.Compensationforfailuretotakeaction(1)Wheregoodshavebeenseizedpursuant toanoticegivenundersection70Dandtheapplicantfailstotakeactionforinfringementwithintheretentionperiod,apersonaggrievedbysuchseizuremayapplytotheCourtforanorderofcompensationagainsttheapplicant.(2)WheretheCourtissatisfiedthatthepersonaggrievedhadsufferedlossordamageasaresultoftheseizureofthegoods,theCourtmayordertheapplicanttopaycompensationinsuchamountastheCourtthinksfittotheaggrievedperson.Section70L.Actionsforinfringementofregisteredtrademark(1) If an action for infringement has been instituted by the applicant, the Courtmay inadditiontoanyreliefthatmaybegranted—

(a) orderthattheseizedgoodsbereleasedtotheimportersubjecttosuchconditions,ifany,astheCourtthinksfit;

(b) order that the seized goods be not released to the importer before the end of aspecifiedperiod;or

(c) orderthattheseizedgoodsbeforfeited,

dependingonthecircumstancesofthecase.(2)TheRegistrarortheauthorizedofficerisentitledtobeheardonthehearingofanactionforinfringement.(3)ACourtmaynotmakeanorderunderparagraph(1)(a)ifitissatisfiedthattheRegistraroranyauthorityisrequiredorpermittedunderanyotherlawtoretaincontroloftheseizedgoods.(4)TheRegistrarshallcomplywithanordermadeundersubsection(1).(5)If—

(a) the action is dismissed or discontinued, or if the Court decides that the relevantregisteredtrademarkwasnotinfringedbytheimportationoftheseizedgoods;and

(b) adefendanttotheactionforinfringementsatisfiestheCourtthathehassufferedlossordamageasaresultoftheseizureofthegoods,

theCourtmayordertheapplicanttopaycompensationinsuchamountastheCourtthinksfittothatdefendant.Section70M.DisposalofseizedgoodsorderedtobeforfeitedIftheCourtordersthatseizedgoodsaretobeforfeited,thegoodsshallbedisposedofinthemannerasdirectedbytheCourt.Section70N.Insufficientsecurity(1)IfthereasonableexpensesincurredbytheRegistrarinrelationtoanyactiontakenbytheRegistrarunderthisPart,ortakeninaccordancewithanorderofCourtunderthisPart,exceedtheamountofsecuritydepositedundersection70E,theamountoftheexcessisadebtduetotheRegistrar.(2)Thedebtcreatedbysubsection(1)isduebytheapplicant,or,iftherearetwoormoreapplicants,bytheapplicantsjointlyandseverally.Section70o.Exofficioaction(1)Anyauthorizedofficermaydetainorsuspendthereleaseofgoodswhich,basedonprimafacieevidencethathehasacquired,arecounterfeittrademarkgoods.(2)Wheresuchgoodshavebeendetained,theauthorizedofficer—

(a) shallinformtheRegistrar,theimporterandtheproprietorofthetrademark;and

(3)Subjecttosection70J,animportermaylodgeanappealagainstthedetentionofgoodsorsuspensionofthereleaseofgoodsundersubsection(1).(4) The authorized officer shall only be exempted from liability if his actions undersubsection(1)aredoneingoodfaith.Section70P.Regulationsrelatingtobordermeasures(1) The Minister may make such regulations as may be necessary or expedient for thepurposeofthisPart.(2)Withoutprejudicetothegeneralityofsubsection(1),regulationsmaybemadefor—

(a) prescribingandimposingfeesandprovidingforthemannerforcollectingsuchfees;

(b) prescribingformsandnotices;

(c) providingforthemannerfordepositingsecurity;

(d) prescribinganythingrequiredtobeprescribedunderthisPart.

PARTXVMISCELLANEOUS

Section71.Useoftrademarkforexporttrade(1)TheapplicationinMalaysiaofatrademarktogoodstobeexportedfromMalaysiaandanyotheractdoneinMalaysiainrelationtothegoodswhichifdoneinrelationtogoodstobesoldorotherwisetradedininMalaysiawouldconstituteuseofatrademarkinMalaysiashallforthepurposeofthisActbedeemedtoconstituteuseofthetrademarkinrelationtothosegoods.(2)Subsection(1)shallbedeemedtohavehadeffectinrelationtoanactdonebeforethedateofthecommencementofthisActasithaseffectinrelationtoanactdoneafterthatdate,butdoesnotaffectadeterminationofaCourtwhichhasbeenmadebeforethatdateorthedeterminationofanappealfromadeterminationsomade.Section72.UseoftrademarkwhereformoftradechangesThe use of a registered trade mark in relation to goods or services where a form ofconnection in thecourseof tradesubsistsbetween thegoodsor servicesand thepersonusingthetrademarkshallnotbedeemedtobelikelytocausedeceptionorconfusiononly

onthegroundthatthetrademarkhasbeenorisusedinrelationtogoodsorserviceswhereadifferentformofconnectioninthecourseoftradesubsistedorsubsistsbetweenthegoodsorservicesandthatpersonorapredecessorintitleofthatperson.Section73.PreliminaryadvicebyRegistrar(1)ThepowertogivetoapersonwhoproposestoapplyfortheregistrationofatrademarkintheRegisteradviceastowhetherthetrademarkappearstotheRegistrarprimafacietobecapableofdistinguishingshallbeafunctionoftheRegistrarunderthisAct.(2) Any person who is desirous of obtaining the advice shall make application to theRegistrarintheprescribedmanner.(3)Whereanapplicationfortheregistrationofatrademarkismadewithinthreemonthsafter the Registrar has given advice in the affirmative and the Registrar, after furtherinvestigationorconsideration,givesnoticetotheapplicantofobjectiononthegroundthatthe trademark is not capable of distinguishing, the applicant shall be entitled, on givingnoticeofwithdrawaloftheapplicationwithintheprescribedperiod,tohaveanyfeepaidonthefilingoftheapplicationrepaidtohim.Section74.PowersofRegistrartoamenddocument(1)TheRegistrarmayonsuchtermsastocostsashethinksjustwhetherforthepurposeofcorrectingaclericalerrororanobviousmistake,permitthecorrectionofanapplicationfortheregistrationofatrademarkornoticeofoppositionorotherdocumentsubmittedatanytrademarksoffice.(2) An amendment of an application shall not be permitted under this section if theamendmentwould substantially affect the identity of the trademark as specified in theapplicationbeforeamendment.(3)AdecisionoftheRegistrarundersubsection(1)issubjecttoappealtotheCourt.Section75.OtherpowersofRegistrar(1)TheRegistrarmay,forthepurposeofthisAct—

(a) summonwitnesses;

(b) receiveevidenceonoath;

(c) requiretheproductionofadocumentorarticle;and

(d) awardcostsasagainstapartytoproceedingsbeforehim.

(2)Anypersonwhowithoutanylawfulexcusefailstocomplywithanysummons,orderordirectionmade by theRegistrar under paragraphs (1)(a), (b)and (c) is deemed to havecommittedanoffenceandisliable,onconviction,toafinenotexceedingonethousandringgitortoatermofimprisonmentnotexceedingthreemonthsortoboth.(3)Costsawardedby theRegistrarmay indefaultofpaymentberecovered inacourtofcompetentjurisdictionasadebtduebythepersonagainstwhomthecostswereaccordedtothepersoninwhosefavourtheywereaccorded.Section76.ExerciseofdiscretionarypowerWhereanydiscretionarypowerisgiventotheRegistrarbythisActorbyanyregulationsmadethereunder,heshallnotexercisethatpoweradverselytotheapplicantforregistrationor the registered proprietor in question without (if duly required to do so within theprescribedtime)givingtotheapplicantanopportunityofbeingheard.Section77.Extensionoftime(1)WherebythisActoranyregulationsmadethereunder,atimeisspecifiedwithinwhichan act or thing is to bedone, theRegistrarmay, unless otherwise expressly providedordirectedby theCourt,uponapplication in theprescribedmanner,extend the timeeitherbeforeorafteritsexpirationuponpaymentoftheprescribedfee.(2)Subsection(1)shallnotapplytosection29,subsection31(3),section70andsection70Aexceptwherethecircumstancesmentionedinsection78apply.Section78.Extensionoftimebyreasonoferrorintrademarksoffice,etc.(1)Wherebyreasonof—

(a) circumstancesbeyondthecontrolofthepersonconcerned;or

(b) anerrororactiononthepartoftheCentralTradeMarksOfficeoranytrademarksoffice,

anact inrelation toanapplication for theregistrationofa trademarkor inproceedingsunderthisAct(notbeingproceedingsinaCourt)requiredtobedonewithinacertaintimehasnotbeensodonetheRegistrarmayextendthetimefordoingtheact.(2)Thetimerequiredfordoinganactmaybeextendedunderthissectionalthoughthattimehasexpired.Section79.Addressforservice(1)Where an applicant for the registration of a trademark does not reside or carry onbusinessinMalaysia,heshallgivetotheRegistraranaddressforserviceinMalaysiawhich

shallbetheaddressofhisagent,andifhefailstodoso,theRegistrarmayrefusetoproceedwiththeapplication.(2)Anaddressforservicestatedintheapplicationoranoticeofoppositionshall, forthepurposes of the application or notice of opposition, be deemed to be the address of theapplicantoropponent,asthecasemaybe,andalldocumentsinrelationtotheapplicationornoticeofoppositionmaybeservedbyleavingthemat,orsendingthembypostto,theaddressforserviceoftheapplicantoropponent,asthecasemaybe.(3)AnaddressforservicemaybechangedbynoticeinwritingtotheRegistrar.(4)Subjecttosubsection(1),theregisteredproprietorofatrademarkshallfromtimetotimenotifytheRegistrarinwritingofanychangeintheRegisterandtheRegistrarshallaltertheRegisteraccordingly.(5)Theaddressoftheregisteredproprietorofatrademarkasappearingforthetimebeingin theRegister shall for all purposes under this Act be deemed to be the address of theregisteredproprietor.Section80.Agent(1)WhereanapplicantforregistrationofatrademarkdoesnotresideorcarryonbusinessinMalaysia,heshallappointanagenttoactforhim.(2)WherebythisActanyacthastobedonebyortoanypersoninconnectionwithatrademarkorproposedtrademarkoranyprocedurerelatingthereto,theactmay,underandinaccordancewith thisAct and any regulationsmade thereunder or in particular cases byspecialleaveoftheRegistrar,bedonebyortoanagentofthatpersondulyauthorizedintheprescribedmanner.(3)Noperson,firmorcompanyshallbeauthorizedtoactasanagentforthepurposesofthisAct unless that person is domiciled or resident in Malaysia or the firm or company isconstitutedunderthelawsofMalaysiaandsuchperson,firmorcompanycarriesonbusinessorpracticeprincipallyinMalaysia.Section81.Falselyrepresentingatrademarkasregistered(1)Apersonwhomakesarepresentation—

(a) withrespect toamark,notbeingaregisteredtrademark, to theeffect that it isaregisteredtrademark;

(b) with respect to a part of a registered trade mark, not being a part separatelyregisteredonatrademark,totheeffectthatitissoregistered;

thetrademarkincircumstancesinwhich,havingregardtoconditionsorlimitationsenteredontheRegister,theregistrationdoesnotgivethatright,

isguiltyofanoffenceandisliable,onconviction,toafinenotexceedingfivehundredringgitortoatermofimprisonmentnotexceedingtwomonthsortoboth.(2)Forthepurposeofthissection,theuseinMalaysiainrelationtoatrademarkoftheword“registered”orofanyotherwordreferringwhetherexpresslyorimpliedlytoregistrationshallbedeemedtoimportareferencetoregistrationintheRegisterexcept—

(a) where the word is used in physical association with other words delineated incharactersatleastaslargeasthoseinwhichthatwordisdelineatedandindicatingthatthereferenceistoregistrationasatrademarkunderthelawofacountryoutsideMalaysiabeingacountryunderthelawofwhichtheregistrationreferredtoisinfactinforce;

(b) wheretheword(beingawordotherthantheword“registered”)isofitselfsuchastoindicatethatthereferenceistoregistrationasmentionedinparagraph(a);or

(c) wherethatwordisusedinrelationtoamarkregisteredasatrademarkunderthelawof a country outsideMalaysia and in relation to goods to be exported to thatcountry.

Section82.Unregisteredtrademarks(1)Nopersonshallbeentitledtoinitiateanyactiontopreventortorecoverdamagesfortheinfringementofanunregisteredtrademark.(2)Notwithstandingsubsection(1),nothinginthisActshallbedeemedtoaffecttherightofactionagainstanypersonforpassingoffgoodsorservicesasthoseofanotherpersonortheremediesinrespectthereof.Section83.Regulations(1)SubjecttotheprovisionsofthisAct,theMinistermaymakeregulationsforthepurposeofcarryingintoeffecttheprovisionsofthisAct.(2)Inparticularandwithoutprejudicetothegeneralityofsubsection(1),suchregulationsmayprovideforalloranyofthefollowing:

(a) toregulatethepractice(otherthanthatrelatingtoproceedingsbeforetheCourtorconnectedtherewith)underthisActincludingserviceofdocuments;

theMinistermaythinkfitofcopiesoftrademarksandotherdocuments;

(e) toprescribe the fees tobepaid in respectof anymatteror thing required for thepurposesofthisAct;

(ea)toprovidefortheregistrationandqualificationsofagents;(f)toregulategenerallyonmatterspertainingtothebusinessoftrademarkscarriedon

inanytrademarksofficewhetherornotspeciallyprescribedunderthisActbutsoasnottobeinconsistentwithanyoftheprovisionsofthisAct.

(3)(DeletedbyActA881).(4)SubjecttotheprovisionsofthisAct,theRulesCommitteeconstitutedundertheCourtsofJudicatureAct1964,[Act91]maymakerulesofcourtregulatingthepracticeandprocedureinrelationtoproceedingsbeforetheCourtorconnectedtherewithandthecostsoftheproceedings.Section84.Repealandsaving(1)TheTradeMarksOrdinance1950,theTradeMarksOrdinanceofSabahandtheTradeMarksOrdinanceofSarawakareherebyrepealed.(2)NotwithstandingtherepealoftheOrdinancesspecifiedinsubsection(1):
