A right granted to officials & employeesnot to report for work WITH or WITHOUTPAY, for one or more days, with theirpositions held for them until their return.

Kinds of Leave

• Vacation Leave

– Granted for personal reasons, the approval of which is contingent upon the necessities of the service.

• Sick Leave

– Granted only on account of sickness ordisability on the part of the employee orany member of his immediate family.

Monetization of VL & SL

Monetization of 50% or more of theaccumulated leave credits may be allowed forvalid & justifiable reasons such as:

• Health, medical and hospital needs of theemployee & the immediate members of thefamily;

• Financial aid & assistance brought about byforce majeure events such as calamities,typhoons, fire, earthquake & accidents thataffect the life, limb & property of theemployee & his/her family;

• Educational needs of the employee & theimmediate members of his/her family;

• Payment of mortgages & loans which wereentered into for the benefit or which inured tothe benefit of the employee & his/herimmediate family;

• In cases of extreme financial needs of theemployee or his/her immediate family wherethe present sources of income are not enoughto fulfill basic needs such as food, shelter &clothing;

• Other analogous cases as may be determinedby the Commission.

Issue:

Whether Sec. 23 of the Omnibus Rules onLeave allows an employee to monetize his sickleave credits if he has no available vacationleave credits.

Ruling:

As a general rule what is allowed to bemonetized are the accumulated vacation leavecredits. Sec. 23, on the other hand is anextraordinary measure to relieve an employeefrom financial difficulties that may be allowedonly for valid and justifiable reasons subject tothe discretion of the agency head andavailability of funds.

Hence, Sec. 23 should be construed as anexception to the general rule under Sec. 22.

Consequently, for purposes ofmonetization, vacation leave credits must beexhausted first before sick leave credits may beused. In this regard, since Maslan’s vacationleave credits have already been exhausted, themonetization of fifty percent (50%) of heravailable 150 sick leave credits may be allowedin accordance with Sec. 23 of CSC Memo.Circular No. 41, s. 1998. [CSC Res. No. 00-0034,d. Jan. 5, 2000; Re: Belen T. Maslan]

Issue:

Whether or not, in the event an employee isexonerated from the criminal charges againsthim, he may claim salary and other benefits forthe duration of his detention, as well as earnleave credits.

Ruling:

No. From all indications, detention in effect isequivalent to an indeterminate preventivesuspension. Therefore, there is no basis for thepayment of his salary corresponding to theperiod of his detention. The doctrine on “nowork, no pay” applies in this case. Consequently,he could not earn leave credits, considering thathis services are suspended for such period. [CSCRes. No. 991879, dated Aug. 23, 1999; Nelda Q.Norona]

• Any officer or employee who incursundertime, regardless of the number ofminutes/hours, ten (10) times a monthfor at least two (2) months in asemester or at least two (2) consecutivemonths during the year shall be liablefor Simple Misconduct and/or ConductPrejudicial to the Best Interest of theService, as the case may be.

What is the computation of the moneyvalue of members of the SangguniangPanlalawigan (SP) paid on per diem basis?

Ruling:

RA No. 6758 (Salary Standardization Law)modified the payment of salary of SPmembers from per diem to per month basis.As an SP member, he is entitled to a monthlysalary. He likewise earns leave credits likeappointive employees considering that as anelective official, his time spent during workingdays may be construed as attendance to theneeds and interest of his constituents.Accordingly, any absence of said member in

any or all of the regular sessions to which he isbound to attend, shall have to be charged to hisaccrued leave credits, if there is any.

Further, under BP 337, otherwise knownas the then LGC, now Sec. 47, Chapter 2 of RA7160 (LGC of 1991), elective officials are entitledto leave credits accorded to appointive officialsand employees in the government. The rulesapplied to appointive employees insofar asleaves and absences, shall now apply to SPmembers. As such, if the absent member hassufficient leave credits, his absences should bededucted there from and not from his salary.

1. Full-time consultancy job of a governmentofficial or employee is not allowable.

b. He/She must obtain permission orauthority from his/her head of agency asthe same constitutes a limited privatepractice of profession;

c. The private practice of profession must notconflict or tend to conflict with his/herofficial functions and the interest of theRepublic of the Philippines; and

d. It must not affect the effective performanceof his/her duty.

3. An employee/officer may take a leave ofabsence, whether with pay or not, to accepta consultancy job, subject to the followingrules:

a. leave of absence must be contingent upon theneeds of the service, i.e., it must not adverselyaffect agency operations, thus, the grant ofvacation leave shall be at the discretion of thehead of the department/agency;

b. Leave without pay shall not exceed one (1)year;

c. Leave without pay shall not be grantedwhenever an employee has leave with pay tohis credit; and

Whether COMELEC Res. No. 4434, s. 2001,granting additional five-day leave credits togovernment employees who served as Board ofElection Inspectors (BEIs) during the May 14,2001 election, is valid.

Ruling:

The CSC holds the view that while COMELECRes. No. 4434, s. 2001, bears the stamp ofregularity, it being promulgated by the COMELECin the course of its official duties, the matter offive-day additional leave credits espoused thereinfinds no legal support in existing leave laws andrules. Who are considered solo parents?

1) a woman who gives birth as a result of rapeand other crimes against chastity, even without afinal conviction of the offender; provided, that themother keeps and raises the child;

2) parent left solo or alone with theresponsibility of parenthood due to any of thefollowing circumstances:

2.1 death of spouse

2.2 detention of the spouse or servingsentence for a criminal conviction for at leastone (1) year;

2.6 abandonment of spouse for at least oneyear;

5)any family member who assumes theresponsibility of head of family as a result of thedeath, abandonment, disappearance orprolonged absence of the parents or solo parent;provided, that such abandonment, disappearanceor absence lasts for at least one (1) year

Conditions for Availment

2) may be availed every year & not convertible tocash, unless specifically agreed upon previously;forfeited if not availed within the year;

Guidelines on the Availment of the Special Leave Benefits for Women Under RA 9710

• Any female public sector employee,regardless of age and civil status, shall beentitled to a special leave of a maximum oftwo months with full pay based on hergross monthly compensation, provided shehas rendered at least 6 months aggregateservice in any or various governmentagencies for the last 12 months prior toundergoing surgery for gynecologicaldisorders

The same is invalid and without force andeffect for being issued in contravention ofexisting CS policies & intent of RA 8292.

Thus, it can be safely concludedthat honoraria and service credits belong todifferent classes of benefits or allowances,hence, they cannot be interchanged norconverted in order to be fully enjoyed by anemployee.”
