MEETING MINUTES Topic Intent/Materials Kickoff, Roll Call & Connecting Moment

Call meeting to order and take roll call.

Minutes: Mr. Duckworth called the meeting to order shortly after 7PM. In addition to the EOSC members noted above, Mayor Schmidt, Committeeman Laul and four additional audience members were in attendance.

Presentation of Minutes

Review and approval of March Meeting Minutes. All commission members can approve except for Ms. Lawler, Mr. Mickley and Ms. Koch who were not present at the March meeting.

Minutes: Mr. Duckworth asked if there were any comments on the meeting minutes for March. A minor typo was identified and fixed. Mr. Duckworth asked for a motion to approve the EOSC March Meeting Minutes. Mr. Henriksen made the motion, Ms. Petzinger seconded and it was unanimously approved.

Mr. Duckworth acknowledged the audience members and offered them an opportunity to speak at the beginning of the meeting so they would not have to sit through the entire meeting first. Two audience members identified themselves as Tom and Joy Scognamiglio of 441 Penwell Road. Ms. Scognamiglio stated that her property borders Point Mountain Reservation and there are fields that are part of the park that are being farmed. She said that she is concerned about the chemicals being used by the farmer. Something was put on the field last year to kill all the vegetation. Ms. Scognamiglio and her husband are concerned about the runoff from the field and potential contamination of their well.

Accompanying them were Shannon and Matt Tubman of 1150 Butlers Park Road. Ms. Tubman stated that she believes they are doing “no till” farming. She is concerned about alerting park visitors about the use of these chemicals and suggesting when they should avoid the area. There may be residual effects on people using the park. Ms. Tubman provided a picture she took last year of the field and neighboring vegetation before and after application of the chemicals and stated that she believes they are using glyphosate. A copy of the picture has been attached to these minutes.

Mr. Duckworth displayed a map of the park on the screen and confirmed the fields to which Ms. Scognamiglio was referring. They were within the boundaries of Point Mountain Reservation. Mr. Duckworth asked Ms. Scognamiglio if she had contacted the County Parks Department. She said no. Mr. Duckworth suggested that the first step would be to engage them and alert them of

Topic Intent/Materials her concern. It is their department that governs leasing of the property for farming. The Township is not consulted on this. Mayor Schmidt stated that the Township police force does not have the authority, nor the expertise, to investigate this complaint. Ms. Koch let the Scognamiglios know that the Township is hosting a well testing event on May 11th. She didn’t know if a well test was available for this type of chemical but would follow up with Raritan Headwaters Association (RHA). Mr. Henriksen said that he would also follow up with a colleague of his to understand what labs may offer a test for glyphosate and pass that information on to the Scognamiglios.

The Scognamiglios and Tubmans thanked the Commission for hearing their concerns and said they would follow up with the County Parks Department.

Minutes: Mr. Duckworth reminded the team that at the last meeting, Ms. Hardy had introduced a model deer management ordinance from Tewksbury Township and the team was tasked to review that and provide feedback at this meeting. Mr. Duckworth proceeded to ask each team member if they had any feedback.

Ms. Hardy stated that we should request two antlerless deer vs. one to further reduce the deer population; Ms. Petzinger concurred. Ms. Petzinger asked about the insurance requirements specified in the ordinance. Is that something a hunter would have? How would they go about getting a policy like that? Mr. Henriksen said they could obtain the insurance via a Rod and Gun Club. Committeeman Laul stated that the Quality Deer Management Association (QDMA) provides insurance coverage. Mr. Chen said that he would explore QDMA and come back with details on if and how they provide insurance.

Ms. Petzinger stated that the ordinance can be simplified if we remove some of the restrictions and reference the state regulations. Mayor Schmidt stated not to worry about that now as the attorney will advise us on that.

Ms. Petzinger asked about certain types of tree stands and whether or not they would harm a tree. Mr. Chen said that the tree stands as specified in the ordinance are all OK and are held up by friction. Ms. Petzinger suggested that we add a requirement to notify the Township of harvested deer. Committeeman Laul asked how many hunters could practically be supported on Township property? Mr. Chen suggested that we limit hunting activities to bow hunting so that more hunters would be able to take part and it would likely raise less concerns from neighboring residents. Mr. Duckworth said he would take an action to calculate the number of acres and follow up with NJ Water Supply Authority to understand if hunting is allowed on co-owned properties.

Mr. Duckworth reminded the team of the May 11th event at the museum and stated that Mr. Collett and he would be volunteering. Mr. Duckworth had spoken with Curator Sampaio and agreed that EOSC members would cover a “bee hotel” craft at the event. Ms. Hardy stated she would be able to help assuming she didn’t have to tackle the hay. Ms. Koch stated that she could come after well testing finished.

Minutes: Mr. Duckworth introduced the topic of the Whitehall property preservation opportunity

Topic Intent/Materials that was brought to his attention by Mayor Schmidt. He asked Mayor Schmidt to recap the opportunity that was outlined in his email attached to the meeting agenda and he did.

Mr. Duckworth acknowledged that removing buildable lots from inventory and reducing septic density were new drivers for preservation not currently outlined in the Open Space and Recreation Plan (OSRP). He asked each EOSC member if they supported the preservation opportunity and each said yes. Mr. Duckworth introduced the following motion.

Whereas the properties of the Whitehall preservation opportunity are at the headwaters of the Hickory Run, and

Whereas the properties provide critical wetland habitat, and

Whereas the Township and the Highlands Council have committed to land preservation as a means to manage septic system density deficiencies as outlined in the Lebanon Township Chapter of the Hunterdon County Wastewater Management Plan, and

Whereas the parcels are located close to Woodglen School, potentially providing outdoor experiential education opportunities,

The Lebanon Township Environmental & Open Space Commission (EOSC) makes a motion to support the pursuit of these parcels for preservation with ownership by the Township if feasible.

He asked for someone to make the motion. The motion was made by Mr. Mickley, seconded by Mr. Henriksen and unanimously approved.

Mr. Duckworth handed the floor to Ms. Hardy. Ms. Hardy stated that the Historians Committee is interested in establishing an interpretive settlement at Squire’s Point, currently the location of Point Mountain Reservation. The Squire’s Point forge used to be there, as well as some other buildings which she provided a description of. She stated the Township would have to work with the County to develop this as it would be on the County Park property. She also stated that it could be a collaborative effort with the MWA. Mr. Henriksen said that MWA would not be the right organization, but rather the Musconetcong River Management Council (MRMC) would be. Ms. Hardy said that this was just an update for the EOSC and she is not asking for anything specific at this time. Ms. Lawler suggested Ms. Hardy make a presentation to the MRMC. Ms. Koch suggested connecting to the archaeology department at Raritan Valley College.

Mr. Duckworth moved on to the next topic, the litter cleanup. He reminded everyone that volunteers were still needed for the event. He then handed the floor to Ms. Lawler.

Ms. Lawler stated that she spoke with Kerry Green at the Invasive Strike Force conference who told her that there is a grant program to assist in stormwater control. The planning of rain gardens might be included, which could present us another opportunity to address the Bunnvale ponding issue for which we previously submitted a grant proposal. Ms. Lawler said she would ask Ms. Green to come to our May meeting.

Mr. Duckworth handed the floor to Ms. Koch to discuss the field mowing that occurred across from Hickory Run Road. Ms. Koch said that recently preserved fields were mowed and asked if anyone knew why. Ms. Petzinger said that the state habitat planner, Melissa Woemer, responsible for those properties would know. They could be preserving early growth or warm season grasses. Ms. Petzinger suggested reaching out to Ms. Woerner for an official answer.

Mr. Duckworth thanked Ms. Koch and Ms. Petzinger and provided a brief update to the team just to let them know that Lebanon Township Trails Facebook page has been retired. This was a page originally started by Ms. Lawler and others awhile back but was no longer actively managed.

Finally, Mr. Duckworth acknowledged Mr. Mickley’s resignation from EOSC. Mr. Mickley stated

Topic Intent/Materials that he enjoyed his time on EOSC but he and his family were moving out of town and he would no longer be able to participate. Everyone thanked Mr. Mickley for his contribution to the team and Mr. Duckworth asked everyone to stay after the end of the meeting for a celebration in honor of Mr. Mickley.

Adam,

At the EOSC Meeting on Monday I would like to ask the Commission provide a view on the preservation of 4 building lots and some additional acreage (total acreage 7.5-10 depending on final subdivision). The timing is driven by a Highlands Open Space Program grant deadline of April 30, meaning the Township Committee needs to consider the application at its April 17 Meeting.

Background:

Josh Rich owns the lots and has discussed preservation with the Highlands. The Highlands referred him to the Township, because the grant requires a Municipal sponsor.

I discussed the lots with Raritan Headwaters. Their reply was that despite being smaller than typical preservation, they see the property as sensitive headwaters to the Hickory Run, which feeds directly into the Raritan. They also see the proximity, though not direct connection, with the preserved lands in the area, especially down Hickory Run, as a positive. RHA will put the project on its Land Committee Agenda in May. They also offered to present their opinion favoring preservation to the Township Committee.

You will observe in the attached reports that there is considerable wetlands in the properties, but they were subdivided before the Highlands regulations, so I am told they are approved Building Lots. Because of the wetlands, the building envelopes are mostly up against E. Hill Road (at the 50 foot setback).

In additional to certain critical habitat, preservation would be in line with the Wastewater Management Plan of the Township, where one of our few action items is to reduce septic density. The 4 building lots are about 1.5 acres each, so preservation would eliminate 4 potential septics on 6 acres.

From a scenic consideration, preservation would keep a rural, forested feel at that corner.

From a recreation consideration, there is probably little potential due to the relatively small size, lack of direct connectivity and wetlands.

I discussed the Highlands Application (copy attached) with the contact, Drew Siglin, and I believe we could get the required information in time for a Committee vote. Josh Rich confirmed that he would sign the Application. Purchase price would be subject to getting an appraiser, but for some idea I am using a number of $250,000, which is high on a per acre basis because of the 4 building lots which might be valued at $60,000 each. Including transaction costs, the application would probably be for $275,000, of which the Highlands Grant would cover 50% if successful. The other half could come from Green Acres, if we learn later this summer that we received funding, or from partners like RHA, and/or from County Open Space.
