The Federal Court of Australia recently handed down a decision in the case of LED Technologies Pty Ltd v Elecspess Pty Ltd, Ren Pty Ltd, Olsen Pty Ltd and Advanced Automotive Australia Pty Ltd, which highlights the benefit of obtaining design registrations for any new products.

The case was also one of the first to consider the infringement test under the new Designs Act 2003. LED Technologies is a manufacturer and importer of automotive LED products. It developed and designed a new and distinctive looking square shaped automotive tail lamp which it manufactured in Taiwan and obtained Design Registrations. Elecspess obtained a similar looking but not identical product made in China with the brand name of ''CONDOR'' and offered it for sale in Australia. LED Technologies Pty Ltd brought an action against Elecspess and other's for design infringement. Justice Gordon of the Federal Court of Australia ruled in favour of LED Technologies and issued injunctions for the prevention of further sales and awarding $200,000 in damages with legal cost's expected to be up to $1,200,000. In her judgment, Justice Gordon considered and found that any product which embodied designs that are substantially similar in overall impression to a registered design would infringe the design registrations. The product does not have to be identical to the design registration. In assessing the similarities, the Court would only have regard to the visible features of the design and would do this by looking at both the infringing product and the registered design. Accordingly, the material used to manufacture the product or the inner workings of the product is irrelevant for design infringement purposes.

On appeal three Federal court Judges, Justice Jessup, Justice Besanko and Justice Emmett dismissed the appeal by Elecspess, Ren, Olsen and Advance Automotive appeal from Justice Gordon’s ruling that it had infringed LED Technologies registered design.This is the first substantive decision by a Full Court on the new Designs Act introduced in 2003 and provides a guideline and reference for any future design infringement cases.

Owner of LED Technologies Tony Ottobre’s comments were, this is a fantastic result for all designers of original products who can now use this case as a precedence and a blow for product copiers.

LED Technologies, manufacturers of LED Autolamps, have begun manufacturing the all new MaXiLED Stop/Tail/Indicator and Reverse lamp. A first in Australia and certified to proudly carry the “Made in Australia” logo. Using only quality components and plastics sourced from overseas suppliers and utilizing our own full SMD/component assembly line to fit out, solder and testing of circuit boards. The finished boards are then fitted to the base, fully potted and sealed against water and dust ingress then assembled with specially designed chrome inner reflectors, honey comb designed lens with reflex reflectors. The finished lamps are then fully tested and packaged into the LED Autolamps blister clamshells.

Large Trailer harness systemLED Technologies has developed an 8 wire cable system to suit any Truck Trailer world wide, we have also manufactured and patented a plug ring to make the complete system waterproof. The T piece is a magnificent product manufactured with a PCB - 8 pins going in, 6 pins left and 6 pins right going out. Encased in a hardened PVC plastic which is resistant to fire and water.The main cable is 9mm in diameter and comes in various lengths from 6 meters to 15 meters, each cable has a junction box in the middle of its length which provides plugs for the side direction indicator and for side marker lamps, at one end there is an 8 pin plug which connects to the T piece, at the other end there are 8 coloured wires for connection to the main trailer plug.Both left and right cables are 1.2m long and have up to six wires that connect to the rear combination. This cable is 9mm in diameter with a 6 pin plug which also has our round and square marker plugs to suit our marker lamp system.

LED Technologies has developed a 2 wire cable system for marker lamps and licence plate lamps, we have included 4 types of markers with this system which gives you a choice of which marker to use. The simplicity of this system is that there is no cutting splicing or joining of wires, we have developed two plugs, one round for earth and one square for power. Included is a T piece

with round and square plugs - the entire system is fool proof, because you cant fit a round plug into a square hole and

vice versa. The cable lengths vary from 1 metre to 5 metres and whenever you need to add a marker

or licence lamp just add the T piece.All plugs and T piece are made from

PVC which is fire and water resistant. We also developed

a special water proof patented ring and as it suggests the whole system is water proof with a rating of IP67.

The requirements specified in the ADRs for the performance and installation of lamps and reflectors are based on international standards.The performance requirements usually involve tests done in a laboratory to show compliance. Trailer manufacturers must ensure that the lamps and reflectors fitted to their trailers comply with these performance requirements.Lamps on a trailer must not show red light to the front or white light to the rear. Two front position lamps showing white light to the front of the trailer must be fitted to trailers which are more than 1600 mm wide.Two rear position lamps showing red light to the rear must be fitted to each trailer. One rear registration plate lamp must be fitted to each trailer. Two stop lamps showing red light to the rear must be fitted to the trailer. Two direction indicator lamps showing amber light to the rear must be fitted to the rear of each trailer. The flashing rate of the indicators must be within the range of 60 to 120 flashes per minute.Two end-outline marker lamps showing white light to the front and two lamps showing red light to the rear must be fitted to trailers more than 2.1 metres wide. Two side marker lamps showing amber light to the front and red light to the rear must be fitted on each side of trailers over 2.1 metres wide or having a total length over 7.5 metres.If a trailer is over 7.5 metres in total length an additional side marker lamp must be fitted on each side midway between the front and the rear lamps. If a trailer such as a boat trailer has no structure at the front and at the rear to which end-outline marker lamps can be attached then fitting one end-outline marker lamp midway on each side is acceptable.Reflex reflectors are reflectors of a conventional lens type and must comply with ADR 47/00. Two white reflectors must be fitted to the front of each trailer. The number of amber coloured side reflex reflectors that must be fitted to each side of a trailer depends on the total length of the trailer including its draw bar. At least one reflector must be fitted to the middle third of the total trailer length. There must be a reflector within 3 metres of the front of the trailer and a reflector within 1 metre of the rear of the trailer. The distance between adjacent reflectors must not exceed 3 metres. The Safety Flash Unit is designed to assist vehicles who pull up on the side of the road and wish to draw attention to the fact that they are parked or stationary to passing vehicles. Examples of the application are in a break down situation or for a road side delivery / service vehicle.Two or more rear facing amber lights mounted on the vehicle at the passing driver’s eye level is a more effective method of attracting the attention of the passing driver. Hazard lights can sometimes be below the drivers eye line and are often confused as indicators or signalling a change of lane rather than the fact that you are stationary.The Safety Flash Unit reduces this problem by allowing the operator to turn on the rear facing lights in the cabin before exiting. With the unit in front of the operator, you can adjust the speed of the alternating flash rate according to your requirements. LED’s on either side of the flash rate knob indicate the flashing rate.

The ACDC1 solves a problem in the transport industry where some trucks have an output in AC only. AC voltage can damage some brands of LED lights! By simply connecting this unit to the output of the AC down converter, the ACDC1 will convert the AC signal to a rectified and regulated 12 volt DC output and supply the LED lights with an acceptable voltage source that will keep them running for years to come.

The Resistor should ALWAYS be wired between the input wires of the lamp, NOT the chassis of the vehicle or trailer! If fitted to the Chassis, a bad earth connection is possible, and can result in problems with the lighting system of the vehicle!Indicator Circuit:If fitting to the indicator circuit, fit one lead of the resistor to the positive supply side (Yellow wire) and the other lead of the resistor to the negative supply or ground input wire (White).brake Circuit:If fitting to the brake circuit, fit one lead of the resistor to the positive supply side (Red Wire) and the other lead of the resistor to the negative supply or ground input wire (White)Actual Fitting:To fit the resistor, use the crimp terminals supplied. WARRANTY PROCEDUREAll warranty returns must be tested off the vehicle to ensure that the unit is at fault. This can be done by simply attaching the lamps to a fully charged 12 volt battery. Do not replace any products to your customers unless you are 100% sure that the product is faulty and will be covered under warranty.If the unit is faulty, return it to your place of purchase so it can be directed to the LED Technologies warranty department for full testing and evaluating.Note: Most of our rear lamp assemblies are designed so that if one insert is damaged it can be replaced easily without replacing the complete light assembly; only return the faulty insert and not the entire assembly.

RETURN FOR CREDITAny product that is returned for a credit and not as a warranty claim, must be in original clean resaleable condition. The packaging must not be opened, sun damaged, UV faded or tampered with.
