Accordingly, Table 1 (attached) lists the updated net rates of return for the precincts with domestic waterfront tenancies admi?nistered by Roads and Maritime Services (RMS). These net rates of return are to be used in calculating the rental rates (per m2) for domestic waterfront tenancies in 2019-20, as per the formula in our Final Report in 2011. 2019 update to net rates of return for domestic waterfront tenancies

In 2011, the NSW Government accepted an recommendations of IPART's 2011 Final Reporton our Review of method for determining rents for domestic zoaterfront tenancies in NSW (FinalReport).

One of our recommendations was that IPART carry out an annual update to the net rate ofreturn for each precinct in accordance with the methodology outlined in our Final Report.The Prernier's letter with our Terms of Reference for the annual update is attached.

TERMS OF REFERENCE

ANNUAL NET RATES OF RETURN UPDATE

1. Barry O'Farrell, Premier, approve the provision of sarvices by theIndependent Pricing and Regulatory Tribunal under section 9 of thelndependant Pricing and Regulatory TribunaI Act 1992 to the Department ofTrade and Investment, Regional Infrastnicture and Services (DTIRIS) andRoads and Maritime Services (RMS) in accordance with this 'terms ofreference' .

The services to be provided by the Tribunal are the calculation of the annualupdate to the rental rate of return less outgoings for each precinct, to beincorporated by DTIRIS and RMS into the formula for determining the rentalcharge for domestic waterfront occupancies. This involves estimating theprecinct specific gross rental rates of return and the precinct specificoutgoings

These net rates of return are the financial rates of return on submerged orreclaimed public land, leased or Iicenced to owners of domestic waterfrontproperties. to be received by the Government after recovering its efficientadministration costs.

In providing these services. the Tribunal should follow the methodologyproposed by the Tribunal in its final report Review of method for determiningrents for domestic waterfront tenancies in NSW (December 2011 ).

The services are to be provided through the provision of an annual writtennotice to the DTIR?S and RMS by 15 April each year from 2013. advisingthem of the suggested rate of returri to be applied to calculate rents for eachprecinct for the upcoming financial yeat.

The update for tha 2C)12-13 financial year should be provided to DT?RIS andRMS as soon as possible.

This arrangement is to contiiiue until the Tribunal is advised by the Premier inwriting that the services are. no longcr required.
