    Act 3 May 13 SB 916 Pennsylvania Election Code - VotingStandards Development Board House Fiscal Note These votingstandards will be published in the Pennsylvania Bulletin and willprovide direction to election officials as to which votes are valid

    and which votes are invalid. For paper ballots or optical scanvoting systems, for example, a vote is valid or invalid based onthe type of mark made by the voter.

    The Last Full Measure of Devotion

    This naming is a reminder of the importance and significance ofPresident Harry Truman to confront Chinese Communistaggression into South Korea.

    Five years after a war-weary America celebrated the end of WorldWar II, costing the deaths of 100s of 1000s of young Americansand billions and billions in American wealth, Americas soldierswere asked to a again fight and die toprevent Soviet and ChineseCommunists from installing a Stalinist-Maoist tyranny in SouthKorea. North Korea had been communist since WWII.

    Over 36,000 Americans died and 92,000 wounded from 1950 to1953 in America's successful effort to keep South Korea from

    becoming communist.

    A satellite photo of North and South Korea dramatizes thesignificance of lives lost to the freedom and prosperity of millionsand millions of South Koreans, now one of Americas mostimportant allies. The US has had tens of thousands of soldiersstationed in South Korea since 1953 at a cost of billions andbillions defending it from the threat of Chinese Communistaggression.

    It is appropriate to remember those who gave the last fullmeasure of devotion to defend America and defend its core value,Freedom of the Individual..

    Rep. Scott Perrys bill HB 916 on second consideration was voteddown to appease SE Penna. Republicans. It will take 27 years topay off current balance; however, even with this billUnemployment Compensation Fund is going deeper in debt.

    Act 6 is a major overhaul of the Unemployment Compensationregimes not only saving taxpayers and businesses 10s of millionsof dollars but giving incentives to unemployed to return to workwhile recognizing the need for a safety net.

    This bill passed in both House and Senate without anynay votes so I will grade it all credit meaning that eventhose who were excused will receive credit.

    Bath Salts is a controlled substance. This seems a reasonableexpansion or modification of underlying bill to protect citizensfrom known and obvious dangers.

    The Fair Share Act

    For Liberty Tier 2: A yea vote will add 25 points tolegislators or governors grade and a nay vote will subtract 25points from the grade.

    The Fair Share Act eliminates joint and several liability forany defendant found to be less than 60 percent liable for causingan injury. Some 40 other states have made this common-sensechange that will keep lawyers from forcing a defendant to pay100 percent of monetary damages, even if they only were foundto be 1 percent at fault.

    David Taylor of Pennsylvania Manufacturers Associationcomments:

    Under the Fair Share Act, defendants less than 60 percentresponsible for a harm would be required to pay damages equalto their percentage of responsibilitybut not more. Anydefendant with a 60 percent or greater share of responsibilitycould be forced to pay up to 100 percent of damages, as couldany defendant who (1) committed an intentional act, (2) dumpedhazardous waste, or (3) violated the Liquor Code. Today, adefendant found even minimally responsible in any kind of civilcase can be on the hook for 100 percent of damages.

    That deep-pocket rule gives the lawsuit industry a powerfulweapon to shake down employers, hospitals, local governments,and other large institutions, knowing that they will pay theransom of a settlement rather than risk a ruinous damage awardat trial. The avenue of attack allowed by "joint-and-several"liability is a major competitive disadvantage for Pennsylvania's

    Act 18 Jun 30 HB 15 Pennsylvania WebAccountability and Transparency (PennWATCH) Act

This is a major step forward in bringing transparency toState Government and allowing The Forgotten Taxpayer to followthe money.

    House Fiscal Note :FISCAL IMPACT: This legislation is the vehicle forimplementation authority to achieve the anticipated state savingsincluded in the General Fund budget for the Department of PublicWelfare and the Department of Corrections.

    Specifically, the following state savings are included in theFY2011-12 budget for DPW: $109million for the adjustment to thehospital assessment; $4.8million for the payment change for

    House Fiscal Note: This legislation provides for the continuationof the Pennsylvania Lotterys statutorily mandated minimumprofit percentage of 27%. Specifically, this legislation amends theLottery Law to provide relief from the 30% minimum profitpercentage for another 4 years to June 30, 2015.

    Act 53 of 2008 amended the Fiscal Code and granted temporaryrelief from the mandated minimum 30% rate of return providedfor in the Lottery Law. This change in the profit percentageallowed the Pennsylvania Lottery the ability to adjust the mix ofinstant and on-line ticket sales in order to meet consumerdemand and maximize profits which fund programs benefitingolder Pennsylvanians. This temporary relief provided for in theFiscal Code was granted for 3 years and is currently set to expireon June 30, 2011.

    The act would take effect July 1, 2011, or immediately, whicheveris later.

    FISCAL IMPACT: Enactment of this legislation will result in anestimated additional $86.3 million in available monies within theLottery Fund to provide funding for programs that benefit olderPennsylvanians. According to information provided by theDepartment of Revenue, the estimated net operating revenuewith the 27% minimum profit percentage is $939.2 million, whichis $86.3 million higher that the estimated net operating revenueof $852.9 million without relief from the 30% minimum profitpercentage.

    The bill also requires that $25 million of the basic education fundsappropriated to the school districts of the first class be used topay costs related to alternative education programs operated bythe district or under contract between the district and a privatealternative education institution.

    2. Can establish direct exposure to a Group 1 carcinogen.

    3. Successfully passed a physical examination prior to asserting aclaim, or prior to engaging in firefighting duties, which revealedno evidence of cancer.

    Provides that the presumption under the act may be rebuttedby substantial competent evidence that shows that thefirefighters cancer was not caused by the occupation offirefighting.

    States that a claim made by a member of a volunteer firecompany must be based on evidence of direct exposure to aGroup 1 carcinogen as documented by a report filed to thePennsylvania Fire Information Reporting System.

    This bill ( then HB 1231) was vetoed by former GovernorEd Rendell because it was too expensive. This is anunfunded mandate falling on the local taxpayers and firecompanies. However, this legislation threatens public safety byraising the specter of cuts to essential services, or of forcing localgovernments to raise property taxes at the same time thatPennsylvania families are struggling economically.

    Unlike most occupational injuries or diseases, HB 1231 wouldestablish a presumption that any cancer diagnosis would be aresult of firefighting activities and the benefit provider, in thiscase local government, would bear the almost impossible burdento prove otherwise. The current printer number of HB 1231 wouldonly permit employers to rebut the presumption of occupationallycaused cancer by attempting to essentially prove a negative byrequiring "proof of conduct or activities outside of firefightingduties that posed a substantial risk of causing the cancer." This

    legislation also drastically differs from every other state cancer-presumption law, both because of this flawed rebuttable standardand because it would create the presumption for virtually everyform of cancer when medical science simply does not know whatcauses most cancers.

    While the total cost of this legislation is unknown which is aproblem in itself experts predict that it would be significant, andthe burden would be felt through tax hikes, cuts to local services,or both and, even worse, those cuts could be to firefighting

    activities. Municipal workers' compensation insurance trustspredict drastic rate increases and question their ability to evenunderwrite coverage of occupational cancer claims under thisflawed bill. If municipalities lose this coverage, it could create acatastrophic financial situation.

    No fiscal impact to the Commonwealth will result from theprovisions in the bill. However, local government entities, trusts,municipalities, and those volunteer fire companies which are self-insured, may experience additional costs due to increased

    out for bid.

    This legislation will have no adverse impact on Commonwealthfunds. The legislation would only widen the pool of potentialapplicants for Rail Freight Assistance Grants, which are contingentupon appropriations by the General Assembly.

    ?? Act 72 Jul 7 SB 791 Bluff Recession and Setback Act -inspections

    This bill amends the Bluff Recession and Setback Act (Act 48 of1980) to expand the definition of bluff recession hazard area toexclude any area where the horizontal distance, measuredperpendicular to the shoreline, between the shoreline and thebluff toe is in excess of 250 feet so that such areas are notsubject to any Environmental Quality Board (EQB) regulations or

    municipal bluff setback ordinance or regulations establishedunder the act. It further defines the terms bluff toe and shorelineto further clarifies issues related to bluff recession hazard area.

    Act 73 Jul 7 SB 828 First Class Township Code amends theFirst Class Township Code to further provide for the office oftownship manager and for powers and duties of a manager

    This legislation would amend Section 1202 of the First ClassTownship Code to provide that the township manager shall serveat the pleasure of the board of commissioners, subject tocontractual rights that may arise as a condition of employment.

    The board may enter into an employment agreement with themanager, which will terminate no later than two years after theeffective date of the agreement or the date of the organizationmeeting of the board following the next municipal election,whichever occurs first. The employment agreement may includeprovisions relating to severance compensation, but shall notguarantee employment through the term of the contract or conferupon the manager any legal remedy based on specificperformance.
