Definitions

"THE ACT" means the Environment Protection Act 1993.

"THE AUTHORITY" means the Environment Protection Authority established under Division 1 of Part 3 of the Act.

"THE PREMISES" means the whole of the land comprised in Titles Register - Certificate of Title, Crown Lease and Crown Record:

"AUTHORISATION FEE PAYMENT DATE" means the anniversary of the grant or renewal ofthis authorisation'.

"E-WASTE" means waste electrical and electronic equipment which is dependent on electric c u r r e " ^ . . . a r o . efecYromagnetic fields in order to function (including all components, subassembly and consumables which are part of the original equipment at the. time of discarding). NOTE. "ENVIRONMENTAL HARM" means the same as is defined in section 5 of the Environment Protection Act 1993.

"INCOMPATIBLE WASTES" means wastes that: ; . •• ,,u

(I) when mixed or otherwise brought into contact, are likely to interact and increase the risk to human health and/or the

"LIQUID WASTE" means waste classified as liquid waste in accordance with the assessment process set out in the

S O T ^ T i S Celcius regardless of whether or not it is packaged or otherwise ct^ l^ned ^ncTirrespective of whether or not the packaging or container is to be disposed of together with the hqu.d that it contains.

"LISTED WASTE" means wastes listed in Part B of Schedule 1 of the Environment Protection Act 1993.

"WTC" means Waste Transport Certificate.

"WTF" means Waste Tracking Form.

Explanatory Notes (NB. - Explanatory Notes do not constitute a part of this Authorisation)

1. This licence does not permit any activity in breach of any other approval by any other authority. For example, this licence does not permit any activity on the Premises which is not authorised under the Development Act 1993. It is the responsibility of the Licensee to ensure that any action or activity referred to in this licence is permitted by, and is carried out in compliance with, statutory requirements.

2. This licence is subject to the Act.

3. Conditions of this licence can be varied by the EPA in accordance with section 45 of the Act.

4. This licence can be suspended, cancelled or surrendered during the term of the licence in accordance with sections 55 and 56 of the Act.

5. The Licensee must report to the EPA (on EPA emergency phone number 1800 100 833) all incidents causing or threatening serious or material environmental harm, upon becoming aware of the incident, in accordance with section 83 of the Act. Note - In the event that the primary emergency phone number is out of order, phone the secondary number (08) 8204 2004.

6. The Licensee must be aware of, and comply with: 1. the requirements of the Environment Protection Policies which operate pursuant to the Act; and 2. the requirements of any National Environment Protection Measure which operates as an Environment Protection Policy under the Act. NB: These requirements govern permissible procedures and protocols, emission or concentration levels, as well as operation and/or maintenance standards of plant and equipment.

7. PUBLIC REGISTER INFORMATION. The Environment Protection Authority maintains a Public Register that is available to the public. Information maintained includes issued Environmental Authorisations (Licences, Exemptions & Works Approvals), Emergency Authorisations and various submitted Applications. Should the conditions of an Environmental Authorisation require that the Holder submit a report or other information to the Authority, then that submitted information is made available on the Public Register subject to commercial confidentiality. Endorsed Public Register information may be available on the EPA website.

8. The EPA undertakes to provide written advice within 14 days of receipt of all information required for assessment.

9. This licence applies only to the Premises. Application for a new licence will be necessary should the Licensee move to new Premises.

CONDITIONS OF LICENCE

The Licensee is authorised to conduct the prescribed activities as described in .this'licence on the Premises nominated, subject to the following conditions:

CONTROL OF EMISSIONS

1. (330-245) STORMWATER MANAGEMENT

The Licensee must:

1. ensure that all stormwater runoff from uncovered hardstand areas on the Premises is directed to the triple interceptor pit; and

2. ensure that the triple interceptor pit is maintained on a regular basis ' to1 provides effective operation.' J ~ - ^ ">?'<•

2. (330-155) DUST

The Licensee must take all reasonable and practicable measures to jareverit dust or sediment escaping from the1 Premises.

3. (330-154) ODOUR

The Licensee must take all reasonable arid practicable measures to prevent the escape of odour from the Premises.

WASTE MANAGEMENT

4. (67-11) PERMITTED WASTES - RECEIPT AND/OR DISPOSAL

C. The Licensee is advised to ensure that any change to waste materials has received prior approval from the relevant planning/development authority (if applicable).

5. (67-622) MUST NOT DISPOSE

The Licensee must not dispose of any waste at the Premises.

6. (67-1027) E-WASTE MANAGEMENT

The Licensee must ensure that e-waste is stored at the Premises in the following manner:

1 on an impermeable surface; and

2 undercover to prevent the entry of stormwater into that material.

NOTE: The Licensee should store e-waste separately from other waste and take care in its handling to maximise its potential for reuse or recycling.

SCRAP METAL MANAGEMENT

The Licensee must:

1 ensure that the scrap metal recovery facility is maintained in a tidy condition;

2. ensure that any non metal waste, including that mixed up in scrap metal, is stored in sealed containers; and

3 the material referred to in paragraph 2 is transported from the Premises each week to a facility that can accept such waste:

3.1 by the Licensee; or

3 2 by a person licenced by the Authority to transport such waste.

STOCKPILE MANAGEMENT

The Licensee must ensure that waste stockpiles at the Premises do not exceed 5.5 metres in height when measured from the existing concrete base.

9. (40-17) SWARF MANAGEMENT

The Licensee must store steel swarf in concrete lined bays fitted with leachate collection sumps.

OPERATIONAL MANAGEMENT

10. (40-30) BALING TO BE UNDERTAKEN INSIDE BUILDING ONLY

The Licensee must ensure that the operation of the 250 tonne baler, briquetting. and' the removal of .coated material is undertaken within the coMnes of a building.' " ' ; ' ' • ' :

11. (67-699) SIGNAGE

The Licensee must display a sign at the entrance to the Premises clearly stating:

1. the Licensee's name;

2 the Licensee's authorisation number;

3. an emergency contact name and telephone number; and

4. the type of wastes that can.be received subject to this authorisation.

12. (67-741) SUPERVISION

The Licensee, must supervise the receipt and handling of waste at the Premises to.ensure;that it is managed in accordance with the conditions of this authorisation.

13. (40-32) BUNDING - SCRAP METALS

The Licensee must ensure thatany scrap material ;with the potential to contain liquid, is stored in a bunded, roofed area in accordance with the 'bunding and spill management' EPA Guidelines June 2007.

14. (67-694) STORAGE OF FUEL, BATTERIES AND OIL

The Licensee must:

store fuel, batteries and oil within a bund in accordance with the EPA Guideline entitled 'Bunding and Spill Management' updated June 2007;

2. store batteries undercover preventing the entry of stormwater into that bund; and

3 store and decant oil under a roofed area preventing the entry of stormwater into tli'at bund:

15. (67-772) SPILL KIT FOR BATTERIES

The Licensee must ensure that:

-I An emergency spill kit and a hazard sign is,'((ocateci at the battery storage area; and

2 An emergency spill kit is provided at the loading/unloading point for batteries (if different from the battery storage area).

16. (67-739) LITTER MANAGEMENT

The Licensee must:

1. take all reasonable and practicable measures to prevent the escape of litter from the Premises, and

collect and dispose of any litter that escapes from the Premises on or before the close of each day's operations.

17. (330-153) VERMIN

The Licensee m u s t t a k e all reasonable and practicable measures to prevent the attraction and harbourage of vermin.

18. (67-700) FENCING

The Licensee must maintain a fence around the Premises that is suitable for preventinguriauthorisedaccess.

19. (67-703) SECURITY

The Licensee must lock all access gates when the Premises is unattended.

20. (300-20) COMPLAINTS REGISTER

The Licensee must:

1. maintain s register of complaints received regarding the Licensee's operations that sets out:

1.1 the date and time that the complaint was reported;

1.2 details of the complaint;

1.3 the name and address of the complainant (if permitted by the complainant);

1.4 the date and time of the events giving rise to the complaint;

1.5 the likely cause of the events giving rise to the complaint;

1.6 an estimate of the temperature, wind speed, wind direction and rainfall at the time of the: events giving rise to the complaint;

1.7 any action taken in response to the complaint and to prevent a recurrence of the events giving rise to the complaint; and

2. retain the register for the duration of this licence.

21. (82-20) GENERAL CONDITIONS FOR THE TRANSPORT OF WASTE

The Licensee must:

1. take all reasonable and practicable measures to prevent the spillage of waste during loading/ unloading and during transportation;

2. ensure that a Ijcence identification label which has been issued by the1 EPA for that vehicle is displayed in a position as hear as practicable to the bottom left'hand corner of the windscreen whenever the Licensee transports waste pursuant to this licence;

have an emergency spill kit on each vehicle, which is suitable for the type of waste that is being transported; and

use that spill kit in the event of a spillage of waste from that vehicle; and

notify the EPA within two hours of becoming aware of a spillage of waste from the vehicle that has the potential to cause, or has caused, serious or material environmental harm.

NOTE. You should also notify the EPA at least 14 days prior to any change of vehicle taking place.

22. (82-21) TRANSPORT OF LISTED OR CONTROLLED WASTE

The Licensee must:

1. only take Listed or Controlled Waste to a waste depot licensed by the EPA to receive that waste;

2. establish and maintain an emergency plan for the containment and recovery of any spillage of Listed or Controlled Waste; and

3. not mix incompatible wastes.

23. (82-22) TRANSPORT OF WASTE WITHIN SOUTH AUSTRALIA

1. The Licensee must hot transport any Listed Waste on List 1, as detailed in the list attached to this licence, within South Australia unless this licence permits the transport of that waste, and it is accompanied by a WTC, and

1.1 the producer of that waste has completed part 1 of that WTC, and

1.2 the Licensee has completed part 2 of that WTC and the tear off slip at the bottom. of the WTC, and

1.3 the Licensee has provided the producer with the pink and green copies of that WTC (with parts 1 and 2 completed)

2. The Licensee must:

2.1 provide the white and yellow copies of that WTC (with parts 1 and 2 completed) to the person receiving that waste

2.2 retain the blue copy of WTCs for no less than 12 months

3. The Licensee must not transport any Listed. Waste,on List 2, as detailed in the list attached to this licence, within South Australia unless this licence permits the transport of that waste, and it is accompanied by a WTF, and

3.1 parts A and B of that WTF have been completed.

4. The Licensee must:

4.1 at the time of collection provide the green copy of the WTF to the producer of originator of the waste;

4.2 provide the white and yellow copy of the WTF (with parts A and B completed) to the person receiving that waste, and

4.3 retain the blue copy of the WTF for no less than 12 months.

ADMINISTRATION

24. (400-338) CHANGE OF LICENSEE DETAILS

If the Licensee's name or postal address (or both) changes, then the Licensee must inform the EPA within 28 days of the change occurring.

25. (400-339) DISPLAY LICENCE

The Ljcensee must display a copy of this licence on a notice board at the Premises;

26. (400-215) LICENCE INFORMATION TO EMPLOYEES/CONTRACTORS

The Licensee must ensure that every employee, agent or contractor responsible for carrying out any task controlled by this licence is properly.advised as to the requirements of this licence and the general environmental duty under section 25 of the Act that relate to that person's tasks and responsibilities as employee, agent or

,, contractor.

27. (400-201) IMPOSE OR VARY CONDITIONS

The EPA may during the term of this licence impose or vary conditions: . .

1. in relation to testing, monitoring and reporting referred to in section 52(1)(a) of the Act;

2. which require the Licensee, in accordance with section 53 of the Act, to prepare a plan of action to be taken in the event of an emergency;

3. which require the Licensee to.develop an EIP as set out in section 54 of the Act and to comply with the requirements of the EIP;

4. which relate to provision of information relating to the Licensee or any agent or contractor undertaking any activity on behalf of the Licensee pursuant to this licence; and

5. which relate to provision of information relating to the activity subject to the licence including the levels of inputs and outputs and the amounts of pollutants or waste generated by the activity.

28. (400-347) CHANGE to PROCESS EMISSIONS or WASTE

The Licensee must:

I not undertake changes to operating processes at the Premises without written approval from the EPA where such changes:

] 1 have the potential to increase the emissions, or alter the nature, of pollutants or waste currently generated by or from the licensed activity; or

1 2 have the potential to increase the risk of environmental harm; or

-I 3 would relocate the point of discharge of pollution or waste at the Premises;

2. ensure that written application is submitted to the EPA on the EPA form entitled 'Application for Change to Process Emissions or Waste", that details the proposed changes; and

3 pay the prescribed application fee indicated on the Application form.

NOTES.

A The EPA may during the term of this licence impose or vary the conditions of this authorisation upon approval of an application made in accordance with this condition.

29. (400-348) ALTERATIONS to PLANT and EQUIPMENT

The Licensee must:

I not construct or alter a building or structure, or, install or alter any plant or-equipment at the Premises, without written approval from the EPA, where such changes:

I I have the potential to increase the. emissions, or alter the nature of pollutants or waste currently generated by, or.from the licensed activity, or

1 2 have the potential to increase the risk of environmental harm, or

1 3 would relocate the point of discharge of pollution or waste at the Premises;

2 ensure that written application is submitted to the'EPA on the EPA form entitled 'Application for Alterations to Plant and Equipment' that details the proposed changes; and

3 pay the prescribed application fee indicated oii the Application form.

The EPA may during the term of this licence impose or vary the conditions of this authorisation upon approval of an application made in accordance with this condition.

The 'Application for Alterationsto Plant and Equipment' form is available on the EPA website at -http://www.epa.sa.gov.au/xstd_files/Licensing/Form/06_equipment_c hange.pdf.

In some circumstances installation of plant and equipment may be subject to consent under the provisions of the Development Act, which may have priority over the obligations of this condition - check with the licence coordinator for advice prior to completing the Application form.

ANNUAL RETURN PROCESS

The Licensee must:

submit an annual return at least 90 days before the authorisation fee payment date, if this licence is for a term of two years or more; and

pay the annual authorisation fee by the authorisation fee payment date.

LICENCE RENEWAL PROCESS

An application for renewal of this licence must be made at least 90 days before the expiry date of this licence.
