TAKEN OUT OF ORDER ITEM NO.9: HUMAN RESOURCES UPDATE: Craig Schwinck said he has talked to John Upton in follow-up of Mr. Upton's presentation on the retirement trust. Mr. Upton wants to take equities down to forty-five (45%) percent (within the policy). Milliman said it will not be necessary to increase our contribution as a percentage of salary. Craig recommends we do the rebalance. Ms. Dye said she agrees. This will be acted on Wednesday. The Health Department has promoted an Environmental Health Specialist I to an Environmental Health Specialist II because she received her certifications. It will mean a seven (7%) percent raise for Step l. Dr. Hesse said she is one of the best in the State, with a Masters degree. Ms. Pampush said she is the best one we have ever had. He gave some comparables. This wage will be close, but slightly below Lincoln County. Vice-Chair Hurliman was surprised that Sherman and Wasco Counties would have a position like this. Dr. Hesse said these positions are hard to recruit. She got her license back in October and he wants to make it retroactive back to November 1 5t . Mr. Schwinck said the County pays based on five (5) surrounding Counties. Mr. Schwinck said there is no automatic promotion due to registration. He had no problem with the retroactive payment. AFSCME contract negotiations are occurring next door and if we go outside the five (5) surrounding Counties he will have a problem during negotiations. Commissioner Josi said Dr. Hesse wasn't the first person to come to the Commissioners with this kind of request. He can't support this. She will get a seven

(7%) percent increase, retroactively and it is not in his budget. Also, it raises havoc withthe Union. Mr. Schwinck said Dr. Hesse has to be patient. Chair Labhart agreed withCommissioner Josi. Vice-Chair Hurliman felt the jobs were different from otherCounties and he agreed with Commissioner Josi.

ITEM NO.1: PUBLIC COMMENTS - NON-AGENDA ITEMS - REQUEST TO SIGNGUEST LIST: Chair Labhart welcomed everyone and reminded them to sign the guestlist.

ITEM NO.2: DISCUSSION CONCERNING ORDER APPOINTING SHARON DAVISTO THE FISHERMAN ADVISORY COMMITTEE FOR TILLAMOOK (FACT) ANDCHANGING FRANK BOHANNON'S REPRESENTATION CATEGORY ON THEFACT: Linda Buell said there was a misunderstanding. They are having a hard timefilling slots. She said the committee is now balanced and an at-large position wouldthrow it out of balance. She said Mr. Bohannon stated it didn't matter to him. ChairLabhart and Vice-Chair Hurliman said Mr. Bohannon told them he preferred to be at­large.

Ms. Buell said this committee has been important to the industry issues. She talkedabout the halibut issue, as an example. Vice-Chair Hurliman felt as an at-large positionMr. Bohannon can be recognized for his expertise. Commissioner Josi asked thecommittee to come back with a recommendation on this. Chair Labhart said they willlisten but the Board makes the decision. She will come back with the FACTrecommendation.

Chair Labhart said a meeting is being arranged with the Governor's Chief of Staff tocome to Tillamook County to discuss Marine Reserves. Commissioner Josi felt a pre­meeting was important to develop a unified message.

ITEM NO.3: DISCUSSION CONCERNING ANIMAL SHELTER'S REQUEST TOENTER INTO AN AGREEMENT WITH THE COUNTY TO OPERATE AN INTERIMANIMAL HOLDING FACILITY LOCATED AT THE TRANSFER STATION: SandyCarbaugh and Diane Johnson were present. Paul Levesque summarized discussionsthat have occurred in recent months as to having the Tillamook Animal Shelter group totake over the Transfer Station site and operations. Ms. Carbaugh outlined theimprovements that need to be made. She hoped the agreement would providetransition in the first year.

Chair Labhart said the group is ready to go. Mr. Levesque will negotiate an agreementand bring it back to the Commissioners. Chair Labhart is a strong supporter. Vice­Chair Hurliman said he trusts that everything will be worked out in an equitable fashion.Commissioner Josi agreed. Ms. Carbaugh thanked Ms. Welch for her help.

ITEM NO.4: DISCUSSION CONCERNING ORDER APPOINTING MEMBERS TOTHE TILLAMOOK COUNTY LOCAL PUBLIC SAFETY COORDINATING COUNCIL:Mike Lawlis said Senate Bill 1145 created an Advisory Committee. He said somemembers have retired. He outlined the proposed members and positions. Mr.Levesque said the Board asked that all positions on committees be placed on terms.Vice-Chair Hurliman asked that on Wednesday, Mr. Lawlis address the purpose of thecommittee. Mr. Lawlis said it is statutory. This will be brought forward to Wednesday.

ITEM NO.5: DISCUSSION CONCERNING AMENDMENT #2 TOINTERGOVERNMENTAL AGREEMENT WITH THE DEPARTMENT OF CONSUMERAND BUSINESS SERVICES, BUILDING CODES DIVISION (STATE CONTRACT #90G0000921 FOR TILLAMOOK COUNTY TO PROCESS MANUFACTUREDSTRUCTURE OWNERSHIP DOCUMENTS AND TRIP PERMITS (COUNTYCONTRACT #3611 I: Mr. Levesque outlined the agreement based on prior experience.Chair Labhart said the amendment merely extends the Agreement for two (2) years.This will be brought forward to Wednesday.

ITEM NO.6: DISCUSSION CONCERNING PROPOSED PURCHASE OF HEALTHDEPARTMENT BUILDING AND ASSOCIATED PROPERTY BY THECOUNTY/HEALTH DEPARTMENT: Dr. Hesse outlined Mr. Riggert's proposal. Hesaid the Health Council recommends that the proposal does not fulfill either the shortterm or long term needs. He discussed the disjointed proximity of administration stafffrom the Clinic. He said the increased mortgage payment would be a problem. Headded that there had been no appraisal but the overall offer was very generous. TheHealth Council was concerned about the age of the structure and beginnings ofmaintenance needs. He discussed the flooring problem and the building transition. Therecommendation was not to move forward.

Commissioner Josi agreed and asked that Dr. Hesse draft a letter for CommissionerJosi's review, to go to the owner with the Board's rationale. Vice-Chair Hurliman askedthat Mr. Levesque also review the letter.

Chair Labhart said Mr. Riggert's intent was to sell the building. Dr. Hesse said if Mr.Riggert moved tenants around it would work better for the Health Department. Dr.Hesse will prepare a letter for the Board's signature.

ITEM NO.7: DISCUSSION AND CONSIDERATION OF GRANT APPLICATION TOTHE OREGON DEPARTMENT OF HUMAN SERVICES FOR A TOBACCOPREVENTION AND EDUCATION PROGRAM FOR TILLAMOOK COUNTY. WHICHINCLUDES AN INTERGOVERNMENTAL AGREEMENT REGARDINGENFORCEMENT OF THE OREGON INDOOR CLEAN AIR ACT: Dr. Hessesummarized the ills of tobacco and related stats. The grant is eighteen (18) months inan amount of Eighty-Four Thousand Nine Hundred Seventy-Five ($89,975) Dollars. Dr.Hesse outlined the grant review process he has to go through. He stated the goals ofthe grant and its nine (9) objectives. It is a non-competitive grant. The majority will gointo personnel costs of a contractor. The County keeps ten (10%) percent of the projectcosts in an amount of Five Thousand Seven Hundred ($5,700) Dollars. Ms. Dye said itwould require a budget adjustment. Vice-Chair Hurliman said he was fine with it if Ms.Dye was, but felt it would not be very effective like prohibition was. Marlene Putmansaid smoking was the pathway to drugs and alcohol.

A motion was made by Commissioner Josi to approve the grant application to theOregon Department of Human Services for a Tobacco Prevention and EducationProgram for Tillamook County. The motion was seconded by Vice-Chair Hurliman. Themotion carried with three (3) aye votes.

ITEM NO.8: COMMISSION ON CHILDREN & FAMILIES UPDATE: a) UPDATE ONCOMMON GROUNDS COMMUNITY SURVEY: Ms. Putman provided a summary ofthe Commission on Children and Families Plan common grounds community survey.She described the volunteer group and the issues that they focused on. One (1) issuewas a focus on kids who won't go to college. There were three hundred seventy-five(375) responses to the on-line survey. She will prepare an executive summary forWednesday. The most important issues identified by respondents were related to drugand alcohol.

b) DISCUSSION CONCERNING APPOINTMENT OF TODD ANDERSON AND LEECOLEMAN AS EX OFFICIO MEMBERS TO THE COMMISSION ON CHILDREN ANDFAMILIES COMMISSION BOARD: Ms. Putman is asking these people to beappointed on a yearly basis. She discussed the importance of these people. Therewas consensus to do so.

c) DISCUSSION CONCERNING MODIFICATION #2 TO PERSONAL SERVICESAGREEMENT (COUNTY CONTRACT #3771) WITH TILLAMOOK SCHOOL DISTRICT#9 FOR THE EARLY LITERACY JUMP START PROGRAM: Ms. Putman said thisprovides training for parents. This will be brought forward to Wednesday.

ITEM NO. 10: PUBLIC WORKS UPDATE/LIANE WELCH: Ms. Welch said this stormreally stressed our system. She described current work with three (3) engineers fromthe City of Portland for damage assessment. She said there is Five Million ($5,000,000)Dollars in damage and there is a seventy-fivettwenty-five (75/25%) percent match. Sheneeds direction from the Commissioners. We lost a bridge. Coordination with thePeople's Utility District has been fantastic.

al DISCUSSION AND CONSIDERATION CONCERNING A CONSTRUCTIONCONTRACT WITH BIG ROCK EXCAVATION, INC. TO REPAIR BLAINE ROADMILEPOST 12.7 SLIDE and bl DISCUSSION AND CONSIDERATION CONCERNINGCONSTRUCTION CONTRACT WITH COASTWAY CONSTRUCTION CO. INC, TOCLEAR AND STABILIZE THE SLIDE ON SANDLAKE ROAD MILEPOST 12.5: Therewas a discussion about the original Federal Housing Administration project.

Commissioner Josi made a motion to approve and sign the Construction Contract withBig Rock Excavation, Inc. to repair Blaine Road at milepost 12.7 and CoastwayConstruction Co. Inc. to clear and stabilize the slide on Sandlake Road milepost 12.5.Vice-Chair Hurliman seconded the motion. The motion carried with three (3) aye votes.The Commissioners signed the Construction Contracts.

The Commissioners thanked Ms. Welch and her crews. She said her AFSCME crewswith overtime are making more than her managers. Vice-Chair Hurliman felt we neededto be doing as much expeditiously as funding will allow. Commissioner Josi said hercrews really appreciate her. Ms. Welch will try to get Jon Oshel here or at least set up aconference call. There was a discussion about coordination and tracking.

ITEM NO.11: COMMUNITY DEVELOPMENT UPDATE: Bill Campbell reported on thecommunity meeting held on Tax Lot 500 in Neskowin. The community will now meet onits own. We will only provide coordination. Gus Meyer said Tillamook EstuaryPartnership might be able to help. Ms. Welch said the Nestucca Watershed Councilcould help as well.

al PERMIT REPORT: Mr. Campbell said with damage assessments, inspections wereabout the same. There was a discussion about the requirements for hooking upgenerators at fire stations. Mr. Campbell said the National Electrical Code (NEC)designates fire halls as Class I facilities, requiring an engineered slab for the placementof generators. Mr. Campbell said there are five or six (5 or 6) public buildings in theCounty with such generator issues.

bl SANITATION REPORT: Mr. Chiola's report shows he is up to speed. He is lookingat systems on flood damaged properties.

OTHER: The Hazard Mitigation Grant funds range between Six Hundred FiftyThousand ($650,000) Dollars to One Million ($1,000,000) Dollars for the 2006 event.They have scheduled a meeting on December 18, 2007 to work on fully qualifyingpeople. Mr. Campbell described how mitigation worked.

c) DISCUSSION CONCERNING AMENDMENT NO.2 TO OREGON DEPARTMENTOF LAND CONSERVATION AND DEVELOPMENT FY06-07 GRANT AGREEMENTFOR NORTH TILLAMOOK COUNTY REGIONAL BUILDABLE LANDS INVENTORY:Mr. Campbell said the three (3) Cities have sufficient lands and are going through theirindividual land use processes. The six (6) month extension will facilitate this. Therewas consensus to move this to Wednesday. Cogan's agreement will also need to beextended.

ITEM NO. 12: DISCUSSION CONCERNING FULL-TIME EQUIVALENT (1 HE)POSITION TO BE SHARED BY COMMISSIONERS' OFFICE AND COMMUNITYDEVELOPMENT: Mr. Campbell described the workload occasioned by the passage ofMeasure 49. They don't have the time to do the research or meet with claimants. Theyhave two (2) positions that have been vacant for six (6) months and revenues are atfifty-two (52%) percent. Mr. Campbell said his budget would cover fifty (50%) percent ofMr. Palter's full time and one hundred (100%) percent of his benefits. Mr. Campbellsaid Mr. Schwinck was supportive. Mr. Campbell will talk to Mr. Schwinck about theposting requirements. Vice-Chair Hurliman said he saw no way around it.

Commissioner Josi said we have severe staffing issues that exacerbate withoutsufficient revenues. He described the cyclical process of re-prioritizing services. Ms.Dye said we have been fortunate for about eight (8) years. Ms. Dye was concernedabout how we pay for the storm damage and we are working on shaky financial ground.Commissioner Josi said he didn't know how we can say no with the vacancies. ChairLabhart said he also supported the request through the end of June. This will bebrought forward to Wednesday. Commissioner Josi said it is only short term until thebudget request.

Commissioner Josi passed along a proposal from McCartney in Oceanside for Mr.Campbell's review.

ITEM NO. 13: FACILITIES. FLEET AND CONTRACTS DIRECTOR UPDATE: a)DISCUSSION CONCERNING BUILDING AND GROUNDS MAINTENANCE WORKERPOSITION: Mr. Levesque stated that this posting was to replace Larry West's positionwhen he retires. It is scheduled to allow a one (1) week overlap. It is an hourly, notsalaried position. There was a discussion about how weekend work would bescheduled.

bl DISCUSSION CONCERNING CUSTODIAN POSITION: Mr. Levesque explainedthat Sara Charlton's adopted five (5) year levy provided a full time maintenance workerat the rate of the current half-time employee. Mr. Levesque said that after furtherdiscussions, it was decided that the maintenance person would continue work there four(4) hours per day/twenty (20) hours per week, but that an entry level custodian would behired at four (4) hours per day/twenty (20) hours per week to do carpets, deep cleaningand other custodial work that doesn't get done as part of the daily routine. It would saveOne Thousand ($1,000) Dollars per month. Vice-Chair Hurliman said he thought thatposition was to be contracted. Mr. Levesque said he was not aware of that and had notbeen Facilities Director at the time the budget was prepared. Consensus for Mr.Levesque to proceed.

cl DISCUSSION CONCERNING PROPOSALS TO WASH TILLAMOOK COUNTYOWNED VEHICLES FROM ELITE CAR WASH. LLC AND NEW AGE CAR WASH:Mr. Levesque stated that the Board has not reviewed the proposals from bothcommercial car wash companies. Each company has a different technology, one (1) ofwhich could accommodate the law enforcement vehicles. Mr. Levesque said thatbecause of the differences it is difficult to make a valid price comparison. He suggestedcontracts with both vendors and leave it to the drivers' choice. He reminded the Boardthat the new vehicle policy required drivers to have their vehicles washed once permonth. Consensus was to have staff prepare contracts for Board action with bothvendors.

dl DISCUSSION CONCERNING PROFESSIONAL SERVICES AGREEMENT WITHPARAMETRIX. INC. TO CONTRACT FOR A WETLAND DELINEATION. MITIGATIONAND PHASE I ENVIRONMENTAL ASSESSMENT FOR COUNTY FAIRGROUNDS:Mr. Levesque said Parametrix is scheduled to begin work this week. Consensus tomove this to Wednesday.

el DISCUSSION CONCERNING INTERGOVERNMENTAL AGREEMENT WITH THESTATE OF OREGON ACTING BY AND THROUGH ITS STATE BOARD OF HIGHEREDUCATION, ON BEHALF OF PORTLAND STATE UNIVERSITY TO DESCRIBETHE PURPOSE. USES AND ADMINISTRATIVE DETAILS APPLICABLE TOOREGON SOLUTIONS FUNDING: Mr. Levesque said this agreement described theuse and payout schedule for the One Million ($1,000,000) Dollars in Oregon Solutionsfunding. This will be brought forward to Wednesday.

fl DISCUSSION CONCERNING NEW DRIVERNEHICLE POLICY: The Board saidthey had reviewed the policy. Commissioner Josi and Vice-Chair Hurliman wereuncomfortable with the cell phone portion of the policy but said they would go along withadoption. Consensus to schedule for Wednesday. Chair Labhart thanked Mr.Levesque for all his work on this.

ITEM NO. 14: STAFF UPDATE/CALENDAR REVIEW & SCHEDULING/AGENDAREVIEW/SUGGESTION BOX/INTER OFFICE MATTERS: The Commissionersdiscussed whether there should be meetings on December 24 and 26 and December31 and January 2. It was decided to eliminate the December 24th and December 31 st

meetings.

The Commissioners reviewed and approved the Wednesday agenda. Ms. Becraftscheduled Budget Committee interviews. There were no suggestions.

ITEM NO. 15: BOARD CONCERNS - NON-AGENDA ITEMS & ANNOUNCEMENTS:Vice-Chair Hurliman suggested we look at floodgates on Hwy 101 north of Wheelerabove the rail crossing.

Chair Labhart said perhaps as an emergency temporary measure to look at that and thetwo (2) floodgates from Oregon Solutions. A meeting will be held tonight.

Vice-Chair Hurliman talked about a recent United States Supreme Court decision thatsaid that the Endangered Species Act doesn't trump other mandatory legislation.

ITEM NO. 16: PUBLIC COMMENTS: There were no public comments today.

There being no further business Chair Labhart adjourned the meeting at 11 :47 a.m.

The Commissioners will meet with the Governor's Chief of Staff regarding Marine Reserves on Wednesday,December 12, 2007 beginning at 4:00 p.m. in the Commissioners' Conference Rooms A & B located in theCourthouse at 201 Laurel Avenue, Tillamook.

The Tillamook County Courthouse will be closed on Tuesday, December 25,2007, for the Christmasholiday and on Tuesday, January 1, 2008, for the New Year's holiday. Oregon State Circuit Courts will alsobe closed.

The Commissioners' evening meeting schedule is as follows:

1. Call to Order: Donna Parks called the meeting to order at 12:24 p.m.

Stephanie Potts NP was introduced and gave a brief history of her qualifications. Stephanie 1st

day with the Health Dept. was Sept 10th

Consumer Community Needs, Concerns, and Issues:Brochure changes were addressed by Curtis and sticker will be provided to make changes to tollfree number. Cynthia Potts asked about no show rate. Lola responded the rate was low at thistime. Curtis went to see Dr. Shiroma about yearly contract. Curtis brought to Dr. Shiroma theconcerns of not treating Health Dept. Patients the same as his regular patients. Concerns werenoted and Contract rewritten just through December 07. Discussion by Council on patient feesand Dr. Shiroma's charges to Health Department.Report Accepted.

3. Consent Calendar:Donna Parks found an error in July Meeting Minutes, Carmen made the report on Dr. Shiromainstead of J. VanderEnde, error was noted and minutes were accepted.

August Meeting Minutes were approved.

4. Report Committee:a. Employee Appreciation: Donna Parks stated the Employee Appreciation Breakfast on

Sept. 12 was well received. The employees also received cards and pencils as a thankyou from the Health Council.

The Health Council will be finding other ways to interact with Clinic Staff.

b. The Quality Assurance Testing evaluation will be reported at next meeting by Lola.Report Accepted.

c. Dr. Parson noted that the West Nile virus is seen in Jays and Crows first and if anyonenotices one of these birds dead from no apparent reason to notify the Health Department.Report Accepted.

5. Financial Report:Sharon Williams explained the budget.a. 1st was the $25,382.01 lowered revenue. Sharon showed the Council where we have less

revenue from Medicaid and FPEP.Discussion.

b. FPEP funds were down due to lack of client documentation.

up that encounters are cyclical.Discussion.

f. On page 7 of report Council noted the Client Generated Only Revenue by Location byMonth.Discussion.

G. On page 8 of report Council noted Accounts Receivable Aging by CategoryDiscussion.Carmen moved we accept the Financial Report, the motion was seconded byCynthia and Report was approved by vote of the council.

6. OLD BUSINESS:Lola Martindale discussed the Policy and Procedure changes:a. Out of County Patients Policy and Procedure

Open DiscussionDr. Rex Parsons moved that the new Policy and Procedure be adopted; the motionwas seconded by Cynthia Putt and approved by vote of the Council.

7. ADMINISTRATOR REPORT:Curtis Hesse reported on the Rinehart FQHC Issue:a. The Commissioners have decided not to provide a letter of support for Rinehart's FQHC

Application. The Commissioners will oppose the application of the Rinehart clinic forFQHC status. Open Discussion.

b. Nehalem Bay Health Center discussed a WIC center in Wheeler and collaboration onEmergency Preparedness. Open Discussion.

c. We are in final stage of preparing the "Statement of Position" - Final Review will becompleted and then mailed to the Feds.

d. Curtis reported on meetings with the Commissioners on Candidate recruitment of Doctors,PA and NP. Curtis is working on salary adjustments and pay scales.

e. Curtis has 2 medical providers that have agreed to work part-time (2 to 3 days) a week.Open Discussion

f. Curtis reported Mr. Riggert's offer to sell Central Clinic to Health Department:There was general consensus by the Health Council on the following issues:

That offer does not fulfill Health DepartmentlFQHC Clinical Services short-termmuch less longer term needs. These needs include the critical reuniting of Administration,

Environmental Health and Public Health with Clinical Health Center services. This issuehas been discussed with Mr. Riggert in the past. If this reuniting cannot be done in asingle building it would need to be done by locating the units in adjacent buildings in closeproximity. It was felt that Mr. Riggert might have other options available to him that mightbetter fulfill these Departmental needs along with freeing up certain of his other buildingsfor sale or other disposition. These potential options might include the little used (1-2 daysper month) office space (Orthodontist) adjacent to the Health Department Administration;the law office next to the Health Center; as well as vacating the area currently used byPH/EH within the Shiroma building. Mr. Riggert may have other options open as well.

The increased monthly mortgage payment of $6,806 would be a challenge with thecurrent financial status and condition of the Health Department.

Realizing that an independent property appraisal was pending, the suggestedproperty value of $1 ,000,000 seemed excessive.

As generous an overall offer as this might seem on the surface there was concernthat based on the level of bUilding deterioration from its construction to this date, thecondition at the end of 16 years and certainly 20 years would not make it a prudent andwise investment.

g. Other Action: Compensation Study by outside entity.

h. Board voiced that they would like a Strategic Planning and Financial Planning Workshop.

i. Curtis will prepare a proposal for Strategic Planning Workshop. Open Discussion.

j. The week of Oct. 29 - Nov. 2, there will be a visit by William Coulombe, Deputy PublicHealth Director for the State of Oregon. The purpose of the visit will be to orient Mr.Coulombe on the every-day life in a County Health Department.

BUILDING AND GROUNDS MAINTENANCE WORKER

INTRODUCTION

This classification performs a variety of tasks involving light labor in the cleaning, maintenance, andcare of buildings, facilities, and grounds of the County facilities and does related work as required.

EXAMPLES OF PRINCIPAL DUTIES(Duties assigned to this level include, but are not limited to, the following examples. Anyone positionmay not perform all listed tasks.)

Sweep, mop, scrub, wax, and polish floors, operate power cleaning equipment such as buffer, sweeper,vacuum cleaners.

Empty wastebaskets. Clean and disinfect water fountains.

Clean and sanitize restrooms and fixtures; replenish restroom supplies.

Perform routine electrical, plumbing and construction maintenance as needed; perform maintenancepainting.

Perform external building maintenance such as painting, pressure washing, etc.

Move and set up furniture; store records in archives; maintain heating system.

Wash windows, blinds, walls and ceilings.

Replace burned out light bulbs; make minor repairs to toilets, faucets, sinks, etc.

Perform grounds maintenance and care such as cutting crass, pruning shrubs and pulling weeds inlandscaped areas, and sweeping steps and walkways.

Operate and maintain power equipment such as chain saws, pressure washers, riding mowers, variouslaw equipment, etc.

Inventory, order, and refill cleaning materials and equipment needed to do the work. Adjust, clean, andoil equipment and change attachments.

Perform related work as required.

KNOWLEDGE, SKILLS, AND ABILITIES

This classification performs a variety of manual tasks III cleaning and maintaining buildings andgrounds.

EXAMPLES OF PRINCIPAL DUTIES(Duties assigned to this level include, but are not limited to, the following examples. Anyone positionmay not perform all listed tasks.)

Basic cleaning of buildings which includes vacuuming, mopping, buffing and waxing floors andstairways; cleaning and sanitizing restrooms; dusting office furniture and counters; washing windows,walls and doors; collecting and disposing of trash; sweeping steps and sidewalks adjacent to buildings;refilling supplies in restrooms as needed.

Basic grounds maintenance such as cutting grass, pruning shrubs, maintaining landscaped areas, etc.

Operate power cleaning equipment such as buffer, polisher, vacuum, shampooer, and sweeper.

Check, lock and secure buildings.

Report needed repairs and maintenance.

Work indoors or outdoors, depending on the assigned location and work shift.

DRIVINGNEHICLE POLICY

A. POLICY

Driving is among the most hazardous tasks performed by employees and volunteers ofTillamook County. Therefore, it is the policy ofTiliamook County that employees andvolunteers will follow safe driving practices. Safe driving practices include steps toensure the driver's total concentration and safe operation of vehicles, such asdetermining clear directions before departure, refraining from operating equipment suchas cell phones and radios while the vehicle is moving under non-emergencycircumstances and not operating a vehicle when the driver's ability to react is impaired.Drivers are expected to follow defensive driving principles, Oregon laws and regulationsto prevent accidents in spite of unsafe driving by others and/or adverse drivingconditions. It is the intent of this Policy that unsafe or improper behavior be identifiedand corrected.

Department Heads are responsible for enforcing this Policy and shall ensure allemployees and volunteers who drive are provided with a copy of this Policy and arenotified of all the potential consequences of Policy violations.

B. PURPOSE

The purpose of this Policy is to provide for the maintenance and safe operation ofvehicles owned by Tillamook County.C. GOALS

Goals of this Policy also include:

1. Ensure safe driving practices.

2. Fully utilize County-owned vehicles.3. Reduce travel expenses and liabilities for use of personal vehicles on County

Business.

D. AUTHORIZATION

1. Tillamook County reserves the right to withhold the use of County-ownedvehicles from any person for reasons associated with safety of equipment orpersonnel.

2. At the discretion of each Department Head, a requirement for maintaining a logbook may be imposed on employee/volunteer drivers. Upon operation of anysuch vehicle, the operator shall enter the required information into the vehicle logbook.

3. Some departments may be assigned permanent vehicles based on specialneeds. These vehicles will be available to the motorpool when not in use by theDepartment. This does not include emergency or other specialized vehicles.

4. Authorized personnel whose work requires travel out of County may use theirown personal vehicle, if approved by the Department Head or Elected Official.Such approval shall be subject to the County's Policy for mileage reimbursementand shall depend upon County vehicle availability, the nature of the trip and theavailability of travel funds within the department's budget.

5. A copy of this Vehicle Policy will be kept in each County-owned vehicle.

E. PROCEDURES

Tillamook County shall allow only drivers that meet the following eligibility criteria todrive on its behalf.

1. Job Applicants

When any position is being filled for which driving is an essential function, thedriving record for the previous three (3) years shall be evaluated according to thefollowing procedure:

1.1. The Tillamook County Personnel Department shall conduct a drivingrecord check through DMV prior to finalizing an employment offer. TheTillamook County Personnel Department may also request that a three (3)year driving history be provided with the application or provided at the timeof interview.

1.2. If the applicant being considered for hire is from outside the State ofOregon, the Tillamook County Personnel Department will require a copy ofthe applicant's driving record to be provided to comply with therequirements of the position.

1.3. The Tillamook County Personnel Department will complete the drivingrecord check and will inform the Department Head with the results. If thedriving record does not meet Tillamook County standards, therecommendation not to hire the applicant will be made.

1.4. If the Department Head requesting the hire wishes to contest thisrecommendation, an appeal may be made to the Tillamook County Boardof Commissioners. If required by the position the driving record shall beconsidered in determining whether an applicant is acceptable (seeAppendix A).

2. Tillamook County EmployeesNolunteers

Any Tillamook County employee/volunteer must meet the following criteria inorder to be allowed to drive on Tillamook County business:

2.1. Must possess a valid Oregon Driver's License or provide an alternatemeans of transportation that is approved by the Manager/Administrator.

2.2. Be at least eighteen (18) years old.

2.3. Possess a valid Commercial Driver's License (COL) if driving a vehiclerequiring such.

2.4. If involved in an at-fault accident on Tillamook County business, anemployeelvolunteer is required to complete a defensive driving coursewithin six (6) months of the accident.

2.5. If in possession of a Washington (or other State) Driver's License, sign arelease form allowing Tillamook County access to his/her motor vehiclereports.

2.6. If driving their personally-owned vehicle, prOVide proof of insurance at theinception of this Policy or when driving responsibilities that are covered bythis Policy begin and at any time there is a change to the Policy, to theirDepartment Head evidencing liability limits no less than the State requiredminimum ofTwenty-Five Thousand ($25,000) Dollars singieoccurrence/Fifty Thousand ($50,000) Dollars annual aggregate.

2.7. In addition to the above requirements, any Tillamook Countyemployee/volunteer holding a position that requires driving as part of thejob duties shall maintain an acceptable driving record, to be determined asfollows:

2.7.1. Upon assigning driving privileges or responsibilities to anemployee/volunteer, the Department Head shall provide pertinentinformation in writing (e.g. name, date of birth, driver's licensenumber) to the Tillamook County Personnel Department.. If adriving violation occurs that falls into the category noted inAppendix A, the Employee shall notify the Department Head and

the Human Resources Department. Violations falling into thecategories noted in Appendix A, as well as a pattern of violations,along with other factors, if relevant, will be used to determine if theemployeelvolunteer has an acceptable driving record.

3. Other Drivers

In addition to Tillamook County employee/volunteers, the following people maybe allowed to drive vehicles on Tillamook County business:

3.1. An officer or agent representing Tillamook County.

3.2. Another person designated by a Department Head to act on behalf ofTillamook County.

Drivers who are not Tillamook County employeelvolunteers must meet thefollowing criteria in order to be allowed to drive on Tillamook County business:

3.3. Possess a Driver's License valid in the State of Oregon.

3.4. Be at least eighteen (18) years old.

3.5. Possess a Commercial Driver's License (CDL) if driving a vehicle requiringsuch.

3.6. If driving their personally owned vehicle, provide proof of insurance to theDepartment Head within which they work evidencing liability limits no lessthan the State required minimum ofTwenty-Five Thousand ($25,000)Dollars single occurrence/Fifty Thousand ($50,000) Dollars annualaggregate.

3.7. Obtain permission from the Department Head within the area they areassigned.

3.8. Proliide a detail log of County Business performed, time of day Countyrelated travel occurred and miles driven.

4. Passengers

Oniy authorized passengers are allowed to ride in Tillamook County vehicles andother vehicles while in use for Tillamook County business. Authorizedpassengers are:

4.1. Tillamook County employeeslvolunteers doing Tillamook County business.

4.4. Vendors and contractors working on behalf of Tillamook County.

4.5. Participants in official Tillamook County business, training, tours andprograms.

4.6. Representatives of other governmental agencies working with TillamookCounty.

4.7. Anyone with prior authorization by the Department Manager or withspecific authorization by an Elected Official or other Department Head.

F. DRIVER RESPONSIBILITIES

The following responsibilities apply to anyone who drives any vehicle on TillamookCounty business:

1. Drivers and passengers are required to wear seatbelts at all times when thevehicle is in motion. It is recognized there are some officer safety issues where adeputy in a tactical situation will not be required to wear a seat belt.

2. Drivers shall have the vehicle's lights on when driving. It is recognized that it iscommon police practice to operate a vehicle without lights when approachingcertain emergency calls.

3. Drivers shall inspect vehicles at the beginning of each shift or prior to each trip toensure that the vehicles are in safe operating condition prior to their use. Thisshould include:

3.1. Check fuel level, tire inflation, lights and mirrors.

3.2. Check for broken, cracked or dirty windows and lights.

3.3. Check that a First Aid Kit is present.

4. Drivers shall comply with all applicable Sate and local driving laws, parkingregulations and all Tillamook County and departmental safety policies and rules.

5. Drivers will drive according to the road conditions during inclement weather.Drivers will know how to drive in such conditions and be prepared, in advance, ofbad weather/adverse weather and road conditions.

6. Drivers shall be held personally responsible for any tickets received while drivinga vehicle on Tillamook County business. All tickets for moving violations and/orparking fines received while driving Tillamook County vehicles shall be paid orotherwise resolved promptly by the driver. Drivers shall notify their Supervisorwithin forty-eight (48) hours of receiving any citation while in a Tillamook Countyvehicle.

7. For photo radar or other citations issued against the vehicle's registration, theemployee/volunteer's department will complete the "Affidavit of Non-Liability" orsimilar document issued with the citation to identify the driver. The driver shall bepersonally responsible and liable for promptly paying the fine or otherwiseresolving the citation.

8. In the event of an accident on Tillamook County business, drivers shallimmediately contact their Supervisor and, if driving a Tillamook County vehicle,follow all Tillamook County instructions/procedures for reporting accidents. (SeeCounty Drug & Alcohol Testing Policy)

9. A driver whose license has been suspended or revoked shall immediately notifyhis/her Supervisor and the Human Resources Department.

10. For employees who are required to drive or maintain a valid Driver's License aspart of their official duties, driving record convictions may be considered asgrounds for disciplinary action up to and including termination, if the offenses andinfractions occurred during or outside work hours affect the employees ability toperform their job. Collective bargaining agreement procedures would be followedwhere applicable. Volunteers with driVing record convictions on or off the jobmay be subject to reassignment or removal from volunteer placement.

11. Drivers shall ensure that any passengers who ride with them in a TillamookCounty vehicle or in any vehicle while on Tillamook County business areauthorized by their Supervisor. Drivers shall not transport passengers unless thepassengers are wearing safety belts or other restraint devices in accordance withOregon Revised Statutes.

12. In the event of a citizen emergency that requires the use of a Tillamook Countyvehicle, Department Heads can grant prior authorization under specificcircumstances they establish. If an employee/volunteer on Tillamook Countybusiness encounters a stranded motorist, please be aware ofthe following:

12.1. There is no obligation to stop and render assistance.

12.2. You should consider all objective circumstances regarding your ownpersonal safety before choosing to stop.

12.3. The only authorized action is to help connect the motorist with theappropriate roadside assistance.

14. Drivers shall not drive Tillamook County vehicles or private vehicles for TillamookCounty business when they are required to take medication that may impair theirability to safely operate a moving vehicle. If in doubt, the employee/volunteershould first obtain approval from his/her physician that it is safe to drive whiletaking the medication. If the employeelvolunteer comes to work but due to themedication cannot drive, the employee/volunteer shall immediately inform theirSupervisor and ask for an alternate work assignment. If there is no workavailable, the empioyeelvolunteer may be assigned to another department orsent home.

15. Employeeslvolunteers are expected to use good judgment at all times whiledriving on behaif of Tillamook County. In circumstances where theemployee/volunteer is uncertain if he/she should be operating or continue tooperate a vehicle (such as prescription or over-the counter medication, extendedor continuous shifts, end-of-day long distance travel, fatigue, poor weather orroad conditions), the employee/volunteer is expected to contact theirSupervisor/Manager to assist in making the safest determination of whether tocontinue to drive or not.

16. When accessories, parts or tools are stolen from a Tillamook County vehicle theloss should be reported immediately to the employee's Department Head.

17. Smoking is prohibited in Tillamook County vehicles.

18. Drivers will not pick up hitchhikers at any time when operating Tillamook Countyvehicles.

G. USING CELL PHONES WHILE DRIVING

Tillamook County encourages the safe use of cellular telephones byemployee/volunteers who use these tools to conduct business for Tillamook County. Itis understood that law enforcement is often called upon to operate radios or talk on acell phone while en-route to an emergency. However, when employee/volunteers areotherwise operating a vehicle, driving is the first responsibility. Employee/volunteerswho use cell phones while on Tillamook County business should refrain from making or .receiving business calls while driving. If an employee/volunteer needs to make orreceive a phone call while driving, the employee/volunteer should make sure the vehicleis stopped and that he/she is parked properly and off the roadway to make or receivethe call.

while driving, like adjusting the radio, eating or writing a note, makes if difficult toconcentrate on driving. Therefore, if the content of a call impairs concentration,postpone the call until you can stop.

Employeelvolunteers who use cell phones and must keep business conversations briefwhile driving. However, the vehicle should be stopped and parked in a safe and properparking area if the conversation becomes involved, notes are to be taken, the traffic isheavy or road conditions are poor.

Employeelvolunteers who are faced with an emergency, such as traffic accident or cartrouble may find it necessary to make a phone call while driving.

H. VEHICLE USE

1. Tillamook County-Owned/Supplied Vehicles

Tillamook County provides vehicles for use by qualified drivers to conduct officialTillamook County business in the course and scope of their job and/or tomaintain the ability to respond to Tillamook County business outside theemployeelvolunteer's normal work hours when special equipment or tools areavailable in or on the vehicle. Tillamook County vehicles shall not be used forpersonal business. Use of Tillamook County vehicles to commute to and fromwork, except as stated above, is prohibited, unless approved in advance by theDepartment Head/Elected OfficiaL Commuting miles are taxable under IRS codeand are not considered work time.

2. Privately Owned Motor Vehicles

Tillamook County allows use of privately owned motor vehicles to conduct officialTillamook County business when a County-owned vehicle is not otherwiseavailable; all employees must complete Appendix D in the Travel Policy prior tothe use of a privately owned vehicle. A privately owned motor vehicle used forTillamook County business must be a conventional, at least four (4) wheelvehicle and be in safe mechanical condition that is adequate to provide safetransport for the road and weather conditions. Vehicle equipment must conformto State of Oregon requirements. A motorpool vehicle shall be used when apersonally owned vehicle does not meet these standards. Vehicle registrationand insurance must be current.

Mileage reimbursement in accordance with the Travel Policy for the use of aprivately owned motor vehicle is considered full payment (including deductibles,depreciation, insurance, maintenance, fuel and operating costs) for its use.

The driver of a privately owned motor vehicle used to conduct official TillamookCounty business must be insured against liability (person and property) in anamount not less than the minimum requirements of the State of Oregon. Proof ofsuch insurance must be provided to the Department Head as indicated inAppendix D to the Travel Policy.

The vehicle owner is responsible for any comprehensive and collision coveragethe owner may elect to carry.

4. Out-of-State Rental Vehicles

Tillamook County provides excess liability coverage to supplement the coverageautomatically provided by rental car companies. However, the Oregon TortClaims Act does not apply outside of Oregon. For that reason, drivers shallpurchase the offered insurance through the rental company. Excess liabilitycoverage, collision coverage deductibles and other charges not covered by thecar rental company insurance will not be paid by Tillamook County if an accidentoccurs when the vehicle is used outside the scope of Tillamook County business(e.g. on an out-of-State trip where a rental vehicle is used for a non job-relatedside trip). Travelers are required to know the driVing laws for any State they drivein, apply the criteria of common sense, propriety and consider the relationship tobusiness purpose to the use of rental vehicles and transporting passengers whileon Tillamook County business.

5. Defensive DrivingAll vehicles will be operated in strict compliance with traffic laws and roadcourtesy. Drivers must exercise principles of skillful and defensive driving.

Driving safety is dependent on good driving attitudes. County drivers shouldfollow a driving pattern, which would tend toward the conservative.

Watch the overall picture. Keep a general watch over a wide deep traffic scenerather than focusing on anyone detail. Keep your eyes moving. Make a habit offorcing your eyes to move about ever two (2) seconds and more often in heavytraffic.

Aim high in steering. Looking over the entire lane is more beneficial than sightingalong either edge of the lane or curb.

Leave yourself an "out". Get in the habit of placing your vehicle in a position tohave an "out' should trouble develop. Don't box yourself in.

1. Safety Checks

No drivers can be safer than the vehicle being driven. Proper care of vehicles isessential to job performance.

1.1. All vehicles are required to have a spot check safety check prior tooperation of the vehicles as follows:

1.1.1. Check fuel level, tire inflation, lights and mirrors.

1.1.2. Check for broken, cracked or dirty windows and lights.

1.1.3. Check that a fully stocked First Aid Kit is present.

1.2. Report any unusual problems with the vehicle.

1.3. Vehicles will be washed once per month.

2. Routine Fuel and Emergency Purchase of Parts. Oil and Gas

2.1. Fuel must be obtained from the centralized fueling area wheneverpractical and possible.

2.1.1. A cardlock system will be used and the appropriate informationentered into the vehicle log book (where required) when a cardlockvendor is available. Use only regular unleaded fuel.

2.1.2. If a need for fueling occurs during a trip and the cardlock system isunavailable, locate a vendor and fuel the vehicle with regularunleaded fuel and record in the log book (where required).

2.2. The contract vendor will provide oil and other fluids (other than gasoline).Oil shall be added when necessary at the vendor's location.

2.2.1. If an oil shortage in the engine is indicated, maintain the properlevel by using a multi-viscosity 10-W-30 or 10-W-40 rating MS asspecified for the vehicle.

2.3. Parts may be needed due to breakdown or mechanical failure.

2.3.1. Call purchasing at (503) 842-3401 for a purchase order number.

2.3.2. Have the problem repaired and bring the invoice to the PurchasingDepartment.

2.4. Reimbursement for fuel, oil or parts must follow these guidelines orreimbursement will not be approved to individuals or to the department.

2.4.1. Vehicle license number must appear on the receipt.

2.4.2. Name and address of the vendor.

2.4.3. Description of purchase.

2.4.4. Date of purchase.

2.4.5. Signature of claimant.

2.4.6. All receipts must be turned in to the Department Supervisor forreview and initialing.

2.4.7. Department Head or Elected Official must turn receipts, astatement of mileage and expenses form and claim voucher intoAccounts Payable for reimbursement.

2.5. Preventative Maintenance

All vehicles will be scheduled for service and maintenance by the driverwhen the vehicle has been driven in excess of three thousand (3,000)miles or six (6) months since the last service and maintenance.

If any malfunction in vehicle's operation should occur, it must be reportedfor evaluation and repair to the Motorpool Administrator at (503) 842-1809.

2.6. Towing2.6.1. Warranty Vehicles

If the vehicle is under warranty call the factory roadside assistancenumber for the manufacturer for free roadside assistance for flattire, fuel or towing.

2.6.2. Non-Warranty Vehicles

If a vehicle requires towing, the driver will contact the nearesttowing company. The vehicle shall be towed to County vehicle contractorif the vehicle is within seventy-five (75) miles. Beyond that distance havethe vehicle towed to the closest dealership or certified shop.

1. If you have an accident:

1.1. Stop at once and as close as possible to the accident without blocking orendangering other traffic.

1.2. Call Police or State Patrol.

1.3. Provide your name, address and the license number of the vehicle to theother driver, passengers or any injured party.

1.4. Obtain names, addresses and the license number of all others involved inthe accident.

1.5. Show your Driver's License and give number, if asked.

1.6. At the employee/volunteer's discretion, an employee/volunteer may renderreasonable aid to injured persons taking into account the following:

1.6.1. Injured persons should NEVER be moved.

1.7. Report the accident to the State DMV if there is more than FifteenHundred ($1,500) Dollars damage to anyone's property or if any person isinjured or killed.

1.7.1. This report must be filed within seventy-two (72) hours.

1.7.2. Accident Report forms are obtained at the Police Department,Sheriff Department of a local DMV field office.

1.7.3. Accidents on private property or when the car is legally parkedneed not be reported to the State.

1.8. Any accident must be reported to the employee/volunteer's Supervisorimmediately.

1.9. The Supervisor shall report any accidents to Tillamook County Counsei,our insurance carrier and to the Tillamook County Personnel Departmentif the accident involves injury to any person.

1.10. A Tillamook County employee/volunteer involved in an accident shall notdiscuss the conditions of the accident with the other invoived party orparty's representative.

1.11. In no case, upon the occurrence of an accident, shall a Tillamook Countyemployee/volunteer tell the other party that Tillamook County will initiateaction towards making repairs to the vehicle or property of the other party.

1.12. A Tillamook County employee shall not make a private settlement with theother party regardless of how minor the damages to the other party's caror property may appear to be.

1.13. The employee/volunteer may be asked to take a drug and alcohol screentest in accordance with the Drug & Alcohol testing policy.

K. PARKING

1. Parking Areas

Vehicles shall only be parked in designated parking spaces at and around theTillamook County facility. No Tillamook County vehicle should be parked indesignated employee parking spaces.

2. Parking Vehicles

When parking vehicles, check to make sure lights, fans, radios and otherelectrical functions on the vehicle are off. Lock the vehicle. Remove personalitems, including business articles, lap top computers, briefcases, books, etc.Items in assigned department vehicles are to be secured and locked if remainingin the vehicle. In all cases, do not leave lap top computers, GPS units or othervaluable equipment in the vehicle.

A Tillamook County employeelvolunteer, who is found to have violated this Policy orwhere any indications of misconduct, misuse or abuse involving a motor vehicle arefound, may be grounds for disciplinary action up to and including termination.Should disciplinary action become necessary, it shall follow the Tillamook CountyPolicy and Procedures Manual and Union contracts, as applicable.

1. Misuse of Tillamook County Vehicle

The following includes the misuse of a Tillamook County vehicle:

1.1. Use of a Tillamook County vehicle for anything other than officialTillamook County business.

1.2. A Tillamook County vehicle driven to or from an employeelvolunteer'shome or vicinity thereof, after completion of a work day unless:

1.2.1. The employeelvolunteer's home is reasonably en-route to or fromthe work area where the work is to commence the next day.

1.2.2. The vehicle is to be used by the employee/volunteer before usualworking hours or unplanned overtime is incurred which would makeit impossible to obtain transportation.

1.2.3. The employeelvolunteer is required to respond to urgent oremergency call outside of their regular work hours, reasonablyrequiring the use of a Tillamook County vehicle.

1.2.4. Carrying in a Tillamook County vehicle any persons other thanthose directly involved with official Tillamook County businessunless the Department Head's approval is obtained prior to eachtrip. .

1.3. Abuse of a Tillamook County Vehicle

The following includes the abuse of a Tillamook County vehicle:

1.3.1. Reckless or abusive driving or other practices that would contributeto immediate or long-term damage to a vehicle and create a hazard

to others.

1.3.2. Except for Sheriff's Department Emergency Response vehicles,attempting to "jump-start" or tow another vehicle.

1.3.3. Not reporting damage of a vehicle to the Department Head orElected Official.

1.3.4. Not keeping vehicle responsibly clean, inside and outside, including

windows.

Requirements of an Acceptable Driving Record

These requirements become effective on the date of adoption of this Policy.

1. No Class A infraction convictions during the past thirty-six (36) months and nomore than one (1) Class A infraction conviction between the past thirty-six (36)and sixty (60) months.

2. No more than one (1) Class B infraction conviction during the past twelve (12)months and no more than two (2) Class B infraction convictions during the past

thirty-six (36) months.3. No more than two (2) Class C infraction convictions during the past twelve (12)

months and no more than three (3) Class C infraction convictions during the past

thirty-six (36) months.4. Demonstrated ability to maintain a driver's license without suspensions for the

past thirty-six (36) months.5. No felony or misdemeanor driving convictions within the past thirty-six (36)

months.
