SUBMISSION IN SUPPORT OF CLAIMS FOR PRIVILEGE BY THE NSW TREASURY - DOCUMENTS RELATING TO THE NSW LEGISLATIVE COUNCIL
RESOLUTION OF 20 JUNE 2019
The documents catalogued in the privileged index have been produced in response to the notice of motion dated 20 June 2019 relating to the Legislative Council's Order for Papers -Document Entitled "Election Commitments - the NSW Budget 2019-2020". Treasury will refer to that document as the "Election Commitments Budget Paper". It is submitted that information recorded in the documents listed in the index, provided in response to the resolution, should not be made public where Treasury has made a claim of privilege over that information.
Treasury has limited its privilege claims over information in the documents listed in the index to partial claims; that is, the claims are made over only some of the information in the relevant documents ("the redacted information"). The claims are described below.
Public Interest Immunity Privilege
A claim of public interest immunity is made in relation to the redacted information described below. In addition to the disclosure of this information possibly affecting the interests of third parties, the State also has a clear interest in whether information of this kind contained in State papers should be publicly disclosed.
Disclosure which harm Commonwealth/State relations
Documents 18A, 32A, 35, 37 A, 56A, 85A, 89A and 90A contain information the disclosure of which may harm the State's ability to negotiate a co-contribution from the Commonwealth Government for certain infrastructure on terms most favourable to the State.
Document 35 is an email chain commencing with an email from Ms Riley Kelly to Ms Lorna Farrar and others sent on 13 June 2019 at 10.45pm ("the Kelly Email"). Broadly, the Kelly Email contains commentary regarding statements proposed to be included in the Election Commitments Budget Paper. There is a real risk that disclosure of the redacted information forming part of the Kelly Email to the public could reveal, in the context of other information in the Kelly Email, information that may reasonably be expected to prejudice future negotiations between NSW and the Commonwealth.
Each of Documents 18A, 32A, 37 A, 56A, 85A, 89A and 90A is a draft (or part of a draft) of the Election Commitments Budget Paper (together, "the ECBP Drafts"). Each ECBP Draft was originally created by Treasury and incorporates subsequent input from Treasury and other government departments. The redacted information forming part of ECBP Drafts could, if disclosed, reasonably be expected to prejudice future negotiations between NSW and the Commonwealth.
Such disclosure could therefore prejudice the proper functioning of the executive arm of government and the public service.1
Given the nature of the claim, more details in relation to the redacted information cannot be set out in these submissions but Treasury would be happy to provide supplementary submissions on a confidential and privileged basis.

Disclosure of personal information
Document 39 is an email chain commencing with an email from Mr Sam Walker to Mr David Withey sent on 6 June 2019 at 1.59pm, and includes an email from Mr Withey to Mr Walker sent at 1.38pm that same day ("the 1.38pm Email").
A claim of public interest immunity is made .over redacted information in the 1.38pm Email that identifies a staff name. Such disclosure would reveal personal information relating to the health of that staff member.
It is accepted that, in general, there is no entitlement for the names of public servants or government sector employees to remain private, in circumstances where Parliament is scrutinising decisions made by those officials. In the present instance, however, there is no reason to think that the House has any interest in publishing the name of a staff member, where such publication would reveal to the public that staff member's personal health circumstances as referred to, as an incidental matter only, in the 1.38pm Email.
The current legal arbiter, the Hon. Mr Keith Mason AC QC, has noted that (whilst "privilege" is a difficult concept to grasp in the context of Standing Order 52), the House has undoubted power to take additional measures to prevent disclosure of confidential information where that is not in the public interest. 2
The arbiter has also, on several occasions, endorsed the agreement of members, who had initially asserted a claim of privilege, that certain personal "private" information be redacted, avoiding the need for the arbiter to resolve such disputes.3 The arbiter has noted , amongst other matters, that members will always have access to un-redacted versions of the documents and the capacity to access such information if it is really needed.4
Treasury produces these documents to the Legislative Council under compulsion of law and is not waiving privilege in respect of any of the privileged documents by producing them.
