Deputy Byrne was a vocal critic of Greyhound’s actions earlier this year, when the company took over bin collection services from Dublin City Council. “Earlier this year, Greyhound resorted to astonishing bullying tactics, when it adopted a restrictive and punitive payment regime for its new bin collection customers. Now, with no prior notice, the company has announced it is going to start charging for recycling household waste, which was free up to this point. “Customers have been delivered a letter stating that they will have to buy Greyhound recycling bags at a cost of €9 for six bags. Placing a levy of €9 on something that had been free of charge up to now seems extraordinary. How can Greyhound justify this charge? “The company seems to have learned nothing from its last customer service disaster. It already hiked up prices on its standard bin tags earlier this year, after failing to deliver new recycling bags to customers for weeks, it has unilaterally decided to place this very high levy on the bags. South Dublin CountyCouncillor Trevor Gilliganhas said it is now clear thatMinister Reilly’s handling ofthe Primary Care debaclehas directly disadvantagedcommunities in Clondalkin.

It’s emerged that theproposed Rowlagh PrimaryCare Centre was droppedfrom a priority list for Stateinvestment and earmarked

for private investment withState support.

Cllr. Gilligan commented:“Government TD's in DublinMid-West should be livid atMinister Reilly’s strokepolitics, removing theRowlagh Primary HealthCare Centre from theCapital programme. localTD's are making promisesnow that they cannot keep

- we could be waitinganother 10 years for a PPP.Dropping Rowlagh down thepriority list in the hope ofsecuring private investmentis not the way to go.“There has been lots of talkabout the Rowlagh PrimaryHealth Care Centre buthave seen no action fromgovernment. The people ofNorth Clondalkin areoutraged at what has

happened and I amextremely disappointed atthe lack of action taken byour local TD's here in DublinMid West They must nowreconsider their support forMinister Reilly.

“Fianna Fáil has noconfidence in James Reillyas Minister for Health. Wepreviously put forward a

motion of no confidence inthe Minister only to see TDsfrom Dublin-West troopthrough the Dáil lobbies toback the Minister. JamesReilly is not the right personto deliver real, transparent,positive reform in ourhealth service. His handlingof the primary care issue isjust one example of thedysfunction he has brought

to the Department ofHealth.

aSH Ireland is very disappointed that the Ministerfor Finance and the government has failed to puta significant increase on the price of tobaccoproducts in the 2013 Budget. an increase of 10cents as announced on the pack of 20 cigaretteswill have no impact whatever on smokingprevalence. This is a missed opportunity as therewas a general acceptance among the generalpublic that there would be a significant increaseon the price of tobacco. Dr Ross Morgan went on to say “the governmenthave once again missed the opportunity tosignificantly increase the price of tobacco, whichis well recognised as the principal means ofencouraging smokers to quit and discouragingyoung people from experimenting with tobacco.Tobacco use is responsible for over 5,000 deaths inthis country every year from a range ofcardiovascular, cancerous and other diseases. Theannual cost of treating tobacco related disease isclose to €1.5 billion annually. The government

must introduce every possible measure whichreduces the number of Irish people who continueto smoke and take up the habit – and price is byfar the most effective measure in this regard. Thegovernment clearly has some concerns about priceincrease and levels of smuggling, which areunjustified. The British government and othershave increased the price of tobacco while alsoreducing the levels of smuggling. Smuggling is acriminal matter and must be treated as such.Smoking levels are a serious health issue and mustbe treated separately from any other issues whichemerge, such as smuggling.”

serviceas financial stresses on families increase, it isvitally important that they celebrate Christmasin ways that do not add to their financialburden, according to the director of a voluntarycounselling service in Tallaght.

"The number of new clients has increased by1,000 this year and financial stresses are drivingthat increase," said Marcella Finnerty, directorof the Village Counselling Service and a recipientthis year of a Tallaght Person of the Year awardin the Disabilities and Carers category.

"Now is the time for families to make differentchoices about Christmas spending," she said. "Ifnecessary we need to lower our expectationsand those of our children about presents,clothes, and so on. a Christmas in which familiescelebrate their own togetherness in a cheerfulatmosphere is worth much more than aChristmas based on material goods which will besoon forgotten but which place a huge strain onfamily finances."

The affordable counselling service which isbased in Killinarden, Tallaght, receives somesupport from the HSE and the Family Supportagency but all its counsellors provide theirservices free of charge. On average clients pay€7 per hour, compared to €50-€60 for privatecounselling.

Fine Gael CouncillorBrian lawlor said thatthe domestic violencefigures released by SafeIreland reveal withshocking clarity what ishappening to womenand children in homesacross the country. Thefigures show that thenumber of womenreceiving support fromdomestic violencecharities has more thandoubled in the last fiveyears. “There has been adramatic increase in

the numbers of womenand children seekinghelp over the last fiveyears. One can onlypresume that thepressure on familiesdue to the economiccrisis is having asignificant impact,” hestated.“The high level ofphone calls received bysupport services, withmany repeat callers,underlines the need foron-going support. It is acredit to the agenciesinvolved that the

number of womenreceiving face-to-facesupports has increasedby 68% since 2007. “Breaking the silence iskey to tacklingdomestic violence. Weneed to consider howwe address thisproblem as a society. Itcannot be simplyattributed to a negativeknock-on effect of ourchallenging economicsituation; when thecountry was awash withmoney, women andchildren were still being

abused in their ownhomes,” he continued.“The Government’snew Child and FamilySupport agency, whichwill be up and runningin the New Year, willallow for interventionat an early stage todeal with issues likedomestic violence. Newmodels of delivery willalso ensure fullintegration betweenState services andvoluntary resources. “Introducing a moretransparent family

court system will alsohelp to lift the lid ondomestic violence. Weneed to know what ishappening in families incrisis if we are to bringabout a change in howwe tackle this problem.Victims of domesticviolence must be giventhe courage to comeforward, and theknowledge that theywill be responded towith support andcompassion,”Councillor lawlorconcluded.

Older & Bolder is alarmed atthe changes in medical cardeligibility criteriaannounced as part of Budget2013.Older & Bolder Director,Patricia Conboy said, “Thesechanges will not yieldsavings from the wealthiestin our society, rather it ismiddle Ireland, older peopleon incomes just above thenew threshold, particularlythose living alone, that willbe hit hardest by the loss of

the medical card. unlike themedical card, the GP cardsdoes not offer the sameaccess to a range vitalsupports including publichealth nursing, social workservices, community careservices and certainin-patient public hospitalservices. In addition, anyprescribed drugs associatedwith your GP visit are notfree. The security that themedical card provides,especially for older people

no country to be old and sickwith ill health, cannot beunderestimated. We hearfrom people who wouldforgo their modestoccupational pensions inorder to retain their medicalcards”.

Patricia Conboy continued,“The cost of being sick andolder in Ireland has nowincreased. For those withmedical cards, prescriptioncharges have increased by300%. For those without amedical card and with highmedical costs, changes tothe Drugs Payment Schememean the threshold forsupport in purchasingprescription drugs hasincreased from €132 amonth to €144”.

Patrica Conboy describedthe property tax as “anunforgiving tax for olderpeople. The proposal topursue property tax afterdeath because peoplecannot afford to pay it inlife does not strike us asbeing fair. Older peoplehave, over decades andduring periods of very highinterest rates, striven to payoff their mortgages. areasonable and widely

shared goal is to arrive intoolder age debt free in orderto maximise independencepost-retirement and to passon something, other thandebt, to a futuregeneration. This proposalrisks turning a hard wonasset, house ownership, intoa liability”.

Older & Bolder welcomesthe retention of the StatePension at current levelsthough the reductions totelephone and electricityallowance will causeconcern. While on the faceof it the announcement thatthe fuel allowance has notbeen reduced further thisyear seems positive, theincreases in carbon tax oncoal and turf will, in allprobability, increase thecost of heating for olderpeople.

Ms Conboy concluded, “withthis Budget the devil isreally in the detail, not allof which is available to us atthe moment. Over thecoming days Older & Bolderwill continue to analyse theproposals to gauge the exactimplications for olderpeople."

Six years ago, Tallaght Newspresented an article onwhat appeared to be anewly emerging yetfashionable addition to thehealth & beauty industry. Byall accounts, laser teethwhitening was making firminroads into the Irish marketplace and even at hefty€1200 price tags, the fadwas managing to attractbeauty conscious consumersthat did not mind partingwith a buck or two.

Despite an obvious growingpublic interest, few mighthave predicted theexplosive nature of thegrowth that was about toengulf the aesthetic dentalindustry. It is currentlyestimated that in any givenweek in Ireland, between800 and 1200 peopleundergo a laser toothwhitening treatment. Thisapparent pre-occupationwith the appearance of ourteeth is to make no mentionof the huge demand fordo-it-yourself whiteningtrays, whiteningtoothpastes or whiteningstrips.

Despite its popularity as a

beauty procedure, few Irishconsumers are aware ofrecent Eu regulations thatlegislate over the teethwhitening industry. On 31October 2012, new lawsdetermine who canadminister teeth whiteningand the types of chemicalsthat are permissible. In abid to help consumersunderstand this legislation,Tallaght News approachedWhite Smile Clinic, Ireland’soldest and largestestablished teeth whiteningspecialist. They have nowconducted over 35 000 laserteeth whitening treatmentsin the country and so weasked their dental teamhow the new laws affect theconsumer.

In principle, White SmileClinic advised us that theadministration orapplication of teethwhitening using HydrogenPeroxide based gels nowexclusively resides withinthe domain of dentistry.Only a qualified andregistered dentist, or adental professional undertheir supervision, is able toadminister peroxide basedgels in concentrations of up

Others willrightly point out that onlymedically trainedpractitioners can manageacceptable standards ofclinical governance andinfection control. Despitethis observation, it shouldbe pointed out that in manyother countries it is legal fornon-dentists to performwhitening. In New Zealandfor example, a country withtraditionally strict standardsof dental governance, theprominent Dental Councilapproached the courts for aban on all cosmetic teethwhitening. The Council wasthwarted as cosmeticpractitioners bandedtogether and had themotion dismissed by thecourts. The new Eu lawshave therefore been metwith significant reprisal

within the cosmeticcommunity in Ireland andthe uK. Many salons havelost a source of income orcontinue to practice withthe imminent threat of legalaction from the State.

Whatever the motivationmight have been to enactrecent Eu legislation, itappears that it is stillpermissible for cosmeticpractitioners to useperoxide free whiteninggels. However, in light ofthe new legislation WhiteSmile Clinic advisesconsumers to exercisecaution when selecting awhitening centre. Results ina cosmetic salon willprobably not meetexpectations unless a salonis practicing illegally. In theunlikely chance of anadverse medical reaction, itis also doubtful that acosmetic practitioner willhold adequate insurancecoverage, as the largercompanies now balk frominsuring the practice bynon-dentists.

In terms of technologyadvancements in laser teethwhitening, 6% strength

peroxides have now beentailored to yield exceptionalresults. Theconsultation was launched byMinister for Finance, MichaelNoonan, and is seekingsuggestions from members of thepublic on what more the CROcan do to ensure SMEs aregetting the support on banklending they require. “This Government is committed

to doing all it can to strengthenbusinesses in order to createmore jobs in our economy. Oneof the ways in which we aredelivering this, is through theaction Plan for Jobs 2012. Theaction Plan contains acommitment to assess the CROto ensure that SME’s are gettingthe support on bank lending theyrequire,” explained Fitzgerald.

a. The best solution to this concern is toprepare both a Will and an Enduring Powerof attorney (E.P.a.). These EnduringPowers of attorney are not just for theelderly, or those on the cusp of lackingmental capacity but, for each and everyresponsible adult. Making a Will governsthe disposal of your assets on your deathand is vitally important. However, howmuch more important is it to put in placea mechanism to govern the administrationof your assets and indeed to authorise aperson to make decisions as to yourwelfare, while you are still alive, butincapable of making those decisionsyourself. This is where the Enduring Powerof attorney (E.P.a.) becomes so important.

an E.P.a. is an Instrument or documentwhich complies with the strict proceduralrequirement of the legislation (EnduringPowers of attorney act 1996). It is aspecial type of a Power of attorney, theconsequences of which are significantlydifferent to an ordinary Power of attorney.This type of Power of attorney is notrevoked by the Donor (the person signingthe Power) subsequently becomingincapacitated by virtue of dementia ormental incapacity of any other sort. It canonly operate if at some point in thefuture, the Donor, being the person whocreates the document, becomes mentallyincapable of managing his or her affairs.as long as the Donor is well, the E.P.a.cannot be acted upon by the attorney.

any adult who has the required level ofability to execute an E.P.a. can plan for apossible future loss of mental capacity. Inother words, it allows for the appointmentof an individual, an attorney, to makedecisions for the Donor in the sad event offuture loss of capacity. The major benefitof an E.P.a. is that it is the Donor, him orher self, who decides, when capable, whois given such a tremendous power over hisor her life, should he or she becomeincapable in the future.

The choice of the attorney is a personalmatter for the Donor. Obviously, it isimportant that the person who is chosenis trustworthy. Remember that theattorney’s actions will be subject to littleor no supervision. You should also makesure that the person chosen to be theattorney is not in conflict by virtue ofbeing a substantial beneficiary in yourEstate.

You can appoint more than one person asyour attorney. You can choose for the twoor more attorneys to act jointly orseverely i.e. whether they must acttogether when making decisions or can do

The act does require a Statement by aSolicitor and a Medical Practitioner,that the Donor, with the assistance ofany explanations given to him or her bythe Doctor, does have the mentalcapacity to understand the full effectof creating the Power. Many peopleonly consider an E.P.a. when they arelosing capacity, but in fact, the time toconsider such a Power of attorney iswhen you are well, not when youmight be running out of time to havethe mental capacity to execute thePower. Remember that it takes acertain amount of time to giveinstructions to your Solicitor to havethe documents drafted, arrange foryour Doctor to be present on the dayof the signing and notify witnesses. assuch, the time to consider such aPower is not when it is urgentlyneeded, but when it is simply goodforward planning for the future.

It is also important to remember thatit is possible to revoke an E.P.a. at anytime before it is registered. an formaldocument of Revocation needs to besigned, specifically confirming that theE.P.a. is being revoked and the originalor a copy of the E.P.a. should beexhibited in the Revocation.Remember that the E.P.a. is signedwhen the Donor is well, but it onlybecomes registered when the Donorbecomes of unsound mind. Therecould be a gap of many years betweensigning an E.P.a. and registering the

E.P.a. Therefore, although it is a veryimportant and formal document,nonetheless, it can be revoked before theDonor becomes of unsound mind.

Once the time is appropriate to registerthe E.P.a., a formal notification of anapplication to register the E.P.a. must beserved on the Donor and also on thepersons who were notified of theexecution of the E.P.a. and are named onit. any person served with this Notice canobject to the registration by sending thegrounds of objection to the Wards of Courtoffice within five weeks of receipt of theNotice. assuming that there are noobjections, then a Medical Certificatemust be obtained from a registeredMedical Practitioner to the affect that theDonor is, or where appropriate isbecoming, incapable by reason of a mentalcondition of managing and administeringhis of her own property and affairs.Various documents are then completed bythe attorney and prepared by the Solicitor,and are forwarded to the Wards of Courtoffice. Once the E.P.a. has beenregistered, the applying party will receivea document called a ‘Certificate ofRegistration’. at this point, the attorneyis now is full control of the Donor’sfinancial and personal well being, subjectto any restrictions originally inserted intothe E.P.a., as instructed by the Donor. Themost important thing is to satisfy yourselfthat the chosen attorney is trustworthyand the right person to make theseimportant decisions for the Donor.

The recent Open TrainingCollege graduationceremony was a celebrationon many levels. Not only dothe graduates now possessan accredited and hardearned Ba in applied SocialStudies for the disability

sector, they also possessvital best practice skills toempower the service usersin their care. It’s all aboutsupporting some of the mostvulnerable in our society.This year’s 128 adult learnergraduates are special

indeed. Not only have mostof them managed theresponsibilities of afull-time job during theirstudies with the OpenTraining College, most haveraised a family too. Quite afull plate for any Third

level learner. Many of thegraduates would speakabout challenging nightswhere the needs of theCollege were finelybalanced with the needs oftheir family. Meetingassignment deadlines is anart for these graduates whoacknowledge the support offamily as being crucial totheir success.But the commitmentdoesn’t stop there. Nowthey are qualified to a levelthat embodies best practicefor the disability sector,which means that disabilityagencies and service usersare now in the best handspossible. Even with thesavage cuts to services andtraining budgets, thesegraduates recognise thevalue of their degree andmost have made financialsacrifices in order to fund itthemselves.Conor Murray of the OpenTraining College commented‘In the past, the majority ofour students were fundedthrough their employers’training budgets. However,due to the massive cuts tothe sector in recent years,agencies are no longer ableto afford the college feesand employees are steppingup to pay the feesthemselves. Despite the ongoingeconomic climate, Irishcouples are not forgoingtheir honeymoon accordingto new research by travelexpert Hotels.com. Theresearch shows anoverwhelming 99% ofnewlyweds-to-be areplanning to get away, withalmost one in four (24%)spending between €5,000and €10,000 on their dreamholiday. The vast majority ofcouples (70%) say theyprefer to go on honeymoonimmediately after the big

day, with just 22% opting todelay their trip so that theycan save some money.

Over 100 engaged orrecently marriedrespondents completed thesurvey which was conductedby Hotels.com throughConfetti.ie, the online homeof Confetti Magazine. Theresults show that almosthalf (42%) ofnewlyweds-to-be like tobook their weddings overone year in advance, with afurther 15% booking

between one and six monthsahead of the big day. Itseems to be a woman’sprerogative when choosingthe wedding location, with60% of those surveyedchoosing to get married inthe bride’s home countywhile one in ten of thosesurveyed have opted to tiethe knot abroad.Thailand is the most popularlocation for honeymoonerswith almost one in five(19%) selecting this as theirdestination of choice. Closerto home, Italy is second

with 11% while 9% say theywill honeymoon in australia.7% of people surveyed claimthey are planning tohoneymoon at home. 64% ofhoneymooners say they willtry and get a room upgradeupon arrival at their hotel.

an Eu proposal to guaranteeyoung people a job offer,apprenticeship or trainingwithin four months ofbecoming unemployedwould not be a “magicbullet” but could avoidcreating a “lost generation,”Irish MEPs said this week.

The European YouthGuarantee, part of an EuYouth unemploymentPackage unveiled in Brusselsthis week, has already wonstrong support from SocialProtection Minister JoanBurton. Speaking at aconference in Dublin aimedat examining how thescheme could beimplemented in Ireland,Minister Burton vowed toprioritise getting Europeanbacking for the youthguarantee during Ireland’ssix-month Eu presidencystarting in January.

Dublin MEP Emer Costello,who also spoke at theconference, pointed out thatIreland’s unemployment rate

among under 25-year-oldshas shot up to about 30 percent from 9 per cent in 2008.

“The Youth Guaranteeapproach would bringtogether public employmentservices, education andtraining institutes and otherstakeholders to identify theneeds of each unemployedperson aged between 18 and24, designing an individualcareer plan. It’s not a magicbullet, but it could helpreduce our historically highyouth unemploymentlevels,” she said.Fianna Fáil MEP liamaylward cited figures provingthat investing in youngpeople’s education andprofessional experience isfar less than the economiccost of paying theirunemployment benefit.“The cost of not acting is€153 billion per year for theEu. In Ireland, this amountsto around 2 per cent of GDP.But it’s estimated that itwould cost only 0.2 per centof GDP to introduce youthguarantee schemes in allmember states. If we wantto avoid creating a lost

generation, we have to actnow,” said Mr aylward.Youth guarantee models arealready in place in Finland,Sweden and austria, whichcurrently has a youthunemployment rate of just8.5 per cent.

Irish MEP Sean Kelly has saidthe Northern peace process“could not have beensuccessful” without thebroader context of Europeanintegration. Speaking at aconference in Brussels onhow the North is aninternational model forpeace and reconciliation,the Fine Gael MEP paidtribute to ongoing financialEu aid for peace work.

However he also praised theEu as an institution that has“contributed more to peaceand prosperity” than anyother body in the history ofhumankind.“It has brought together acontinent that had been atwar with itself for most of itshistory. When the most

ancient of enmities aresettled through increasedeconomic integration, itcreates a pressure to bringabout peace even in themost ingrained of conflicts,”he added.Mr Kelly pointed out thatwhen the IRa ceasefire wasdeclared in 1994, the thenEuropean CommissionPresident Jacques Delorsimmediately intervened toensure a sizeablecontribution from the Eubudget to the InternationalFund for Ireland. Meanwhile,MEPs from north and southof the border held a historicmeeting in Strasbourg inSeptember 1994.
