Introduction

The following statement sets out how each new policy of the Detailed Sites and Policies

Development Plan Document (DSPDPD) is consistent with Newham’s Local Plan Core Strategy

(2012), the London Plan (2015) and the National Planning Policy Framework (NPPF, 2012).

SP8 - ENSURING NEIGHBOURLY DEVELOPMENT

What does central government say? (NPPF plus ministerial statements)

Core Principle: Create safe and accessible environments, where crime and fear of do not undermine quality of life or community cohesion. Para 7: The purpose of planning is to achieve Sustainable Development. Para 17: Core Principles seek to secure High Quality Design and good standard of amenity; conserve natural environment and reduce pollutions; and improve health and social wellbeing. Para 29: Promote Sustainable transport including road safety. Para 44: Telecoms will not cause significant and irremediable interference with other electrical equipment, air traffic services. Para 50: Local Plans should set out quality of development and seek to deliver high quality homes Para 58: Planning policies should aim to establish a strong sense of place, creating attractive, safe and comfortable places to live. Para 67: Poorly placed adverts can have a negative impact on appearance on built and natural environment (amenity/cumulative impact). Para 69: Promoting healthy communities can play an important role in facilitating social interaction and creating healthy communities. What does the London Plan say?

3.2: Integrate housing, transport, planning and environmental policies to promote health and wellbeing of communities by working with key partners to address significant health issues and ensuring the health inequalities impact of development is taken into account. 3.5: New housing development should enhance the quality of places, taking into account its context, density, tenure and land use mix. Establishes minimum space standards. 5.3: Provide high standards of sustainable design which aims to reduce carbon dioxide emissions, avoid internal overheating, minimise pollution and promote and protect biodiversity and green infrastructure 6.1: Promote public transport and other sustainable means of transport and a high quality public realm. 7.1: People should have a good quality environment enabling people to live healthy, active lives and boroughs should ensure the nature of existing and planned infrastructure and services are complementary and meet the needs of existing and new communities. 7.14: Boroughs should recognise the importance of tackling air pollution and improving air quality to improve health and wellbeing preparing policies that seek reductions in pollutants taking account of their Air Quality Action Plan. 7.15: Reduce and manage noise to improve health and quality of life through the management of noise sensitive uses. 7.3: Create safe, secure and appropriately accessible environments where crime and fear of crime does not undermine the quality of life. 7.4: Build on the positive characteristics of their area ensuring they are sustained, protected and enhanced through managed change. 7.5: Enhance public realm, ensuring access for all with provision for sustainable management. SP1: Enhance positive elements and create successful and distinctive places SP2: Create healthier neighbourhoods, reduce exposure to pollutant; attend to environmental impacts of development (noise etc.) including improved open spaces SP3: Securing high quality design to contribute towards safe, sociable, and inclusive mixed and balanced communities. SP4: Consideration of microclimates (tall buildings) through design and relationship with other buildings. SP7: Principles of good urban design positively contribute to street scene and way finding H1: New homes should provide high levels of design quality meeting internal space standards as minimum to support quality neighbourhoods. SC1: Major developments should meet sustainable design and construction standards for residential and non-residential standards, incorporate sustainable urban drainage systems , facilitate sustainable waste management and increased greening of the Borough. SC3: Encourages the reduction of flood risk and the utilisation of opportunities to improve flood risk resilience and resistance. INF2: Promotes sustainable transport ensuring road safety and high quality measures to encourage and facilitate cycling, as well as managing capacity and parking for motor vehicles in order to reduce or minimise congestion. INF3: Seeks to manage Newham’s waste by promoting development that supports movement up the waste hierarchy and identifying suitable locations for appropriate storage facilities. INF6: Seeks improvements to open space facilities and to improve the quality, connectivity and accessibility of existing open spaces. INF9: To ensure infrastructure delivery is provided including new and improved open space.

Are links clear?

Yes. This policy seeks to improve the ‘social’ (health/wellbeing/ safety/ vibrant communities) and the ‘environmental’ roles (enhancing built and natural environment) to improve the possibility of achieving neighbourly development across all developments within the Borough in line with NPPF goals and London Plan objectives. Studies at national, regional and local level identified the issues to be addressed by this policy. It is intended that by using summary tables related to each of the sections of the policy, the links to current guidelines, standards and policies are clear and understandable to be used as a Development Management Tool.

Does it contribute to sustainable development?

Neighbourly development supports the NPPF overall strategy to achieve sustainable development in that it seeks to improve the quality of people’s lives, by incorporating wider issues such as crime and perception of crime, and health and well-being to make small step changes improving the environment in which people live, work and stay. The policy brings together a number of environmental and social issues, standards and guidance which seek to improve how people feel about the environment in which they live.

SP9 - RECOGNISING CUMULATIVE IMPACT and SP10 – MANAGING CUMULATIVE IMPACT What does central government say? (NPPF, Localism Act plus ministerial statements) Para 7: Highlights planning’s economic, social and environmental role as part of sustainable development including the importance of supporting health and social wellbeing and contributing to the protection and enhancement of the natural, built and historic environment. Para 17: Core policies require plans/decisions to contribute to, conserve and enhance the natural environment and reducing pollution and authorities to take account of local strategies to improve health. Para 120: Plan making should address the effects (including cumulative effects) of pollution on health, the natural environment or general amenity, and the potential sensitivity of the area or proposed development to adverse effects from pollution, should be taken into account. Para 70: Planning system to create healthy communities by promoting safe and accessible environments, access to high quality open space and to local shops. Policies should promote centre vitality and viability and ensure shops are able to develop sustainably. Para 124: Policies should sustain compliance with and contribute towards EU limit values or national objectives for pollutants, taking into account the presence of Air Quality Management Areas and the cumulative impacts on air quality from individual sites in local areas. Para 23: Planning policies should positively promote competitive town centres that provide customer choice and a diverse retail offer.

What does the London Plan say?

3.2: Local Plan policies should promote the health and well-being of communities 4.8: Boroughs should manage cluster of uses having regard to their impact on vitality and viability of the centre and the diversity of the retail sector, sense of place and local identity, community safety or security and their role in promoting health and well-being. 5.14-5.15: Need to promote and protect the water environment by implementing the Thames River Basin Management Plan requirements. 7.14: Specifically relates to improving air quality, with a focus upon strategy, planning decisions and Local Plan preparation. 6.1: Promotion of public transport and other sustainable means of transport 7.18: Boroughs should include appropriate designations and policies for the protection open space to address deficiencies and identify areas of open space deficiency. 7.19: Boroughs should identify areas deficient in accessible wildlife sites and seek opportunities to address them.

What does the Core Strategy say?

S1-S6/ SP1-SP6: Promotes transformational change requiring a step change in the borough’s image and characteristics achieving principles of the Convergence Agenda and making it more likely people will choose to live work and stay in the area SP2: Defines cumulative impact that needs addressing and establishes the need to promote healthy lifestyles, reducing health inequalities through the creation of healthy places. This includes the promotion of healthy eating through taking into consideration the cumulative impact of A5 uses; the need to improve Newham seeks to improve air quality and reduce noise and air pollution, alongside the need to facilitate and promote walking and cycling to increase peoples activity rates; and the need for new or improved open space to encourage greater participation in physical activity and provide relief from urban intensity. SP3: seeks to create safe, sociable places and specifically to avoid problems relating to uses such as hot

food take-aways, flood risk and cumulative impact. SP7: Seeks to reduce noise and air pollutions within quality movement corridors and linear gateways. INF1: Proposals will have regard to Airport Safeguarding Area and Public Safety Zone. INF2: Development proposals will be expected to contribute to on site and off site measures to facilitate the use of sustainable transport modes and requires the reduction/minimisation of congestion. SC3: Requires flood risk reduction across the Borough. SC4 & INF7: require consideration of effects of development proposals in riparian margin areas as well as consideration over the quality/quantity of the natural environment and requires access to SINCs to be maintained and improved. INF6: highlights need to deal with deficiencies in quality, quantity and access to open space. SP6 & INF5: seek to focus commercial, retail and leisure activities within identified town and local centres. SP6 specifically seeks to prevent clustering of hot-food take-aways either within or outside of the boundaries of designated centres and aims to maintain a robust retail core.

Are links clear?

Yes. This policy seeks to provide clear direction to issues identified in Core Strategy policies noted under the ambit of cumulative impact. Issues identified in Core Strategy policies which this policy seeks to influence include local amenity and antisocial behaviour; town centre vitality; promoting active travel and behaviours and militating against identified health concerns. It is intended that the impact of issues identified within both adopted zones and areas of local concern are clear and understandable to be used as a Development Management Tool.

Does it contribute to sustainable development?

Policy supports the NPPF overall strategy to achieve sustainable development in that it seeks to improve the quality of people’s lives, by incorporating wider issues such as antisocial behaviour, health and well-being to make small step changes to improve the environment in which people live, work and stay. The policy brings together a number of issues and provides guidance for decision making which enhance place-making across the Borough.

J4 - MANAGING A MIXED USE BOROUGH

What does central government say? (NPPF plus ministerial statements)

Para 21: NPPF requires boroughs to support existing business sectors. Sites allocated for employment use should be regularly reviewed to ensure they are brought into effective use.

What does the London Plan say? (see Land for Industry and Transport SPG)

4.4 & 2.17: Local Plans should demonstrate how the borough’s stock of land and premises in strategic industrial locations, locally significant industrial sites and other industrial sites will be planned and managed to meet the future needs of different types of industrial and related uses through designated locations. 4.4: Plan, monitor and manage release of surplus industrial land to ensure a sufficient stock of employment land and premises to meet future needs in appropriate locations, while contributing to strategic and local planning objectives. SPG3: Take account of borough level indicative release benchmarks including reallocations SPG4: To implement LP 4.4 outside of SIL framework designating Locally Significant Industrial Sites for enhancement and protection, subject to robust strategic and local evidence of demand in DPDs SPG4: To implement LP4.4 by developing policies and criteria in DPDs to manage the release and retention of other smaller industrial sites.

What does the Core Strategy say?

S1-S6/ SP1-SP6: Promotes transformational change, genuinely mixed use places to promote healthy, stable and mixed/balanced communities and seeks to achieve a balance between jobs, homes and infrastructure in the pursuit of convergence. J1: Seeks to create a dynamic business environment by selective protection of industrial locations and creation of successful places capable of attracting innovative and high value added companies and better and affordable employment spaces (including managed employment uses). J2: Seeks the more efficient use of employment land by managed release of employment land. The approach to local employment land designations and release of these will be set out in the DSPDPD. J3: More detailed policies and guidance on employment, training and business development will be considered as part of the DSPDPD to Improve employment opportunities in the Borough. INF9: Requires Infrastructure delivery alongside community facilities and affordable work spaces.

Are links clear?

Yes. National, regional and local policies seek to protect specific industrial locations where appropriate. This policy elaborates further into the allocation/designation of employment land seeking to protect and enhance the local employment in the borough and promote flexibility in identified transition areas to facilitate the development of employment as well as non-employment uses.

Does it contribute to sustainable development?

Policy positively seeks opportunities to meet development needs for employment in the borough, and to support a stronger economy, in line with NPPF. It will help to achieve economic (job opportunities), social (associated with being in employment) and environmental dimensions (uplift of LMUAs and other areas) of sustainable development.

H5- ACHIEVING HOUSING MIX, H6 – ACHIEVING HIGH QUALITY ACCOMMODATION AND H7 – DISTRIBUTION OF SPECIALIST ACCOMMODATION

What does central government say? (NPPF plus ministerial statements)

Mix Quality Distribution

Para 17: Core Principles: Every effort should be made objectively to identify and then meet the housing, business and other development needs of an area, and respond positively to wider opportunities for growth taking account of the needs of the residential and business communities. Para 50: plan for a mix of housing based on current and future demographic trends, market trends and the needs of different groups in the community (such as, but not limited to, families with children, older people, people with disabilities, service families and people wishing to build their own homes).

Para 17: Core Principles seek high quality of design and good amenity standards. Para 50: To deliver a wide choice of high quality homes, widen opportunities for home ownership and create sustainable, inclusive and mixed communities Local Plans should set out quality of development.

Para 17: Core Principles take account of different roles and character of different areas. Para 50: Local Plans should identify the size, type, tenure and range of housing that is required in particular locations, reflecting local demand. Para 58: Establish strong sense of place; attractive and comfortable places

What does the London Plan say?

3.8: Seeks to achieve mixed and balanced communities and Londoners should have a genuine choice of homes that they can afford and meet their requirements including a mix of housing sizes and types taking into account housing requirements of different groups. 3.9: A balanced mix of tenures, especially in deprived areas should be provided, in order to promote sustainable communities.

3.5: New housing development should enhance the quality of places, taking into account its context, density, tenure and land use mix. Establishes minimum space standards. 7.2: Promotes inclusive environments where everyone can move safely, easily and with dignity and housing that offers solutions for everyone’s needs. 7.4: housing proposals should respect form, function and structure of an area improve connections and build upon positive elements.

3.3: Consistent provision towards housing in line with established targets. Housing proposals should consider new site allocations, brownfield development, intensification and mixed use developments. 3.4: optimise housing output in accordance to location.

SP3: Creating attractive spaces engendering a sense of safety and preventing crime and anti-social behaviour through high quality of design. H1: New homes should meet internal space standards as minimum to support quality neighbourhoods.

S1: Promotes genuinely mixed use areas and provide the required amount of new homes S6: population will be stabilised, with a greater focus in improving housing quality, protecting and increasing family housing, and restricting HMOs and flat conversions. SP1: Enhance positive elements and create successful and distinctive places whilst promoting mixed and balanced communities. H3: ensure that specialist housing solutions are appropriately provided in line with the spatial vision.

Are links clear?

It is considered that the level of detail and the approach provided follows local, regional and national policy requirements, giving clarity and necessary detail to be used as a development management tool. It is considered that national and regional policy sets the baseline for these policies and the links are visible and direct.

Does it contribute to sustainable development?

Yes. By setting clear guidelines and standards regarding the type, quality and location of specialist housing. The housing policies seek to provide a variety of quality homes in appropriate locations to achieve mixed and balanced communities.

SC5 - MAXIMISING SUSTAINABLE DESIGN Flooding & Drainage Build Standards / Energy Use Biodiversity

What does central government say? (NPPF plus ministerial statements)

Core principles: Support transition to a low carbon future in a changing climate, taking full account of flood risk; encourage the use of renewable resources (including development of renewable energy); encourage multiple benefits from the use of land in urban and rural areas, recognising that some open land can perform many functions (such as for wildlife, recreation, flood risk mitigation, carbon storage, or food production).

Para 100: Develop policies to manage flood risk from all sources, taking account of advice from the Environment Agency and other relevant flood risk management bodies, such as lead local flood authorities and internal drainage boards using opportunities offered by new development to reduce the causes and impacts of flooding.

Para 95: Authorities should actively support energy efficiency improvements to existing buildings; and when setting any local requirement for a building’s sustainability, do so in a way consistent with the Government’s zero carbon buildings policy. WMS, March 2015: Advises that CfSH is discontinued and should no longer be included as a requirement in Local Plans.

Para 118: Minimising impacts on biodiversity and providing net gains where possible, contributing to the commitment to promote the conservation and enhancement of biodiversity opportunities.

5.3: Within Local Plans boroughs should consider the need to develop more detailed policies and proposals based on the sustainable design principles [outlined here and in the Sustainable Design SPG] that are specific to their local circumstances.

SC3: sequential test; FRAs; SUDS for all majors / presumption against hard standing; identify critical drainage areas; expecting development to contribute to flood defences; set back from Blue Ribbon; encourage community to take up resilience measures in flood risk areas. SC1: SUDS + consumption target of 105 l/p/d. INF3: Waste and recycling must demonstrate arrangements for on site waste management facilities. W1:(ELJWP) Encourages innovative approaches to sustainable waste management.

SC1: Major developments should meet sustainable design and construction standards for residential and non-residential standards, incorporate sustainable urban drainage systems , facilitate sustainable waste management and increased greening; passive solar design;; and retrofitting for resource efficiency. SC2: zero carbon by 2016/2019; decentralised heat networks; on site renewable energy generation; retrofitting to reduce carbon emissions. INF6/INF7: seeks to have regard to and protect and enhance biodiversity.

SC1: living roofs; greening the borough; contamination remediation. SC4: all majors contribute to BAP targets; development only where impact on species & habitats avoided; new SINCS, development should improve access; landscaping / tree planting / allotments / TPOs; enhancing around Blue Ribbon.

Does policy help promote sustainable development?

This additional policy will help improve the sustainable design standards of development across the borough by providing more guidance to developers, and providing more ways for the Planning Authority to ensure development demonstrates increasingly sustainable standards of design. Across the themes of flood risk, biodiversity, and build standards / energy use, the policy will help achieve development that responds to the threats of climate change and contributes to a more robust, resilient, and future-proof built environment.

INF10 - LOCATING COMMUNITY FACILITIES

What does central government say? (NPPF plus ministerial statements)

Para 17: Take account of and support local strategies to improve health, social and cultural wellbeing for all, and deliver sufficient community and cultural facilities and services to meet local needs. Para 23: Allocate appropriate edge of centre sites for main town centre uses that are well connected to the town centre where suitable and viable town centre sites are not available. Para 70: To deliver the social, recreational and cultural facilities and services the community needs, planning policies and decisions should:

plan positively for the provision and use of shared space, community facilities (such as local shops, meeting places, sports venues, cultural buildings, public houses and places of worship) and other local services to enhance the sustainability of communities and residential environments;

guard against the unnecessary loss of valued facilities and services, particularly where this would reduce the community’s ability to meet its day-to-day needs; and

ensure that established shops, facilities and services are able to develop and modernise in a way that is sustainable, and retained for the benefit of the community

What does the London Plan say?

3.1: Facilities and services that meet the needs of groups and communities should be protected and enhanced by development proposals. Loss of facilities without adequate justification or replacement provision should be resisted. Boroughs should engage with local groups to identify needs –and make appropriate provision for them. 3.16: High quality infrastructure will be provided that is supported by needs assessment. Resists the loss of facilities without re-provision in areas of need. Facilities should be available to all sections of the community and located in accessible areas. Multiple use is encouraged. Boroughs need to ensure that adequate social infrastructure provision is made to support new development. 3.17: Health and social care facilities supported in areas of identified need, in accessible locations.

What does the Core Strategy say?

S1-S6/ SP1-SP6: Promotes transformational change / successful inclusive places where people will choose to live work and stay. SP2: The need for new or improved health facilities, and importance of protection and promotion of local access to health and other community facilities and employment, including sources of fresh, healthy food in line with Policies SP6 and INF5. SP3: The importance of contributing to the creation of, and continued support for, genuinely mixed use areas with an integrated range of high quality accommodation for living, community facilities and work places, ensuring easy and inclusive access to these and associated walking, cycling and public transport links. SP6: Encourages the location of services and flexible community spaces to be in town/local centres . SP7: The importance of consolidating ribbon developments of commercial and community uses into defined local and Town Centres and Local Shopping Parades. J1: New town centre uses and community facilities will be directed within the defined hierarchy and, where relevant, boundaries identified by Policy INF5, with other commercial and community uses additionally managed by Polices INF8, SP3, SP2 & SP7. J3: Seeks improvements to education, skills and training provision within the Borough.

Infrastructure

INF8: Ensure a suitable range of facilities to meet existing and forecast demand. Requires facilities that meet local need and where retention or re-provision is proposed, this needs to be clearly demonstrated. Facilities need to be accessible – with town/local centre as the locational preference. Facilities need to be open and available to all members of the local community, co-location is encouraged as are joint venture agreements. Provision of services by social enterprise and third sector organisation. INF9: Priorities include infrastructure delivery (community facilities) as part of new development.

Does it contribute to sustainable development?

Yes. Community facilities are required to meet local need for the improvement of social and cultural wellbeing (health), to meet local need for successful mixed communities.
