L533 Cheyenne County Court House December 21, 2015 Sidney, Nebraska The Cheyenne County Board of Commissioners and Board of Equalization held an open and public meeting on Monday, December 21, 2015 in the Commissioners Meeting Room, Cheyenne County Court House, 1000 10th Avenue, Sidney, Nebraska. A notice of this meeting was published in the Sidney Sun-Telegraph, aired on KSID Radio, posted on the bulletin board in the County Court House and on the Cheyenne County website. Copies of the agenda were post- ed on the Court House bulletin board and on the Cheyenne County website, transmitted to each Commissioner and kept current and available to the public at the County Clerk’s Office. Chairman Darrell J. Johnson called the meeting to order at 8:00 A.M., with the following present:Steven L. Olson, Commissioner of the First District; Darrell J. Johnson, Commissioner of the Second District; Philip E. Sanders, Commissioner of the Third District; Beth E. Fiegenschuh, County Clerk and Clerk to the Board. Everyone present participat- ed in the Pledge of Allegiance. County Attorney Paul Schaub was present at the meeting. Chairman Johnson announced a copy of the current Open Meetings Law Act is post- ed on the window immediately outside of the Commissioners Meeting Room. The current Agenda was reviewed. A motion was made by Olson, seconded by Sanders to approve the Agenda as writ- ten. Roll Call: Aye: Sanders, Johnson, Olson. Nay: None. The Minutes of the meeting held on December 7, 2015 were reviewed. A motion was made by Sanders, seconded by Olson to approve the Minutes as writ- ten. Roll Call: Aye: Johnson, Olson, Sanders. The Board reviewed Monthly Fee Reports for the month of November for the Clerk, Treasurer, Clerk of the District Court and Highway Superintendent and for the month of October for the County Sheriff. A motion was made by Sanders, seconded by Olson to approve the Monthly Fee Reports as submitted. Roll Call: Aye: Sanders, Johnson, Olson. Nay: None. The Board discussed the appointment of Josh Loghry to the Cheyenne County Fairboard. A motion was made by Sanders, seconded by Olson to table the appointment at this time. Roll Call: Aye: Johnson, Olson, Sanders. Nay: None. At 8:15 A.M., a motion was made by Olson, seconded by Sanders to recess the Board of Commissioners and reconvene as the Board of Equalization. Roll Call: Aye: Olson, Sanders, Johnson. Nay: None. Assessor Louella Pippitt pre- sented a Tax List Correction for the tax year 2015 for Paul J. Huff and a Tax List Correction for the tax year 2015 for Kurt A. Huff. The corrections were necessary because an amended personal property schedule was filed by Paul J. Huff and also Kurt A. Huff. NEW YORK (AP) — Cancer is becom-ing the No. 1 killer in more and more states as deaths from heart disease have declined, new health statistics show.

Nationwide, heart disease is still the leading cause of death, just ahead of can-cer. While death rates for both have been falling for nearly 25 years, heart disease has dropped at a steeper rate.

As a result, cancer moved up to the top slot in 22 states in 2014, according to the latest government figures.

It’s also the leading cause of death in certain groups of people, including Hispanics, Asians and adults ages 40 to 79.

The trend is noted in the American Cancer Society’s latest annual report released Thursday.

The cancer death rate has fallen 23 per-cent since its peak in 1991. The decrease is attributed to declining smoking rates and advances in cancer detection, treat-ment and prevention.

The heart disease death rate fell 46 percent in that time.

The cancer society predicts there will be nearly 1.7 million new cancer cases this year, and nearly 600,000 deaths.

Government figures for 2014 show cancer was the leading cause of death in Alaska, Arizona, California, Colorado, Delaware, Idaho, Kansas, Kentucky, Maine, Massachusetts, Minnesota, Montana, Nebraska, New Hampshire, New Mexico, North Carolina, Oregon, Vermont, Virginia, Washington, West Virginia and Wisconsin.

The Sidney Street Department main-tains the 200 land-miles of roadway in the city, and it owns 10 pieces of equip-ment that clear snow – including plows and one motor grader.

City statutes dictate stage one desig-nations – emergency snow routes – are attended to first after snow events. Stage two designations, which include areas around schools and collector streets, are second. Finally, stage three designations,

which include residential streets, are plowed.

However, residential streets are not necessarily plowed following every snow event. According to the statues, the type of snow and amount, wind, existing snow on the ground and next expected snow-fall are considerations used in evaluating whether to plow.

While emergency snow routes are plowed their entire width to prevent the buildup of snowbanks, residential streets are plowed with one or two passes to open driving lanes.

LINCOLN (AP) — The University of Nebraska-Lincoln is establishing a facility that will focus on providing the state detailed pictures of the state’s weather and his-torical climate data, uni-versity officials said.

The new Nebraska State Climate Office will operate under the wing of university’s Institute of Agriculture and Natural Resources. The office will identify and provide the climate recording and reporting services needed most by Nebraska users, especially those engaged in agriculture.

The data will be shared

through the state climate office’s website, mobile apps and other products in development, said John Carroll, the School of Natural Resources director. Many of the products have been “sitting on the shelf” waiting for deployment, Carroll said, and could be launched yet this year.

The university said Wednesday that the office staff of climatologists and meteorologists will manage a network of 69 weather stations called the Nebraska Mesonet. Martha Shulski, who will direct the new office along with longtime state clima-tologist Al Dutcher, said

the climate office wants stations in all 93 Nebraska counties.

“We’d like more in the Sandhills and the Panhandle especially,” Shulski told the Lincoln Journal Star.

The network has been managed by the uni-versity’s High Plains Regional Climate Center. Transferring those duties to the new state climate office, university officials said, will let the center focus on the needs of the broader region, which is composed of Colorado, Kansas, Nebraska, North Dakota, South Dakota and Wyoming.

University establishes Nebraska State Climate Office

OMAHA (AP) — The mother of a 4-year-old girl who was found dead tried to regain custody of her daughter from the girl’s guardian several months ago, Omaha police said.

Officers called to the home of Chelsey Cook on Tuesday night found the body of Alicia Morrow. Cook, 22, was arrested the next day.

Douglas County Attorney Don Kleine said Thursday that she will be charged with intentional child abuse. Cook did not have an attorney listed in online court records.

The preliminary autopsy results were inconclusive, so the girl’s cause of death

remains unclear, Kleine said.

There is no Douglas County record of Cook seek-ing legal guardianship, the Omaha World-Herald reported. A police inci-dent report said the girl’s mother signed an informal agreement with Cook in December 2014 to have Cook care for Alicia. Cook told police in September that Alicia’s mom, Lakisha Morrow, was belligerent in asking for Alicia’s return.

Morrow told the news-paper that Cook offered to care for Alicia when Morrow was homeless. Morrow said she thought Alicia would be better off staying with Cook.

Morrow said she can’t understand why Cook wouldn’t give back Alicia.

“I did not abandon my baby,” Morrow said. “I wanted her back and I tried to get her back. Now she’s dead.”

Some of Cook’s relatives told the newspaper that the little girl didn’t attend a Tuesday family gathering. Cook told them the girl was at home.

Cook, her father and another relative went to her home later that night. They found the girl’s body, and one of them called 911. Her father, Kevin Cook, said the furnace wasn’t working and that it was cold inside the home.

VALENTINE (AP) — A state audit performed after the arrest of the deputy county clerk shows almost $199,000 in Cherry County funds is unaccounted for.

The county commissioners say state auditors found more than 1,000 credit card transactions totaling $83,000 that appeared to be for the personal use of Monica Bristow when she worked for

the county. Auditors also found dis-crepancies in claim procedures, payroll issues and county expenditures.

Bristow was arrested in July. Valentine radio station KVSH reports that Bristow pleaded guilty in August to felony charges of theft and unau-thorized use of a financial transaction device. Court records say she’s sched-uled to be sentenced on Jan. 15.

Mr. Oliver stated that all can-didates were determined to be qualified for the position. The recommendation of the Advisory Committee for Public Defender was Stacy Bach for the contract bid of $96,000.00 for a one-year contract and $192,000.00 for a two-year contract.

The Guardian ad Litem posi-tion was then discussed. The recommendation of the Advisory Committee for Guardian ad Litem was Audrey M. Elliot for the contract bid of $63,000.00 for a one-year contract and $126,000.00 for a two-year contract. In explaining the rec-ommendation for the Guardian ad Litem position, Advisory Committee member Philip Kelly stated that the bid from Audrey M. Elliott included an added proposal to provide juvenile defense services in the event of a conflict. She proposed a fee of $10,000 for this ser-vice. Concern was expressed by the Advisory Committee that the original advertisement for proposals only requested a Contract for a Public Defender position and a separate Contract for a Guardian ad Litem posi-tion. Since the other appli-cants were not asked to pres-ent proposals on combining the Public Defender and Guardian ad Litem positions, the Advisory Committee took no position on Ms. Elliott’s added proposal. The Advisory Committee suggested that if the Commissioners were interested in this type of pro-posal, the Advisory Committee could be directed to again meet and discuss the matter.

County Attorney Paul Schaub stated that, according to state statutes on biddings, the Commissioners may consider a variety of factors and that they were not obligated to accept the lowest bid.

Comments were heard from Stacy Bach and Donald Miller. Mr. Miller proposed that he would contract with an attor-ney to handle approximately one-half of the Public Defender cases. This attorney would be independent from Mr. Miller’s office in order to reduce the number of conflict cases in Cheyenne County. Mr. Kelly expressed concerns about a possible conflict of interest with this proposal.

Mr. Kelly also stated that the Advisory Committee was charged with the responsibil-ity of recommending a candi-date for a Cheyenne County Public Defender and Cheyenne County Guardian ad Litem. He added that the Committee could research further the need to contract with an attorney who would handle conflict cases of the public defender and guard-ian ad litem. Chairman Johnson suggested that it would be in the County’s best interest for the Committee to do so.

A motion was made by

Sanders, seconded by Olson to table the matter to allow the Advisory Committee the oppor-tunity to research further the need to contract with an attor-ney who would handle conflict cases of the public defender and guardian ad litem, and to thereafter make its recommen-dations to the Commissioners. It was understood that the Committee, if it recommends moving forward with a conflict attorney position, may publish an invitation to seek bids from attorneys interested in handling the conflict cases. Roll Call: Aye: Olson, Sanders, Johnson. Nay: None.

Highway Superintendent Doug Hart updated the Board on road activities.

At 10:15 A.M., a motion was made by Olson, seconded by Sanders to go into execu-tive session to discuss person-nel. Roll Call: Aye: Sanders, Johnson, Olson. Nay: None. Present in executive session were County Attorney Paul Schaub, Clerk Beth Fiegenschuh and Highway Superintendent Doug Hart.

There were no comments from the public.
