Acouple bailed out of a homepurchase when they heard arumour it had been used as a

grow op. That cost them more than$12,000.

If you learn that your home was onceowned by a drug dealer, must you dis-close that to a potential buyer when yousell?

Donald and Jodi Dietrich bought ahome in Winterbourne, Ont. in 2001.They were told by a neighbour severalyears later that an earlier owner was adrug dealer. In 2007, the Dietrichs con-tacted Waterloo Regional Police becausethey had heard that their property hadbeen a grow house. The police told themthere was no record of any grow op on theproperty.

They sold their home on January 31,2010 to Mark and Elizabeth Leech for$655,000, with a $10,000 deposit. Thedeal was scheduled to close on May 14,2010. They did not say anything aboutthe rumours, but before closing, the buy-ers also heard that a prior owner was adrug dealer.

The Leechs also went to theWaterloo Regional Police who told themthe property had been identified as hav-ing a “clandestine or secret lab”. On

March 29, 1995 a large quantity of hashoil was seized at the property althoughpolice did not find any grow operation ormeth lab.

The Leechs wanted out of the deal.They argued that since the sellers musthave known about this, they had a legalduty to disclose it and since they didn’t,the deal was off.

The Dietrichs claimed they knewnothing about a grow operation or methlab, but the deal didn’t close. The Leechssued for the return of their $10,000deposit and the Dietrichs sued for dam-ages suffered in not being able to closethe deal, which came to $12,237.68.

In Small Claims Court, the Leechssubmitted a March, 1995 newspaper arti-cle that suggested seven pounds of hashoil was seized, and a police report thatsaid a room beneath the garage may havebeen at one time a hydroponic growroom. The police report suggested thatcharges were laid against several peopleas a result of that criminal investigation.

Deputy Judge Sebastien Winny ofthe Kitchener Small Claims Court deter-mined on October 17, 2012 that a priorowner of the property manufacturedsome hash oil in the garage as a clandes-tine or secret laboratory. No evidence was

provided that those activities caused anydamage to the property. There was noproof of there having been any marijuanagrow operation or meth lab on the proper-ty.

The judge also found that the sellershad no actual knowledge of anythingrelated to the drug manufacturing exceptthe rumour from the neighbour. Theinformation the sellers received from thepolice suggested the rumour was false.There was no duty on the seller to dis-close vague, unsubstantiated rumours.

As such, the judge held that the buy-ers had no legal justification for refusingto close, so the sellers were given alldamages that they proved as a result ofthe buyers not closing, including extrarental costs and lost wages in dealingwith the matter. If the sellers did haveactual knowledge about a grow house opor meth lab on the property, they wouldhave been required to disclose this infor-mation.

If you are thinking about buying ahome that used to be a grow house oper-ation, there may be damage caused byexcess moisture. You will need to makesure the property has been remedied andcertified by a company that providesthese services. This could also require

having the electrical system inspectedand cleared by the Electrical SafetyAuthority. This will be the minimumrequired by any insurance company.

Senior Downsizing can be overwhelming

Downsizing one's home can bevery demanding physically,mentally and emotionally.

This is the case especially for seniors as itinvolves a lot of planning, packing andletting go of emotional ties to the home.

There are several reasons why sen-iors downsize. Most seniors want tomove to a smaller home because they feelthat their house is too big. When theirkids move out and it becomes an emptynest, it becomes tougher and tougher tomaintain a big house as they age. Whilesome sell their house to move to a retire-ment community or other senior carefacilities, there are other seniors that pre-fer to move to a smaller house or apart-ment.

The decision to downsize is not aneasy one. Moving to a new place isalways hard to deal with especially withall the memories shared in the home overthe years. However, the most challengingaspect when seniors downsize is stillpacking, as most seniors would agree. Itwill be very tough to decide on whichthings to bring and which things to throwaway, leave or sell. One has to accept thatthe new home will be smaller, therefore,it is impossible to bring all the things thathave been accumulate over the years.

1. Check the Layout of the newPlaceTo help seniors downsize, it will be goodto find out the layout for the new place inadvance so you know how much spacethe senior will have. This will help youand your senior loved one decide on whatwill fit and things you can bring.

2. Sort WiselyWhen a senior decides to downsize, help

the senior avoid clutter. Be sure to helpyour senior loved one sort out his or herbelongings. Separate the things that thesenior uses and things that your seniorloved one barely uses or does not need atall.

3. one Room at a time

When packing, start with rooms that thesenior uses the least, as it will have lessemotional attachments like attic, garage,bathroom, etc.

4. Keep a List

Dowsizing can be very overwhelming asthere are tons of things to do. In order tostay organize it is important to keep a listso you do not forget anything.

Without a marriage contract,most assets accumulatedby a couple will be divided

50-50 on separation. But in order to min-imize the impact of divorce on a family,in many cases one spouse stays in thehouse with the children while the otherspouse leaves.

This is a tricky question. Althoughyou can appraise a home and a businessand put values on them, the tax treatmentfor each is very different. For example,let’s say you have a home and businessand each are appraised at $500,000. Theywere each purchased for $100,000. Whenyou sell a business, you will have to paytax on any gain that you made. Yet whenyou sell your home, which is your princi-pal residence, no tax will be payable.Therefore, in most cases, a home that isappraised the same as a business is actu-ally worth more than the business. This

must be taken into account when negoti-ating any division of property.

Can one spouse be forced to moveout?

Each married spouse has the equalright to live in the family home. Let’s saythe house is registered in the wife’s namealone. They decide to separate. The wifecannot demand that her husband leave. Ifthis cannot be worked out amicably, thenthe couple will likely have to go to courtto get an order as to whether one spouseleaves, or whether the home is sold andthe money divided.

Does it matter who stays in the house?In many cases, upon separation, one

spouse will move out of the family home.It will still require the permission of bothspouses to either mortgage or sell thehome, even if they are not on title.However, while the spouse who lives in

the home will not be paying any rent, thespouse who moves out will have to payrent in another location, and will likelystill be responsible for 50 per cent of themortgage and other expenses in the mat-rimonial home.

Can the spouse who stays put amortgage on the home and keep themoney?

The answer is no. Even if you leavethe home, and even if the property is reg-istered solely in the spouse’s name whostays, you cannot mortgage a familyhome without the permission of bothmarried spouses.

Do common law spouses have thesame rights?

The answer is no. Common lawspouses have no entitlement to a share ina family home, unless their name is ontitle, or if they can prove that they have

contributed financially to the purchase ofthe home. If you are buying a home withyour common law partner, you must getyour name on title to protect yourself.

Family lawyer Elliot Birnboim ofToronto also tells me that when onespouse gets possession of the familyhome, this will also affect child andspousal support calculations.

The lesson here is to obtain expertfamily law advice before you make anydecision about what to do with your fam-ily home if you decide to separate. Thegoal should be to balance what will bebest for all members of the family, whilealso ensuring that any property is dividedfairly.
