If you are submitting a Photoshop PSD file, leave the layers unflattened. If you built the job in Indesign, export the art as a PDF and send both files.

• Include all supporting graphics and photos. Because the resolution of an embedded or linked image is critical to a high quality final product it needs to be at least 300 dpi, in CMYK, saved as a TIFF or EPS AND included in the same folder with the artwork. If you are unsure whether sending art is necessary, go ahead and send it.

• Create your artwork according to our dieline templates. Neither Times Journal Inc. or its agents warrant that the service will be uninterrupted or error free and shall not be liable for any inability to use theservice.

3. If Advertiser does NOT fulfill this contract obligation, the agreement will be automatically cancelled and the advertiser agrees to pay the difference between the discount earned and amounts previously billed.

4. Payment will be made within 30 days of billing. Consistent with Times Journal Inc. collection and credit policies, Times Journal, Inc. reserves the right to cancel this contract at any time during the contract period if payments are not kept current. Should this become necessary, the contract will be recalculated to determine the rate the advertiser had actually earned. Advertiser also agrees to pay all attorney’s fees if the account becomes delinquent and must be given to an attorney for collection and may be subject to a monthly finance charge of 1.5%.

5. The Advertiser shall hold Times Journal Inc. harmless and indemnify it from all damages, costs and expenses of any nature whatsoever for which Times Journal Inc. may become liable by reason of its publication of Advertisers’ advertising. This contract cannot be invalidated for typographical errors, incorrect insertions or omissions in advertising published. The company shall not be liable to advertiser for any loss that results from the incorrect publication of advertisements.

6. This agreement may not be assigned or transferred by Advertiser or its Agency.7. If Advertiser uses an agency, the Advertiser and the Agency shall be jointly and severally liable for payment in compliance with all terms of this contract. Agency

commissions, if any, shall apply to all space charges and adjustments under this contract. This agreement renders void any statement concerning liability which appear on correspondence from the Agency/Advertiser and is irrevocable without the written consent of the Times Journal Inc. Credit Department.

COMMISSION AND TERMS OF PAYMENTAll open rates are fully commissionable (15%) to recognized agencies providedfull agency services are performed and payment terms are met.

Full agency services include:1. Submission of camera ready materials2. Submission of written insertion order3. Guaranteed payment by the 15th of the following month 4. Signed advertising agency recognition agreement.5. In-house agencies do not qualify for agency commission.

All advertising is payable cash in advance unless advertiser has established acredit account with the newspaper. All accounts on credit will be billed on the lastday of the month and will be due upon receipt and considered past due on the25th of the following month.

Monthly statements rendered will be accepted as correct unless recipient notifiesthe paper in writing within ten days of mailing of statement.

All accounts are billed at the gross or open rate. Contract discounts will be earnedif invoices are paid by the 15th day of the month following billing provided thereis no previous balance.

All accounts considered past due will receive a finance charge of 1-1/2% (annualpercentage rate of 18%) applied to the total past due balance. There is a minimumservice charge of $1.00 per month for each past due account.

All transient, sellout, bankruptcy, going out of business or like advertising will bepayable cash in advance at the open rate.

Political candidates may qualify for agreement rates (normally six weeksmaximum) but must pay cash in advance.

COPY AND CONTRACT REGULATIONS1. The Marietta Daily Journal and Neighbor Newspapers retain all rights, title,and interest to all layouts which represent the creative efforts of the newspaper-s’ staff and/or utilization of its own illustrators, labor, composition or material.Photographic or other reproduction of such layouts appearing in the MariettaDaily Journal and Neighbor Newspapers by any other publication without spe-cific written authorization from the Marietta Daily Journal and NeighborNewspapers is prohibited.

2. All advertising is payable in advance unless advertiser has established creditwith the newspaper’s credit department. All space, after credit is established withthe credit department, will be billed on the last day of the month, will be due onreceipt and will be considered past due on the 25th of the following month.

3. No contract is valid unless signed by the Advertising Director or the Publisher.

4. The Publisher reserves the right to adjust rates within 30 days written noticeand all contracts are accepted subject to this reservation. In such event, advertis-er may terminate without penalty.

5. No contracts accepted for a period longer than one year.

6. All “Transient,” “Sell-Out,” “Closing Up,” “Going Out of Business Sale,” “FortuneTeller,” “Palm Reader,” or advertisements of similar nature are payable in advanceat open rate.

7. Political candidates may qualify for agreement rates (normally 13 weeksmaximum), but must remit cash with copy.

8. The Publisher reserves the right to consider contracts void on which advertis-ing is not ordered to be inserted within the first 30 day period.

9. On frequency or multiple insertion contracts, newspaper reserves the right toprint previous week’s copy when new copy is not received by final deadline.

10. The Marietta Daily Journal and Neighbor Newspapers will not be liable for anyerror in advertisements to a greater extent than the cost of the space occupied bythe item in the advertisement. On multiple insertions of the same ad, we are notresponsible for errors after the first insertion.

11. All insertions are made on the basis of the provisions of this rate card.No verbal agreements will be recognized.

12. Advertiser or advertising agency assumes liability of all content of advertise-ments printed and the responsibility of any claims arising therefrom which aremade against Publisher.

13. Advertisements which resemble reading matter will have the word “adver-tisement” printed on the copy in each column occupied by such advertisement.

14. All ads are measured from cut-off rule to cut-off rule.

15. Advertising must be in good taste as to form, subject matter, size, working,illustration and typography. The Publisher may refuse advertising considered inbad taste, offensive or detrimental to the public, the newspaper or an advertiser.

16. No ads may be placed upside-down, reversed or sideways.

17. Any advertisement over 18” in depth is billed as full column depth (21”). Twocolumn inch advertisement is the minimum size accepted. Advertisement mustbe as many inches deep as columns wide.

18. Position requests are given full consideration. If position guaranteed, add 25%to rate. Minimum ad size position guaranteed is 31 column inches. Minimumcolor ad size is 31 column inches.

19. Proofs shown upon request for all ads over 25 column inches.

20. All open rates and color rates commissionable (15%) to recognized agenciesfor camera-ready copy meeting all deadline and payment terms.

21. Sold in combinations, advertiser has available the combination discount andone of the following...

1 - agency discounts, 2 - non-contract volume discounts3 - contract frequency, 4 - contract bulk discounts.

22. Photography Department: A Photography department is available for use byadvertisers. Staff members are available to make photographs for advertisers at acharge of $10.00 per accepted print - $15.00 minimum charge.

23. Remarks: When revised proofs are required due to change of style, copy, etc.by advertiser and are not caused by our composing room, a time charge at therate of $50.00 per hour, but not less than one- half hour will be made for such cor-rection.

24. Art Department: Services of the newspaper Art department are available atthe cost of $60.00 per hour with a one-half hour minimum. Art department artistsare available for logo designs and any special art requests of the advertiser.

25. Double Trucks: On all double trucks, the center (gutter) will be charged as afull column. No double trucks accepted for less than 9 full columns (four on eachpage plus gutter).

26. Electronic format accepted. See page 33.

27. Monthly statements rendered will be accepted as correct, both as to amountof space and rate, unless The Marietta Daily Journal is notified within ten days ofmailing such statement that it is incorrect and in what amount(s).
