The Public Safety Commission met in Austin, Texas on January 12, 2005. Attending the meeting were Chairman Colleen McHugh and Commissioners Carlos Cascos and Ernest Angelo, Jr.

The meeting was called to order by Chairman McHugh. Proper notice had been posted.

I. Minutes. Upon motion by Commissioner Cascos and seconded by Commissioner McHugh, the minutes of the December 1, 2004 meeting were approved.

II. Public comment. There was no public comment.

Ill. Honorary Texas Ranger Captain. Commissioner McHugh expressed appreciation to Bobby Holt for his years of service on the Commission. Upon motion by Commissioner Angelo and seconded by Commissioner Cascos, Robert Holt was named an Honorary Texas Ranger Captain.

IV. Budget matters. Oscar Ybarra gave the budget report. There was some discussion on DPS appropriation priorities and crime lab facilities and staffing.

Audit & Inspection report. Farrell Walker gave the audit & inspection report. There was some discussion on reconciliation of funds and inventory between DPS and the Comptroller's Office.

Division reports. Burt Christian gave the Administration Division report. There was some discussion on electronic arrest reporting, sex offender notification mailings, criminal background check investigations, Private Security Commission investigations and licensing, recruit schools, and building projects. The Texas Highway Patrol Division report was given by Randy Elliston. There was some discussion on ongoing STEP programs and THP criminal interdiction efforts. Judy Brown gave the Driver License Division report, including an update on the Fraud Investigation Unit and ongoing projects (DL reengineering, CRIS, image verification, field compliance). There was some discussion on the recent driver license mismailing problem and steps that were taken to rectify it. The Criminal Law Enforcement Division report was given by Kent Mawyer. There was some discussion on the forensic DNA and CODIS backlogs and ongoing activities of the various services. Earl Pearson gave the Ranger Division report. The Information Management Service report was given by Ed Kelly.

For publication for public comment A. Proposed amendment to Rule 3.28, 37 TAC Sec. 3.28, relating to the Citation

Disposition Receipt Program and the specific circumstances under which a Trooper may utilize the progam. Randy Elliston briefed the Commission on the proposed amendment. Upon motion by Commissioner Cascos and seconded by Commissioner Angelo, the attached amendment was unanimously approved for publication for public comment.

Personnel matters, pending and contemplated litigation, ongoing criminal investigations, status of purchase of real property. The Commission went into Executive Session pursuant to Tex. Gov. Code Secs. 551.071, 551.074, 551.072 & 411.0041 to discuss personnel matters; Special Ranger and Special Texas Ranger commissions, including consideration of renewal of all current Special Ranger and Special Texas Ranger commissions; pending and contemplated litigation; status of purchase of real property; and ongoing criminal investigations. Upon reconvening Regular Session, Commissioner McHugh announced that the Commission had discussed personnel matters, pending litigation and ongoing criminal investigations. Special Ranger commissions had been considered for DPS retirees David F. Bradshaw, William J. Brewer, Randy Edwards, George Elizondo, Cornell A. Evans, Jesus V. Hernandez, Lesly McCuiston, Earl W. McNiel and Stephen A. Severn; Special Texas Ranger commissions had been considered for Charles K. Fleming and Phillip R. Ryan, DPS retirees, and Tommy R. Reed of the National Insurance Crime Bureau; and the renewal of all current Special Ranger and Special Texas Ranger commissions had also been considered. Upon motion by Commissioner Cascos and seconded by Commissioner Angelo, Special Ranger and Special Texas Ranger commissions were approved for the above named individuals respectively and all current Special Ranger and Special Texas Ranger commissions were renewed for a 2

year period beginning January 1, 2005. A list of the Special Ranger and Special Texas Rangers approved for renewal is attached.

Mary Ann Courter advised that prior to today's meeting Commissioner Angelo had received the statutorily required training pursuant to Gov. Code, Chapter 411, Section 411.0031, to serve on the Public Safety Commission.

A motion was made by Commissioner Cascos and seconded by Commissioner Angelo adjourning the meeting.
