Business Liability Business Liability includes medical payments and personal and advertising injury. The available limits of business liability are $300,000, $500,000, $1,000,000 or $2,000,000 per occurrence.

The aggregate limit for injury or damage under the products/completed operations hazard arising from all occurrences is twice the Liability and Medical Payments Occurrence Limit.

The aggregate limit for all other injury or damage including medical expenses is twice the Liability and Medical Expenses Occurrence Limit. This limitation does not apply to Medical Expenses.

Medical Expenses is included for $5,000 per person. Optional limits of $10,000 and $25,000 are available.

Tenants Fire Liability (providing coverage for the named insured as a tenant in building owned by someone else) is included for $300,000. No increase or decrease in limits is available.

RATING FACTORS Age of Building

Buildings built less than 45 years ago qualify for the Age of Building credit. Age of building is the difference between policy effective year and year of building construction.

All Perils Deductible

All policies contain the All Perils Deductible. The standard All Perils Deductible is $1,000. The following optional higher deductibles are available: $2,500, $5,000, $10,000, $15,000, $20,000, $25,000, $50,000, $75,000, and $100,000.

Policy all perils deductible is selected at the policy level but rated based on each building plus business personal property coverage amount like commercial property rating. The table gives the deductible factors by range of coverage amount.

Association Type Factor

If the product is CAPsure, then the user needs to select the type of association and the appropriate factor is applied.

Condominium Association - An association whose members have individual ownership of the space within the boundaries of their residential units and share an undivided interest in common areas

Tax Districts Condominium Associations - As a tax district, the association would provide services such as sewer treatment, water treatment and streets and roads.

Homeowner’s Association - An association of single-family homeowners who own property in common that consists of green belts, paths, parks, community centers, pools or other jointly owned property. The association provides maintenance, repairs and insurance covering only the property held in common.

Base Rate

Base rates are determined by territory.

Building and Business Personal Property Limit Type

Specific or Blanket at the location level. Property may be insured on specific or blanket limits. Blanket limits are at the location level. The limit is the sum of Building and BPP for all blanketed buildings. Blanketed buildings are always written on a Replacement Cost basis.

Class

Company-specific classes are used.

For residential classes, the liability exposure base is number of units.

For non-residential classes (Club House, Mercantile, Office, Parking Garage, Restaurant and Outbuildings), the liability exposure base is the Limit of Insurance.

Auxiliary buildings, garages and other appurtenant structures must be insured separately.

There is no charge for liability on outbuildings.

Individual Risk Premium Modification (IRPM)

To recognize special circumstances, IRPM may be used in accordance with the following guidelines subject to underwriter approval:

The total credits or debits applied may not exceed 40%.

Application of credits may not reduce the total premium below the policy minimum premium of $1500.

IRPM is applied after all other rating procedures.

IRPM does not apply to the following coverages: Employee Benefits Liability, Employee Benefits Liability – Extended Reporting Period.

IRPM should not reduce Liquor Liability premium below minimum premium of $500.

Lead Maryland Changes - Liability For Hazards of Lead - BP 04 44 Lead Exclusion - AIL 10 01 - If the offer of coverage under BP 04 44 is rejected in writing by the Named Insured, attach AIL 10 01 to exclude all lead coverage. BP 04 44 must be offered to owners of properties in Maryland that contain one or more rental dwelling units. A rental dwelling unit is defined in the Maryland Lead Poisoning Prevention Program Act as a room or group of rooms that form a single habitable unit for permanent occupation by one or more persons, with provisions for living, sleeping, eating, cooking and sanitation. However, a rental dwelling unit does not include units in a hotel or units not offered for rent. Such units must be registered with the Department of the Environment and certified to be in compliance with the Maryland Lead Poisoning Prevention Program Act. For units, which meet these criteria, the endorsement provides coverage for expenses included in a qualified offer. Coverage for expenses included in a qualified offer is limited to:

$9,500 for each eligible person for relocation expenses, rent subsidy and other incidental expenses.

$7,500 for each eligible person for medical expenses necessary to mitigate the effects of lead poisoning from lead in or on an affected property. This coverage is provided only in lieu of payment for such treatments by the Maryland Medical Assistance Program or a health insurance plan covering these persons. An eligible person is a person who is either under six years old and a pregnant

woman and who resides, or regularly spends at least 24 hours a week, on that part of an affected property which has been certified to be in compliance with the

Maryland Lead Poisoning Prevention Program Act.

Loss Settlement Options

Moratorium Protocol In response to MARYLAND INSURANCE ADMINISTRATION Title 31 Subtitle 08 Chapter 12, the following outlines Moratorium Protocol for the Worlds Apart/CAPsure program, effective April 1, 2010. The moratorium is designed to have the least impact on the conduct of business throughout the State as reasonably possible. The moratorium may not suspend the binding, or writing, or both of all lines of business of an insurer. Moratoriums shall be based on the following weather or non-weather related events, or emergencies and are not effective until: (1) The National Weather Service issues a hurricane or tropical storm watch, warning, or advisory for part of the State or the entire State; (2) The Governor or other governmental entity declares a state of emergency for part of the State or the entire State; (3) The announcement of an evacuation, whether mandatory or voluntary, for part of the State or the entire State; (4) The imposition of a special curfew for part of the State or the entire State; or (5) The onset of an earthquake that is in an area within: (a) 50 miles of the epicenter of an earthquake that is 5.0 to 5.9 on the Richter scale; or (b) 100 miles of the epicenter of an earthquake measured 6.0 or greater on the Richter scale. The moratorium SHALL be limited to:

Those areas of the State that are impacted by the National Weather Service watch, warning, or advisory;

Areas of the State that are included within the government-declared area of disaster or emergency;

Areas of the State that are under an evacuation order, whether mandatory or voluntary;

Areas of the State under a special curfew; or Areas of the State that are within:

(a) 50 miles of the epicenter of an earthquake that is 5.0 to 5.9 on the Richter scale; or (b) 100 miles of the epicenter of an earthquake measured 6.0 or greater on the Richter scale.

A moratorium applies only to lines of business that are reasonably expected to be affected by the impending weather or non-weather related event or disaster or government-declared emergency for part of the State or the entire State that was the basis for the moratorium. Exceptions The implementation of a moratorium will not be used to deny binding authority or coverage for the following transactions: Property insurance that was bound prior to the implementation of the moratorium; Automobile liability insurance being purchased in connection with the purchase of a new or used motor vehicle by a consumer; Issuance of policies where the risk of loss is unrelated to the impending weather event or government-declared disaster; and Additional types of coverage, endorsements, or limits being made to an existing policy while it is in the renewal period which includes the 45 days prior to, and up to and including, the renewal date of an existing property and casualty insurance policy, subject to any change becoming effective on the renewal date of the policy Lifting the Moratorium A moratorium issued by the company shall be regularly monitored by the insurer. Except as provided above, a moratorium for a weather related event shall not continue for more than 24 hours after the termination of the last warning issued for part of the state or the entire state. Earthquake (1) A moratorium issued because of an earthquake shall be lifted 72 hours after the onset of the earthquake. (2) An aftershock of 5.0 or greater on the Richter scale that occurs during the restricted period shall be treated as a new earthquake, resulting in a new 72 hour period of suspended binding authority. Notice to the Commissioner The company shall notify the Maryland Insurance Administration of its implementation of a moratorium by: (1) Email to an electronic mailbox provided by the Administration and; (2) Filing through the System for Electronic Rate and Form Filing (SERFF). The notice shall be provided to the Administration when a moratorium has been implemented and shall identify those geographic areas of the State where the moratorium is being applied.

Number of Stories Factor

This factor is determined by the construction and number of stories.

Primary Per Occurrence Loss Limit, AWA 66 58 This coverage will be at a policy level in that only ONE value may be selected to cover multiple locations/buildings. Each building will have a factor applied to the base building premium. This factor will be designated by location (no matter how many buildings there are per location). All buildings at a given location will have the same factor applied. The factor may be determined with the following algorithm:

1. Calculate TIV (total insured value) for the location as:

Total Building limits; plus

Total Contents limits; plus

Total Ordinance or Law limits (2&3 combined), capped at 10% of the building limit for all buildings at the location.

2. Divide the primary loss limit per occurrence by the TIV for the location to determine % of Value

3. Use the % of Value to look up the percent of premium in the First Loss table.

4. Multiply the premium for any location property coverage by this factor to get the final location premium.

Protective Devices

Credit is given for protective devices. The credit is the product of all the individual factors. No maximum credit applies.

Sprinkler Systems Credit

A risk is eligible for Sprinkler Systems Credit if it is 100% fitted with a System 13 Sprinkler System. 100% means the total building including attics, eaves, basements, concealed areas, closets etc. A system 13R does not qualify for credit.

Central Alarm

A risk eligible for a Central Alarm Credit has full alarm including burglar and fire connected to a 24 hour monitored station.

Low Temperature/ Freeze Alarm A risk eligible for a Low Temperature / Freeze Alarm credit has technology that will contact the insured or property manager by telephone or central station connection if the temperature inside the premises drops below a level indicating a loss of heat and a threat of frozen pipes.

Stove Top Fire Suppression

A risk is eligible for the Stove Top Fire Suppression System Credit if 100% of the units have a Stove Top Fire Suppression system which meets our loss control requirements.

Hardwired Smoke Detectors

A risk eligible for the Hardwired Smoke Detectors Credit must have 100% of the building smoke detectors wired to the building electrical system. There must be an adequate number of detectors within the building to meet the state or local code.

This program uses the ISO Protection class grading system of classes 1 to 10.

Water Damage or Ice Dam Deductible Per Building - AWA 68 36 – Available for Worlds Apart classes only. Deductible options available are $2,500, $5,000, $10,000, $15,000, $20,000, $25,000, $35,000, $50,000. $75,000 and $100,000

Water Damage or Ice Dam Deductible Per Unit - AWA 68 37 – Available for CAPsure classes only. Deductible options available are $1,000, $2,500, $5,000, $7,500, $10,000, $15,000, $20,000 and $25,000.

Water Heater and Other Mechanical Accident Damage Deductible

– AWA 68 22 Deductible options available are $10,000, $15,000, $20,000, $25,000, $35,000, and $50,000.

Wind Zones

Applicable wind zone for each building is determined by ZIP Code.

Wind zone factors will apply to the property premium for risks located within these zones. Factors vary further by building construction type and proximity to the coastline (inside or outside 2500 feet).

The following minimum Wind Deductibles will apply to risks located within these zones.

Otherwise, a wind deductible is optional for Masonry or Non-Combustible in Zone 3 and for all risks in Zone 0. In all cases, a higher wind deductible can be purchased. Wind Deductibles of $1000, $2500, 1%, 2%, 5% are available. Wind deductible factors do not apply to any buildings with a wind exclusion.

Wind Deductibles

Special Windstorm Deductible – AWA 66 32 Special Wind Deductible options are 1%, 2% or 5% of the building limit of insurance or $1,000 or $2,500.

The deductible options are 1%, 2%, 5%, $1,000 or $2,500. This deductible is used to apply a windstorm or hail deductible and applies in addition to the All Perils Deductible.

Windstorm or Hail Exclusion – AWA 66 30 The factor to exclude wind is applied to the building and contents rate. Windstorm or Hail Losses to Roof Surfacing - Actual Cash Value Loss Settlement – BP 14 04 Rating factor applies to this endorsement.

Sub-limited Earthquake coverage may be provided either on a total policy blanket basis or on a location basis.

The deductible for construction types other than Joisted Masonry is 5% of the property value. For Joisted Masonry, the deductible is 10% of the property value.

Specific Building Rating Sub-Limit Factor = Specific building Earthquake limit / Total Amount of Insurance for that specific building (Building and Business Personal Property).

For example, if the total Earthquake coverage desired is $500,000 and the total amount of insurance provided at that building is $1,000,000.

Blanket Rating Sub-Limit Factor = Earthquake Sub-Limit / Total Amount of Insurance for all buildings included under the blanket sub-limit.

The policy is returned for cancellation on the effective date and we receive this request within 45 days of the receipt of the policy by the Named Insured.

Other Cancellations

Cancellation return premiums for reasons other than the above stated reasons or subject to special State requirements will be computed at .90 of the pro rata unearned premium and rounded to the next higher whole dollar.

Policy Minimum Premium The policy annual minimum premium is $1500. If more than one policy is issued for billing purposes, the sum of the policies must equal $1500. This minimum may be pro-rated for a short-term policy. The minimum premium will not be retained if the policy is cancelled.

Policy Term The policy term is for one year. Shorter terms are available subject to underwriting approval.

Restrictions of Coverage Policies may be issued with special restrictions in accordance with State requirements if:

The insured agrees in writing; and the policy would not be written otherwise.
