EXPLANATORY NOTE

This Ordinance is enacted pursuant toArticle X, Section 5 of the 1987 Constitutionwhich grants to each Local GovernmentUnit the power to create its own source ofrevenues and levy taxes, fees and chargessubject to such guidelines and limitationsas the Congress may provide consistent withthe basic policy of local autonomy, whichtaxes, fees and charges shall accrue exclu­sively to the Local Government Unit.Likewise, this Tax Ordinance is enactedpursuant to Section 18, 151, 186, 187, andmore particularly Section 149, of RepublicAct No. 7160, otherwise known as the LocalGovernment Code of 1991.

Be it ordained by . the Sangguniang Pan­lungsod of the City of Zamboanga, that:

SECTION 1. PRELIMINARY TITLE.­This ordinance shall be known as theFishery Rentals, Fees and Charges Ordi­nance of the City of Zamboanga.

SEC. 2. CITY WATERS.-:-For purposesof this Ordinance, the phrase "City Waters"shall include not only streams, lakes, andtidal waters included within the city, notbeing the subject of private ownership, andnot comprised within national parks, publicforests, timber lands, forest reserves, orfishery reserves, but also marine watersincluded between two lines drawn perpen­dicularly to the general coastline frompoints where the boundary lines of thecity touch the sea at low tide and a thirdline 'parallel with the general coastline andfifteen (15) kilometers from such coastline.

SEC. 3. LICENSE PERMIT FISHERY'.GRANT.-It shall be unlawful for any per-son, cooperative, partnership, association orcorporation to take or catch fish or otheraquatic products by means of nets, traps,or other fishing gears in the city waters ofthis city or by means of fishing boats orvessels three (3) tons gross or less, unlessprovided with the necessary license permitissued for the purpose by the City Mayorupon recommendation of the City Treasurer.It shall be likewise illegal for any person,cooperative, partnership, association or cor­poration to operate fish corrals or oysterculture beds, take or catch "bangus" fry orfry of other species for propagation withinthe jurisdiction of the City of Zamboangawithout first securing a city grant thereforconferred as provided for by law and thisOrdinance.

SEC. 4. PERSONS ELIGIBLE FOR FISH­ING AND/OR FISHERY PRIVILEGES.­The following are eligible for fishing and/orfishery privileges:

(a) Citizens of the Philippines;(b) Cooperatives, partnerships, associa­

tions or corporations duly registeredor incorporated under the laws ofthe Philippines and authorized totransact business in the Philippines,and at least sixty (60) per centumof whose capital stock belong whollyto citizens of the Philippines;

(c) Marginal fishermen engaged in sub­sistence fishing of which shall belimited to the sale, barter of marineproducts produced by himself andhis immediate family.

It shall be unlawful for persons, coopera­tives, partnerships, associations or corpora­tions not qualified by law and this Ordinanceto engage, personally or through otherpersons, in fishing or catching or collectingaquatic products in the City Waters withinthe jurisdiction of the City of Zamboanga.

waters within the jurisdiction of the Cityof Zamboanga shall be divided and classi­fied, as follows:

SEC.8. APPLICATION FOR EXCLU­SIVE FISHING PRIVILEGES.-Applica­tion for any of the exclusive fisheryprivilege mentioned in the preceding sec­tion shall be made on official form dulyapproved by the Sangguniang Panlungsod.

SEC. 9. TO WHOM TO SUBMIT APPLI­CATION.-All applications shall. be for­warded to the Secretary to the Mayor, whoshall submit it to the City Mayor. Uponreceipt of the application, the City Mayor

SEC. 6. EXCLUSIVE PISHERY PRIVI­LEGES.-Operating fish corrals, oysterculture beds or the catching of "bangus"fry or fry of other species for propagationshall be considered as exclusive fisheryprivileges which shall be granted always tothe highest bidder in public bidding heldaccording to the provision of this Ordinance.

The Sangguniang Panlungsod may grantto the highest qualified bidder the exclusiveprivilege of constructing and operating fishcorrals, oyster culture beds, or of gathering"bangus" fry or fry of other species, incity waters for a period not exceeding five(5) years.

SEC. 7. ISSUANCE OP INDIVIDUALLICENSES IN CASE NO BIDDERS OPTTO LEASE PISHING ZONES.-If, aftertwo (2) notices for the grant of exclusivefishery rights thru public bidding, no in­terested biddersopt to lease any fishing zonewithin the municipal waters, the Sang­gunian Panlungsod is authorized to grantthe privilege of erecting fish corrals, operat­ing oyster culture beds, or catching"bangus" fry or "kawag'-kawag" within adefinite area or portion of the City watersto individuals upon payment of license feestherefor at the rate not exceeding thosefixed hereunder:

shall satisfy himself that the license appliedfor will not prejudice public interest andthat the portion or area for which an appli­cation for lease has been presented is notcovered by any subsisting lease.

SEC. 10. COMMITTEE ON AUCTION.­A Committee on Auction is hereby "created .to composed of the City Mayor, as Chair­man, the City Treasurer and two (2) Mem­bel's of the Sangguniang Panlungsod, asMembers.

SEC. 11. PUBLICATION OF NOTICE.­The Chairman of the Committee on Auctionshall advertise notice for sealed bids forexclusive fishery privileges in areas-or zonesof the City Waters available for erectingfish corrals, or constructing or operatingoyster culture beds, or taking or catching"bangus" fry or fry of other species forpropagation by posting said notice in anewspaper published in the City of Zam­boanga, for a period of not less than fifteen(15) days or at the "main entrance .,pf theCity Hall Building and other public con­spicuous places in the districts where theareas to be leased are located for the sameperiod of time.

SEC. 12. TIME AND PLACE OF AUC­TION.-The Sangguniang Eanlungsod shall,in a resolution, provide for a notice callingfor sealed bids for the exclusive fisheryprivileges specifying the time and place ofthe auction, the amount to be depositedbefore an individual or an entity is entitledto participate, the procedure to be followedby the' Committee on Auction before anyexclusive privilege is granted and the bondas guarantee of good faith and for satis­factory compliance with the terms of thelease or grant, but in no case shall be mini­mum annual r.ental for the gathering orcatching of "bangus" fry or "kawag­kawag" be less than what is provided insubsection (4) of Section 6 of this Chapter.The bond shall be in cash in real estatesituated within the Philippines or by suretycompany authorized for that purpose in anamount not less than two years rental.

SEC. 13. LICENSE PERM/T.-The :pri­vilege of taking or catching fish in the citywaters of the City of Zamboanga, withnets, traps or other fishing gears, with '01' .

fishing shall be allowed to fish in themunicipal waters for home consumption:Provided, Finally, That it shall be beyondthe power of the City Government to im­pose a license for the privilege of gatheringmarine mollusca or the shells thereof, forpearling boats and pearl divers, or forprospecting, collecting or gathering spongesor other aquatic products, or for the cultureof fishery/aquatic products: Provided,lastly, That they shall not fish within twohundred (200) meters from any fish corraloperated under exclusive privilege grantedby the city in accordance with thisOrdinance.

License permits issued under this sectionshall be valid for the year in which theyare issued.

SEC. 14. RESTRICTIONS.-Licenses andpermits issued or contracts executed underthis Ordinance shall contain provisions tothe effect that:

(a) No fish corral or "baklad" shall beconstructed within two hundred(200) meters of another fish corralin marine fisheries or one hundred(100) meters in fresh water fish­eries, unless they belong to the samelicenses or grantee, but in no caseshall the distance be less than sixty(60) meters apart, except in watersless than two (2) meters deep atlow tide, or unless previously.approved by the Secretary of NaturalResources.

(b) Fish corrals shall be entirely openedduring closed season period orperiods, for the free passage of fishesto enable a considerable number toreach the spawning grounds.

(c) Nothing in the license shall be con­strued as permitting the lessee orlicensee, grantee or permitee, toundertake any construction whichwill obstruct the free navigation inany stream or lake flowing through

or adjoining the fish corral, or im­pede the flow and ebb of the tide toand from the area, wherein the lesseeor licensee, grantee or permitee isgranted a fishery privilege.

(d) The licensee agrees unconditionallyto comply with all the laws, decrees,orders, rules and regulations govern­ing fishing law, or which may laterbe promulgated.

(e) The licensee assumed responsibilityfor any and all the acts of his agentsand employees of the contracts con­nected with his fishing operation.

(f) Failure to pay any fee or file a bondwhen due as prescribed in the per­mit, license, contract or regulationshall be sufficient reason for the can­cellation of the license, permit orcontract.

SEC. 15. SEPARABILITY CLAUSE.­Should any provision, section, or part ofthis Ordinance be adjudged or declaredillegal or unconstitutional by any court ofcompetent jurisdiction, each judgment shallnot aff'ect 'or impair the remaining provi­sions, sections or part which shall continueto be in force and effect.

SEC. 16. REPEALING CLAUSE.-AllOrdinances or provisions of Ordinanceswhich are inconsistent with this Ordinanceare hereby repealed.

SEC. 17. PENAL PROVISIONS.-Ex­cept as herein provided, violation of theprovisions of this Ordinance or portionthereof and upon conviction shall pay afine of not less than ONE THOUSAND(Pl,OOO.OO) PESOS nor more than FIVE THOU­SAND (P5,OOO.OO) PESOS or imprisonment ofnot less than ONE (1) MONTH· nor morethan SIX (6) MONTHS or both at the dis­cretion of the court.

SEC. 18. EFFECTIVITY.-This Ordi­nance shall take effect in accordance with
