Spring is well under way and registration for the 2016 NHLA Annual Convention has been open for several weeks. The purpose of this month’s letter is to encourage each and every member and friend to attend the 2016 NHLA Annual Convention & Exhibit Showcase. This year’s convention will be held October 5-7 at the Omni Shoreham Hotel in Washington, D.C. Not only is Washington a great venue, this year is extra special because we will be in Washington just one month before the 2016 Presidential Election.

I encourage you to attend the meeting for the three reasons: the people, the people and the people. This thought is grounded on the following reason. First and foremost, I will put the people that we do business with every day up against anyone, i.e., while we are all out to conduct good serious business, the people in the hardwood lumber industry are some of the nicest in the world. Again, I will put them up against anybody. Secondly, there is no other meeting where every corner of the hardwood lumber business is represented and every region is represented. You can come to the conven-tion and see customers, suppliers and vendors from all over the United States and the world. It is a networking gold mine and a great opportunity. Finally, the seminars and the people presenting them will provide take home value that you can apply to your business. Like I said, it is the people, the people and the people.

The headline event at the Opening Session for the 2016 NHLA Convention will include a joint presentation by Charles Krauthammer and Robert Reich, two of America’s most respected intellects. Charles Krauthammer is a Pulitzer Prize-winning syndicated columnist, author, political commentator and physician. Krauthammer’s award-winning weekly column is syndicated to more than 400 newspapers worldwide. Robert Reich is a political economist, professor, author and political commentator. Reich has been named one of Time Magazine’s most successful cabinet secretaries of the past centuries. Together, these two men will debate both sides of the upcoming Presidential election and the state of America. Given this year’s election landscape, this will be very interesting. There will also be seminars and educational opportunities that will bring value to you and your business.

I hope that each of you reading this article will attend. The NHLA Convention is the premier networking opportunity of the year in the hardwood lumber business and I encourage you to come and bring the key members of your team. The additional bonus is that this is an election year and this makes the Washington venue especially interesting and I look forward to seeing you there. Have you downloaded the Membership Directory app? More than 1,500 people already have and I personally encourage you to do so also.

May is Member Appreciation month and I want to personally thank our current members and past members for making this organization what it is today. We are a smaller, more consolidated group than what we were just a few years ago, but most of our membership has been continuous members for many years.

In fact, in 2016 we are welcoming our 12th 100 year plus member into the organization in Hartzell Hardwoods, Piqua, OH. (Be sure to check out their special video presentation at the 2016 Annual Convention & Exhibit Show-case). The longest tenure of membership belongs to T.T. Jones Corporation of St. Paul, Minn. who joined in July of 1902 and has maintained continuous membership since that time. I would like to extend a special thanks to T.T. RAISING OUR TAX FLAGBy Dana Cole, Executive Director Hardwood Federation

LEGISLATIVE LOG

The last time Congress enacted comprehensive reforms to the federal tax code was 1986 and Ronald Reagan was President. Since that time, tax preparation in the U.S.

has become a $75 billion industry, as tax payers wrestle with tax laws and requirements that are tweaked annually and are increas-ingly complex. So comprehensive tax reform is long overdue. Will it happen this year? The short answer is no. But the 2016 elections will bring a new President and a new Congress to the the table for serious discussion in 2017. It must be noted that a few very important tax reform measures did become law in 2015, including making permanent Sec. 179 deductions and the Research & Development Tax Credit. But in order to be prepared for a serious debate on more comprehensive

tax reform in the New Year, the Hardwood Federation Board of Directors formed a working group to help develop a policy platform about this very important issue. Why so early? Even though the election is still months away and the President and Congress won’t be sworn in until January of 2017, we strongly believe we need to start now . . . so we are prepared to enter into the discussion with an agreed upon set of policy recommenda-tions as soon as Congress begins the conversation. It is much better to be playing offense early in the game than defense when it is too late.

The Hardwood Federation Tax Reform Working Group met for the first time at the end of March and anticipates several more meetings before presenting its final recommendations to the

Hardwood Federation Board of Directors in September. While we can-not know at this time exactly what the final policies will look like, we are exploring several paths and options.

We do know that it is very important to continue to support current tax structures that encourage forest land owners to maintain their land as working forests; this includes preferential capital gains treatment for standing timber and landowner deductions for reforestation costs. This has been a priority for the federation for the last few years and will continue to be a part of our policy. However, we would also like to have recommendations for reform efforts that will support lumber mills, lumber yards and hardwood manufacturing facilities.

Some of the concepts we are considering for inclusion in our final policy position document include:

• Accelerated depreciation schedules including reform recommenda-tions that would reduce current inventory and reporting requirements regarding depreciation of parts and machinery;

• Exploring potential reforms that would positively benefit how com-panies value their inventory from a tax perspective and which capital accounting measures are used;

• Supporting existing and future efforts to lower the overall U.S. cor-porate tax rate and to protect current benefits related to S-Corp status;

• Limiting the scope of the Estate Tax and other federal tax provisions that have an inordinate impact on small and medium sized businesses.

This is by no means an exhaustive list, but it should give you some idea of what our thinking is. Our goal is to have finalized recommendations ready for participants of the September Hardwood Federation Fly-In to share with Members of Congress. VETERAN MEMBER PROFILE

Hartzell Hardwoods

The Hartzell Company was founded in 1875 when John T. Hartzell borrowed $25 from his uncle to go into the wagon business because he no longer wanted

to work on the family farm. He soon set up a sawmill to sup-ply the Oak and Ash lumber needed for his business. George W. Hartzell, his son, bought the company in 1900 and began specializing in Walnut lumber for the European market.

When a World War I embargo shut off lumber markets into Europe, Hartzell turned to production of walnut gunstocks and walnut airplane propellers for the war effort. Hartzell’s propeller manufacturing experience had a simple beginning, as the first blades were literally chopped out of glued-up walnut blocks with hatchets. During World War II, Hartzell again furnished many of the gunstocks that were used.

Over the last 20 years, Hartzell Hardwoods has experienced fast and dramatic growth by doubling kiln, steambox, and predryer capacity. They have built two high-tech Lumber Grading Sys-tems with width-sorting capabilities. In addition their market-ing base has continued to expand by diversifying heavily into the export market. Today, Hartzell exports its lumber through-out 40 countries in Europe, Asia, and the Middle East. They continue to diversify their market base as well as keeping the

advances in technology on the front burner, as they have char-acterized throughout their 140-year history. Jim Hartzell is the current CEO and he is the 5th generation of Hartzell’s to work at the company. The company has remained in the family since its inception and looks forward to welcome the 7th generation to the work fold very soon.

RULES CORNER

This month’s article, much like many of my articles, was initiated by a recently received question.

THE QUESTION: If a shipment of 8/4 FAS1Face and Better kiln dried is shipped to a customer and they claim there is too much warp/cup in the lumber, how would the NHLA Inspector handle this? Would you downgrade the lumber based on the areas of skip? Would the boards be reduced in thickness?

To answer this question, we need to reference several areas of the NHLA Rules Book. First, the NHLA Inspector would determine if the lumber was shipped and received as rough or surfaced. Then they would need to determine if the lumber was

intact and remained in the state it was shipped, with the exception of some surfaced boards used for testing purposes by the receiving company. If the entire shipment or a substantial part of the shipment had been surfaced, without the permission of the shipping company, the Inspector would deem the lumber to not be intact and remind both parties of the Sales Code, Article X, Inspection, where the buyer must hold the entire shipment intact to be inspected.

If the lumber was intact as it was shipped, then the Inspector would grade each piece using the NHLA Grading Rules. There are several areas that pertain to warp/cup in Select and Better lumber. The first is covered under the definition of a Cutting on page 9, paragraph 29, of the 2015 NHLA Rules Book. This is the

sentence from the paragraph that pertains to this issue: “In the grades of Selects and Better the entire board must be flat enough to surface two sides to standard surfaced thickness (for skip limitations, see page 58 under the rule “Clear-Face” Cutting Grade).”

There is another area in the Rules Book that also states the limits for FAS boards, page 15, paragraph 61 states that: “Warp and Cup shall be admitted if the entire board will surface two sides to standard surfaced thickness in accordance with the rules for lumber surfaced two sides, except that cupped or warped pieces 12” and wider are admitted if they can be ripped to produce two pieces each of which would grade FAS and meet this warp and cup requirement. The exception as to pieces 12” and wider shall not apply to contracts for lumber in special widths 10” and wider.” The major difference be-tween these two rules is the allowance for the 12” and wider pieces mentioned in the last sentence.

The two different Rules listed above have both mentioned standard surfaced thickness and the Rules for lumber surfaced two sides. The Rule they are mentioning is on page 58, under the heading of “The “Clear-Face” Cutting Grade” and it states: “Slight skips, chipped

or torn grain will be admitted on the better face of the required cuttings, the aggregate area not exceeding 6” long by the width of the piece in FAS; 12” long by the width of the piece in F1F and Selects;” The important thing to note here is that when it men-tions that the Selects and Better must surface two sides to standard surfaced thickness, there is some allowance for skip.

To wrap things up for this question, if the lumber is indeed intact and not surfaced, the NHLA Inspector would inspect the lumber based on the Standard Grades and apply all limitations listed. The Inspector would then determine, to the best of their ability, if the warp limitation (considering the skip allowance), was exceeded and if so, either grade the board as 1 Common or below based on the Cuttings being flat, or measure for thickness at the thinnest cut-ting used and determine if it is thick enough to be considered 8/4 (1 7/8” (1.875”) after kiln drying). This is a lot of information to absorb, but the Inspector must consider all of this when inspecting lumber as well as all of the other Rules involved.
