    AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 123

    “FEES” OF THE CODE OF THE BOROUGH OF LEONIA NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Leonia, as follows: Section 1. Chapter 123 “Fees” Article I “Schedule of Fees” Section 123-16 “Property Maintenance Inspection Certification (Chapter 212)” of the Code of the Borough of Leonia is amended and supplemented, as follows: §123-16 Property maintenance inspection certification (Chapter 212). A. Inspection fee three weeks prior to inspection date: $50.00. B. Inspection fee two weeks prior to inspection date: $75.00. C. Inspection fee one week prior to inspection date: $100.00. D. Re-inspection fee, per occurrence: $50.00 Section 2. Should any section, part or provision of this ordinance be held unconstitutional or invalid, such decision shall not affect the validity of this ordinance as a whole, or any other part thereof. Section 3. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. Section 4.     BOROUGH OF LEONIA ORDINANCE NO. 2020-11

    AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 136

    “FIRE PREVENTION” OF THE CODE OF THE BOROUGH OF LEONIA

    NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Leonia, as follows: Section 1. Chapter 136 “Fire Prevention” Article V “Uniform Fire Code” Section 136-23 “Fire Safety Permits and Fees” of the Code of the Borough of Leonia is amended and supplemented, as follows: §136-23. Fire safety permits and fees. A. The Fees for the following special inspections are hereby established: (1) Certificate of smoke detector and carbon monoxide alarm compliance: (a) Requests made more than ten business days prior to inspection: $50. (b) Requests made four to ten business days prior to inspection: $75. (c) Requests made fewer than four business days prior to inspection: $100. (d) Reinspection fee, per occurrence: $50. Sections A. (2) through (7) and B. remain unchanged.

    Section 2. Should any section, part or provision of this ordinance be held unconstitutional or invalid, such decision shall not affect the validity of this ordinance as a whole, or any other part thereof. Section 3. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

    BOROUGH OF LEONIA ORDINANCE NO. 2020-12

    AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 212

    “PROPERTY MAINTENANCE” OF THE CODE OF THE BOROUGH OF LEONIA

    NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Leonia, that Chapter 212 “Property Maintenance” of the Code of the Borough of Leonia is hereby amended and supplemented, as follows: Section 1. Chapter 212 “Property Maintenance” Article VIII “General Sanitation and Safety” Section 212-20 “Requirements for Multiple-Family, Mixed Occupancy and Nonresidential Buildings” of the Code of the Borough of Leonia is amended and supplemented, as follows: §212-20. Requirements for single-family, multiple-family, mixed occupancy and

    nonresidential buildings.

    All single-family, multiple-family, mixed occupancy and nonresidential buildings and their premises shall be kept free of nuisances or other conditions which may constitute health, safety or fire hazards for occupants, neighbors or the general public. The owner, operator or occupant of every such building and its premises shall, along with other responsibilities necessary to attain these objectives: Items A. – F. of §212-20 remain unchanged.

    Section 2.

    Chapter 212 “Property Maintenance” Article X “Occupancy in One-Family and Multiple-Family Dwellings” Section 212-27 “Minimum Floor Area Per Occupant” of the Code of the Borough of Leonia is amended and supplemented, as follows:

    §212-27. Minimum floor area per occupant. Every dwelling unit having its own cooking facilities and shall contain bedrooms that can house two (2) individuals and any child under the age of four (4). Section 3.

    Chapter 212 “Property Maintenance” Article XI “Inspection Certificates” Section 212-32 “When Required” of the Code of the Borough of Leonia is amended and supplemented, in its

    entirety, as follows:

    §212-32. When required. A. Residential structures.

    1. When required. No owner or operator of a single-family or a multiple-family dwelling shall permit the occupancy of a dwelling unit by a tenant not previously occupying said dwelling unit without first obtaining an inspection certificate from the Public Officer. All inspections required hereunder shall be made within 10 days after receipt of a written request from the owner or operator.

    2. When not required. No inspection certificate shall be required:

    (a) For 12 months after issuance of a certificate of occupancy for a new dwelling unit, unless the dwelling unit is sold within the 12 month period.

    (b) When an existing tenant remains in the same dwelling unit under a new

    lease or as a holdover.

    3. Resale only certificates may be issued provided that a notarized letter is received from a purchaser’s attorney that the dwelling will not be occupied until an inspection certificate pursuant to this Chapter or a certificate of occupancy has been issued.

    B. Commercial structures.

    1. When required. No owner or operator of a commercial structure shall permit the occupancy of a commercial structure by a tenant not previously occupying said commercial structure without first obtaining an inspection certificate from the Public Officer. All inspections required hereunder shall be made within 10 days after receipt of a written request from the owner or operator.

    2. When not required. No inspection certificate shall be required:

    (a) For 12 months after issuance of a certificate of occupancy for a new commercial structure, unless the commercial structure is sold within the 12 month period.

    (b) When an existing tenant remains in the same commercial structure under a

    new lease or as a holdover.

    Chapter 212 “Property Maintenance” Article XVI “BOCA National Property Maintenance Code” of the Code of the Borough of Leonia is amended and supplemented, in its entirety, as follows:

    Article XVI. International Property Maintenance Code

    §212-51. Adoption. The International Property Maintenance Code 2018 is hereby adopted as a supplement to Chapter 212 of the Borough of Leonia. Three copies of this Code will be kept on file in the Office of the Borough Clerk. The International Property Maintenance Code 2018, as may be further amended and supplemented, and Chapter 212 will control buildings and structures within the Borough of Leonia, and regulate and provide conditions and terms of property maintenance, and that Code as referred to herein is adopted and made a part of as if fully set forth in this article, with the amendments set forth herein. All references in the Code to “jurisdiction” shall mean the Borough of Leonia.

    §212-52. Supplementary nature of International Property Maintenance Code. The provisions of §212-1 et seq. be and same are supplemented by the adoption of this article and not replaced. Section 5. Should any section, part or provision of this ordinance be held unconstitutional or invalid, such decision shall not affect the validity of this ordinance as a whole, or any other part thereof. Section 6. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. Section 7.   • BOROUGH OF LEONIA BERGEN COUNTY, NEW JERSEY

    Date: May 4, 2020 RESOLUTION NO. 2020-113

    Resolution Establishing the Rate of Interest for Delinquent Taxes

    WHEREAS, N.J.S.A. 54:4-67a permits the governing body by resolution to fix the rate of interest to be charged for the nonpayment of taxes, assessments, or other municipal liens or charges, on or before the date when they would become delinquent; and WHEREAS, the statute fixes the rate of interest cannot exceed 8% per annum on the first $1,500.00 of the delinquency and 18% per annum on any amount in excess of $1,500.00, to be calculated from the date the tax was payable until the date that actual payment to the tax collector is made; and WHEREAS, the Borough of Leonia, on April 20, 2020, adopted Resolution 2020-110 setting the Rate of Interest for Delinquent Taxes at 0.000001% for the first $1,500.00 of delinquency, and 0.000001% on any amount of taxes in excess of $1,500.00; and WHEREAS, on April 29, 2020, New Jersey Governor Philip D. Murphy issued Executive Order 130, which permitted municipal governments to extend the grace period for second quarter tax payments from May 1, 2020 to not later than June 1, 2020, and WHEREAS, Executive Order 130 also contains a provision stating, in part, that “No municipality, county, or any other agency or political subdivision of this State shall enact or enforce any order, rule, regulation, ordinance, or resolution that will or might in any way conflict with any of the provisions of this Order, or that will in any way interfere with or impede its achievement, which shall include, but not be limited to, any attempt to provide an additional extension of the installment date or grace period for the payment of property taxes, and any attempt to otherwise temporarily fix, reduce, or retroactively modify the rate of interest charged for failure to make timely payment to achieve this effect,” and WHEREAS, the Borough of Leonia does not believe that the Governor’s Executive Order 130 is in the financial best interests of the taxpayers of the Borough of Leonia, because extending the grace period would require the Borough of Leonia to issue Tax Anticipation Notes in order to ensure proper cash flow, thereby requiring the taxpayers of the Borough of Leonia to pay additional taxes to serve such debt, and because the Executive Order does not permit municipalities to choose the option of lowering interest rates on property taxes, and, WHEREAS, in spite of the fact that the Borough of Leonia does not believe that the Governor has the constitutional authority to unilaterally negate an existing Statute which does not expressly concern itself with the health and/or safety of the residents of the State of New Jersey, the Borough of Leonia does not wish to expend taxpayer dollars on legal challenges,

    Date: May 4, 2020 RESOLUTION NO. 2020-113

    NOW THEREFORE, BE IT RESOLVED, by the governing body of the Borough of Leonia in the County of Bergen, that the rate of interest for taxes unpaid after May 10, 2020 is fixed at eight percent (8%) on the first $1,500.00 of delinquency and eighteen percent (18%) per annum on any amount of taxes in excess of $1,500.00, effective May 4, 2020; and BE IT FURTHER RESOLVED, by the governing body of the Borough of Leonia in the County of Bergen that the Borough is increasing the interest rate based solely on the requirements contained in New Jersey Governor Philip D. Murphy’s Executive Order 130, specifically the provision negating the municipality’s ability to assist its taxpayers by reducing the interest rate for delinquent tax payments, and BE IT FURTHER RESOLVED, by the governing body of the Borough of Leonia in the County of Bergen that we urge Governor Murphy to consider, in the event that any similar Executive Orders are issued in the future, the ability for municipal governments to continue their ability to reduce the interest rate on delinquent property taxes, rather than simply extending the grace period for tax payments, in order to allow municipal governments the maximum flexibility possible to assist their taxpayers, while ensuring that they are continuing to operate their municipal government in a fiscally responsible manner, and BE IT FURTHER RESOLVED, that the rate of interest for taxes unpaid shall be calculated from date of the quarterly payment until the date of actual payment; and BE IT FURTHER RESOLVED, this Resolution shall be published in its entirety once in the official newspaper of the Borough of Leonia and a copy of this adopted Resolution forwarded to the Division of Local Government Services in the Department of Community Affairs, to Governor Philip D. Murphy, and to Lieutenant Governor Sheila Oliver. I hereby certify that the above resolution was duly adopted by the Mayor and Council of the Borough of Leonia at a meeting of said Borough Council on May 4, 2020.

    Date: May 4, 2020 RESOLUTION NO. 2020-114

    Resolution Calling on Residents and Businesses to Honor Frontline

    Healthcare Workers of the COVID-19 Crisis & #LightTheFight. WHEREAS, the Coronavirus (aka, SARS-CoV-2) causes the disease COVID-19, which has been declared a global pandemic by the World Health Organization; WHEREAS, the COVID-19 pandemic has impacted the lives of every resident of State of New Jersey and Borough of Leonia WHEREAS, Coronavirus is highly contagious, and can be deadly. Approximately 20 percent of those infected with Coronavirus require hospitalization, and five percent require critical care according to the CDC; WHEREAS, frontline healthcare workers, including doctors, nurses, respiratory therapists, paramedics, EMTs, and support staff, put themselves at risk to care for Coronavirus patients; WHEREAS, shortages of healthcare workers to care for patients in this unprecedented crisis demands that many work extra shifts, in difficult conditions, away from their families, at all times of the day and night and on holidays; WHEREAS, this service, all for the selfless benefit of the community, can place healthcare workers in harm’s way and at personal risk; WHEREAS, it is important to recognize the enormity of the day-to-day sacrifices and heroism of our healthcare workers in hospitals, skilled nursing facilities, urgent care sites, ambulances, and testing centers; WHEREAS, many residents and businesses in the Borough of Leonia would like to shine a light on the tireless dedication, bravery, and service of health care workers during the COVID-19 pandemic. ; WHEREAS, communities across the State of New Jersey are encouraging residents and businesses to “Light The Fight,” where all of our communities can celebrate the heroism of our healthcare workers by hanging a string of lights, or placing bright lanterns or flameless candles in front of their homes or places of business;

    Date: May 4, 2020 RESOLUTION NO. 2020-114

    WHEREAS; the lights reflect the appreciation we feel towards our heroic health care workers— letting them know how grateful we are for their dedication to the health and well-being of our communities. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Leonia recognize all frontline healthcare workers as “Healthcare Heroes” for their dedicated heroism and bravery and for going to work to fight Coronavirus and COVID-19; BE IT FURTHER RESOLVED, that all residents and businesses in the Borough of Leonia are encouraged to hang a string of lights, or place bright lanterns or flameless candles in front of their property, in their front window, or elsewhere on their property; BE IT FURTHER RESOLVED, that all residents and businesses are encouraged to take photos of their lights and post them to social media with the hash tag “#LightTheFight” to let our Healthcare Heroes know that we are standing behind them; BE IT FURTHER RESOLVED, that the Borough of Leonia shall display lights on Borough Hall for the duration of the State of Emergency and a Public Health Emergency declared pursuant to Governor Phil Murphy’s Executive Orders 103 and 119.

  • BOROUGH OF LEONIA BERGEN COUNTY, NEW JERSEY

    Date: May 4, 2020 RESOLUTION NO. 2020-115

    WHEREAS, the collective negotiations agreement between the Borough of Leonia (“Borough”) and Leonia PBA Local No. 381 (“PBA”) expired on December 31, 2019; and

    WHEREAS, the Borough and the PBA have been negotiating the terms to a successor collective negotiations agreement; and

    WHEREAS, the Borough and the PBA have negotiated and agreed upon the terms to a successor collective negotiation agreement set forth in the Memorandum of Agreement attached hereto as Exhibit A; and

    WHEREAS, the Memorandum of Agreement was executed and ratified by the PBA on January 17, 2020; and

    WHEREAS, the Borough of Leonia is desirous of ratifying the agreed upon terms to the successor collective negotiations agreement set forth in the Memorandum of Agreement dated January 17, 2020; and

    THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Leonia, in the County of Bergen and State of New Jersey that the Memorandum of Agreement executed and ratified by the PBA on January 17, 2020 for the period from January 1, 2020 through December 31, 2023 is hereby ratified.

  • MEMORANDUM OF AGREEMENT BETWEEN THE

    BOROUGH OF LEONIA

    AND

    LEONIA PBA LOCAL NO. 381

    The negotiation committees of the Borough of Leonia and Leonia PBA Local No. 381 agree to the terms of this Memorandum of Agreement as set forth below:

    ARTICLE III PROMOTIONS

    Delete in its entirety.

    ARTICLE IX SALARIES

    1. Increases across the board to the salary guides A-1 through A-3: January 1, 2020 – 2% January 1, 2021 – 2% January 1, 2022 – 2% January 1, 2023 – 2% 2. Section B – Modify as follows: There shall be one (1) year in between each step represented in the salary guides; A-1 through A-3. Officers move through the guide on a year basis based upon their anniversary date of hire.

    ARTICLE X

    HOURS AND OVERTIME

    1. Section A, 3rd Paragraph – Add the following language: Half of an officers Kelly time shall be used during the first half of the calendar year and the remaining Kelly time shall be used during the second half of the calendar year.

    ARTICLE XVII MEDICAL COVERAGE AND INSURANCE BENEFITS

    1. Section A – Delete and replace with the following:

  • Employees shall be afforded health benefits by the New Jersey State Health Benefits Plan. Additionally, co-pays and deductibles are as set by the New Jersey State Health Benefits Plan. The Borough shall provide for insurance to employees of the Police Department covered under this Agreement who are on normal full-time or disability retirement, as well as each such retired member’s spouse. If the retired member of the Police Department is employed following his retirement, and similar type of insurance coverage is available to the retired Employee by virtue of said employment, or if the retired Employee is covered by similar insurance of the spouse of the retired Employee, there shall be no obligation on part of the Borough to provide for the coverage heretofore mentioned. The obligation of the Borough to provide health benefits shall terminate upon the retired Employee becoming eligible for “Medicare” or if the retired Employee accepts full time employment following his retirement from the Police Department of the Borough. 2. Section C – Delete the following language: “Employee contributions will be made in accordance with P.L. 2011 c.78.” and replace with the following: “Employees and retirees shall be required to contribute to his/her health benefits in accordance with the Tier IV rates set forth in Chapter 78. P.L. 2011”. 3. New Section E – Officers whom enroll in the Horizon OMNIA health Plan for Year 2020 for the first time and participate in the plan for at least one year will be eligible to receive an incentive payment of $1000. The incentive will be issued no later than the end of the tax year of the enrollment effective date (by December 31, 2020, for a January 1, 2020 effective date), and is reportable as taxable income. The incentive will be forfeited and returned to the Borough of Leonia if the officer is not enrolled for at least one (1) plan year.

    ARTICLE XIX SICK TIME

    1. New Section 6 – Officers hired on or after January 1, 2020 shall be afforded fifteen (15) sick days that may accumulate from year to year. Upon retirement, the employee will be afforded a payout of a maximum of $15,000 or any new statutory limit. Additionally, sick time shall be prorated during the last year of employment.

    EXTRA DUTY RATE SET FORTH IN BOROUGH CODE:

    Total charge of $150 per hour, broken down with $100 to the officer and $50 to the

    Borough for administrative fees. The Borough Ordinance will be required to be modified

    prior to this implementation.

    IN ACCORDANCE WITH THE PREVIOUS SETTLEMENT AGREEMENT BETWEEN

    THE PARTIES, DOCKET NO. AR-2019-285, THE LANGUAGE ON PRORATION OF

    LEAVE TIME SHALL BE INPUTTED INTO THE SUCCESSOR COLLECTIVE

    NEGOTIATIONS AGREEMENT IN LIEU OF ALWAYS HAVING TO REFER TO THE

    SETTLEMENT AGREEMENT ON PRORATION OF LEAVE TIME DURING THE LAST

    YEAR OF EMPLOYMENT.

    The parties acknowledge that the terms and conditions are subject to ratification by the Borough of Leonia and Leonia PBA Local No. 381. All parties agree to recommend these terms and conditions to their respective constituents for ratification. All proposals which are not included in this Memorandum of Agreement shall be deemed withdrawn by both parties. In witness whereof, this Memorandum of Agreement is executed on January ___, 2020. 17
