I. CANNAN ELECTRICIreland Cannan is a licensed Electrical Contractor operating in the San Francis-co Bay Area. Raised in Marin County, he has 20 years experience in the electri-cal field. Working initially as an apprentice electrician for Hannibal’s Inc. in San Rafael, Ireland learned to troubleshoot complex wiring problems. In time Ireland accepted a job with T.O.E.O.E. as a journeyman electrician working on several high-end residential projects.

In 1997, he started his own electrical service business, I. Cannan Electric (ICE), specializing in residential projects, service upgrades, and electrical repairs. I. Cannan Electric is also Green Business Certified.

By 2003, due to positive feedback and a growing network of referrals, Ireland decided to add a few highly skilled electricians to the payroll in order to satisfy increasing demand.

Although the ICE has increased from its original single man operation, we still remain relatively small to ensure a level of quality and customer satisfaction our customers can depend on. Ireland has been an active member of the Marin Builders Association since 2002 and appreciates the opportunities afforded him because of the services and benefits the Association provides.

Also In This Update• New Bill Start to Trickle In

Update On New Hire Law Problem

In last week’s update, I wrote about the new hire law (which took effect on January 1st) and the problems it is causing employers. I just received confirmation of a conference call next Thursday morning between the Labor Commissioner’s office, myself, and all of my colleagues (including Bob Roginson) who have been working to resolve the problems. Keep your fingers crossed that next week’s call will find the solutions. As always, you’ll be the first to know and have the latest information at your finger tips. Stay tuned!

New Bills Begin To Trickle In

The commencement of the second year of the two-year session means that new bills are being introduced daily. Following are a couple that should get your attention!

Remember, the introduction of a new bill only notes the ‘start of the fun!’ While the first one, AB 1514 is intended to ‘go after’ excavators that don’t call before excavating, the second one, AB 1508 is trying to go after metal thefts. Unfortunately, while well-intentioned, this could become a royal pain, too! Your thoughts and suggestions would be appreciated.

Summary Digest

Existing law generally requires any person planning to conduct anexcavation to contact a regional notification center prior toexcavation, and, if practical, to delineate the areas to beexcavated. Existing law authorizes the Attorney General, a districtattorney, or the state or a local agency that issued a permit to

excavate to bring an action for the enforcement of a civil penaltyagainst an operator or excavator who negligently or knowingly andwillfully violates these and related provisions. This bill would also authorize the Public Utilities Commission tobring an action for enforcement pursuant to the provisions describedabove.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:SECTION 1. Section 4216.6 of the Government Code is amended to read:4216.6. (a) (1) Any operator or excavator who negligently violates this article is subject to a civil penalty in an amount not to exceed ten thousand dollars ($10,000).(2) Any operator or excavator who knowingly and willfully violates any of the provisions of this article is subject to a civil penalty in an

amount not to exceed fifty thousand dollars ($50,000).

(3) Except as otherwise specifically provided in this article, this section is not intended to affect any civil remedies otherwise provided by law for personal injury or for property damage, including any damage to subsurface installations, nor is this section intended to create any new civil remedies for those injuries or that damage.

(4) This article shall not be construed to limit any other provision of law granting governmental immunity to state or local agencies or to impose any liability or duty of care not otherwise imposed by law upon any state or local agency.(b) An action may be brought by the Attorney General, the district attorney, the Public Utilities Commission, or the local or state agency which issued the permit to excavate, for the enforcement of the civil penalty pursuant to this section. If penalties are collected as a result of a civil suit brought by a state or local agency for collection of those civil penalties, the penalties imposed shall be paid to the general fund of the agency. If more than one agency is involved in enforcement, the penalties imposed shall be apportioned among them by the court in a manner that will fairly offset the relative costs incurred by the state or local agencies, or both, in collecting these fees.

AB 1508, as introduced, Carter. Vehicles: inspection of loads. Summary Digest

(1) Existing law authorizes the Department of the California Highway Patrol to stop a vehicle transporting timber products,livestock, poultry, farm produce, crude oil, petroleum products, or inedible kitchen grease and

inspect certain documents to determine whether the driver is in legal possession of the load, and, upon reasonable belief that the driver of the vehicle is not in legalpossession, to take custody of the vehicle and load, as prescribed, and imposes duties on the sheriff with respect to the care and safekeeping of those products. This bill would additionally authorize a member of a city police department or a member of a county sheriff’s office, whose primary responsibility is to conduct theft investigations, to stop any vehicle, and would make those provisions applicable with regard to a vehicle that is transporting metal products or metal alloy products. By imposing additional duties on a sheriff regarding the care and safekeeping of metal products and metal alloy products, this bill would impose a state-mandated local program. The bill additionally would authorize a member of a city police department and a member of the county sheriff’s office, whose primary responsibility is to conduct theft investigations, to stop and inspect vehicles transporting any of those loads.

(2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions. Vote: majority. Appropriation: no. Fiscal committee: yes.State-mandated local program: yes.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 2810 of the Vehicle Code is amended to read:

2810. (a) A member of the Department of the California Highway Patrol, a member of a city police department whose primary responsibility is to conduct theft investigations, or a member of a county sheriff’s office whose primary responsibility is to conduct theft investigations may stop any vehicle transporting any timber products, livestock, poultry, farm produce, crude oil, petroleum products, metal products, metal alloy products, or inedible kitchen grease, and inspect the bills of lading, shipping or delivery papers, or other evidence to determine whether the driver is in legal possession of the load, and, upon reasonable belief that the driver of the vehicle is not in legal possession, shall take custody of the vehicle and load and turn them over to the custody of the sheriff of the county in which the timber products, livestock, poultry, farm produce, crude oil, petroleum products, metal products, metal alloy products, or inedible kitchen grease, or any part thereof of those loads, is apprehended.

(b) The sheriff shall receive and provide for the care and safekeeping of the apprehended timber products, livestock, poultry, farm produce, crude oil, petroleum products, metal products, metal alloy products, or inedible kitchen grease, or any part thereof of those loads, and immediately, in cooperation with the department, proceed with an investigation and its legal disposition.

(c) Any expense incurred by the sheriff in the performance

of his or her duties under this section shall be a legal charge against the county.

SEC. 2. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.

Kalb's Q&A for Contractors By David Kalb, President of Capitol Services, Inc.

We have been busy at Capitol Services helping con-tractors discover new opportunity in Nevada and Arizona, a ‘rush’ that is reflected in recent news of their leading the nation in state population growth over the last decade. Meanwhile, licensed contractors may find greater opportunity within the borders of California as government focuses on creating a ‘level’ playing field by cracking down on the unlicensed operators ‘bending’ the rules…

The CSLB Enforcement Committee met in Sacramento last week to discuss a wide variety of topics related to contractors and the construction industry. Of particular note was their emphasis on increasing proactive en-forcement aimed at the underground economy.

The Contractors Board will be stepping up partnering with other state agencies including the Employment Development Department (EDD) and Department of Industrial Relations (DIR), among others. The focal point will be the newly created DIR Labor Enforcement Task Force (LETF), which was launched on January 1st. According to the DIR, “this is a collaborative ef-fort between state agencies to combat the underground economy and to improve California’s business environ-ment where legitimate employers can thrive.”

The primary partners of the LETF include DIR, the Em-ployment Development Department, Contractor’s State License Board, Board of Equalization, and the Bureau of Automotive Repair. “The goal of LETF is to ensure fair and safe working conditions in all workplaces and promote a level playing field for employers through education and enforcement of state laws,” said Labor and Workforce Agency Secretary Marty Morgenstern. “Labor law violators endanger workers and have an un-fair market advantage over law-abiding businesses”. The goals of the task force will be to:

fines due from employers; 3) Make efficient use of state and federal resources in carrying out the mission of the Labor Enforcement Task Force; and 4) Eliminate unfair business competition by ‘leveling the playing field’ so that employers who comply with the law do not have to compete with employers who break the law. Accord-ing to DIR Director, Christine Baker, “By joining forces with other agencies conducting inspections, we can have a greater impact on stopping labor violations and the underground economy. Collaboration will also save time and money by avoiding overlapping inspections and focusing our efforts on the egregious violators.”

According to the DIR, and echoed by the CSLB, busi-nesses operating underground typically violate many laws designed to protect workers and our state’s econo-my. These include: not paying income taxes, unemploy-ment insurance or disability insurance; not carrying (or under-reporting) Workers Compensation coverage; not paying proper wages; and not registering for required licenses or permits. These underground operators sub-sequently pay lower overhead costs, which give them an unfair competitive advantage over legitimate, law-abid-ing businesses.In addition to discussing the goals of the LETF, the Enforcement Committee heard from the Chief of EDD’s Compliance Development Operations, Dan Kurttila, who emphasized their commitment to the construction industry and the Board’s strategic objective to combat the underground economy.

Mounting or dismounting a large truck or piece of equipment without hurting your-self seems simple, but many accidents involve this type of injury. The best way to prevent falling while getting into or out of a truck, tractor cab or heavy equip-ment is to follow the three-point contact system.

The Three-Point Contact SystemThree-point contact is exactly that: three of your four limbs are in contact with the vehicle at all times. That can be two hands and one foot, or two feet and one hand.

No matter what type of access system your vehicle or equipment has available, the three-point system will significantly reduce the chance of a slip or fall be-cause it allows you to maintain maximum stability and support when entering and exiting the equipment. The three points work to form a triangle, distributing your body’s weight at the center.

Remember, the only person who can pre-vent a fall is you. Here are some simple dos and don’ts to follow when entering or exiting a large vehicle or other construc-tion equipment to avoid injury.

Dos • Always exit and enter your ve-hicle facing the cab. • Slow down and use extra caution in bad weather. • Get a firm grip on rails or han-dles with your hands.

• Use parts designed by the manufacturer for mounting and dismount-ing. This includes steps, running boards, traction strips, footholds, handgrips, etc. • Look below for obstacles on the ground before exiting. • Wear safe non-slip shoes with good support.• Clean your shoes off; mud, grease and oil can cause you to slip.• Inspect hand holds and ladders/rungs to ensure they are in good condi-tion. • Only climb on and off when the equipment is stationary.

Don’ts • Never carry anything with your free hand when mounting or dismount-ing. Put the object on the vehicle floor and reach up for it when you get down on the ground. • Don’t rush to climb out of your vehicle or machinery after a long period of sitting. Climb down slowly to avoid straining a muscle or losing your bal-ance. • Never jump out of construction equipment or vehicles. You may land off balance or on an uneven surface and fall. • Don’t use tires, wheel hubs or machine tracks as a step surface. • Do not use door frames, door edges or door handles as a handhold.

Familiarize yourself with these dos and don’ts, and always maintain three-point contact when entering or exiting a large truck or heavy construction equipment.
