    4 Data formats: We recommend delivery of: PDF high-resolution (X3 Standard or X4 Standard, other options upon request). Our support department can provide the PDF settings for InDesign. Image formats: TIFF, EPS or JPG (CMYK, final resolution 240–300 dpi), line art at least 600 dpi. Open typesetting data (e.g. InDesign, Quark Xpress) after consultation. The file must be printable: all fonts used must be embedded.

    5 Colours: Print colours (CMYK) according to ISO 12647-2 (PSO), special colours possible by arrangement.

    6 Proof: Colour-binding proof according to “Print Media Standard” (bvdm). In order to verify colour accuracy, digitally prepared pre-prints must contain the FORGA Media Wedge (can be obtained for a fee at www.forgra.org). Proofs must include an official print control strip. Colour prints and copies are not suitable for use as contract proofs!

    7 Data archiving: As data are archived, reinsertions of unchanged data are gene-rally possible. However, we cannot assume any data guarantee.

    8 Warranty: If incomplete or deviating data (texts, colours, images) are delivered, we shall not accept liability for the printed result. Incorrect exposure due to fragmentary o r d e f e c t i -ve files, wrong settings or incomplete information will be invoiced. This also applies to additional typesetting or re-production work as well as to the creation of faulty proofs.

    General terms and conditions for advertisements and third-party inserts in newspapers and magazines

    Section 1 Within the meaning of the following terms and conditions, an “advertising order” is a contract for the publication of one or more advertisements of an advertising agency or other advertiser in a printed medium for the purposes of distribution.Section 2 In case of doubt, advertisements must be released for publication within one year after the conclusion of the contract. If the right to call for individual advertisements has been reserved under the terms of the advertising order, the order must be carried out within a period of one year from the publication of the first advertisement, if the first advertisement was submitted and published within the time period designated under Section 1. Section 3 If an order has been placed, the customer shall also be entitled, within the agreed time period or the time period mentioned in Section 2, to submit additional advertisements beyond the quantity mentioned in the order.Section 4 If an order is not fulfilled due to circumstances for which the publisher is not responsible, then the customer shall be entitled, notwithstanding any further legal obligations, to reimburse the publisher the difference between the discount granted and the discount actually accepted. The obligation to reimburse shall no longer apply if the order could not be executed due to an act of God within the sphere of responsibility of the publisher.Section 5 For the purpose of calculation quantities, millimetres of text will be converted into advertising millimetres based on price. Section 6 Orders for advertisements and third-party inserts, which the advertiser expressly wishes to appear in certain issues, certain editions, or in specific positions in the printed title, must reach the publisher in good time for the customer to be notified prior to the closing date in the event that the order cannot be executed in the desired manner. Classified advertisements will be printed in the relevant category without the need for express agreement.Section 7 Text advertisements are any advertisements bordered by editorial text on at least three sides and not by any other advertisements.Advertisements that because of their editorial design are not recognisable as such will be made more clearly distinguishable by the publisher adding the word „advertisement“.Section 8 The publisher retains the right to decline advertising orders – including individual requests for placement in conjunction with an executed contract - and orders for inserts, because of content, origin, or technical form in accordance with the publisher‘s uniform, objectively justified principles, if the content violates the law or the regulations of government or other authorities, or if their publication cannot be reasonably expected of the publisher. This shall also apply to orders placed at external offices, agencies, or representative offices. Orders for inserts shall be considered binding by the publisher only upon presentation of a specimen of the insert and subsequent approval thereof. Inserts which through their format or presentation give the impression of being a part of the magazine or newspaper, or which contain advertisements by third parties, will not be accepted.The customer must be informed immediately of the rejection of an order. Section 9 The customer shall be solely responsible for the timely delivery of advertising copy and for proper printing material. In the event of clearly unsuitable or damaged printing material, the publisher shall immediately request replacement. The publisher shall guarantee the printing quality normal for the attached titles within the context of the possibilities given by the printing documents. Section 10 In the case of illegible, incorrect or incomplete printing of the advertisement, in whole or in part, the customer shall be entitled to a reduction in payment or to a correct substitute advertisement, but only to the extent that the purpose of the advertisement has been impaired. If the publisher fails to meet these conditions within a reasonable time limit set for this purpose or if the substitute advertisement should again be incorrect, the customer shall have the right to a reduction in price or to withdraw from the contract.Indemnity claims from positive breach of obligation, negligence in contracting and tort are excluded - including in the case of orders placed by telephone. Indemnity claims from impossibility of performance and default are restricted to the replacement of the foreseeable loss and to the remuneration to be paid for the advertisement or advertising supplement in question. This does not apply in the case of intent or gross negligence on the part of the publisher, its legal representatives and its vicarious agents. A liability of the publisher for damages owing to the lack of warranted qualities remains unaffected.Furthermore, the publisher is not liable for gross negligence of vicarious agents in commercial business transactions; in the remaining cases, the liability towards merchants for gross negligence is restricted in its extent to the foreseeable damage up to the amount of the remuneration for the advertisement in question. Complaints – with the exception of defects that are not obvious - must be put forward within four weeks of receiving the invoice and receipt.

    Section 11 Proofs shall be delivered only when expressly requested. The customer shall bear the responsibility for the correctness of the returned proofs. The publisher shall take into account all error corrections of which it shall be informed within the period set at the time of forwarding the proofs.Section 12 If no specific size is stipulated, the actual print size customary for the type of advertisement will be used as a basis for invoicing.Section 13 In the event that the advertiser does not make an advance payment, the invoice will be sent immediately, if possible, however, 14 days after the publication of the advertisement.The invoice is to be paid within the period evident from the price list, beginning from the time of receipt of the invoice, unless, in individual cases, another method of payment has been agreed upon or an advance payment has been made. Any discounts for advance payment shall be granted in accordance with the price list.Section 14 Interest and collection expenses will be charged if there is a delay in payment or a deferral. In the event of default, the publisher may postpone further execution of the current order until payment has been made and request advance payment for the remaining advertisements.If there is reasonable doubt regarding the customer’s ability to pay, the publisher is entitled, even during the term of the transaction, to make the publication of further advertisements dependent upon advance payment of the amount charged and settlement of unpaid bills, regardless of previously agreed terms of payment. Section 15 Upon request, the publisher shall deliver a specimen of the advertisement with the invoice. Depending on the type and size of the advertisement, the specimens shall be delivered as clippings, entire pages or entire issues. If a specimen can no longer be procured, a legally binding certification from the publisher regarding the publication and distribution of the advertisement shall serve as a substitute.Section 16 The customer shall bear the costs for the production of ordered printing data and drawings or for considerable changes in previously determined versions, which the advertiser may request or be responsible for.Section 17 In the case of a transaction involving several advertisements, a claim to a reduction in price may result from a reduction in the circulation if the total average circulation in the insertion year, beginning with the first adver-tisement, is less than the average amount stated in the pricelist or otherwise, or – if no circulation amount is stated – is less than the average circulation of issues sold (for trade journals, this can also be the average number actually distributed) in the previous calendar year. A reduction in circulation shall grant the right to a price reduction only if it amounts to 20 % for a circulation of up to 50,00015 % for a circulation of up to 100,00010 % for a circulation of up to 500,0005 % for a circulation of more than 500,000Claims to price reductions are excluded, however, if the publisher has informed the customer of the drop in circulation in due time for the customer to withdraw from the contract.Section 18 In the case of box number advertisements, the publisher shall exercise the due care of a responsible businessman for the keeping and timely forwarding of the offers received. Registered and express letters as response to box number advertisements shall be forwarded with regular mail only. Replies to box number advertisements shall be retained for four weeks. Replies which are not collected within this period shall be destroyed. The publisher shall return valuable documents without being obliged to do so. To prevent misuse of the box number advertisement service, the publisher reserves the right, for inspection purposes, to open incoming offers as a representative on behalf of, and in the declared interests, of the customer. The publisher is not obliged to forward business proposals or agency offers. Section 19 Printing data shall be returned to the customer only if expressly requested. The obligation to retain this material shall end three months after the order has expired.Section 20 The place of fulfilment is the principal place of business of the publisher. Insofar as claims of the publisher are not put forward by collection procedure, the place of jurisdiction for non-traders shall be determined according to their place of residence.It shall be agreed that the place of jurisdiction shall be the principal place of business of the publisher if the place of residence or customary place of abode of the customer, including non-traders, is unknown at the time that the legal proceedings are instituted or if the customer’s place of residence or customary place of abode should be moved outside the purview of the law after closing the contract.

    General terms and conditions for advertisements and third-party inserts in newspapers and magazines

    Section 1 Within the meaning of the following terms and conditions, an “advertising order” is a contract for the publication of one or more advertisements of an advertising agency or other advertiser in a printed medium for the purposes of distribution.Section 2 In case of doubt, advertisements must be released for publication within one year after the conclusion of the contract. If the right to call for individual advertisements has been reserved under the terms of the advertising order, the order must be carried out within a period of one year from the publication of the first advertisement, if the first advertisement was submitted and published within the time period designated under Section 1. Section 3 If an order has been placed, the customer shall also be entitled, within the agreed time period or the time period mentioned in Section 2, to submit additional advertisements beyond the quantity mentioned in the order.Section 4 If an order is not fulfilled due to circumstances for which the publisher is not responsible, then the customer shall be entitled, notwithstanding any further legal obligations, to reimburse the publisher the difference between the discount granted and the discount actually accepted. The obligation to reimburse shall no longer apply if the order could not be executed due to an act of God within the sphere of responsibility of the publisher.Section 5 For the purpose of calculation quantities, millimetres of text will be converted into advertising millimetres based on price. Section 6 Orders for advertisements and third-party inserts, which the advertiser expressly wishes to appear in certain issues, certain editions, or in specific positions in the printed title, must reach the publisher in good time for the customer to be notified prior to the closing date in the event that the order cannot be executed in the desired manner. Classified advertisements will be printed in the relevant category without the need for express agreement.Section 7 Text advertisements are any advertisements bordered by editorial text on at least three sides and not by any other advertisements.Advertisements that because of their editorial design are not recognisable as such will be made more clearly distinguishable by the publisher adding the word „advertisement“.Section 8 The publisher retains the right to decline advertising orders – including individual requests for placement in conjunction with an executed contract - and orders for inserts, because of content, origin, or technical form in accordance with the publisher‘s uniform, objectively justified principles, if the content violates the law or the regulations of government or other authorities, or if their publication cannot be reasonably expected of the publisher. This shall also apply to orders placed at external offices, agencies, or representative offices. Orders for inserts shall be considered binding by the publisher only upon presentation of a specimen of the insert and subsequent approval thereof. Inserts which through their format or presentation give the impression of being a part of the magazine or newspaper, or which contain advertisements by third parties, will not be accepted.The customer must be informed immediately of the rejection of an order. Section 9 The customer shall be solely responsible for the timely delivery of advertising copy and for proper printing material. In the event of clearly unsuitable or damaged printing material, the publisher shall immediately request replacement. The publisher shall guarantee the printing quality normal for the attached titles within the context of the possibilities given by the printing documents. Section 10 In the case of illegible, incorrect or incomplete printing of the advertisement, in whole or in part, the customer shall be entitled to a reduction in payment or to a correct substitute advertisement, but only to the extent that the purpose of the advertisement has been impaired. If the publisher fails to meet these conditions within a reasonable time limit set for this purpose or if the substitute advertisement should again be incorrect, the customer shall have the right to a reduction in price or to withdraw from the contract.Indemnity claims from positive breach of obligation, negligence in contracting and tort are excluded - including in the case of orders placed by telephone. Indemnity claims from impossibility of performance and default are restricted to the replacement of the foreseeable loss and to the remuneration to be paid for the advertisement or advertising supplement in question. This does not apply in the case of intent or gross negligence on the part of the publisher, its legal representatives and its vicarious agents. A liability of the publisher for damages owing to the lack of warranted qualities remains unaffected.Furthermore, the publisher is not liable for gross negligence of vicarious agents in commercial business transactions; in the remaining cases, the liability towards merchants for gross negligence is restricted in its extent to the foreseeable damage up to the amount of the remuneration for the advertisement in question. Complaints – with the exception of defects that are not obvious - must be put forward within four weeks of receiving the invoice and receipt.

    Section 11 Proofs shall be delivered only when expressly requested. The customer shall bear the responsibility for the correctness of the returned proofs. The publisher shall take into account all error corrections of which it shall be informed within the period set at the time of forwarding the proofs.Section 12 If no specific size is stipulated, the actual print size customary for the type of advertisement will be used as a basis for invoicing.Section 13 In the event that the advertiser does not make an advance payment, the invoice will be sent immediately, if possible, however, 14 days after the publication of the advertisement.The invoice is to be paid within the period evident from the price list, beginning from the time of receipt of the invoice, unless, in individual cases, another method of payment has been agreed upon or an advance payment has been made. Any discounts for advance payment shall be granted in accordance with the price list.Section 14 Interest and collection expenses will be charged if there is a delay in payment or a deferral. In the event of default, the publisher may postpone further execution of the current order until payment has been made and request advance payment for the remaining advertisements.If there is reasonable doubt regarding the customer’s ability to pay, the publisher is entitled, even during the term of the transaction, to make the publication of further advertisements dependent upon advance payment of the amount charged and settlement of unpaid bills, regardless of previously agreed terms of payment. Section 15 Upon request, the publisher shall deliver a specimen of the advertisement with the invoice. Depending on the type and size of the advertisement, the specimens shall be delivered as clippings, entire pages or entire issues. If a specimen can no longer be procured, a legally binding certification from the publisher regarding the publication and distribution of the advertisement shall serve as a substitute.Section 16 The customer shall bear the costs for the production of ordered printing data and drawings or for considerable changes in previously determined versions, which the advertiser may request or be responsible for.Section 17 In the case of a transaction involving several advertisements, a claim to a reduction in price may result from a reduction in the circulation if the total average circulation in the insertion year, beginning with the first adver-tisement, is less than the average amount stated in the pricelist or otherwise, or – if no circulation amount is stated – is less than the average circulation of issues sold (for trade journals, this can also be the average number actually distributed) in the previous calendar year. A reduction in circulation shall grant the right to a price reduction only if it amounts to 20 % for a circulation of up to 50,00015 % for a circulation of up to 100,00010 % for a circulation of up to 500,0005 % for a circulation of more than 500,000Claims to price reductions are excluded, however, if the publisher has informed the customer of the drop in circulation in due time for the customer to withdraw from the contract.Section 18 In the case of box number advertisements, the publisher shall exercise the due care of a responsible businessman for the keeping and timely forwarding of the offers received. Registered and express letters as response to box number advertisements shall be forwarded with regular mail only. Replies to box number advertisements shall be retained for four weeks. Replies which are not collected within this period shall be destroyed. The publisher shall return valuable documents without being obliged to do so. To prevent misuse of the box number advertisement service, the publisher reserves the right, for inspection purposes, to open incoming offers as a representative on behalf of, and in the declared interests, of the customer. The publisher is not obliged to forward business proposals or agency offers. Section 19 Printing data shall be returned to the customer only if expressly requested. The obligation to retain this material shall end three months after the order has expired.Section 20 The place of fulfilment is the principal place of business of the publisher. Insofar as claims of the publisher are not put forward by collection procedure, the place of jurisdiction for non-traders shall be determined according to their place of residence.It shall be agreed that the place of jurisdiction shall be the principal place of business of the publisher if the place of residence or customary place of abode of the customer, including non-traders, is unknown at the time that the legal proceedings are instituted or if the customer’s place of residence or customary place of abode should be moved outside the purview of the law after closing the contract.
