General terms and conditions

1. Anzeigenaufträge sind im Zweifel innerhalb eines Jahres nach Vertragsabschluss abzuwickeln.2. Die in der Anzeigenpreisliste bezeichneten Nachlässe werden nur für die innerhalb eines Jahres

in einer Druckschrift erscheinenden Anzeigen eines Werbungtreibenden gewährt.3. Der Werbungtreibende erhält rückwirkend Anspruch auf den seiner tatsächlichen Abnahme

von Anzeigen innerhalb Jahresfrist entsprechenden Nachlass, wenn er zu Beginn der Frist ei-nen Auftrag abgeschlossen hat, der aufgrund der Preisliste zu einem Nachlass von vornherein berechtigt.

4. Für die Aufnahme von Anzeigen an bestimmten Plätzen oder in bestimmten Ausgaben wird keine Gewähr übernommen. Enthalten Anzeigen trotzdem Platzvorschriften, so gilt der Anzei-genauftrag an sich unter allen Umständen als verbindlich erteilt, auch wenn den Platzvorschrif-ten nicht entsprochen werden kann.

5. Der Ausschluss von Mitbewerbern ist nicht möglich.6. Die Annahme eines Anzeigen- oder Beilagenauftrages wird nur nach einheitlichen Grundsät-

zen wegen des Inhaltes, der Herkunft oder der technischen Form abgelehnt.7. Der Verlag gewährleistet die drucktechnisch einwandfreie Wiedergabe der Anzeige. Ungeeig-

nete oder beschädigte Druckunterlagen werden dem Auftraggeber zurückgesandt.8. Der Auftraggeber hat bei ganz oder teilweise unleserlichem, unrichtigem oder unvollstän-

digem Abdruck der Anzeige Anspruch auf Zahlungsminderung oder eine Ersatzanzeige, aber nur in dem Ausmaß, in dem der Zweck der Anzeige beeinträchtigt wurde. Weitergehende Haftungen für den Verlag sind ausgeschlossen. Fehlerhaft gedruckte Kontrollangaben ergeben keinen Anspruch für den Auftraggeber.

9. Probeabzüge werden nur auf ausdrücklichen Wunsch geliefert. Der Auftraggeber trägt die Verantwortung für die Richtigkeit der zurückgesandten Probeabzüge. Sendet der Auftrag-geber den ihm rechtzeitig übermittelten Probeabzug nicht fristgemäß zurück, so gilt die Genehmigung zum Druck als erteilt.

10. Sind keine besonderen Größenvorschriften gegeben, so wird die tatsächliche Abdruckhöhe der Preisberechnung zugrunde gelegt.

11. Falls der Auftraggeber nicht Vorauszahlung leistet, wird die Rechnung spätestens am fünften Tag des auf die Veröffentlichung der Anzeigen folgenden Monats erteilt. Die Rechnung ist innerhalb der aus der Preisliste ersichtlichen, vom Empfang der Rechnung an laufenden Frist zu bezahlen.

12. Bei Zahlungsverzug oder Stundung werden Zinsen in Höhe von 1 v. H. über dem Diskontsatz der Deutschen Bundesbank sowie die Einziehungskosten berechnet; der Verlag kann die wei-tere Ausführung des Auftrages bis zur Bezahlung zurückstellen. Bei Insolvenzen, Vergleichen oder im Fall einer Klage enfällt jeglicher Nachlass.

13. Der Verlag liefert auf Wunsch jeweils sofort nach Erscheinen der Anzeige kostenlos einen Belegausschnitt. Eine vollständige Belegnummer wird geliefert, sofern Art und Umfang des Anzeigenauftrages dieses rechtfertigen. Kann ein Beleg nicht mehr beschafft werden, so tritt an seine Stelle eine Aufnahmebescheinigung des Verlages.

14. Wird ein Auftrag aus Umständen nicht erfüllt, die der Verlag nicht zu vertreten hat, so hat der Auftraggeber, unbeschadet etwaiger Rechtspflichten, den Unterschied zwischen dem gewährten und dem der tatsächlichen Abnahme entsprechenden Nachlass dem Verlag zurückzuvergüten.

15. Kosten für erhebliche Änderungen ursprünglich vereinbarter Ausführungen und für Lieferung bestellter Druckunterlagen hat der Auftraggeber zu tragen.

Supplementary terms and conditions

a) Bei Änderungen der Anzeigenpreise treten die neuen Bedingungen auch bei laufenden Aufträ-gen sofort in Kraft, sofern nicht ausdrücklich eine andere Vereinbarung getroffen ist.

b) Der in Ziff. 3 der allgemeinen Geschäftsbedingungen festgelegte Nachlassanspruch des Wer-bungtreibenden erlischt, wenn er diesen Anspruch nicht spätestens einen Monat nach Ablauf der Jahresfrist geltend gemacht hat, für die ihm nun der Nachlass zusteht. Der Werbungtrei-bende muss seinen Anspruch belegen. Die Nachvergütung kann als Gutschrift auf laufende oder künftige Anzeigen erfolgen.

c) Bei Anzeigen bzw. Änderungen, die per Telefon, Telefax oder E-Mail aufgegeben wurden, übernimmt der Verlag keine Haftung.

d) Sind etwaige Mängel bei den Druckunterlagen nicht sofort erkennbar, sondern werden erst beim Druckvorgang deutlich, so hat der Werbungtreibende bei ungenügendem Abdruck keine Ansprüche. Für rechtzeitige Lieferung der Anzeigentexte und Vorlagen ist der Werbungtrei-bende verantwortlich.

e) Für Anzeigenaufträge, die von Geschäftsstellen, durch Verlagsvertreter oder sonstige Annah-mestellen entgegengenommen wurden, behält sich der Verlag die Ablehnung vor.

f) Im Falle höherer Gewalt erlischt jede Verpflichtung auf Erfüllung von Aufträgen und Leistung von Schadenersatz. Insbesondere wird auch kein Schadenersatz für nicht veröffentlichte oder nicht rechtzeitig veröffentlichte Anzeigen geleistet.

g) Rücktrittsrecht für Anzeigenaufträge: 20 Tage vor Erscheinen. Rücktrittsrecht für Vorzugsplat-zierungen: 3 Monate vor Erscheinen.

h) Beanstandungen jeglicher Art sind innerhalb 8 Tagen nach Erscheinen der Anzeige bzw. nach Empfang der Rechnung zu erheben.

i) Der Verlag ist unter wichtigen Umständen berechtigt, auch während der Laufzeit eines Anzeigenauftrages das Erscheinen weiterer Anzeigen ohne Rücksicht auf ein ursprünglich vereinbartes Zahlungsziel von der Vorauszahlung des Betrages und von dem Ausgleich offenstehender Rechnungsbeträge abhängig zu machen, ohne dass hieraus dem Auftraggeber irgendwelche Ansprüche gegen den Verlag erwachsen.

k) Bei Zifferanzeigen stellt der Verlag seine Einrichtungen für die Entgegennahme, Verwahrung und möglichst beschleunigte Weiterleitung etwa eingehender Angebote zur Verfügung. Eine Gewähr für die Verwahrung und rechtzeitige Weitergabe der Angebotsschreiben wird nicht übernommen. Ansprüche auf Wandlung, Minderung oder Schadenersatz wegen Verlust oder Verzögerung in der Aushändigung derartiger Durchgangsschreiben sind ausgeschlossen.

l) Angebote, die geschäftliche Anpreisung enthalten oder auf die Anzeige nicht direkt Bezug haben sowie Angebote von Vermittlungsstellen werden von der Beförderung und Aushändi-gung ausgeschlossen. Der Verlag hat das Recht, bei vorliegendem Verdacht auf Mißbrauch des Zifferndienstes eingehende Angebote auf Zifferanzeigen zu Prüfzwecken zu öffnen. Im Kennzifferdienst haftet der Auftraggeber für die Rücksendung aller Unterlagen.

m) Die Pflicht zur Aufbewahrung der Druckunterlagen endet drei Monate nach Erscheinen der letzten Anzeige.

n) Erfüllungsort und Gerichtsstand für beide Teile: Winsen (Luhe).
